The answer is yes, in a few instances, 13 TISHREI 5780 Na’anu’im being one of them. The Shulhan Aruch (Orah Haim 651:9) rules that the Na’anu’im begin in front and then wind around the right and conclude with up and down motions. Sepharadim (and Hassidim), though, follow the Ari z”l’s practice of shaking to the south, then Friday Night north, east, east in the upwards direction, east in a downward motion and finally to the west (Kaf HaHaim Orah Haim 651:49). Shir Hashirim 5:55 pm Maran Rav Karo writes that one performs the Na’anu’im simply by moving one’s Minha 6:05 pm hands. While Ashkenazi Jews follow this practice, Sephardic Jews fully extend their arms Candle Lighting 6:04 pm followed by Kabbalat Shabbat / holding the four Minim in a full motion back and forth, once again following the approach of the Arvit Ari z”l (Kaf HaHaim Orah Haim 651:48 and 93). Shabbat Day The Kaf HaHaim (651:96) notes that it appears from the Shuhan Aruch (op. cit.) that one moves his hands and not his body when performing the Na’anu’im. -

Teshuvah: Introduction: About fifteen years ago, a congregant approached me to perform a baby naming for her newborn daughter. I knew the woman. She had grown up in the congregation. She was single, had despaired of ever getting married, and had chosen to utilize ART to have a child of her own and raise that child on her own. She wanted to welcome her child into the covenant within her congregational home. The next Sabbath, with the proud grandparents in attendance, the woman carried her daughter up to the bimah for her aliyah, following which I blessed her and her child and announced the child’s name. After services, I was approached by several older members who were distressed that the congregation had “legitimized” a child born “out of wedlock.” It was irrelevant to them that they knew the woman since she had been a child and were otherwise sympathetic to her. -

DANI PASSOW Jewish Ethics of Employee Treatment and Communal Responsibility Introduction THERE IS AMPLE EVIDENCE that the current system implementing labor laws is flawed. Consider the following facts from a recent study entitled, “Broken Laws, Unprotected Workers” that presents findings about surveyed restau- rant workers in New York, Chicago, and Los Angeles. ! 76 percent of restaurant employees surveyed who worked more than 40 hours a week did not receive overtime as required by fed- eral law. ! 26 percent received below minimum wage. ! 86 percent of workers did not receive full meal breaks when working a minimum number of consecutive hours. ! A full 69 percent received no breaks whatsoever or had their breaks shortened by their employers. ! 30 percent of tipped employees, whose minimum wage is signif- icantly less than non-tipped employees, failed to receive even that reduced minimum wage. 12 percent had some tips stolen by their employers.1 20 percent of those surveyed spoke up and complained to their employ- ers. Of these, nearly half, 43 percent, were the victims of illegal retaliatory measures: their employers fired or suspended them, cut their wages, or DANI PASSOW is a third year rabbinical student at Yeshivat Chovevei Torah, where he is also a Wexner Graduate Fellow. As a result of fear created by such measures, 20 percent of those polled failed to complain even though they worked in dangerous conditions or did not receive minimum wage.2 Such flagrant abuses of law and justice demand that we question to what extent our own tradition requires communal responsibility, outside of the current enforcement structure, to ensure that the eating establishments we patronize adhere to legal standards of employee treatment. -

1 Exodus 21-24: Specimen of a Numerical Composition A Fresh Approach to Resolve Two Literary Problems An earlier version of this article was submitted in September 2012 for publication in Vetus Testamentum, but since it was summarily rejected as being ‘speculative’ and showing ‘a selective and manipulative use of the data’, I submitted a slightly revised version in April 2013 for publication in Journal of Biblical Literature. Having been notified that the article is ‘inappropriate for JBL’ and that it fails ‘to be a useful contribution to the academic study of the Hebrew Bible’, I have now decided to publish it here. Let the unprejudiced readers judge for themselves. Abstract The purpose of the present article is to shed new light on Exodus 21-24, the passage dealing with the Book of the Covenant and the ratification of the covenant; more specifically to address two crucial questions: its precise delimitation, and its compositional architecture. On neither of these issues has any accordance of opinion been reached. The great variety of scholarly opinion can be explained as based on subjective considerations by which the objective criteria provided by the text itself are disregarded. I shall argue that the key to finding objective criteria lies in a fresh approach to the literary analysis of a biblical text, based on the Masoretic layout markers and the crucial insight that these writings are numerical compositions constructed with the help of specific numbers which function as structural devices. This insight, which has been substantiated by the numerical analysis of a large number of texts, stems primarily from the fact that the transmitters of the Hebrew text diligently counted verses, words, and even letters, and that they located and marked the centre of books and groups of books in terms of verses, words, and even letters. -
