Richard Wm. Wesch County Attorney I am writing on behalf of the Lee County Board of Commissioners to urge

Donna Marie Collins expansion of the Marvin B. Clayton Firefighters Pension Trust Fund Act (Act) to Hearing Examiner include municipalities that provide fire protection services to unincorporated

areas.

The Firefighters’ Pension Trust Fund is funded through an excise tax of 1.85% imposed on the gross premiums of property insurance written within a municipality or special fire district. Currently, a municipality providing fire services to a Municipal Service Taxing Unit (MSTU) within an unincorporated area is not entitled to receive the premium tax collected from the MSTU by the State. House Bill 1189 and Senate Bill 1442 would allow such taxes to be reallocated to such a city for the purpose of providing pension benefits to its firefighters.

The City of Cape Coral currently provides fire protection, non-transport

advanced life support and fire inspection services to the Burnt Store Fire MSTU in unincorporated Lee County. Despite having provided these services since 1990, Cape Coral is unable to receive the premium tax collections on insurance policies for the properties located within the MSTU. Reallocating these funds for the benefit of the firefighters providing the service is the right thing to do and will have an exceedingly small fiscal impact on the State.
