FORCED MARRIAGE FACT SHEET w w w . i - p r o b o n o . c o m In July 2019, Princess Haya, the wife of Dubai’s ruler Sheikh Mohammed bin Rashid al-Maktoum, applied for a ‘forced marriage protection order’ (FMPO) in the UK to protect her daughter.1 Forced marriage is both a civil and criminal offence in the UK. An FMPO is issued to protect a person who has been, or is being, forced into a marriage. Princess Haya’s application and subsequent media coverage brought the subject of forced marriage back into the limelight. iProbono is currently working with the UK National Commission on Forced Marriage with its report on the impact of the current law on the practice in UK. This factsheet explains what a forced marriage is and highlights legislations and rules that prohibit or encourage it in different jurisdictions of the world, with special emphasis on India. 10/31/2014 A Polyandrous Society in transition: A CASE STUDY OF JAUNSAR-BAWAR SUBMITTED BY: Nargis Jahan IndraniTalukdar ShrutiChoudhary (Department of Sociology) (Delhi School of Economics) Abstract Man being a social animal cannot survive alone and has therefore been livingin groups or communities called families for ages. How these ‘families’ come about through the institution of marriage or any other way is rather an elaborate and an arduous notion. India along with its diverse people and societies offers innumerable ways by which people unite to come together as a family. Polyandry is one such way that has been prevalent in various regions of the sub-continent evidently among the Paharis of Himachal Pradesh, the Todas of Nilgiris, Nairs of Travancore and the Ezhavas of Malabar. While polyandrous unions have disappeared from the traditions of many of the groups and tribes, it is still practiced by some Jaunsaris—an ethnic group living in the lower Himalayan range—especially in the JaunsarBawar region of Uttarakhand.The concept of polyandry is so vast and mystifying that people who have just heard of the practice or the people who even did an in- depth study of it are confused in certain matters regarding it. This thesis aims at providing answers to many questions arising in the minds of people who have little or no knowledge of this subject. In this paper we have tried to find out why people follow this tradition and whether or not it has undergone transition. Also its various characteristics along with its socio-economic issues like the state and position of women in such a society and how the economic balance in a polyandrous family is maintained has been looked into. -

(Hons.), 5th year, Law College Dehradun, **Assistant Professor, Law College Dehradun, Uttaranchal University. “WITH CHANGING SOCIAL NORMS OF LEGITIMACY IN EVERY SOCIETY INCLUDING OURS, WHAT WAS ILLEGITIMATE IN THE PAST, MAY BE LEGITIMATE TODAY.” ABSTRACT India is a country which is world known for its unique cultural diversity and cultural variation. This article works an attempt to sort out and find out why cohabitation have to face legal and cultural issues, even when, it is a right of every person to cohabit whether heterosexually or homosexually. It clears the idea that cohabitation is a human right and is nothing for which a separate demand is to be made. Human rights are natural rights and are vested into a person by Mother Nature and may not require a backbone of any statute. The article has been divided into seven major heads starting with Introduction to the topic which gives the statement of problem and object of the study. Further the article explains the concept of human rights and relationship of human rights with other existent rights. The article proceeds with the concept of cohabitation and legal provisions which support cohabitation in India. There are no any explicit provisions which legalize cohabitation but judicial interpretation is done in such a way that it has become legal and have been said to be human right of every person. Now, cohabitation is not only about living together of heterosexual people but also of homosexuals which is elaborated upon in the article. -

Peccerelli is founder and executive director of the Guatemalan Forensic Anthropology Founda- tion (Fundación de Antropología Forense de Guatemala or FAFG), a group that focuses on the recovery and identifica- tion of some of the 200 000 people, mostly indigenous Maya of the mountainous regions, that Guatemalan military forces killed or “disappeared” during the brutal civil war that occurred between the mid-1960s and the mid-1990s. Peccerelli was born in Guatemala. His family immigrated to the United States when his father, a lawyer, was threatened by death squads. He grew up in New York and attended Brooklyn College in the 1990s. But he felt a need to reconnect with his heritage and began to study anthropology as a vehicle that would allow him to serve his country. The FAFG scientists excavate clandestine mass graves, exhume the bodies, and identify them through several means, such as matching dental and/or medical records. Anthropologists In studying skeletons, they try to determine the person’s age, gender, stature, ancestry, and lifestyle. DNA studies at are few because of the expense. MONOGAMY, POLYGAMY, AND POLYAMORY IN AMERICAN SOCIETY 1 The most debatable topics of the 21st century are monogamy, marriage, and sexuality. We live in the world where the words “homosexual” and “the same-sex-marriage” are our everyday reality. We hear and read about it all the time. Sometimes we get involved into heated discussions on whether homosexuals should have the right to get married or they should have open relationships. We even love to watch the popular TV series “Big Love” about openly polygamous couples. In these series, the women involved into polygamous relationships were portrayed as well-educated and independent women that had made a conscious choice of polygamy. The end of these series has also represented the general population’s view about polygamy and polyamory as the models of alternative relationships. Bill’s neighbor killed him to show his protest against the basic beliefs about marriage constitution. It was a symbolic presentation of general population’s opinion about polygamy as a system. It is very interesting to see the progression of the American society to the point when the hot topics like these do not create a shock in a general population, but make the points for discussions. How did we get to this point? What are monogamy, non-monogamy, poligamy, and poliamory? How do they affect us? Why do many people react negatively to polyamory? How do debates about same-sex-marriages and polyamory affect each other? Why is our reaction to these topics changing? All these questions create a lot of tension in our society. -

A Reflection on the Challenges for Hindu Women in the Twenty-first Century1 Neelima Shukla-Bhatt Introduction T the turn of the 21st century, it is clear that religion is not an insti- Atution of the past; it continues to be a powerful force in societies across the world. For this reason, some purely secularist and sociologi- cal theories of religion of the early twentieth century, which led to a wide spread view that religion was on the decline in the modern times, have proved to be limited, even though they are helpful in examining the social aspects of religious life.2 As Brian Hatcher suggests in a recent article, a major shortcoming of the secularist approaches to religion has been a purely dichotomous view of faith vs reason and tradition vs modernity. Instead of the demise of religion, Hatcher finds transforma- tion of religion with changing times, as proposed by sociologist Damiele Hervieu-Leger a more helpful way to understand religious phenomena (Hatcher 2006: 54–55). An aspect of religion that is widely debated with regard to need for transformation is treatment of women. In most organized religions of the world, women have not enjoyed equal rights with men. The norms assigned to them by male religious authorities have subjected them to various forms of marginalization. A major challenge for religious communities across the world today is to ensure that their religious practices and values are compatible with the ideal of gender equality as an aspect of the ideology of social justice, which is being widely upheld across the globe. -
