NOTICE OF GRANT OF PLANNING PERMISSION

PART 2 - PARTICULARS OF DECISION

IN PURSUANCE of their powers under the Town and Country Planning Act 1990, the Lake District National Park Authority as local planning authority HEREBY GIVE NOTICE THAT PLANNING PERMISSION for the development referred to in Part 1 hereof HAS BEEN GRANTED.

SAVE as hereunder specified the development shall be carried out and completed in entire accordance with the particulars specified in the application and plans submitted. The development shall be subject to the following conditions:

1 The development hereby permitted shall be commenced before the expiration of THREE years from the date hereof.

REASON: Imposed in accordance with the provisions of Section 91 of the Town and Country Planning Act, 1990.

2 The development hereby permitted shall not be carried out otherwise than in conformity with the following submitted plans and details: - Drawing no. 5811-01B, 5811-02C received by the Local Planning Authority on 11 January 2016. - Structural appraisal by Grasmere Structural Engineers received by the Local Planning Authority 9 November 2015. 7/2015/5652 Page 2 of 6

REASON: For the avoidance of doubt.

3 The dwellinghouse(s) hereby permitted shall not be occupied otherwise than by a Person with a Local Connection as his or her Only or Principal Home, or the widow or widower of such a person, and any dependents of such a person living with him or her.

The Occupant will supply to the Local Planning Authority (within 14 days of the Local Planning Authority's written request so to do) such information as the Authority may reasonably require in order to determine whether this condition is being observed.

In this condition the following definitions apply:

'Person with a Local Connection' means an individual who before taking up occupation of the dwelling satisfies one of the following conditions:

(1) The person has been in continuous employment in the Locality defined for at least the last nine months and for a minimum of 16 hours per week immediately prior to occupation; or

(2) The person needs to live in the Locality defined because they need substantial care from a relative who lives in the Locality defined, or because they need to provide substantial care to a relative who lives in the Locality defined. Substantial care means that identified as required by a medical doctor or relevant statutory support agency; or

(3) The person has been continuously resident in the locality defined for three years immediately prior to: a) Needing another dwelling resulting from changes to their household, including circumstances such as getting married, divorced, having children, or downsizing. b) Undertaking full-time post-secondary education or skills training and is returning to the locality defined within 12 months of its completion, or c) being admitted to hospital, residential care or sentenced to prison, and are returning to the locality defined within 12 months of their discharge/release, or

(4) The person is a person who – a) Is serving in the regular forces or who has served in the regular forces within five years prior to occupation; b) Has recently ceased, or will cease to be entitled, to reside in accommodation provided by the Ministry of Defence following the death of that person’s spouse or civil partner where - i. The spouse or civil partner has served in the regular forces; and ii. Their death was attributable (wholly or partly) to that service; or c) Is serving or has served in the reserve forces and who is suffering from a serious injury, illness or disability which is attributable (wholly or partly) to that service

'Locality' shall mean the administrative areas of the Parishes of Blawith & 7/2015/5652 Page 3 of 6

Subberthwaite; Broughton West; Claife; Colton; Coniston; Dunnerdale with Seathwaite; Hawkshead; Haverthwaite; Lowick; Satterthwaite; Torver; and those parts of the Parishes of Egton with Newland; and Kirkby Ireleth which are within the Lake District National Park.

An 'Only or Principal Home' is a dwellinghouse which is occupied continuously for a minimum period of six months in every twelve month period. For the avoidance of doubt the dwelling shall not be occupied as a second home or for holiday letting accommodation.

The obligations contained in this condition shall not be binding or enforceable against any mortgagee or any receiver appointed by such a mortgagee, or any person deriving title through such a mortgagee or receiver provided always that a successor in title of such a person will be bound by the obligations contained in this condition.

REASON: To ensure that the resulting accommodation is occupied by persons with a defined local need in order to comply with Lake District National Park Core Strategy (Local Plan Part One) Policy CS18 and the accompanying Housing Provisions: Supplementary Planning Document. The provisions relating to armed forces personnel are in accordance with the Allocation of Housing (Qualification Criteria for Armed Forces) () Regulations 2012.

4 The windows and doors for the development hereby permitted shall be of timber construction and painted or stained in a colour to be first agreed in writing by the Local Planning Authority prior to their installation and thereafter implemented in full accordance with those agreed details and maintained as such.

REASON: To ensure a satisfactory standard of appearance of the development.

5 Prior to occupation of the dwellinghouse hereby permitted full details of both hard and soft landscaping shall have been submitted to and approved in writing by the Local Planning Authority and these works shall be carried out as approved. These details shall include any boundary features and any existing trees and hedgerows on the land, those to be retained together with measures for their protection during the course of development and car parking and circulation areas.

Unless otherwise agreed in writing with the Local Planning Authority, all landscaping works shall be carried out not later than 12 months from the substantial completion of the development, whichever is the sooner. Any trees or plants which, within a period of five years thereafter, die, are removed or become seriously damaged or diseased shall be replaced in the next planting season with others of similar sizes and species unless the Local Planning Authority gives written consent to any variation.

REASON: To safeguard the visual amenities of the area.

writing by the Local Planning Authority details/samples of the following matters:

i) the materials of construction of rainwater and external sanitary goods; ii) the design, style and finished appearance of windows including method of opening, doors, framing, window surrounds, mullions, lintels, sills, rainwater and external sanitary goods. iii) details of boundary treatment

Thereafter the works shall be carried out in accordance with the approved details.

REASON: To ensure a satisfactory standard of appearance of the building.

7 The dwelling hereby permitted shall not be occupied prior to the installation and operation of the Klargester BA Biodisc or other agreed system for disposal of foul sewage.

REASON: To ensure no pollution of the local environment.

8 Notwithstanding the provisions of the Town and Country Planning (General Permitted Development) Order 1995 (or any order revoking and re-enacting that Order with or without modification), no material external alterations ( including new windows) or extensions shall be carried out to the dwellinghouse, nor shall any building, enclosure, domestic fuel oil container, pool or hardstanding be constructed within the curtilage of the dwellinghouse, aside from that shown on the approved plans without application to, and the grant of permission by, the Local Planning Authority.

REASON: The Local Planning Authority considers that such development should be subject to formal control to safeguard the amenities of the area.

9 The roof of the dwelling hereby permitted shall be covered in matching local blue grey slates (that is slates which have been mined or quarried in Cumbria and are similar to each other in colour and texture), and shall be laid in diminishing courses from eaves to ridge.

REASON: To ensure a satisfactory standard of appearance of the development by the use of traditional materials in accordance with Policy BE1 of the Lake District National Park Local Plan.

10 The rooflights shall be recessed into the roof plane such that no part projects above the surface of the roofing slates.

REASON: To safeguard the character and appearance of the building by ensuring that the rooflight does not appear as an unduly conspicuous feature.

11 The facing stone to be used in the development hereby permitted shall match (in terms of size, method of laying, pointing and jointing details) the appearance, character, colour and texture of the local stone walls of the existing building.

REASON: For the avoidance of doubt and to ensure a satisfactory standard of appearance of the development.

Notes and Informatives In accordance with paragraph 187 of the National Planning Policy Framework we have worked with the applicant in a positive and proactive manner and sought solutions to problems arising in relation to dealing with this application. We have done so in the following ways: by requesting additional information on the drainage to address neighbours concerns and through community engagement with the Parish Council.

INFORMATIVE:

Regulation 39 of the Conservation (Natural Habitat, &c.) Regulations 1994 makes it an offence deliberately to capture, kill or disturb a member of a European protected species or to damage or destroy the breeding site or resting place of such an animal. New developments for which development works would contravene the protection afforded to European protected species require derogation in the form of a European Protected Species (EPS) Licence. EPS Licenses are issued by the Natural England Wildlife Licensing Unit (tel: 0117 959 8453).

Building contractors should be advised of the possible presence of bats in the building. They should be made aware of the signs to look out for and of the need for sensitive working, particularly during the removal of ridge tiles or slates. If the presence of bats is confirmed or suspected at any time during the course of the demolition or development then work must cease in that area and further advice must be sought from Natural England or a licenced bat worker as a legal requirement (tel. 01539 792800 or the bat help line 017687 76911).

NOTICE

IMPORTANT – This permission refers only to that required under the Town and Country Planning Act 1990 and does not include any consent or approval under any other enactment or under the building regulations.

Appeals to the Secretary of State

If you are aggrieved by the decision of the Authority to refuse your application or to impose conditions on the consent with which you are dissatisfied, you may appeal to the Secretary of State under Section 78 of the Town and Country Planning Act 1990. All appeals are handled on behalf of the Secretary of State by the Planning Inspectorate.

If you want to appeal against this decision then you must do so within six months of the date of this notice, or such longer period as the Secretary of State may, at any time, allow. Although the Secretary of State can allow a longer period for giving notice of an appeal, he will not normally be prepared to use this power unless there are special circumstances which excuse the delay in giving notice of appeal.

Appeals must be made electronically via the Planning Portal (www.planningportal.gov.uk/planning/appeals/online/makeanappeal) or using a form which you can get from the Planning Inspectorate Customer Support Team (0303 444 50 00).

Please note only the applicant possesses the right of appeal.

The Secretary of State need not consider an appeal if it seems to him that the Authority could not have granted planning permission for the proposed development or could not have granted it without the conditions it imposed, having regard to the statutory requirements, to the provisions any development order and to any directions given under a development order. In practice, the Secretary of State does not refuse to consider appeals solely because the Authority based its decision on a direction given by him.

Purchase Notices

If either the Authority or the Secretary of State refuses permission to develop land or grants it subject to conditions, the owner may claim that he can neither put the land to a reasonably beneficial use in its existing state nor can he render the land capable of a reasonably beneficial use by the carrying out of any development which has been or would be permitted.

In these circumstances, the owner may serve a purchase notice on the National Park Authority. This notice will require the Authority to purchase his/her interest in the land in accordance with the provisions of Part VI of the Town and Country Planning Act 1990.
