ACCESSION DE LA RÉPUBLIQUE D'ARMÉNIE À L'ACCORD SUR LES MARCHÉS PUBLICS

Décision du Comité du 7 décembre 2010

Le Comité des marchés publics,

Eu égard à l'article XXIV:2 de l'Accord sur les marchés publics;

Considérant la demande d'accession à l'Accord sur les marchés publics présentée par l'Arménie, reproduite dans le document GPA/ACC/ARM/1 du 4 septembre 2009, et les consultations tenues avec les parties à l'Accord sur les marchés publics par suite de cette demande;

Rappelant la disposition de l'article XXIV:5 a) de l'Accord sur les marchés publics selon laquelle chaque gouvernement qui acceptera le présent accord ou qui y accédera assurera, au plus tard à la date où ledit accord entrera en vigueur en ce qui le concerne, la conformité de ses lois, règlements et procédures administratives, ainsi que des règles, procédures et pratiques appliquées par les entités reprises dans ses listes annexées à l'Accord, avec les dispositions dudit accord;

Considérant les renseignements relatifs aux textes législatifs sur les marchés publics prévus par l'Arménie, indiqués dans le document GPA/ACC/ARM/11 du 8 novembre 2010, en sus de l'intention déclarée de l'Arménie d'adopter ces textes et de leur donner effet;

Notant aussi que conformément à l'article 6 de la Constitution de la République d'Arménie, les traités internationaux font partie intégrante du système juridique arménien. Si un traité international ratifié stipule des règles autres que celles qui sont stipulées dans les lois, les règles du traité prévaudront. Comme l'Accord sur les marchés publics est un accord international devant être ratifié par l'Arménie, il fera partie intégrante du système juridique arménien. Si l'Accord stipule des règles autres que celles qui sont prévues dans les lois, notamment la "Loi sur les marchés publics" arménienne, les règles de l'Accord prévaudront.

Décide ce qui suit:

1. Conformément aux dispositions de l'article XXIV:2 de l'Accord sur les marchés publics, l'Arménie pourra accéder audit accord selon les modalités énoncées dans la pièce jointe à la présente décision et à condition qu'elle dépose auparavant son instrument d'accession:

a) l'Arménie adopte et met en vigueur les textes législatifs en conformité avec les dispositions de l'Accord sur les marchés publics, conformément à l'article XXIV:5 a) dudit accord;

b) après l'adoption des textes législatifs susmentionnés, l'Arménie présente, pour examen par le Comité des marchés publics, lesdits textes accompagnés de renseignements sur leur entrée en vigueur; et

c) le Comité, ayant examiné les textes législatifs et les renseignements connexes présentés par l'Arménie, confirme que l'Arménie a respecté toutes les modalités et conditions attachées à l'accession et qu'elle peut donc, déposer son instrument d'accession.

2. L'Accord sur les marchés publics entrera en vigueur pour l'Arménie le trentième jour qui suivra le dépôt auprès du Directeur général de son instrument d'accession, reproduisant les modalités énoncées en annexe à la présente décision et confirmant que l'Arménie a adopté et mis en vigueur les textes législatifs visés au paragraphe 1.

3. L'Arménie pourra déposer son instrument d'accession dans un délai de trois mois à compter de la date à laquelle le Comité aura confirmé qu'elle a respecté toutes les modalités et conditions attachées à l'accession, conformément à ce qui est indiqué au paragraphe 1 c), ou pour toute date ultérieure qui pourra être fixée par le Comité.

4. Dès l'accession de l'Arménie, les modalités jointes à son instrument d'accession feront partie intégrante de l'Accord sur les marchés publics de même que les Appendices, Annexes et Notes concernant l'Arménie.

ANNEX 5

Construction Services

A construction services contract is a contract which has as its objective the realization by whatever means of a civil or building works, in the sense of Division 51 of the Central Product Classification.

Threshold:

SDR 5,000,000 for Annexes 1, 2 and 3.

List of construction services offered:

All services listed under Division 51.

GENERAL NOTES

1. Armenia will not extend the benefits of this Agreement to any contract:

(a) awarded under an international agreement and intended for the joint implementation or exploitation of a project by the signatory States;

(b) awarded under an international agreement relating to the stationing of troops;

(c) funded wholly or in part by or awarded under the particular procedure of an international organization, where the applicable procedure would be inconsistent with the Agreement.

2. This Agreement shall not apply to procurements of agriculture products made in furtherance of agriculture support programme and human feeding programmes.

3. This Agreement shall not apply to goods and services procured with a view to commercial sale or resale, or for use in the production of goods or provision of services for commercial sale or resale, provided that the contracting authority enjoys no special or exclusive right to sell and other entities are free to sell it under the same conditions as the contracting entity.

4. This Agreement shall not apply to the acquisition of land, existing buildings or other immoveable property or concerning rights thereon.
