Armed Forces Establishments Road Traffic Bylaws 1978 (SR 1978/149)

Pursuant to section 72 of the Transport Act 1962, the Minister of Defence, being the Minister having the control of the roads within the bounds of the Establishments specified in Schedule 1 of these bylaws, hereby makes the following bylaws.

Schedule 2 7 Special speed limits

Bylaws 1 Title and commencement (1) These bylaws may be cited as the Armed Forces Establish- ments Road Traffic Bylaws 1978. (2) These bylaws shall come into force on the day after the date of their notification in the Gazette.

2 Interpretation In these bylaws, Establishment means any air force base, army camp, or naval establishment, as defined in section 2(1) of the Defence Act 1990, that is specified in Schedule 1 of these regulations. Bylaw 2: amended, on 1 April 1990, pursuant to section 105(2) of the Defence Act 1990 (1990 No 28).

3 Application of bylaws These bylaws shall apply with respect to every road within the bounds of any Establishment.

4 Speed limits (1) No person shall drive any vehicle or ride any animal on any road specified in Schedule 2 at a speed exceeding the speed specified in that schedule in relation to that road. (2) No person shall drive any vehicle or ride any animal on any road (not being a road specified in Schedule 2) within the bounds of any Establishment at a speed exceeding 50 kilo- metres per hour.

5 Parking of vehicles (1) No person shall park any vehicle on any road within the bounds of any Establishment in a place that is not approved as a parking place by the Commanding Officer of the Estab- lishment.

(2) In this bylaw, the expression park means to stop or stand a vehicle; but does not include the stopping or standing of a vehicle for any period not exceeding 5 minutes, and does not include the standing of a vehicle while actually taking up or setting down persons or goods.

6 Authority to stop vehicle or ridden animal (1) Any authorised person may order any person driving any ve- hicle or riding any animal within the bounds of the Establish- ment to which the authorised person for the time being belongs to stop the vehicle or animal to enable the authorised person to ascertain whether its use constitutes a breach of any provision of these bylaws. (2) In this bylaw, authorised person means an officer or non- commissioned officer of the Armed Forces, or a security guard or warden engaged by the Crown, in uniform.

7 Offences and penalty (1) Every person who contravenes or fails to comply with any provision of these bylaws commits an offence against these bylaws. (2) Every person who fails to comply with any order given to him under these bylaws commits an offence against these bylaws. (3) Every person who obstructs any other person in the exercise of that other person’s powers under these bylaws commits an offence against these bylaws. (4) Every person who commits an offence against these bylaws is liable on conviction to a fine not exceeding $200. Bylaw 7(4): amended, on 1 July 2013, by section 413 of the Criminal Procedure Act 2011 (2011 No 81).

8 Bylaws to be subject to regulations These bylaws shall, in relation to any Establishment to which the Defence Regulations 1990 (SR 1990/78) apply, be read subject to those regulations. Bylaw 8: amended, on 6 April 1990, pursuant to regulation 41 of the Defence Regulations 1990 (SR 1990/78).

9 Bylaws not to derogate from powers of Commanding Officers Nothing in these bylaws shall be construed to derogate from the powers of the Commanding Officer of any Establishment, by virtue of his office, to exclude persons or animals from the Establishment or to regulate or restrict the movement of persons or animals within the Establishment.

10 Revocations The following bylaws are hereby revoked: (a) the Armed Forces Establishments Road Traffic Bylaws 1970 (SR 1970/197): (b) the Armed Forces Establishments Road Traffic Bylaws 1970, Amendment No 1 (SR 1971/1): (c) the Armed Forces Establishments Road Traffic Bylaws 1970, Amendment No 2 (SR 1971/248).

4 Changes made under section 17C of the Acts and Regulations Publication Act 1989 Section 17C of the Acts and Regulations Publication Act 1989 authorises the making of editorial changes in a reprint as set out in sections 17D and 17E of that Act so that, to the extent permitted, the format and style of the reprinted enactment is consistent with current legislative drafting practice. Changes that would alter the effect of the legislation are not permitted. A new format of legislation was introduced on 1 January 2000. Changes to legislative drafting style have also been made since 1997, and are ongoing. To the extent permitted by section 17C of the Acts and Regulations Publication Act 1989, all legisla- tion reprinted after 1 January 2000 is in the new format for legislation and reflects current drafting practice at the time of the reprint.
