Guinet1 1 Centre d’Etudes Biologiques de Chizé CNRS, UPR 1934 Villiers-en-Bois, 79360 France Email – [email protected] 2 MNHN Paris, 75005 France Abstract Within the Crozet Islands Exclusive Economic Zone (EEZ), the Patagonian toothfish (Dissostichus eleginoides) longline fishery is exposed to high levels of depredation by killer (Orcinus orca) and sperm whales (Physeter macrocephalus). From 2003 to 2008, sperm whales alone, killer whales alone, and the two species co-occurring were observed on 32.6%, 18.6% and 23.4% respectively of the 4 289 hauled lines. It was estimated that a total of 571 tonnes (€4.8 million) of Patagonian toothfish were lost due to depredation by killer whales and both killer and sperm whales. Killer whales were found to be responsible for the largest part of this loss (>75%), while sperm whales had a lower impact (>25%). Photo-identification data revealed 35 killer whales belonging to four different pods were involved in 81.3% of the interactions. Significant variations of interaction rates with killer whales were detected between vessels suggesting the influence of operational factors on depredation. When killer whales were absent at the beginning of the line hauling process, short lines (<5 000 m) provided higher yield and were significantly less impacted by depredation than longer lines. -

Laird Clark University In three previous studies, most subjects who anticipated having to perform an unpleasant task (e.g., eat a worm) and who were then offered a choice of that or a neutral task chose the unpleasant task. It was hypothesized that this "choosing to suffer" effect was produced by the subjects' attempt to make sense of their anticipated suffering, through one of three kinds of change in their conception of themselves and the situation: (a) they deserved the suffer- ing, (b) they were brave, or (c) the worm was not too bad. Subjects antici- pating a neutral task did not change on these measures, while subjects eating a worm changed significantly, indicating that anticipated suffering did cause the predicted reconceptualizations. Changes in these three kinds of conception predicted subject's choice or not of eating the worm, indicating that these changes produced the subsequent choice. Finally, subjects who saw them- selves as either more brave or more deserving also chose to administer painful electric shocks to themselves, while subjects who had changed their concep- tions of the worm did not, indicating that these conceptual changes can affect behavior in situations different from that which initially caused the conceptual changes. IV China and the Law of the Sea: An Update Guifang Xue* Introduction his article examines the practice of the People's Republic of China with re Tspect to the 1982 United Nations Convention on the Law of the Sea {1982 LOS Convention),l Two principal areas will be assessed: China's efforts to accom modate the challenges of the Convention to its ocean domain as a coastal State and its major maritime legislation to implement the Convention regime. The analysis begins with a brief introduction of China's maritime features and a review of its basic stance toward the Convention. This is followed by a discussion of the major challenges China encountered while establishing its ocean domain based on the Convention regime. China's efforts in implementing the 1982 LOS Convention through national legislation are examined to assess the consistency of that statu tory framework with Convention requirements. Finally, conclusions are drawn from China's law of the sea practice. It is shown that China, fo r its part, has been accelerating domestic procedures with a view to enabling it to comply with Con vention requi rements. However, China's maritime practice has not been wholly consistent with Convention provisions. At the same time, China's oceans policy adjustments indicate a move away from its previous position as solely a coastal .. Understanding the Emerging Danger of the Stand Alone Complex
Andrew DeMarco University Honors in Communications, Legal Institutions, Economics, and Government Capstone Advisor: Professor Andrea Tschemplik, CAS: Philosophy Standing Alone: Understanding the Emerging Danger of the Stand Alone Complex Japanese director and screenwriter, Kenji Kamiyama, has written works on the implications of the acceleration of technology, but it is in his most famous work, Ghost in the Shell: Stand Alone Complex, that he renders his most insightful and ominous theory about the changing nature of human society. Kamiyama proposes that in an increasingly interconnected society, the potential for individuals to act independently of one another, yet toward what may appear to others to be the same goal increases as well. Standalone individuals may be deceived into emulating the actions of an original actor for a perceived end when neither of these existbecoming “copycats without originals.” Kamiyama’s theory of the Stand Alone Complex is a valid one, and the danger it heralds needs to be addressed before the brunt of its effects are felt by those unable obtain remedy. What little literature exists on the theory is primarily concerned with medialogy, but the examination herein addresses the theoretical and philosophical grounding on which the theory stands. This study finds sufficient grounding for the theory through theoretical and philosophical discourse and historical case study. The practical and moral implications of the Stand Alone Complex are addressed through related frameworks, as Kant’s moral system provides a different perspective that informs legal discussions of intent. The implications for national governments are found highly dangerous, and further discourse on the theory is recommended, despite its “juvenile” origins. -

Child Tax Credit & Credit for Other Dependents Introduction The child tax credit is unique because if a taxpayer cannot benefit from the nonrefundable credit, the taxpayer may be able to qualify for the refundable additional child tax credit on Schedule 8812, Additional Child Tax Credit. In this chapter, we will learn about both credits and their relationship to each other. Some taxpayers may not be aware of these credits. Your time, effort, and understanding of this credit may result in a lower tax for the taxpayer. The child tax credit, credit for other dependents, and the additional child tax credit are entered on Form 1040. The intake and interview sheet, along with the Volunteer Resource Guide, Tab G, Nonrefundable Credits are critical tools needed to determine eligibility for the credit. Don’t confuse these credits with the child and dependent care credit! Objectives What do I need? A Transnational Law of the Sea Josh Martin Abstract It is widely accepted that we are presently struggling to govern the vast expanse of the ocean effectively. This Article finally gets to the real cause of much of the failures of the law of the sea: Westphalian sovereignty. In particular, it evidences that certain features of our obstinate model of public international law—such as sovereign exclusivity, equality, and territoriality—can be linked with a large majority of the governance “gaps” in the global ocean context. It thereby exonerates the falsely accused Grotius’s mare liberum doctrine and flag state regulation, which both still continue to receive an unmerited level of condemnation. This Article also argues that worldwide searches for new integrated systems of ocean management are, in fact, a search for a new paradigm of governance, well-known among lawyers, but yet to be thoroughly analyzed in the law of the sea context, that of transnational law and governance.
