Notice to Correspondents

In accordance Council’s Procedure By-law 111-2017, as amended, during the COVID-19 Pandemic Emergency and in order to maintain the Provincial guidelines regarding limiting the size of public gatherings, the Mayor or Deputy Mayor (or designate), the City Clerk, the Deputy City Clerk (or designate), City Clerk Services support staff and Information Technology Services staff will be permitted in the Council Chamber. All other Members of Council and City staff will participate electronically from their offices or an alternate private location to maintain required physical distance in accordance with Provincial orders.

In-person attendance by the public will not be permitted. The Municipal Act, 2001 requires that, subject to the provisions in Section 239, all meetings be open in order for members of the public to observe the meetings. In order to comply with these provisions, members of the public may still view open meeting web streams online live and following the meeting as archived on the City’s website.

Members of the public may request to address Council as a delegation through remote electronic access regarding an item printed on the Agenda and received by City Clerk Services a minimum of two business days prior to the meeting. Members of the public unable to meet the timeline, may submit written correspondence regarding an item on the agenda up to 2 hours prior to the meeting for Council’s consideration. The Clerk will e-mail the correspondence to all members of Council. The personal information contained in your correspondence to City Council or its committees is collected under the Municipal Act, 2001. Any personal information you choose to disclose in your correspondence will be used to receive your views on the relevant issue(s) to enable the City to make its decision on the matter. Report of the Community Services Committee

The Community Services Committee respectfully reports and recommends to City Council its Twenty Sixth Report.

CS-21-10 Recreation Programs Fee Assistance and Notice of Assessment

Recommendation

Pursuant to Report CS-21-10, dated February 11, 2021, concerning Recreation Programs Fee Assistance and Notice of Assessment, the criteria for documentation for Oshawa’s Recreation Fee Assistance Program be expanded to reflect the same government issued documents accepted in other Durham Region municipalities which includes, the Canada Child Tax Benefit Statement and statements from Works or Ontario Disability Support Program.

CS-21-12 Garden Bed Program

Recommendation

Whereas the Region of Durham’s Health Department reported in 2019 that one in seven residents experience food insecurity; and,

Whereas food insecurity is not being able to access safe and nutritious food due to lack of money; and,

Whereas food insecurity often leads to worry about running out of food, settling for lower quality foods and reduced food intake; and,

Whereas, the impacts of COVID-19 has had a dramatic impact on the economy and food systems leading to greater potential of food insecurity; and,

Whereas the City partnered successfully in 2020 with Durham Master Gardeners, the Oshawa Garden Club and Feed the Need Durham to transform the annual garden beds on the north side of City Hall into giving gardens to grow vegetables; and,

Whereas the program engaged numerous volunteers who planned, planted, maintained and harvested more than 750lbs of fresh produce for Feed the Need Durham in 2020 while also building community in the downtown by engaging passersby and sharing the joys of gardening; and, City Council Agenda February 22, 2021 Page 4

Whereas Durham Master Gardeners and the Oshawa Garden Club have expressed an interest in continuing with the program during the 2021 growing season;

Therefore, be it resolved:

1. That annual garden beds with suitable access to water and of an appropriate size, including garden beds around City Hall, be considered for conversion from an annual flower garden to a vegetable garden; and,

2. That the City partner with interested community groups and organizations on an “Adopt-a-Garden Bed” program, during the duration of the pandemic for the planting, maintaining and harvesting of a “Giving Garden” that would contribute much needed fresh vegetables to Feed the Need; and,

3. That the Commissioner, Community Services Department be authorized to execute agreements with various gardening organizations and volunteers, in a form and content acceptable to Legal and Finance Services

CS-21-14 Removal of On-Street Parking on a portion of King Street East

Recommendation

That Report CS-21-14 dated February 10, 2021 concerning parking along the south side of King Street East between Drew Street and Ritson Road be received for information.

CS-21-15 Julian Luke Requesting to Lease Nine (9) Parking Spaces at the Municipally-owned Parking Lot on Ray Street

Recommendation

CS-21-18 Proposed Purchase and Installation of a Commemorative Bench in Honour of Linda Tamburro (OAAC-21-13)

Recommendation

That the recommendation contained in CS-21-18 being the First Report of the Oshawa Accessibility Advisory Committee be endorsed:

“That based on the verbal presentation from the Manager, Parks Planning and Development concerning Council approved 2021 Accessibility Upgrades to City-owned Parks, a commemorative bench be purchased and installed in the Oshawa Valley Botanical Garden (O.V.B.G.) at a cost of $2,612.91 inclusive of H.S.T. in honour of Linda Tamburro utilizing the surplus 2020 funds from capital project 21110139 – ‘Accessibility Improvements (ODA)’, to coordinate with existing park amenities within the O.V.B.G., the location of the commemorative bench will be at the discretion of Parks Planning and Development Staff.”

CS-21-11 Unsanctioned Bike Park Review and Proposed Alternative Location

Recommendation

That pursuant to Report CS-21-11 dated February 10, 2021, that the October 19, 2020 Correspondence CS-20-61 being a petition opposing the demolition of the unsanctioned bike trails and riding features be taken as an indication of the need and interest in a bike park in Oshawa thereby fulfilling Council direction to determine the level of interest rather than holding a public meeting; and,

1. That Option 1: Thornton Road Community Park be selected as the preferred alternative site based on Section 5.5; and, City Council Agenda February 22, 2021 Page 6

2. That the project description under Project 18-500043 titled ‘Thornton Road Sport Field Study’ be replaced with the following wording ‘This project includes funding for the completion of background and technical investigations, conceptual design development of the Thornton Road Community Park which will include potentially sports fields and a B.M.X. facility’; and,

3. That staff investigate and report back to the Community Services Committee on March 19, 2021 the opportunity to build a temporary BMX bike park on the south-west side of City-owned Thornton lands, closer to Thornton Road including costing and timing.

CS-21-13 Request for the Installation of a Municipal Street Light at 2770 Wilson Road North

Recommendation

1. That based on Report CS-21-13, dated February 10, 2021, additional street lighting not be installed along Wilson Road North, north of Winchester Road East; and,

2. That a copy of this report be sent to the resident inquirer.

CORP-21-04 Engine Brake Noise from Heavy Vehicles

Recommendation

That in accordance with Report CORP-21-04, dated February 3, 2021, concerning Engine Brake Noise from Heavy Vehicles:

1. That the City request the Province of Ontario to enhance the enforcement of deficient muffler systems as part of the province’s commercial vehicle inspection program to mitigate concerns regarding excessive noise from engine retarder brakes; and,

2. That the Region of Durham be requested to communicate to residents the availability of the courtesy “residential area - avoid engine brake noise” sign program; and, City Council Agenda February 22, 2021 Page 7

3. That Service Oshawa be advised about the Region of Durham’s “residential area – avoid engine brake noise” courtesy signs so that they can advise residents should a complaint be received; and,

4. That a copy of this Report be provided to the Ontario Minister of Transportation, Regional M.P.P.s, the Region of Durham, Durham Region area municipalities, Durham Regional Police Services and the Association of Municipalities of Ontario (A.M.O.).

CORP-21-03 Trespass By-law 98-2013 and Proposed Amendment to “Authorized Person”

Recommendation:

Whereas the City of Oshawa’s Trespass By-law 98-2013, as amended (“Trespass By-law”) establishes a system for administering notices and other matters under the Trespass to Property Act, R.S.O. 1990, c. T.21; and,

Whereas the Trespass By-law authorizes the following individuals referred to in the Trespass By-law as “Authorized Person[s]” to issue Trespass Notices: the City’s security guards; certain Recreation and Culture Services Branch staff members; police officers; Municipal Law Enforcement Officers; and, Senior Staff Persons; and,

Whereas the Manager, Corporate Security was recently hired and as part of their responsibilities will manage the frontline response to issues related to unlawful behaviour or activities that may warrant the issuance of a Trespass Notice; and,

Whereas the responsibilities of corporate security have been transferred from Municipal Law Enforcement and Licensing Services to Facilities Management Services;

Therefore be it resolved that Council pass a by-law to further amend Trespass By-law 98-2013, as amended, as follows:

1. That the Manager, Corporate Security be included as an “Authorized Person” in Section 1.3 of the Trespass By-law 98-2013, as amended; and,

2. That Section 14 of the Trespass By-law 98-2013, as amended be revised to replace the Director, Municipal Law City Council Agenda February 22, 2021 Page 8

Enforcement and Licensing Services with the Director, Facilities Management Services.

CORP-21-06 Corporate Security Services Annual Contract

Recommendation

1. That in accordance with Report CORP-21-06, dated February 3, 2021, concerning the Corporate Security Services Annual Contract, that staff be directed to implement the direction as outlined in Section 5.7.2 of Confidential Attachment 2 and as directed in closed session; and,

2. That the Chart located on page C14 of Confidential Report CORP-21-06 be added to the public report.

CORP-21-11 Education about Coyotes

Whereas members of Council have been receiving resident complaints regarding coyotes in their neighbourhoods; and,

Whereas in consultation with Coyote Watch Canada, the best course of action is to remove the factors that are attracting the wildlife; and,

Whereas Durham Regional Police Services can be called when residents feel there is an imminent threat to their safety due to a coyote; and,

Whereas there is a need to increase communication on what to do in the event a resident is concerned about a coyote in their neighbourhood; and,

Therefore staff be directed to:

1. Develop a communication plan to educate residents on how to deal with coyotes in their neighbourhood and to report any sightings to Service Oshawa;

2. Solicit comments from the Oshawa Animal Care Advisory Committee regarding the communication plan;

3. Amend the Nuisance By-law to prohibit the feeding of wildlife, or leaving food that is accessible by wildlife so as to constitute a public nuisance, whether occurring on public or private property.” City Council Agenda February 22, 2021 Page 9

Recommendation

DS-21-16 Application for Variance to Sign By-Law 72-96, 27 to 33 Simcoe Street South, WJW Canada Inc.

Recommendation

That Report DS-21-16 concerning an application for variance to Sign By-law 72-96, 27 to 33 Simcoe Street South, WJW Canada Inc. be referred to Council without recommendation.

DS-21-17 Results of Planning Act Public Meeting Concerning a Proposal to Relocate the Community Park Currently Designated West of Harmony Road North and North of Britannia Avenue East in the Kedron Part II Plan via a City-initiated Amendment to the Oshawa Official Plan

Recommendation

1. That, pursuant to Report DS-21-17 dated February 3, 2021, the City-initiated amendment to the Oshawa Official Plan (File: OPA-2020-03) to permit a potential alternative location for the future Kedron (Part II Plan) Community Park on lands designated for Prime Agricultural purposes located outside of the Major Urban Area at the northwest corner of Harmony Road North and the future east-west Type ‘C’ Arterial Road forming the northerly limit of the Kedron Part II Plan, as generally set out in Attachment 2 to said Report, be adopted that the necessary by-law be passed in a form and content acceptable to the Commissioner, Development Services Department and Legal Services and forwarded to the Region of Durham for approval; and, City Council Agenda February 22, 2021 Page 10

2. That, pursuant to Report DS-21-17 dated February 3, 2021, staff be authorized to submit an application and associated planning rationale to the Region of Durham to amend the Durham Regional Official Plan, to ensure conformity between the Durham Regional Official Plan and the Oshawa Official Plan by implementing an appropriate Regional Official Plan amendment that reciprocates the City-initiated amendment to the Oshawa Official Plan, as outlined in Part 1 of the recommendation; and,

3. That, pursuant to Report DS-21-17 dated February 3, 2021, and in the event Parts 1 and 2 of the recommendation are approved, City staff be directed to report back to the Development Services Committee with a separate closed report to advance a strategy for the potential acquisition of the subject lands located at the northwest corner of Harmony Road North and the future east-west Type ‘C’ Arterial Road forming the northerly limits of the Kedron Part II Plan, as shown in Attachments 1 and 2 of said Report.

DS-21-18 Application to Amend the Oshawa Official Plan (Kedron Part II Plan) for portions of the lands municipally known as 2466 Harmony Road North, Minto (Harmony Road) LP, 1040 Conlin Road East, Conlin (Oshawa) 130 Acres Inc., and 0 Wilson Road North, Kedron North GP Inc.

Recommendation

That, pursuant to Report DS-21-18 dated February 3, 2021, the application submitted by Minto (Harmony Road) LP to amend the Oshawa Official Plan (Kedron Part II Plan) (File: OPA-2020-01) to permit alternative residential land uses in the Community Park designation in the event that the Community Park is relocated or otherwise not needed, in whole or in part, for a portion of the lands owned by Minto (Harmony Road) LP municipally known as 2466 Harmony Road North, as well as a portion of the abutting lands owned by Conlin (Oshawa) 130 Acres Inc. municipally known as 1040 Conlin Road East and a portion of the abutting lands owned by Kedron North GP Inc. municipally known as 0 Wilson Road North, be approved generally as set out in Attachment 2 to this Report in accordance with the comments contained in said Report, and the necessary by-law be passed in a form and content acceptable to the Commissioner, Development Services Department and Legal Services. DS-21-19 Durham-Scarborough Bus Rapid Transit Project Public Information Centre 3

Recommendation

1. That the comments contained in Report DS-21-19 dated February 3, 2021 be endorsed as the City’s comments with respect to the Durham-Scarborough Bus Rapid Transit Project Public Information Centre 3; and,

2. That Metrolinx and Durham Region Transit be requested to not advance the Durham-Scarborough Bus Rapid Transit Project described in this Report until all City comments have been addressed to the City’s satisfaction; and,

3. That staff be authorized to forward a copy of Report DS-21-19 dated February 3, 2021 and the related Council resolution to Metrolinx, the Region of Durham, the City of Pickering and the Towns of Ajax and Whitby.

DS-21-20 Durham Region’s Municipal Comprehensive Review: City Comments on Major Transit Station Areas - Proposed Policy Directions

Recommendation

1. That Report DS-21-20 dated February 3, 2021 be endorsed as the City’s comments on the Major Transit Station Areas Proposed Policy Directions Report dated December 2020 prepared by the Region of Durham as part of Envision Durham, the Municipal Comprehensive Review of the Durham Regional Official Plan; and,

2. That staff be authorized to forward a copy of Report DS-21- 20 dated February 3, 2021 and the related Council resolution to the Region of Durham and Durham area municipalities.

DS-21-23 Process to Establish a New Noise Abatement Procedure at the Oshawa Executive Airport

Recommendation

1. That, pursuant to Report DS-21-23 dated February 3, 2021, the Commissioner, Development Services Department, in consultation with the City’s Airport Manager, be authorized to advance the process prescribed in Advisory Circular 302- 002 to request Transport Canada to establish a new noise abatement procedure at the Oshawa Executive Airport; and, City Council Agenda February 22, 2021 Page 12

2. That, the Airport Manager, in consultation with the Commissioner, Development Services Department, be authorized to engage a qualified, independent consultant with familiarity of the requirements of Advisory Circular 302- 002 to assist in the advancement of Part 1 of the recommendation, at an upset limit of $60,000 exclusive of H.S.T.; and,

3. That copies of this Report and associated resolution be forwarded to all Oshawa and Whitby MPs and MPPs as well as to the Town of Whitby.

DS-21-25 Application to Amend the Windfields Part II Plan of the Oshawa Official Plan and Revised Applications to Amend Zoning By-law 60- 94 and for Approval of a Draft Plan of Subdivision, Southwest corner of Thoroughbred Street and Dance Act Avenue, 2157236 Ontario Limited

1. That, pursuant to Report DS-21-25 dated February 3, 2021, the application submitted by 2157236 Ontario Limited to amend the Windfields Part II Plan of the Oshawa Official Plan (File: OPA-2020-02) in order to implement the draft plan of subdivision (File: S-O-2020-02) for lands located at the southwest corner of the intersection of Thoroughbred Street and Dance Act Avenue be approved generally in accordance with the comments in said Report, and that the necessary by-law be passed in a form and content acceptable to the Commissioner, Development Services Department and Legal Services; and,

2. That, pursuant to Report DS-21-25 dated February 3, 2021, the revised application submitted by 2157236 Ontario Limited to amend Zoning By-law 60-94 (File: Z-2020-06) in order to implement the draft plan of subdivision (File: S-O- 2020-02) for lands located at the southwest corner of the intersection of Thoroughbred Street and Dance Act Avenue be approved generally in accordance with the comments in said Report, and that the necessary by-law be passed in a form and content satisfactory to the Commissioner, Development Services Department and Legal Services; and, City Council Agenda February 22, 2021 Page 13

3. That, pursuant to Report DS-21-25 dated February 3, 2021, the revised application submitted by 2157236 Ontario Limited for approval of a draft plan of subdivision (File: S-O- 2020-02) featuring one (1) block for up to 16 single detached and/or semi-detached dwellings, four (4) blocks for up to 27 street townhouses and a new local road for lands located at the southwest corner of the intersection of Thoroughbred Street and Dance Act Avenue be approved, subject to the conditions as generally set out in Attachment 7 of said Report. 4. That, in accordance with Section 34(17) of the Planning Act and notwithstanding that the Zoning By-law amendment proposed in Report DS-20-126 dated November 4, 2020 presented at the public meeting of November 9, 2020 differs to some degree from the proposed amendment recommended to be approved by City Council, pursuant to Part 2 of this Recommendation, such differences are not substantial enough to require further notice and another public meeting; and,

4. That, the Commissioner, Community Services Department be authorized to pass a by-law to amend Schedule XXV of the City’s Traffic and Parking By-law 79-99, in a form and content satisfactory to the Commissioner of Community Services and the City Solicitor, to remove the bike lane on the south side of Dance Act Avenue, west of Thoroughbred Street, previously designated under Amending By-law 14-2020 dated January 24, 2020.

DS-21-28 Downtown Restaurant Patio Season

Whereas the Provincial restrictions placed on businesses during the COVID-19 Pandemic have had a significant economic impact on downtown restaurants; and,

Whereas these impacts were exacerbated by the lockdown on December 26, 2020, allowing local restaurants to only be open for curbside pick-up and takeout; and,

Whereas a delegation spoke at the February 5, 2021 meeting of the Mayor’s Task Force on Economic Recovery and provided first-hand experience with the restrictions placed on local businesses and stressed the importance of patios that permit outdoor dining to the restaurant industry; and,

Whereas on February 5, 2021 the Mayor’s Task Force on Economic Recovery recommended that the City extend the downtown restaurant patio season by permitting patios to establish on April 1, 2021 rather than May 1, 2021; and, City Council Agenda February 22, 2021 Page 14

Whereas, it is important for the City to support for downtown restaurants during the pandemic;

Therefore be it resolved:

1. That staff be directed to take the necessary steps to allow sidewalk cafes and patios to be erected on April 1, 2021; and,

2. That staff be authorized to extend the downtown restaurant patio season beyond October 31, 2021 in the event that Provincial restrictions are still in place following the normal cessation of the downtown patio season.

DS-21-29 Extension to Submit Applications under the City of Oshawa Urban Growth Centre Community Improvement Plan

Whereas the Provincial restrictions placed on businesses during the COVID-19 Pandemic have had a significant impact on local businesses; and,

Whereas this has impacted the ability of businesses to submit a complete application under the City of Oshawa Urban Growth Centre Community Improvement Plan; and,

Whereas as of February 5, 2021, Economic Development Services has only received 1 application under the City of Oshawa Urban Growth Centre Community Improvement Plan; and,

Whereas on February 5, 2021 the Mayor’s Task Force on Economic Recovery recommended that the City extend the existing deadline to submit an application under the City of Oshawa Urban Growth Centre Community Improvement Plan for the first intake of applications from March 1, 2021 to April 30, 2021;

Therefore be it resolved:

1. That staff be directed to extend the deadline to submit an application for the first intake under the City of Oshawa Urban Growth Centre Community Improvement Plan from March 1, 2021 to April 30, 2021; and,

2. That staff process applications submitted before the current March 1, 2021 under the normal course of business; and, City Council Agenda February 22, 2021 Page 15

3. That applications received between March 1, 2021 and April 30, 2021 be processed consistent with the City of Oshawa Urban Growth Centre Community Improvement Plan which is dependent on the number of approved grants during the first intake, and the availability of funding at that time; and,

4. That staff continue to accept applications between May 1, 2021 and September 1, 2021 for the City of Oshawa Urban Growth Centre Community Improvement Plan which is dependent on the number of approved grants during the first intake and the extended first intake, and the availability of remaining funding at that time.

Recommendation

That Correspondence FIN-21-12 concerning the corporate payments for the month of November 2020 be received for information.

FIN-21-13 Doug Thomson, Oshawa Public Library Board submitting correspondence concerning the Oshawa Public Library 2021 Budget (INFO-21-12)

Recommendation

Whereas the Oshawa Public Libraries Board is responsible to undertake all capital improvements to the McLaughlin and Northview Library Branches with limited resources even though they are both City-owned buildings; and,

Whereas the Oshawa Public Libraries Board submits an annual budget submission to City Council for approval as part of the tax levy deliberations to address both capital needs for these buildings and overall library operating needs; and,

Whereas the Oshawa Public Libraries Board is not treated in a similar and consistent manner as the Robert McLaughlin Art Gallery which is also located in a City owned building but in that case the City is wholly responsible for capital improvements; and, City Council Agenda February 22, 2021 Page 16

Whereas there may be some operational efficiencies (i.e. tendering process, increased City assistance) and potential cost savings to the taxpayer if the City were to help address the responsibilities of undertaking capital improvements to these two City owned buildings that are library branches;

Therefore be it resolved:

1. That City staff discuss with Oshawa Public Library CEO and Chair of the OPL Board the potential of investigating the possibility of the City assisting in the capital program for the City owned buildings that are the McLaughlin and Northview Library Branches, which investigation will include a municipal scan of other municipalities and consultation with Library staff, and report back to the Finance Committee well in advance of when the Library Board needs to submit it’s 2022 budget submission to the City; and,

2. That a copy of this resolution be forwarded to the CEO of the Oshawa Public Library, the Chair of the Oshawa Public Library, and the Oshawa Public Libraries Board of Directors.

FIN-21-11 Asset Management Support Services

Recommendation

1. That pursuant to Report FIN-21-11, dated February 10, 2021 concerning Asset Management Support Services, the Supervisor, Purchasing Support Services be authorized to award a single source contract to Watson & Associates Economists Ltd. at a cost of $62,500, plus H.S.T., to complete life costing analyses and financial modelling working with City Staff; and,

2. That the contract be funded through the Administrative Studies Development Charge Reserve and Growth Related Non-Development Charge Reserve; and,

3. That City Council directs staff to apply for a grant opportunity from the Federation of Canadian Municipalities’ Municipal Asset Management Program for development of life cycle costing analyses and financial modelling; and,

That the City of Oshawa commits to conducting the following activities in its proposed project submitted to the Federation of Canadian Municipalities’ Municipal Asset Management Program to advance our asset management program: Development of life cycle costing analyses and financial modelling working with City staff to advance the City’s asset management planning capabilities by informing infrastructure investment decisions through improving data collection, analysis and reporting; and,

That FCM be advised that the City of Oshawa commits $13,600 from its budget toward the cost of this initiative.

“SnowAngelsCanada.ca is a platform for sharing and connecting people wanting to participate in acts of winter kindness by shovelling a neighbour’s sidewalk or driveway.

Whereas this platform started in London Ontario 6 years ago and recently became a Canada-wide pilot project;

Whereas other municipalities, such as the City of Barrie and the City of Belleville are posting a link to the SnowAngelsCanada.ca on the City’s website;

Whereas the municipalities who post the SnowAngelsCanada.ca include a note to remind residents that Snow Angels is a community initiative, not a City run program, and the City does not have any administrative control, however the City is happy to promote the program, raise awareness, and encourage community involvement;

Now therefore the City include a SnowAngelsCanada.ca link on the City’s website with a similar reminder.”
