    Presumption of Innocence or Presumption of Mercy?: Weighing Two Western Modes of Justice James Q. Whitman* American criminal law has a deep commitment to the presumption of innocence. Yet at the same time, American criminaljustice is, by international standards, extraordinarilyharsh. This Article addresses this troubling state of affairs. The Article contrasts the American approach with the approach of the inquisitorial tradition of continental Europe. Inquisitorialjustice, it argues, has a less far-reachingpresumption of innocence than American justice does. Yet if continentaljustice puts less weight on the rights of the innocent, it puts more on the rights of the guilty: while its presumption of innocence is comparatively weaker, it has what can be called a strong presumption of mercy. The continental approach produces forms of criminal procedure that can shock Americans. Continental trial in particularoften seems to American observers to operate on a disturbing de facto presumption of guilt; the most recent example is the high-profile trial of Amanda Knox. Yet the continental approach has contributed to the making of a significantly more humane criminaljustice system than ours. Moreover, the continental approach is better suited to cope with the rise of new forms of scientific investigation. The Article pleads for a shift away from the American culture of rights for the innocent toward a greaterconcern with continental-style rightsfor the guilty. I.     THE WILTED LILY REPRESENTATIONS OF THE GREATER CAPETIAN DYNASTY WITHIN THE VERNACULAR TRADITION OF SAINT-DENIS, 1274-1464 by Derek R. Whaley A thesis submitted in fulfilment of the requirements of the Degree of Doctor of Philosophy in History at the University of Canterbury, 2017. ABSTRACT Much has been written about representations of kingship and regnal au- thority in the French vernacular chronicles popularly known as Les grandes chroniques de France, first composed at the Benedictine abbey of Saint-Denis in 1274 by the monk Primat. However, historians have ignored the fact that Primat intended his work to be a miroir for the princes—a didactic guidebook from which cadets of the Capetian royal family of France could learn good governance and morality. This study intends to correct this oversight by analysing the ways in which the chroniclers Guillaume de Nangis, Richard Lescot, Pierre d’Orgemont, Jean Juvénal des Ursins, and Jean Chartier constructed moral character arcs for many of the members of the Capetian family in their continua- tions to Primat’s text. This thesis is organised into case studies that fol- low the storylines of various cadets from their introduction in the narrative to their departure. Each cadet is analysed in isolation to deter- mine how the continuators portrayed them and what moral themes their depictions supported, if any. Together, these cases prove that the chron- iclers carefully crafted their narratives to serve as miroirs, but also that their overarching goals shifted in response to the growing political cri- ses caused by the Hundred Years War (1337-1453) and the Armagnac- Burgundian civil war (1405-1435).

Stoneman University of Notre Dame Press Notre Dame, Indiana The Extravagantes communes and Its Medieval Predecessors Jacqueline Brown N1501, when Jean Chappuis completed the editio princeps of what would Ibecome known as the Corpus iuris canonici, he saw into print five texts whose contents had long been established, either by tradition (Gratian's Decre- tum, the Extravagantes Johannis XXIII or by papal decree (the Dectetales Gregorii IX, Boniface VIII's Libet sextus, the Constitutiones Clemetitinaes. But the sixth and last part of his edition was a novelty: the title, Extravagantes communes, was of Chappuis's own devising, and the contents, sixty-eight pa- pal letters I ranging in date from the pontificate of Boniface VIII (1294-13031 to that of Sixtus IV 11471-841,2were of his own choosing. There were precedents in print for Chappuis's Communes, but it is strik- ing how far he departed from them. Earlier printers and editors of the Sext and Clementines had included extravagantes at the end of those works, some- times only one, sometimes as many as thirty-seven. In 1503, when Chappuis brought out his revised, and definitive, version of the Communes, it contained seventy-three papal decrees, double the highest number available in other printed editionsr' The manuscript precedents for Chappuis's Extravagantes communes are both more numerous and more varied than those in printed form. Even so, like the printed texts, none of the extant manuscript collections of late-medieval extravagantes provides even an approximate exemplar of Chappuis's work.

    VISUALIZATIONS OF FASHION IN SEVENTEENTH-CENTURY FRENCH PRINTS A Dissertation Presented to the Faculty of the Graduate School Of Cornell University In Partial Fulfillment of the Requirements for the Degree of Doctor of Philosophy by Elizabeth Seaton Davis January 2012 © 2012, Elizabeth Seaton Davis VISUALISATIONS OF FASHION IN SEVENTEENTH-CENTURY FRENCH PRINTS Elizabeth Davis, PhD Cornell University 2012 The period in French history which began in the mid-1670s and ended in 1715 with the death of Louis XIV, experienced a burgeoning French interest in the textile and fashion arts. At the same time, Paris was becoming the center of printmaking in Europe, and among its many products were large numbers of etched and engraved fashion prints. This study investigates a particular group of prints which depicted dress of the wealthy class of France, including images of well-known personages of the royal court. It explores the role of these images as early manifestations of a fashion print genre which flourished, but eventually declined, only to resurface and succeed later in the eighteenth century. These late seventeenth-century prints disseminated French fashion as part of a nascent fashion system developing in France, and contributed to the beginnings of French fashion hegemony. The methodology for this study derives from practices used in both dress history and art history. Data collection involved the examination and documentation of extant French prints, supplemented by the study of contemporaneous textiles and paintings. A set of criteria was developed in order to compile and quantitatively analyze the imagery presented in the 750 prints included in the study.
