CITY COUNCIL MEETINGS

City Council meetings are held on the following Mondays commencing at 6:30 p.m. and the public is welcome to attend: January 7 and 28, February 19 (Tuesday), March 18, April 8 and 29, May 21 (Tuesday), June 10 and 24, September 3 (Tuesday) and 23, October 15 (Tuesday), November 4 and 25 and December 16, 2013.

City Council will take a 15 minute break at 8:30 p.m. during every regular City Council meeting, or at the next opportunity after 8:30 p.m. upon the completion of the item being discussed.

There are four Standing Committees of Council: Development Services Committee, Corporate Services Committee, Community Services Committee and the Strategic Initiatives Committee. A calendar of all Standing Committee meeting dates is available on the City of Oshawa website at www.oshawa.ca

Tammy MacLean requesting to address City Council in opposition to Item 2 of the Twenty-third Report of the Corporate Services Committee concerning her request that the City’s Property Standards By-law be enforced in the south end of Oshawa and the Residential Rental Housing By-law be applied throughout the City.

1. Lou DeVuono, Heroes Highway Ride & Rally requesting to address City Council in opposition to Item 1 of the Twenty-third Report of the Corporate Services Committee concerning his request for cancellation of the City’s invoice for the Heroes Highway Ride & Rally event held on June 4, 2011.

1. Bill Steele requesting any replies received from the Prime Minister in response to Mayor Henry’s letters of September 26, 2012 and November 1, 2012 be made public; and, requesting to understand the current relationship between the City and the Federal Government and to be advised of possible future financial assistance from the Federal Government with respect to the City’s infrastructure. Bill Steele requesting the General Motors Centre implement a $2 ticket surcharge to reasonably and responsibly decrease its debt, and expressing that American ticket companies make tons of money by printing our tickets while Oshawa taxpayers pick up the losses at the General Motors Centre year after year.

Daniel Weatherbe requesting the City of Oshawa call for an end to the practice of water fluoridation because, in his opinion, adding fluoride to the water is unsafe, unethical and ineffective; and, forwarding an article by the Fluoride Action Network entitled ‘50 Reasons to Oppose Fluoridation’.

4. John Challinor II, Director, Corporate Affairs, Nestle Waters supporting the recommendation contained in Item 8 of the Forty-third Development Services Committee Report and further, opposing The Blue Communities Project and in particular their call to ban the selling of bottled water, stating it is not an environmental initiative but a political campaign based on dogmatism instead of science.

5. Bill Steele requesting to be advised why the City Manager’s base salary increased by 6.8% in one year; and, requesting to be provided with the Council approved wage increase between 2011 and 2012; and, further, in the event an increase is higher than approved, to be provided an explanation.

6. Rob Vella opposing Item 1 of the Twenty-third Report of the Corporate Services Committee concerning the Heroes Highway Ride & Rally request for cancellation of the City’s invoice for their event held on June 4, 2011.

7. Canadian Beverage Association, Brandon Ashmore, Coordinator, Communications and Government Affairs supporting the recommendation contained in Item 8 of the Forty-third Development Services Committee Report, and commending the Committee for voting against restricting or limiting bottled water in City facilities.

8. Mayor Hazel McCallion, City of Mississauga requesting members of the Large Urban Mayors’ Caucus of (LUMCO) support Jim Wilson’s Private Members’ Bill, along with the Association of Municipalities in Ontario, regarding the issue of interest arbitration which covers essential service employers who are not allowed to strike; and, forwarding her letter to leaders of the three political parties: Premier Kathleen Wynne, Official Opposition Leader Tim Hudak and Andrea Horwath. The Development Services Committee respectfully reports and recommends to City Council its Forty-third Report.

1. First Report of Heritage Oshawa (DS-13-56)

Recommendation

That Item 1 of the First Report of Heritage Oshawa be replaced with the following:

“1. Region of Durham – Invitation for Public Comment for Municipal Class Environment Assessment Study for Simcoe Street Between Conlin Road and Winchester Road (HTG-13-20)

That pursuant to Correspondence HTG-13-20 dated January 10, 2013 from the Region of Durham Works Department (Regional Works) inviting public comment for the Municipal Class Environment Assessment Study for Simcoe Street between Conlin Road and Winchester Road, the following comments from Heritage Oshawa be provided to Regional Works:

1. Whereas the City of Oshawa believes the stone pillars and gates marking the entrance to the former Windfields Farm have cultural significance, therefore be it resolved that they be retained in situ, or, if in situ reuse is not possible, relocated and incorporated into the planned use of the area west of Simcoe Street; and,

2. That future notices regarding next steps in this project be forwarded to Heritage Oshawa.”

That Item 2 of the First Report of Heritage Oshawa be endorsed:

“2. Ministry of Transportation – Seeking Direction Regarding Scheduling and Logistics for Salvage of a Barn Gate Feature at an MTO Owned Property (HTG-13-23)

That pursuant to Correspondence HTG-13-23 dated February 21, 2013 from the Ministry of Transportation (MTO) regarding the opportunity to salvage two heritage gate features from the 200 Winchester Road barn structure, Heritage Oshawa coordinate with City staff to undertake appropriate arrangements with the MTO to have the Ministry’s salvage contractors retrieve the two heritage gate features stamped with the word ‘Pedlar’ and transport them to the City’s storage facility in the parking garage at 1 Mary Street North as soon as possible.” City Council Agenda - 104 - April 8, 2013

That pursuant to City Council Referral OEAC-13-18, being a direction from City Council from their meeting on February 19, 2013 regarding making Oshawa a ‘Blue Community’, staff be directed to review the ‘Blue Communities Project’ to consider all implications of this program to the City of Oshawa.

3. Greater Oshawa Chamber of Commerce – Oshawa Airport Business Plan (DS-13-53)

Recommendation

10. Update of Storm Sewer Use By-law 95-95 (DS-13-66)

Recommendation

1. That, pursuant to Report DS-13-66 dated March 20, 2013, a new Storm Sewer Use By-law be adopted generally in conformity with Attachment 3 to said Report; and,

2. That the Region of Durham, Central Lake Ontario Conservation Authority, Oshawa Environmental Advisory Committee, and Durham Home Builders Association be provided a copy of any new by-law and related Report and Council Resolution; and,

3. That the Commissioner of Development Services undertake, in conjunction with Corporate Communications, an appropriate notification process regarding any new By-law.

11. Applications to Amend Zoning By-law 60-94 and for Approval of a Draft Plan of Subdivision S-O-2012-02, 1848 Townline Road North, 1494339 Ontario Ltd. (DS-13-59)

Recommendation

1. That, pursuant to Report DS-13-59 dated March 20, 2013, the application submitted by 1494339 Ontario Ltd. to implement a Draft Plan of Subdivision (File: S-O-2012-02) which proposes 33 lots for single detached dwellings on new local roads, future development blocks and a landscape strip be approved subject to the conditions set out as Attachment 5 to said Report; and,

2. That, pursuant to Report DS-13-59 dated March 20, 2013, the application submitted by 1494339 Ontario Ltd. to amend Zoning By-law 60-94 (File: Z-2012-10) to implement the proposed Draft Plan of Subdivision at 1848 Townline Road North be approved and the necessary by-law passed generally in accordance with the comments in the above noted Report; and,

3. That, in accordance with Section 34(17) of the Planning Act and notwithstanding that the rezoning proposed in the public meeting report and at the public meeting differs to some degree from that approved by City Council, such differences are not substantial enough to require further notice and another public meeting.

12. Status of Heritage Salvage Efforts from Structures Slated for Demolition Due to the Highway 407 Extension Through Oshawa (DS-13-60)

Recommendation

That Report DS-13-60 dated March 20, 2013 regarding the ‘Status of Heritage Salvage Efforts from Structures Slated for Demolition Due to the Highway 407 Extension through Oshawa’ be received for information.

13. Proposed Revision to Draft Plan of Condominium (C-O-2005-03), Cher-Brook Properties Corp., 394 & 400 Bloor Street East (Formerly 380 Bloor Street East) (DS-13-67)

(See Page 404 and Pages 181 to 184)

Recommendation

Whereas on May 23, 2006 City Council approved, subject to conditions, Draft Plan of Condominium C-O-2005-03 submitted by Cher-Brook Properties Corp. to allow 34 apartment units in 3 buildings as a condominium on lands municipally known as 394 & 400 Bloor Street East (see Attachment 1 to Item DS-13-67 – Location Plan and Attachment 2 to Item DS-13-67– Current Approved Draft Plan Design); and,

Whereas Cher-Brook Properties Corp. has requested that the City approve a revised Draft Plan of Condominium (see Attachment 3 to Item DS-13-67 for Proposed Draft Plan Design) which includes the following key revisions:

• An increase in the total number of apartment units from 34 to 42;

• The deletion of the most westerly proposed apartment building;

• A revised parking layout; and,

Whereas the two apartment buildings as shown on Attachment 3 to Item DS-13-67 have been constructed; and, City Council Agenda - 108 - April 8, 2013

Whereas the proposed revisions to the draft plan conform with the Oshawa Official Plan designation and zoning regulations; and,

Whereas the proposed revisions are appropriate; and,

Whereas the Planning Act specifies that an approval authority is not required to give written notice of a change to the conditions of approval, if in the opinion of the approval authority the changes are minor in nature; and,

Whereas the proposed changes are minor in nature and do not affect any adjacent property owner;

Therefore, pursuant to DS-13-67, the proposed revision to Draft Plan of Condominium C-O-2005-03 to accommodate the increase in the number of dwelling units and the deletion of the most westerly proposed building as shown on Attachment 3 to Item DS-13-67 be approved subject to the following change to Council’s May 23, 2006 conditions of approval:

1. Delete the first paragraph in Condition 1 and replace it with the following:

“1. That the revised application submitted by Cher-Brook Properties Corp. for approval of a draft plan of condominium for 42 apartment units (File C-O-2005-03) at 394 and 400 Bloor Street East be approved, subject to the following conditions:”

14. Development Services Committee’s Outstanding Items Status Report (DS-13-58)

Recommendation

Item 7: Applications to Amend Zoning By-law 60-94, and for Approval of Draft Plan of Subdivision S-O-2005-03 and Revised Draft Plan of Subdivision 18T-96004, 135 Bruce Street and a Portion of City lands, King Charles Developments Inc.

Whereas in 2005 King Charles Developments Inc. (Medican) submitted applications to amend Zoning By-law 60-94 (Z-2005-07) and for approval of a Draft Plan of Subdivision S-O-2005-03 to permit 1346 apartment units, 15 lots for single detached dwellings, a neighbourhood park block and convenience commercial uses on the former Fittings site located at 135 Bruce Street (see Attachment 1 to Item DS-13-58 – Location Plan); and,

Whereas on February 27, 2006 City Council approved, subject to conditions, Phase 1 of Draft Plan of Subdivision S-O-2005-03 and a related Zoning By-law amendment to permit 320 apartment units on Block A, a neighbourhood park block on Block G and part of Street B (see Attachment 2 to Item DS-13-58 - Current Approved Draft Plan Design for Phase 1); and,

Whereas Medallion Corporation has recently purchased the subject site, has advised that it will be submitting its own applications for the lands outside of Phase 1 and has agreed that the existing Draft Plan of Subdivision application be amended to include only those lands in Phase 1 which have draft plan approval; and,

Whereas it is now appropriate for the City to remove this item from the Development Services Committee’s Outstanding Items Status Report;

Therefore be it resolved that Item 7 of the Development Services Committee Outstanding Items Status Report ‘Applications to Amend Zoning By-law 60-94, and for Approval of Draft Plan of Subdivision S-O-2005-03 and Revised Draft Plan of Subdivision 18T-96004, 135 Bruce Street and a Portion of City lands, King Charles Developments Inc.’, be removed from the Development Services Committee’s Outstanding Items Status Report.

Item 16: Matters Tabled: Proposed Name Change for the Oshawa Municipal Airport

Whereas the Council-approved Airport Business Plan Working Team is assisting staff in the preparation of a new Airport Business Plan; and,

Whereas a potential name change for the Airport remains an outstanding matter that should be assessed by the Working Team as part of a new Airport Business Plan;

Therefore be it resolved that Item 16 of the Development Services Committee Outstanding Items Status Report be lifted from the table; and;

That Council reconsider its previous decision to not refer the proposed name change to the Working Team; and,

That the name of the Airport and any potential name change be referred to the Airport Business Plan Working Team for consideration and a future recommendation to the Development Services Committee and Council as part of the new Airport Business Plan; and,

That the remainder of the Development Services Committee’s Outstanding Items Status Report be received for information.

1. Lou DeVuono, Heroes Highway Ride & Rally – Requesting Cancellation of Invoice for their Event Held June 4, 2011 in the City of Oshawa (CORP-13-31)

Recommendation

That Correspondence CORP-13-31 dated February 25, 2013 from Lou DeVuono requesting cancellation of an invoice for the Heroes Highway Ride & Rally event held on June 4, 2011 in the City of Oshawa be referred to Legal Services.

2. Tammy Maclean – Requesting to Address the Corporate Services Committee Concerning the Enforcement of the Property Standards By-law in the South End of Oshawa (CORP-13-35)

That the Manager, Purchasing Services be authorized to award a contract as outlined in Report CORP-13-28-CM dated March 18, 2013 to AMEC Environment & Infrastructure, a division of AMEC Americas Limited (AMEC), for Environmental Assessment Services for Conlin Road East, in the amount of $324,298, including all taxes being the highest ranked proposal received.

4. First Intake – Late Request for Waiving of Fees (CORP-13-29-CM)

Recommendation

1. That in accordance with Report CORP-13-29-CM dated March 18, 2013, the request for waiving of fees from the Oshawa Senior Citizens Centres be approved for $935.07 as it meets the Council approved criteria notwithstanding it exceeds the $500 maximum and was submitted after the December 1, 2012 deadline; and,

2. That the Financial Assistance and Waiving of Fees policies be amended to continue to accept late applications under these programs as long as funds exist in the budget for these programs.

5. 2012 Annual Statement of Building Permit Revenues and Expenses (CORP-13-30-CM)

Whereas First Responders keep our communities safe, our lives secure, our homes protected and improve the quality of life for all the people in our community; and,

Whereas the City of Oshawa supports Private Members' Bill 123, designating May 1st of each year as ‘First Responders Day in Ontario’, which was recently presented by Newmarket-Aurora MPP Frank Klees and passed, receiving all-party support in the Legislature;

Whereas the cost to update the 25-Year Capital Plan is approximately $9,000 plus taxes; and,

Details - The City of Oshawa and Durham Region have demonstrated how petty and small-minded po liticians can damage the very city they represent. The Heroes Highway Ride should be welcomed with open arms, not a demand for payment. It is a black mark on an otherwise heartfelt effort to honour t he soldiers who have served, and died, for ot hers. Details- I just saw a CTV news report of the $10,000 bill that Durham Region is leving on the bikers for use of the Armoury & some parking in Oshawa. Hell---if Oshawa doesn't have enough of a bad rap for a "blue collar" town and the disappointment of visitors to the downtown, now The Region of Durham is BILLING a cause like t his? I haven't been a flag-waver on the bridges, nor I am I a vet; but as an ordinary guy from this Region, and of Canada, I can 't BE LIEVE this. This annuat award was established In 1994 to give each municipality In Ontario the opportunity to honour one outstanding local senior. The Government of Ontario Is proud of thls Important Initiative. You may wish to consfdar Involving local MPPs In your selection process or presentation ceremony.

Recipients are Individuals who, after age 66, have enriched the social, cultural or clvfc life of the community without thought of personal or financial gain. A certificate, provided by the Ontario government, Is signed by the Honourable David C. Onley, Lieutenant Governor, myself as Minister Responsible for Seniors, and the looal Head of Council.

Council may also wish to host a presentation ceremony honouring the Senior of the Year Award recipient In June, when we pay tribute to seniors across Ontario. This year wm mark the 29th anniversary of Senfors' Month which recognizes the contributions seniors make to family, community, province and country.

RE: CORP 13-31 Lou DeVuono, Heroes Highway Ride & Rally - Requesting Cancellation of Invoice for their Event Held June 4, 2011 in the City ofOshawa

1. Oct 14/10: DeVuono submits a partnership grant application for $19,300 for in- kind services related to a downtown rally.

2. Jan 20/11: DeVuono attends before Community Services Committee seeking endorsement for the event. The following are relevant comments (paraphrased) from that Committee Meeting:

Minute Statement 47 "I'm just looking for an endorsement to take to council at this time so I can bring the event in and then I'd happily work with economic development" 51:08 "I'm proposing a one year partnership" 53 City Manager asking (through the Chair) whether the endorsement is contingent upon the concurrent grant application. 53:51 Answer: "It doesn't affect it, we will go forward without the grant" "us holding the event is not contingent on the in-kind support." 54:27 "The most important thing is getting the endorsement to hold the event so I can seek out sponsors."

3. Feb 6/11: The City advises Mr. DeVuono that staff will be recommending against the partnership grant request because it does not meet Council's approved partnership grant criteria and invites him to Council's Feb 9/11 budget meeting.

4. Feb 9/11 : Mr. DeVuono attends at Council and makes a delegation in respect of the grant application for $19,300 of in-kind se!Vices, as part of the budget process.

5. Feb 23/11: Council moves to endorse the Heroes Highway Ride conditional upon all permits and approvals being received but DENIES the request for in- kind services.

6. Mar 11 /11: the City advises Mr. DeVuono that Council did not approve the partnership grant application.

7. May 1/11: Mr. DeVuono submits special event permit by which he agrees to be responsible for all costs and expenses respecting the event. The event includes rolling or full closures of several City and Regional roads. 8. May 12/11 : Mr. DeVuono appears before Community Services Committee. Direction, Recreation and Culture Ser-Vices advises that the estimated cost for services related to the event is approximately $5,100. A Motion is moved before the committee to waive up to a maximum of $5,100. The motion does not pass.

9. Jun 1/11: Special event permit issued.

10. Jun 4/11: Event

11 . Jun 13/11: Mr. DeVuono presents a Certificate of Thanks and a t-shirt for each Council member to thank the City for supporting the event. Mr. DeVuono made no mention of further request for financial support.

12. Jun 30/11: Invoice issued $5,452.41 ($4,825.14 plus HST). Actual cost to the City is over $6,000 plus HST but the invoice is reduced .

13. Sep 21/11: outstanding invoice referred to Legal Services for collection pursuant to the Accounts Receivable policy.
