Flexsenhar III, M.A. The University of Texas at Austin, 2013 Supervisor: L. Michael White The Roman Empire was a slave society. New Testament and Early Christian scholars have long recognized that slaves formed a substantial portion of the earliest Christian communities. Yet there has been extensive debate about manumission, the freeing of a slave, both in the wider context of the Roman Empire and more specifically in Paul’s context. 1 Cor. 7:20-23 is a key passage for understanding both slavery and manumission in Pauline communities, as well as Paul’s own thoughts on these two contentious issues. The pivotal verse is 1 Cor. 7:21. The majority opinion is that Paul is suggesting slaves should become free, i.e., manumitted, if they are able. In order to better understand this biblical passage and its social implications, this project explores the various types of manumissions operative the Roman world: the legal processes and results; the factors that galvanized and constrained manumissions; the political and social environment surrounding manumission in Corinth during Paul’s ministry; as well as the results of manumission as it relates to Paul’s communities. -

Wiebe Inception This paper was written for Dr. Jason Brown’s Roman Law and Legacy course in the winter term of the 2017-18 academic year. Students where asked to choose a topic that related to Roman law and its relation to legal history. Abstract This essay looks at the legal framework of slavery in ancient Rome and America, leading up to the Civil War and emancipation. By taking account of legal documents from these two time periods and placing them in relation to each other, the philosophic underpinnings of the law emerge more clearly. Where American perceptions of justice revolve around natural law and natural justice, Roman ones take a more practical approach to justice. This leads to three positions: American pro-slavery, American abolitionist, and Roman pro-slavery. The American pro-slavery arguments posit slavery as a positive good, some texts going so far as to say that anti-slavery arguments are against God. The abolitionist position roots in the same natural justice and natural law philosophic position as their pro-slavery opponents, only the abolitionist position views all humans regardless of race as equal under the law. The Roman position, on the other hand, views slavery as a necessary evil, and as such, has more protections, and a more humane legal position than the American legal system allows for slaves. These three legal positions and their philosophic underpinnings are discussed. -

3. Is there a human right to tobacco control? Andreas Schmidt1 1. INTRODUCTION Smokers lose around ten years in life expectancy and one in two smokers die of smoking-related conditions, such as chronic obstructive pulmonary disease, cancer and cardiovascular conditions.2 As mentioned in the Introduction to this book, the magnitude of tobacco as a public health problem is staggering. If human rights are meant to protect fundamental human interests – and life and health clearly rank among them – we might conclude that individuals should have a human right to be covered by tobacco control, given that tobacco threatens the health and lives of so many people. However, legally and philo- sophically, human rights are in a category of their own. To claim that it would be good if fewer people smoked is one thing. To say that national sovereignty should be restricted by human rights law to enforce tobacco control is quite another. In this chapter, I argue that tobacco control should be covered by human rights law and defend this idea against philosophical objections. In Section 2, I draw on Allen Buchanan’s theory of human rights and existing legal research to make the case for a right to tobacco control. In Sections 3, 4, 5 and 6, I com- plete this defence by addressing philosophical objections one might raise to a human right to tobacco control. Section 3 addresses a libertarian objection around the negative/positive rights distinction. Section 4 discusses whether strict tobacco control is compatible with freedom of choice. Section 5 dis- cusses whether strict tobacco control is compatible with respect for individual consent. -

We will examine daily life for both slaves and their masters, how slavery was affected by the growth of the Empire, the laws and rituals surrounding manumission (freeing of slaves), and subsequent changes in social status. Educated Greeks – tutors, doctors Gladiators (mostly slaves): weird mix of low status and fame/wealth for the best Higher status slaves could earn money, buy their freedom (Peculium), or their own slaves. -

Most of these negative views is based on the fact that the Romans created and used a great variety of painful and severe penalties, very often accompanied by different kinds of torture or disgrace1. Although such opinions derive from legal and literary sources, occasionally in their context a very important factor seems to be missing. Sometimes in the process of evaluation of foreign or historical legal systems researchers make a mistake and use modern standards, both legal and moral, and from this point of view they proclaim their statements. This incorrect attitude may lead to ascertainment that no legal system before 20th century should be judged positively in this aspect. However, the goal of this paper is not to change those statements, as they are based on sources, but rather to give examples and to underline some important achievements of Roman crimi- nal law which, sometimes forgotten or disregarded, should be considered in the process of its historical evaluation. 1 The most cruel are definitely aggravated forms of death penalty, such as crucifixion (crux), burning alive (vivi crematio), throwing to wild animals during the games (damnatio ad bestias), throwing to the sea in a sack with ritual animals (poena cullei). TOPICAL RESEARCH DIGEST: HUMAN RIGHTS AND CONTEMPORARY SLAVERY The Economic Foundations of Contemporary Slavery By Justin Guay “Slavery existed before money or law” (Hochschild 2005). Indeed the “peculiar institution” is one of humanity’s oldest. It has, however, evolved and manifested itself quite distinctly in different periods of history. In contrast to historical views of slavery that are associated with Chattel Slavery, numerous forms fall under the umbrella term of contemporary slavery. The United Nations (U.N.) Working Group recognizes such radically new forms as: child labor, children in conflict, trafficking in persons, sexual exploitation, and the sale of children. The International Labor Office (ILO) approaches the topic through the lens of forced labor. The ILO recognizes slavery and abductions, compulsory participation in public works projects, forced labor in agriculture, domestic workers, bonded labor, forced labor imposed by the military, forced labor in the trafficking of persons, as well as some aspects of prison labor and rehabilitation through work. A linking factor between these varied forms of contemporary slavery, according to the U.N. Working Group, is the role that poverty plays in creating vulnerability. This link is echoed in the work of Kevin Bales, arguably the world’s foremost expert on contemporary slavery. According to Bales, contemporary slavery is “the complete control of a person, for economic exploitation, by violence, or the threat of violence.” Using this definition, it is possible to explore the economic links that all forms of slavery, despite their unique characteristics, share. Economic conditions are decisive in the formation of slavery. Chattel slavery emerged as a disturbing manifestation of a push for labor-intensive goods created in the new world. -
