Thank you for your Freedom of Information request dated 22nd February 2019 which was received by us on 25th February 2019. Your request has been dealt with under the Freedom of Information Act and is detailed below in italics with our response in bold.

Our Response

The Freedom of Information Team has been provided with the following information in response to your recent request on behalf of Northamptonshire County Council (NCC).

Please can you advise me of the number of children with Statements of Special Educational Need or Education Health Care Plans who were admitted to Year 7 at each secondary school (including special schools) in the county

a. In the current academic year (2018/19) b. The previous five academic years (2013/14; 2014/15; 2015/16; 2016/17 and 2017/18).

Detailed below are numbers of pupils who transferred into Year 7 for years requested above. However, for years 15/16 and 14/15 the information is based on the current Year 10 & 11 pupils who would have been Year 7 at that time who may not have been Year 7 transfer pupils. This is due to changes in schools becoming academies with start dates later than the date the pupil actually commenced at the school. It is not possible for us to provide the

Unfortunately, I have estimated that the time it will take to undertake the necessary search, retrieval and preparation work that will enable us to respond to the request you have made will exceed the fee limit as set out in the Appropriate Limit and Fees Regulations. Therefore, the Council is not obliged to provide a response and I will not be processing your request further. For information purposes, the fee limit set down by the Regulations is £450.00 and in our case this equates to a maximum of 18 hours’ of search and retrieval time.

Therefore, in accordance with Section 17 of the Freedom of Information Act 2000, this letter acts as a refusal to release the information you have requested.

Section 12-Exemption where cost of compliance exceeds appropriate limit

(1) Section 1 (1) does not oblige a public authority to comply with a request for information if the authority estimates that the cost of complying with the request would exceed the appropriate limit.
