MARTTI KOSKENNIEMI It is widely agreed that international law has its origins in the writings of the Spanish theologians of the 16th century, especially the so-called «School of Sala- manca», who were reacting to the news of Columbus having found not only a new continent but a new population, living in conditions unknown to Europeans and having never heard the gospel. The name of Francisco de Vitoria (c. 1492- 1546) the Dominican scholar who taught as Prima Professor with the theology fa- culty at the University of Salamanca from 1526 to 1546, is well-known to interna- tional law historians. This was not always the case. For a long time, international lawyers used to draw their pedigree from the Dutch Protestant Hugo de Groot (or Grotius) (1583-1645) who wrote as advocate of the Dutch East-India company in favour of opening the seas to Dutch commerce against the Spanish-Portuguese monopoly. Still in the 18th and 19th centuries, the law of nations —ius gentium— was seen as a predominantly Protestant discipline that drew its inspiration from the natural law taught by such followers of Grotius as the Saxon Samuel Pufen- dorf (1632-1694) and the Swiss Huguenot Emer de Vattel (1714-1767), followed by a series of professors at 18th century German universities1. It was only towards the late-19th century when the Belgian legal historian Er- nest Nys pointed to the Catholic renewal of natural law during the Spanish siglo de oro that attention was directed to Vitoria and some of his successors, especially the Jesuit Francisco Suárez, (1548-1617), who had indeed developed a universally applicable legal vocabulary —something that late— 19th century jurists, including Nys himself, were trying to achieve2. -

IGNATIUS, PRAYER AND THE SPIRITUAL EXERCISES Harvey D. Egan ECAUSE OF HIS EXTRAORDINARY apostolic success, and later that of B the order he founded, Ignatius’ reputation as one of the greatest mystics in the Christian tradition still remains somewhat obscured. When, years ago, I told a friend from a contemplative order that I was writing a book centred on Ignatius’ mysticism, he all but denied that Ignatius had a mystical side.1 Ignatius’ life, however, was profoundly affected by four foundational mystical events: his conversion experience while recovering at Loyola from the Pamplona battlefield injury; an experience of the Virgin Mary during that same recuperation which confirmed his desire to live a chaste life henceforth; the subsequent enlightenment at the River Cardoner; and his vision at La Storta leading him to a mysticism of service.2 In addition, God blessed him with numerous extraordinary secondary mystical phenomena. And one of the purest examples of the direct reporting of mystical experiences in Christian history can be found in Ignatius’ short Spiritual Diary. This extraordinary document contains irrefutable evidence of Ignatius’ deeply trinitarian, Christ-centred, Marian reverential love, and of the priestly, eucharistic and apostolic aspects of his mysticism. Also permeating it is a profoundly mystical emphasis on discernment, visions, intellectual and affective mystical events, somatic phenomena, mystical tears and mysterious loquela—a phenomenon consisting of different levels of inner words saturated with meaning, tones, rhythm and music. Bernard of Clairvaux, John of the Cross and others in the Christian tradition emphasized mystical bridal sleep—that is, swooning lovingly in God’s embrace at the centre of the soul—as the most valuable way of serving God, the Church and one’s neighbour. -

Legal Imagination in Vitoria. The Power of Ideas Pablo Zapatero* Professor of Public International Law, Carlos III University, Madrid, Spain 1. A Man’s Ideas Legal progress is often propelled by concepts first envisioned in academia. In this light, the present article explores the ideas of a fascinating intellectual figure: Francisco de Vitoria (1483-1546),1 a man broadly recognized as one of the “founding fathers” of international law. The writings and lectures of this 16th century Dominican friar formulated innovative legal doctrines in an age of uncertainty and profound social change; an age that gave birth to the modern States that, with their centralized power, signalled the demise of medieval pluralism, the dismemberment of Christendom, and the erosion of imperial and papal aspirations to universal power. Medieval Europe, before then, had defined itself as a cultural, political and religious unity: the Res Publica Christiana. The first half of the 16th century witnessed the final breakdown of that order, the emergence of the modern sovereign state and the subsequent development of the European state system. It was also in this age that a singular event transformed con- ventional conceptions of the world and consolidated anthropocentrism: the discovery of America.2 A ‘stellar moment’ of literature, political and legal * For correspondence use [email protected]. Manresa and Saint Ignatius of Loyola
JOAN SEGARRA PIJUAN was born in Tárrega, Spain on June 29, 1926. He joined the Society of Jesus in 1942. Seventeen years later he completed his religious and cultural education. On July 29, 1956 – in the Year of Saint Ignatius – he was ordained at the cathedral in Manresa. He has spent much of his life in Veruela, Bar- celona, Sant Cugat del Vallès, Palma (Majorca), Raimat, Rome and Man- resa and has also lived in a number of countries in Central and South Ameri- ca, Africa and Europe. He has always been interested in spi- ritual theology and the study of Saint Ignatius of Loyola. SAINT IGNA- TIUS AND MANRESA describes the Saint’s sojourn here in a simple, rea- dable style. The footnotes and exten- sive bibliography will be of particular interest to scholars wishing the study the life of St. Ignatius in greater de- tail. This book deals only with the months Saint Ignatius spent in Man- resa, which may have been the most interesting part of his life: the months of his pilgrimage and his mystical en- lightenments. Manresa is at the heart of the Pilgrim’s stay in Catalonia because “between Ignatius and Man- resa there is a bond that nothing can break” (Torras y Bages). Topoi vol.2 no.se Rio de Janeiro 2006 Las Casas, Alonso de Sandoval and the defence of black slavery Juliana Beatriz Almeida de Souza ABSTRACT The aim of this paper is to analyse the contributions made by the Dominican Bartolomé da Las casas, in the XVI century, and the Jesuit Alonso de Sandoval, in the XVII century, to legitimaze and regularize discourses about the slave trade and black slavery in the Spanish Americas. Key-words: Colonization of the Hispanic America; Evangelize of blacks; Black slavery. David Brion Davis in the 1960s warned that many historians were exaggerating the antithesis between slavery and Catholic doctrine. The purpose of this article is to move away from a value-laden analysis of the actions of the Catholic Church both in defence of black slavery and in defence of the blacks.1 Rather, I seek to revise the work of two missionaries who worked in Spanish America and who played an important role in the construction of a discourse that at the same time legitimated and regulated the black slave trade. I refer to the Dominican Bartolomé de Las Casas in the sixteenth century and the Jesuit Alonso de Sandoval in the seventeenth.
