Re: Broadcasting Notice of Consultation CRTC 2011-788, Review of the Local Programming Improvement Fund (BNC 2011-788) – Comments of Corus Entertainment Inc.

1. Corus Entertainment Inc. (Corus) is pleased to submit these comments in response to the BNC 2011-788.

2. Corus operates three television stations serving small markets in Ontario: CKWS- TV Kingston, CHEX-TV Peterborough and CHEX-TV-2 Oshawa. Each of these stations is eligible for funding from the Local Programming Improvement Fund (LPIF), funding which is critical to our ability to sustain and improve the local programming we provide to our viewers in each of these markets.

3. Corus requests the opportunity to appear at the public hearing. We believe it is important to provide the Commission with a first-hand perspective of the challenges we face in trying to provide a viable over-the-air television service to small markets that are subject to enormous competitive pressures.

4. An understanding of these challenges is integral to the central point of this submission – namely, that retention of the LPIF on substantially the present same terms and conditions is essential to support our continued ability to properly reflect the needs and interests of our viewing audience.

The competitive context

5. In order to fully appreciate the importance of the LPIF to Corus’ ability to sustain and improve its local programming, it is important to understand the broader competitive context and the difficult economic circumstances under which we must operate on a day-to-day basis.

6. Corus operates three over-the-air television stations as CBC affiliates in three small markets in southern and : Kingston, Peterborough and Oshawa. While we operate the only local television station licensed to serve each of these markets, the reality is that we face enormous competitive pressures from the five major English-language conventional television services – CBC, CTV, CTV 2, Global and – that are available in each market in which Corus operates, either directly over-the-air or via cable and DTH broadcasting distribution undertakings (BDUs). Moreover, we face increasing pressure on our national advertising revenue from the scores of specialty channels available in our markets, often in HD, on cable and satellite.

7. For the reasons explained in the attached analysis prepared by Airtime Television Sales Inc., while we have been able to achieve a modest increase in our national advertising revenues over the past two years (a cumulative 12% increase from 2008-2009 to 2010-2011), it is unrealistic to expect continued growth in this area in the coming years. Major national advertisers are relying more on the extensive reach of the larger regional and national broadcasters to access viewers throughout Ontario. As noted in the attached analysis:

In the fall of 2011 CTV 2 and the Rogers Network were marketed to national agencies as yet another way to make one purchase and cover off many markets. With better than average programming they were able to secure huge dollars at the expense of single market stations in Ottawa, London, Kitchener Kingston, Sudbury, Hamilton and Peterborough.

With the largest broadcasters in control of the best shows this trend will continue to be present. With more options being provided to viewers in the form of programming, HD, satellite, time shifting, internet and pvr out of market tuning will continue to be a problem that plagues these markets and will make it tougher to see new account entries and to grow budgets from current accounts.

8. The Commission’s recent decision approving Inc.’s application for new digital transmitters to rebroadcast CKVR-DT in the areas of Burlington, Fonthill, Fort Erie, Hamilton, Niagara Falls, St. Catharines, Oakville and Welland1 is further evidence that our three small stations in will find it increasingly difficult to get national advertising sales.

9. We note in particular the following comments in the dissenting opinion attached to that decision:

The television business model derives the vast majority of its revenue not from local but from national sales and this decision will clearly enhance Bell/CTV’s national sales revenue. The money to be “repatriated” will most likely come therefore not from the U.S. but from Bell/CTV’s competitors in southern Ontario, including small independent operators.

10. As one of the small independent operators in southern Ontario, Corus agrees that its ability to sustain its conventional television national advertising revenues will be negatively impacted by this decision.

11. Going forward, it is clear that we will need to rely to a much greater extent on increasing local advertising revenues to obtain an overall gain in advertising revenues. Yet, our local advertising revenues have increased by less than 1% in total over the past two years. The challenge is to find ways to increase our audience in order to have an opportunity to increase local advertising revenues.

12. Our competitive challenges in Kingston and Peterborough are heightened by the fact that satellite penetration in both of those markets is extremely high. Between 55% and 60% of our viewers in these markets receive our signal from either Bell TVor .

13. The key issue is that, although we have incurred considerable expense to make our signals available in HD to all BDUs, only one of the DTH operators (Bell TV) has started carrying one of our HD signals (CKWS-HD) as of February 2012. The signal is being made available on Nimiq2, which has limited distribution. The result is that the DTH viewers of the CBC network programming we broadcast who have HD sets naturally prefer to watch such programming on the HD CBC feeds that are provided by the DTH operators.

14. This significantly limits our viewing audience and, in the absence of a Commission requirement that the DTH operators carry local signals in HD where available, it means that we cannot compete on an equal footing in our own markets for DTH viewers. There have been clear declines in our ratings for our non-news programming, and this is particularly alarming with respect to CBC’s hockey broadcasts, which have always been a ratings driver for local CBC affiliates.

15. In Oshawa, we face even more challenging competitive realities. Our Oshawa station receives no DTH carriage. While we expect this to be remedied when the Commission’s rules requiring the DTH carriage of LPIF-eligible stations take effect, we may again be denied carriage in HD by the DTH operators. Our ability to compete in Oshawa with the HD CBC services on DTH will again be hampered.

16. Even more important than the lack of DTH carriage of CHEX-TV-2 is the proximity of Oshawa to and the fact that CBLT-DT Toronto receives priority cable distribution throughout our local market area. As a result, we do not have the right to request simultaneous substitution over duplicated network programming on CBLT-DT in Oshawa, Ajax and Whitby. Our potential audience for the CBC network programming we carry on CHEX-TV-2 Oshawa is therefore seriously limited.

17. Our new affiliation agreement with the CBC, which commenced on September 1st, 2011, is another important factor that will affect our ability to compete for advertising revenues going forward. Suffice it to say that it has changed the nature of the historical terms of our business relationship with the CBC. As a result, it will be extremely difficult for Corus to maintain, let alone increase, our local and national advertising in 2011-2012 and future years, compared to what we were able to achieve in 2010-2011.

The economic environment

18. Given the competitive environment we have described, Corus has worked hard to maintain economically viable operations in Kingston, Peterborough and Oshawa. There is no doubt that, without the support we have received over the past two years from the LPIF, it would have been difficult to avoid significant cuts to our local programming budgets.

19. In the 2008-2009 broadcast year, the last year prior to the introduction of the LPIF, the Canadian economy was affected by a global recession. This in turn strongly impacted revenues available for all sectors of the broadcasting industry.

20. Since then, the broadcasting industry has made progress in its recovery from the effects of the 2008 recession. At the same time, the revenue performance of Corus’ conventional television stations over the last two years remains below that of all sectors of the industry.

21. The following table compares revenue growth of the three Corus television stations (excluding LPIF funds) from 2008-2009 to 2009-2010 with the broader conventional television sector, the specialty and pay sector, and the broadcast distribution sector.

22. In 2009-2010, the rate of recovery for Corus’ conventional television stations in terms of revenues was approximately half of that for the broadcasting industry in general. In 2010-2011, our revenues, excluding LPIF funds, grew by only 3.3%.

23. In these circumstances, Corus was still able to increase its local programming expenditures (LPE) by 9.2% for our three stations combined, but only with the assistance of the LPIF. This would not have been possible in the competitive and economic environment in which we have been forced to operate over the past two years without the vital support that has been provided by the LPIF.

24. During a time of relatively flat revenues, we also needed to undertake substantial capital improvement to upgrade our studio and master control facilities to accommodate HD production and transmission. This was a competitive necessity in light of the importance of providing an HD signal to cable BDUs in our market areas so that we could operate on a relatively level footing, at least in terms of cable distribution, with the CBC and other English-language broadcasters in our markets.

25. The HD initiative entailed significant capital expenditures in 2009-2010 and 2010- 2011 in order to make us HD-capable. Without the support of the LPIF, we would have been forced to make deep cuts in operating costs, including LPE, in order to finance these expenditures. While capital upgrades are not eligible for LPIF-support, the reality is that the LPIF allowed us to maintain and increase LPE during the past two years during times of large capital expenditures and below-average revenue increases, something that would not otherwise have been possible.

26. Going forward, we face continuing competitive realities as described above that will challenge our ability to sustain, let alone increase, advertising revenues. A continuation of the LPIF at existing levels of funding is absolutely essential to the continued viability of our stations and to our ability to sustain and make further improvement to our local programming.

Local programming improvements in Kingston, Peterborough and Oshawa

27. In Kingston, our focus has been on improving the quality of our local news programming, rather than on expanding the number of hours we provide.

28. In the 2010-2011 broadcast year, we continued to produce three Newswatch shows each weekday at 5:30 pm (30 minutes), 6:00 pm (60 minutes) and 11:00 pm (35 minutes). On the weekends, we produced two 30-minute news programs, Newswatch Saturday and Regional Review on Sundays. These news programs total 11.4 hours each week, adding up to almost 600 hours of local news programming each year.

29. Other local programming includes coverage of the annual Easter Seals Telethon, but given that we are the only local television outlet in the market, the clear focus of our local programming is news.

30. With the assistance of the LPIF over the past two years we have been able to increase our LPE in Kingston by 11.2%, thereby improving the quality of our local newscasts and improving its relevance to our local audience. We expanded our newsroom staff, hiring an additional full-time reporter/videographer plus a part-time videographer to improve our weekend coverage, particularly on Sundays. We also made improvements to the studio, set and graphics packages to update the look of the 5:30 pm and 6:00 pm newscasts.

31. We adopted a similar approach in Peterborough, focusing on the improvement of our existing newscasts. CHEX-TV broadcasts three Newswatch programs daily, as in Kingston, plus a half-hour Regional Review on the weekends, totalling just under 11 hours weekly or almost 570 hours annually of local news. We also provide several hours of other local programming consisting of coverage of various community events, but again the clear focus of our local programming is on our local newscasts.

32. Over the last two years we have increased our LPE in Peterborough by almost 14%, a substantial increase in the resources dedicated to local news that was only made possible by the support this station received from the LPIF. These funds were used to hire two new full-time videographers, expanding our pool from four to six, and to staff the position of News Director, which had been vacant for several years, with an internal promotion. We also hired a new Assignment Editor, reporting to the News Director. These changes greatly improved our newsgathering capabilities and allowed us to provide much more aggressive coverage of breaking stories.

33. We also were able to find the funds to do a total upgrade of the set and we updated the graphic look of our newscasts.

34. In the current broadcast year, starting in September 2011, we have added an additional 2.5 hours a week of original local news production in both Kingston and Peterborough, again with the assistance of the LPIF.

35. While we are proud of the improvements that we have made to our local news coverage on both Kingston and Peterborough, perhaps the most significant changes and the most visible improvements were made to the local programming of CHEX-TV-2 Oshawa.

36. Oshawa is our most difficult market to serve, given the limited advertising revenues that we are able to generate under our existing conditions of licence and due to the presence of all major English-language networks blanketing this region. Excluding LPIF funding, our revenues in Oshawa in 2010-2011 were down more than 10% compared to 2008-2009, meaning that there would have 7

been no reasonable prospect of improvements to local programming without the support of the LPIF.

37. Prior to the LPIF, while we provided over 500 hours of local programming annually, the local news component of this was limited to a daily 30-minute newscast at 5:00 pm. We had limited resources and little ability to pursue and follow-up on breaking stories. Much of our local programming consisted of relatively inexpensive lifestyle programming, including a daily phone-in show on local issues and concerns called First Take Live.

38. Unfortunately, this program had little chance of attracting an audience in the very competitive supper hour news marketplace. With the benefit of LIPF funding, however, we were able to map out a complete multi-year strategy for the station to significantly upgrade its news coverage.

39. In 2009-2010, as a first step, we replaced First Take Live with an expanded Live@5 newscast of 60 minutes in duration. The expanded Live@5 made more of an effort to discuss the current issues in the region with studio guests. However, it still had no capability to do any reporting in the field, or to cover stories other than by making phone calls.

40. In the same year we integrated our Peterborough computerized weather system with Oshawa, enabling Oshawa residents to get a detailed local weather package with sophisticated computer graphics for the first time. We also hired a part-time sports videographer, and invested in Skype technology to give us the capability for live location interviews.

41. Perhaps the most significant long-term change in Oshawa in 2009-2010 was relocating our local studio to the heart of downtown Oshawa, with major investments in technology, including new cable and satellite transmission paths. This major upgrade to our studio and production facilities would not have been possible without the support of the LPIF. The primary impact of this relocation would show up in 2010-2011, but the planning and the bulk of the spending occurred in 2009-2010.

42. LPIF funding enabled us to make very substantive improvements to our on-air product for the 2010-2011 broadcast year. We discontinued the Live@5 newscast and in its place launched Studio 12 News, a full-fledged 30-minute local newscast with three reporters/videographers regularly covering stories in the area. For the first time in Oshawa we were able to mount a competitive news program with field reports, footage, graphic capability, all in a dynamic new downtown studio. We started to break stories in Oshawa and were often ahead in our coverage of the large Toronto stations.

43. Some of the important local stories that we broke on CHEX-TV-2 as a result of the improvements to our local news coverage include the planned ethanol plant in Oshawa, a local investment advisor charged with embezzling retired GM 8

workers’ funds, the Highway 401 Pickering overpass financial mess, and numerous others. The major networks later picked up these stories, but they were reported first on CHEX-TV-2. The LPIF funding we received has helped us keep the residents of Oshawa and the surrounding area better informed of events that affect their lives.

44. The improvements in news coverage in Oshawa have continued into the current broadcast year. Between 6:00 pm and 7:00 pm, after Studio 12 News, CHEX-TV-2 now carries the CHEX-TV Peterborough newscast. Although a Peterborough local news service, this newscast has expanded its daily news, weather and sports coverage to include the Oshawa area, with contributions from the Oshawa reporters.

45. In addition, our daily Newswatch First at 5:30 pm in Peterborough now includes a significant window of Oshawa news, fed to us from the Oshawa studio.

46. With the benefit of LPIF funding, we have also been able to undertake major in- depth initiatives to better serve our viewers in all three markets. The most visible of such initiative was a survey that we commissioned in all three markets as well as a general sample from across Ontario, to discover how high school students were doing with a broad variety of variables – their families, their social situation, the law, their schools and their futures. We also assembled experts and panels of students from all markets to discuss how they would interpret the findings.

47. We presented the data in seven feature reports on each station during seven weeks of news programming. It was the kind of ambitious (and expensive) coverage that generally only major stations in major markets can undertake. And it was important that we did it, because the results for our markets did differ significantly in some areas from the province as a whole. That series would have been impossible to mount without the LPIF funding.

48. In short, we believe that the record clearly shows that LPIF funding has given us the resources to make significant improvements in the scope and quality of the local news coverage we provide in each of our markets. All of this was accomplished during a time of economic uncertainty and enormous competitive challenges.

49. Without the creation of the LPIF, most of these improvements would not have been possible. We certainly would not have undertaken the additional 2.5 hours a week of new original news production in Peterborough and Kingston, starting in September 2011, without the funding from the LPIF. In short, without a continuation of the LPIF at similar levels of funding support for our local stations, we will be unable to sustain the improvements we have made over the past two years, and we will be precluded from making further improvement in the years to come.

Recommendations

50. Corus is a member of the Coalition of Small Market Television Stations (the SMITS Coalition) and, as such, has participated in the formulation and submission of the SMITS Coalition comments in this proceeding.

51. We fully endorse and adopt the following key recommendations made by the SMITS Coalition, for the reasons elaborated in their submission and taking into account the Corus-specific analysis provided in this submission.

LPIF objectives

52. The current LPIF objectives remain appropriate. We would support the addition of a fourth objective, as outlined in the SMITS submission: to ensure the financial health of Canadian small market independently owned television stations, which enrich the diversity of information and editorial viewpoints through their local programming in Canada’s smallest television markets.

Indicators of success

53. The existing indicators of success strongly support the conclusion that the LPIF is meeting its stated objectives. This conclusion has been amply demonstrated in the assessment reports filed by Corus and other broadcasters for the 2009-2010 and 2010-2011 broadcast years.

54. While the existing indicators are generally reasonable in the context of all stations that receive LPIF support, Corus agrees that indicators related to increased local advertising revenues and the number of local news stories that are picked up nationally are not always relevant in the case of small market television stations operated by independent broadcasters. These specific indicators should be given less weight when assessing the extent to which the LIPF has contributed to improving the quality of local programming for such stations.

Incrementality of local programming expenditures

55. Corus agrees that imposing a formal incrementality obligation with respect to local programming expenditures is not necessary to ensure the continued success of the LPIF.

56. During the first two years of operation of the LPIF, a period of time during which our advertising revenues have grown at a rate much lower than that of the broader television, specialty & pay and broadcasting distribution sectors, we were able to increase LPE by 9.2% for our three stations combined.

57. We have made significant improvements to the quality of our local news coverage in each market we serve because it was a competitive necessity that we do so. A Commission rule requiring incremental spending on local programming is simply unnecessary.

Eligibility criteria

58. The current criteria that determine the eligibility of stations to receive funding from the LPIF are appropriate and should be continued.

Vertical integration

59. If the Commission should contemplate changes to the LPIF to address perceived issues related to vertically integrated entities, it should ensure that such changes do not inadvertently impact small market independently owned television stations, including those operated by Corus.

LPIF allocation formula

60. Corus agrees with the SMITS Coalition that the current allocation formula remains appropriate, provided that the overall level of contributions by BDUs to the LPIF is not reduced below the current level of 1.5% of gross revenues derived from broadcasting activities.

61. Under the current allocation formula, Corus received $2.9 million in 2010-2011 from the LPIF, support that was essential in allowing us to enhance the quality of our local content.

BDU contributions to the LPIF

62. BDU contributions to the LPIF should remain at 1.5% of gross revenues derived from broadcasting activities in order to ensure that the level of funding available to support the provision of local programming in small markets served by independent broadcasters is not reduced.

63. Any reductions in LPIF support would make it difficult, if not impossible, for Corus to sustain the improvement in the quality of our local programming that we have instituted over the past two years and would clearly preclude any further improvements.

Should the LPIF be maintained, modified or discontinued?

64. Corus strongly supports the SMITS recommendation that the Commission should maintain the LIPF in accordance with the existing requirements respecting BDU contributions, eligibility criteria and allocation formula. It has successfully met its objectives and there is no compelling public policy rationale to alter the existing requirements. 11

65. If the Commission nevertheless considers that there should be fundamental changes to the operation of the LPIF, Corus agrees with the SMITS Coalition that any such changes should be implemented in a way to ensure that the existing level of support available to the licensees of small market independently owned television stations, including, Corus, be maintained. This could be accomplished by establishing a separate and dedicated LPIF funding envelope for small market independently owned television stations within the LPIF, equivalent to the level of funding they currently receive.

66. Corus appreciates the opportunity to submit these comments and looks forward to further discussing the challenges we outlined at the public hearing in April.

In a letter dated February 17th, 2012, the Commission requested that the over-the-air stations CHEX-TV Peterborough, CKWS-TV Kingston and CHEX-TV-2 Oshawa that are owned and operated by Corus Entertainment Inc. (“Corus”) provide “logger tapes containing all the local news programming broadcast each broadcast day by each of the stations during the broadcast week of February 12-18”.

The Commission also requested information related to the news programming contained in the logger tapes and this information was to be provided in an Excel file to be sent with Corus’ response. The requested Excel files are attached to our response.

Finally, the Commission requested that Corus provide what in our view constitutes an appropriate working definition for “local news programming” that is consistent with the manner in which the programming was classified in our response set out in the Excel files provided. Corus believes the following definition achieves this objective:

“Local news programming” is defined as news programming that originates with the station airing the programming or is directly relevant or tailored to the needs and interests of the local market audience.

Corus appreciates the additional time provided by the Commission in which to provide its response. The collation and preparation of the requested information was very time intensive requiring in excess of 160 hours of staff time to complete.

Corus trusts that this additional information is satisfactory and remains available to provide further clarifications if so required.

Re: Broadcasting Notice of Consultation CRTC 2011-788 and 788-3, Corus Entertainment Inc. (Corus) – Responses to undertakings

Corus operates three over-the-air television stations -- CHEX-TV (Peterborough), CKWS-TV (Kingston) and CHEX-TV-2 (Oshawa) -- each of which is eligible for funding from the Local Programming Improvement Fund (LPIF).

Corus appeared at the oral phase of the public hearing reviewing the existing parameters of the LPIF (Broadcasting Public Notice CRTC 2011-788). During its appearance, Corus undertook to provide additional information. The transcript references and the responses are provided below.

1. Eligibility to LPIF based on profitability of local television station1

There was discussion at the oral phase of the LPIF hearing about whether the Commission should adopt a new eligibility criterion for LPIF funding which would be based on the local television station’s profitability.

A number of parties, including Corus and the Coalition of Small Market Independent Television Stations (the SMITS Coalition), undertook to provide the Commission with a proposal on how a profitability criterion could apply in the context of the LPIF.

Corus considered very carefully whether and how a profitability criterion could possibly be implemented. After careful consideration, Corus came to the conclusion that a profitability criterion in the context of the LPIF is neither workable nor would it achieve the objective of ensuring that a greater amount of LPIF monies are used towards local programming expenditures (LPE). The SMITS Coalition came to the same conclusion as Corus and, accordingly, we support the response submitted by the SMITS Coalition on this issue.

There are several reasons for coming to the conclusion that a profitability criterion is not workable. They include the following:

(i) A profitability criterion could not be implemented with respect to the CBC, which is currently the single largest recipient of LPIF monies ($41M in 2010-2011) for a number of reasons. First, the CBC is a not-for-profit entity; its appropriations and revenues are fully expensed every year. These expenses are attributed to all of the CBC’s media operations both regulated and unregulated. Accordingly, there is no mechanism by which to attribute a profitability level to any given CBC television station. However, it would be clearly inequitable to treat all of CBC’s television operations as unprofitable simply because it is not possible, given the CBC’s accounting practices, to attribute a profitability level to a single CBC television station. Second, CBC receives a separate parliamentary allocation for its capital expenses. Those expenses are totally outside the regular reporting of income or cash flow. Third, for a variety of reasons, the CBC has, unlike other Canadian private broadcasters, major production facilities located in non-metropolitan markets. These facilities enable the CBC to produce high-cost Category 7 drama productions in LPIF eligible markets. Those productions skew the allocation of LPIF funding. They also compromise a category of expense (or revenue) that may be recognized locally, regionally, or nationally – each with different results to an LPIF allocation dependent on profitability. Accordingly, the CBC’s operations are so different than those of private broadcasters that a profitability measure could not be equitably applied. Therefore, the implementation of a profitability criterion could only apply to private broadcasters, which would, in and of itself, be unfair. If the Commission were to consider such a criterion, it would need to apply to all LPIF recipients, which is not possible in the case of the CBC given the manner in which the public broadcaster accounts for its revenues and expenditures.

(ii) The introduction of such a proposal at this time would signal a major policy shift in broadcasting regulation. It would be tantamount to the introduction of a form of rate of return regulation, something which is not contemplated by the Broadcasting Act.

(iii) The application of a profitability criterion could result in an LPIF recipient station being eligible one year and not the next. In such a circumstance, this would introduce a level of complexity and uncertainty to the budgeting process both on an annual and on a multi-year basis. Given that the majority of LPE is spent on salaries, stations would have to lay off staff when LPIF monies were not 3

available and then re-hire them once funding had been restored. This is both an inefficient and very costly manner in which to run a station, not to mention the difficulties this would create with staff.

(iv) Given the financial implications of losing access to the LPIF funds, the introduction of this criterion could encourage parties to “game” the system. It would also encourage parties to be less efficient in order to achieve only the level of profitability that will allow them to retain LPIF monies. In essence, the Commission would end up rewarding parties that operate inefficient operations by awarding them LPIF monies. At the same time, it would be penalizing those operators that operate in an innovative and efficient manner by denying them access to LPIF monies.

(v) Trying to guarantee only certain profitability levels would distort the economics of television markets even more than what the LPIF currently may or may not do. At a time when the regulated is facing enormous challenges, the Commission would be establishing a criterion that would reward failure rather than incent financial success along with stronger local programming. Canadians would neither understand nor accept this type of public policy. This would also serve to discourage further investment in broadcast operations.

(vi) Since the contributions from broadcasting distribution undertakings (BDUs) are determined on a fixed basis, not all LPIF monies may be allocated in any given year, especially where a number of potential recipients would exceed the profitability criterion established by the Commission. This means the Commission would need to introduce a new and more complex level of LPIF administration. The Commission would need to determine what can or should be done with unallocated monies in any given year, which could include returning the monies to BDUs and requesting that such amounts be returned to consumers or, establishing some sort of trust fund for future use. The Commission would then need to determine which consumers should receive those monies. The Commission could choose to re-allocate the monies the following year, but the same issue would simply be perpetuated in such a circumstance. The Commission could also determine that these monies be directed to other programming initiatives such as the CMF but, in such a circumstance, the Commission would be asking consumers to support programming that would not deliver local programming which is the purpose of the LPIF.

(vii) The actual implementation of a profitability criterion could be a complex exercise. The Commission would need to look at profitability levels absent the LPIF and other revenues that do not relate to advertising such as funding from the Small Market Local Programming Fund (SMLPF). This is because the Commission established the SMLPF to address the impact on small market television of the mass importation by DTH BDUs of distant signals. This problem is exacerbated by the gray and black market distribution of television signals that 4

impacts mainly the smaller markets. These distant signals erode the value of the exclusive program rights acquired by local television stations and also erode the advertising revenue base. Other revenues that should not be taken into account include affiliation revenues, so essentially what you would be looking at are those revenues that are reported for the purposes of paying Part 1 licence fees. Without the full knowledge of what profitability actually means in such circumstances, the Commission could be unfairly restricting the access of a local television station to LPIF funding.

(viii) Instituting a profitability criterion does not have any bearing on a station’s level of LPE or any specific local programming initiative. In one station’s case, a certain level of profitability may result in increased spending on LPE, but in other cases, it may not. Thus, establishing a profitability threshold would, in addition to being complicated to administer, not guarantee that LPIF-eligible stations spend those funds on LPE.

(ix) From an accounting perspective, when looking at profitability, the Commission would be including elements such as sales and administration expenses, technical and other expenditures that have absolutely nothing to do with local programming expenditures. It also takes into account depreciation, which may or may not be tied to a capital expenditure related to local programming. This is a fundamental flaw associated with the implementation of a profitability criterion -- there are too many variables in a profit and loss sheet that are not tied to local programming per se. In addition, it would make it difficult if not impossible to plan multi-year local programming initiatives and plan capital spending projects.

(x) A profitability criterion for either broadcasters or independent producers is not used to determine eligibility to the CMF, as this would artificially distort where and how monies should be disbursed. It would mean that independent productions would only be supported on programming services that sustain an artificially low level of profitability. This would run counter to the CMF’s objective of ensuring that it supports projects that will garner the greatest audiences. You can’t encourage success and then penalize it – this is the case with the CMF and Corus believes this also applies to the LPIF.

(xi) Finally, a profitability criterion would also not take into account the scale in which small television stations operate. One significant event in a small television market has a much greater impact on station revenues than in larger television markets (markets with a population of more than 1 million). That is the nature of economic scale. Restricting profitability in smaller television markets would have a greater impact overall on the operations of the station.

The LPIF was created to support one category of programming: local programming. It was not meant to artificially suppress a station’s efficiencies or otherwise impact the general operations of our stations. The Commission’s main concern is to ensure that a greater portion of local programming is supported by LPIF funding. This objective can 5 be achieved through other means such as incrementality, which is an issue that Corus will be addressing in its final comments on May 2nd, 2012. What is important to understand however, is that there is no direct nexus between the level of profitability achieved by a station and the level of investments made in regards to LPE.

2. Funding other than advertising revenue sources for Corus stations

The Commission also asked Corus to provide the revenue amounts that our LPIF eligible stations take in from sources other than from sales and marketing (or otherwise driven by the stations) as a percentage of all revenue.2 Corus has provided this information in confidence in a document identified as Attachment A. An abridged version of the table is provided below. It should be noted that only CKWS-TV (Kingston) and CHEX-TV (Peterborough) receive funding from the SMLPF. Therefore, the percentage provided in the case of CHEX-TV-2 is strictly related to revenues from the LPIF.

Corus requests that the information provided in Attachment A be treated as confidential in accordance with the procedures set out in sections 30-32 and 39 of the CRTC Rules of Practice and Procedure.

The information designated as confidential is consistent with the practice set out in Broadcasting and Telecom Information Bulletin CRTC 2010-961. The redacted financial information would allow parties to calculate the revenues for the individual television stations for the historical period in question. Disclosure of this information could seriously prejudice the competitive position of Corus and as a result could have a significant detrimental impact on these television stations. As such, disclosure would not be in the public interest.

Corus notes that every year the CAB provides to the Commission the amounts of SMLPF monies disbursed to eligible stations and we understand that this information is publicly available.

3. Requiring a minimum level of local news as a criterion for eligibility for funding from the LPIF

Commissioner Morin produced a table regarding local news information, which was distributed at the oral phase of the hearing. The table contained a summary of the local news information submitted by licensed television stations submitted to the Commission in response to its letter dated February 17th, 2012. The table purports to

2See April 17th, 2012 transcript line 3401. 6 represent an average per station of local news programming offered by the stations that are part of the groups included in the table. At the hearing, Corus undertook to comment on this table as well as Commissioner Morin’s proposal that funding from the LPIF should only be available to stations that meet a minimum threshold of local news programming.3

From a purely theoretical perspective, however, there are many pitfalls associated with this proposal, some which are as follows:

(i) Although this model purports to introduce a criterion that would, in principle, be simple to apply, this is not the case when one looks to how it would be implemented. This is primarily because there is no standard approach to determine what constitutes local news programming. There was much debate at the hearing as to whether only local news segments should be included in the calculation of local news programming. Many television station operators offer regional, national and international news segments as part of their local newscasts. These regional, national and international news segments are often tied back or tailored to the local market by a variety of means such as editing, tying the news segment to a local individual or local initiative, or by the news reader providing local context. Our audiences enjoy all components of our local newscasts and therefore, we fail to see why the Commission would not want to support all components of a local newscast provided they cater to and address the needs of the local market.

(ii) Corus offers a very high level of local news segments in its local newscasts. Two of our television stations (Peterborough and Kingston) include local news segments representing 94% of the total newscast. For our other station (Oshawa), 90% of the total newscast includes local news segments. Our Kingston and Peterborough stations offer more than 10 hours of local newscasts, excluding repeats that incorporate a very high percentage of local news segments. Our Oshawa station offers 2.5 hours per week of local newscasts. Those newscasts are repeated Monday through Friday in , and early morning. This station has limited access to local advertising by condition of licence and is a television market that is very challenged by its very proximity to the GTA. It does not receive wide cable distribution and is not carried by DTH either. It would therefore not be possible to immediately increase the local news information to 10 hours a week of original programming without counting repeats. Corus considers that it would be unfair for this station to lose its access to LPIF or have reduced access to LPIF simply because historically this station offered a lower level of local news due to its limited access to revenue sources through a historical and existing condition of licence. We believe that this station and its viewers should have access to the best local newscast that can be offered, which has now been made possible as a result ofthe station’s access to the LPIF. We are on the right track in Oshawa, and will increase the local programming incrementally as we build our viewer base, revenue and resources.

Accordingly, Corus does not believe that such a criterion would recognize (as it should in order to be transparent and fair) the different circumstances of each television market. Nor would it recognize the historical level of local news information provided by individual stations. Rather than introduce a requirement that cannot be applied fairly in all individual television markets in Canada (because averages do not reflect the particularities of each television market’s circumstances), Corus believes that the objective to ensure meaningful contributions to local programming can be achieved through a flexible incrementality provision. Corus will address this in its final comments.

In sum the profitability and minimum local news programming proposals require complex analysis and administration and could result in counter-productive, unintended negative results for the Canadian broadcasting system. In particular, they could negatively impact the ability of Canada’s small market television operators to provide improved local programming to its audiences.

Finally, the LPIF was created in order to improve the quality and diversity of local programming, particularly in smaller television markets. This objective would not be achieved if the Commission were to limit the accessibility to the LPIF only to those stations that met regulated profitability levels.

A. Purpose of Over-the-Air Television (OTA) in Canada and Role of the Local Programming Improvement Fund (LPIF)

1. Corus Entertainment Inc. (Corus) is pleased to provide these final written comments in the proceeding to review the LPIF.

2. On April 25th, 2012, Corus submitted its response to undertakings made during the oral phase of the hearing. In our response, we addressed three points. First, we provided our thoughts as to whether the Commission should impose a profitability threshold for eligibility to the LPIF. Second, in connection with our LPIF-eligible stations, we provided the Commission with a breakdown of revenues from the Small Market Local Programming Fund (SMLPF) and the LPIF as a percentage of total revenue in the fiscal years 2009, 2010 and 2011. Third, we addressed the question of whether the Commission should impose a minimum threshold of local news programming as a criterion for eligibility to the LPIF. Corus notes that in its April 25th letter, we also made remarks as to how the Commission should deal with the LPIF on a going forward basis.

3. In BNC 2011-788, the Commission stated that it would hold a public hearing to “review its policies and regulations relating to the LPIF and, in particular, to examine the performance of the Fund and its effectiveness in supporting the production of local programming.”

4. At the oral phase of the hearing, there was discussion on whether the LPIF had performed well and was effective and whether the continuity of the LPIF should depend on there being a business case for OTA stations, particularly in smaller markets. The concern expressed was that absent continuing and growing subsidies in the system, OTA stations and particularly those in smaller markets would never be financially viable. It was also suggested that there might be alternate means that are more cost efficient and less reliant on public subsidies in order to provide local reflection to Canadian viewers.

5. Although we understand why local television stations and particularly stations in smaller markets should rely more on market forces to achieve financial sustainability, the reality is that without the Canadian cultural objectives mandated in the Broadcasting Act (the Act), we would not have the strong and vibrant Canadian broadcast industry that we have today. It is precisely because of Canada’s small population base and proximity to the US television market that we needed to enact such principles into law. In the forties and fifties, when television first started, there was very little distinct Canadian content being produced.

6. To spur our Canadian television industry, Parliament decided to enshrine in law the notion that our cultural identity depended on having a strong Canadian broadcast voice. More importantly, it was recognized that market forces alone would not achieve this objective and this is why we do not have in section 3 of the Act any requirement that the Canadian broadcast industry be regulated in accordance with market forces. What is most important and what is at the root of public policy when it comes to the Canadian broadcasting system, is the achievement of the cultural objectives set out in the Act such as paragraph 9 (1) (b) which states that “the Canadian broadcasting system…provides, through its programming, a public service essential to the maintenance and enhancement of national identity and cultural sovereignty.” This is where the public interest lies.

7. Over the years, we have seen the creation of a number of institutions and funding mechanisms such as Telefilm and the Canada Media Fund precisely because the creation of certain programming such as high-end Canadian drama series and films required public support. The economics of the Canadian market, absent subsidies, would simply not provide the impetus to create such content.

8. When the Commission decided in 2008 that local television required support through a new funding mechanism (i.e. the LPIF), it was because it understood the pivotal role OTA stations play within our Canadian broadcasting system. This sector is widely acknowledged by all, including the Commission, as the foundation of the Canadian broadcast system. It is still the media outlet that consistently delivers the greatest number of viewers and where the greatest proportion of original content is offered. This will remain the reality for many years to come. 2

9. More importantly, OTA stations provide the greatest proportion of audiovisual local content. The evidence in the hearing is that overall, and particularly in the case of smaller stations such as SMITS stations, more and higher quality local programming content has been made available in the last two years as a result of the establishment of the LPIF1. Absent the LPIF, the trends would have been much different in these television markets.

10. This is not to say that the receipt of a subsidy makes market forces irrelevant to the operation of an OTA station. In fact, our OTA stations are managed in a very innovative and efficient manner.

11. At the oral phase of the hearing, the Commission circulated a document, which included aggregated financial data regarding the television stations operated by the SMITS Coalition members. This information purported to demonstrate the increased reliance by SMITS stations on funding from sources other than advertising revenues.

12. Corus notes that the information provided also demonstrates another fact; that is the efficiency with which SMITS stations operate. For example, the table demonstrates that SMITS stations expenditures on Sales & Promo and Admin & General have remained relatively flat for at least the last six years. These costs have remained relatively flat despite inflationary increases during this same period of time. It also means that salaries and benefits have remained stable despite the subsidies received through the LPIF.

13. However, what this table doesn’t demonstrate is the fact that capital expenditures are dependent on the cash flow generated by television stations. So when one considers whether Corus should be relying more on advertising in the future, it is important to consider that Corus’ three OTA stations have in total increased their advertising revenues (local and national) by only $300K annually on average during the period we received LPIF monies. Our capital expenditures for these stations have increased on average by $900K annually. Since these capital expenditures must be financed through our cash flow, it is obvious that the stations need to generate the necessary cash flow to support this level of expenditures.

14. So when the Commission considers whether there is too high a level of dependence on the LPIF or whether the profitability of our stations seems high, it is important to remember that a healthier profit margin is necessary for small market stations because proportionately they pay a higher share of their revenues for capital expenditures than stations operating in metropolitan markets. It is a matter of scale.

15. Corus believes the LPIF is well designed, and is meeting its very important public interest objective, which is to support the creation of local programming and particularly local news programming in non-metropolitan markets. As outlined in our original submission to the Commission in response to the BNC 2011-788, and in our oral remarks

at the hearing, Corus urges the Commission to continue the LPIF at current funding levels for small market television stations, for three more years, and on the existing criteria with one modification, which we have outlined below.

B. Modification to LPIF Criteria --- Re-introduction of Incrementality

16. In Broadcasting Regulatory Policy 2009-406 (BRP 2009-406), the Commission re-examined certain issues relating to the LPIF and made specific determinations as to its implementation. In particular, it suspended the requirement of incremental spending on local programming for LPIF-eligible stations. It was the Commission’s intention to maintain that suspension until it had completed a comprehensive review of the LPIF in its third year of operation.

17. As noted above, the Commission’s current review of the LPIF sought to evaluate the performance and effectiveness of the fund especially in light of certain changes made to the initial 2008 LPIF criteria such as incrementality.

18. Corus believes the record of this proceeding demonstrates that the LPIF has realized its objective of ensuring the continued and growing provision of quality local programming, especially local news programming in non-metropolitan markets. Even without an incrementality criterion, we note that SMITS stations, of which Corus is a member, delivered both more hours and higher quality local content through the expenditures made and supported by LPIF monies. Corus OTA stations also improved their local programming offering from a quantitative and qualitative perspective.

19. Recognizing, however, that the Commission is concerned that the dependence of small market television stations on funding measures to sustain their financial viability is growing, Corus undertook at the oral phase of the hearing to propose to the Commission an incrementality requirement that would establish a new criterion for access to the LPIF monies.

20. Before detailing its proposal, Corus wishes to note that in order for any incrementality criterion to be workable and fair, it must recognize the particularities of each television market that receives LPIF monies. No two markets are alike nor do they operate in the same manner. For example, Corus LPIF-eligible OTA stations CKWS-TV (Kingston), CHEX-TV (Peterborough), and CHEX-TV-2 (Oshawa) are all CBC affiliates. Under the terms of our affiliation agreement with the CBC, 60% of our stations’ programming schedule is comprised of CBC programs, much of which must be broadcast during peak viewing hours.

21. As a result, our OTA stations have limited control of our programming schedule. It is vitally important that the hours we do have at our disposal are used to broadcast local programming, and in particular, local news programming, as this is what drives our ratings and makes us distinct in the market.

22. Prior to receiving LPIF funding, our OTA stations in Kingston and Peterborough broadcast over two hours of local news each weekday, Monday through Friday, from 5:30 p.m. to 7:00 p.m. and from 11:00 p.m. to 11:35 p.m. Since receiving LPIF funds, these stations have been able to add one half hour of local news to their schedules, from 5:00 p.m. to 5:30 p.m. This half hour bolsters our “suppertime” news offering, and has been very helpful in leveraging the local advertising market.

23. However, due to our arrangement with the CBC there is a limit to how many more hours of local news programming Corus OTA stations can broadcast. We decided that in addition to increasing the quantity of our local news, LPIF funds should be used to improve its overall quality. The qualitative reports we submitted to the Commission in connection with this hearing reflect those improvements.

24. An incrementality proposal such as the CBC’s, which is tied solely to a quantitative requirement, would not work for Corus since in at least two of the markets in which we operate (Peterborough and Kingston), we could not increase the number of local programming hours given the constraints of our affiliation agreement with the CBC. In the Oshawa market, although we could increase the number of local programming hours, the amount of local advertising we can sell is restricted by condition of licence. Therefore, Corus has constraints in how it can monetize the additional local programming offering.

25. In the event the Commission chooses to re-introduce an incrementality requirement, we believe it is imperative that any such obligation be flexible and recognize the operational realities in which small market television operates. The mechanism used to measure incrementality should permit all LPIF-eligible stations to select whether they will demonstrate increased spending in terms of quantity or quality of local news programming (or both), depending on the circumstances of that station.

26. Corus, in conjunction with the SMITS Coalition, developed an incrementality proposal for English-language television stations that we believe fully addresses the concerns expressed by the Commission at the oral phase of the hearing. This incrementality proposal is designed to ensure that local programming expenditures (LPE) will increase at a greater rate than LPIF funding from one year to the next. As a result, the percentage portion of LPE attributable to LPIF will decrease on an annual basis from the level established in the previous year.

27. Moreover, our incrementality proposal would ensure that two key objectives are met:

• it would achieve incrementality in terms of LPE because the level to which an LPIF-eligible station funds LPE over-and-above LPIF monies it has received must increase every year; and • individual LPIF-eligible stations would reduce their reliance on LPIF funds each year because a smaller portion of LPIF funding would constitute the total LPE expenditures from one year to the next.

28. Under this proposal, the objective of decreasing local stations reliance on LPIF subsidies to produce local programming would be achieved. However, this proposal is dependent on SMITS stations continuing to receive substantially the same level of funding as at present for the next three years.

29. With the implementation of the proposed incrementality provision, there is no need to add further criteria for LPIF eligibility, such as a profitability restriction requiring either a set level of local programming hours or quantitative yearly increases in the number of local programming hours.

30. Finally, evidence of incrementality would be filed by each LPIF-eligible station as part of its Annual Return.

31. Accordingly, Corus endorses the proposal for incrementality for English-language television markets outlined in the reply provided by the SMITS Coalition. We have appended a copy of this proposal to this response. As noted in the SMITS Coalition submission, given that we are already committed to the F’13 budget, we propose that this criterion begin in the F’14 broadcast year. Corus requests however that should the Commission seek to adopt an incrementality criterion that differs to that proposed by Corus and the SMITS Coalition for English-language television, that this criterion be the subject of another public process to ensure that it is operationally workable and fair to all LPIF-eligible stations to which it applies.

C. Response to Matters Raised by Other Interveners

(i) Advertising Revenues Have Increased

32. Several interveners have argued that the LPIF was put in place in response to the economic decline of conventional television stations as a result of the 2009 recession. By extension, the LPIF was intended simply as a stop-gap measure.

33. These same interveners stated that the 2009 recession is over and that broadcasters have, in the last two years, enjoyed an increase in advertising revenues. As stated by MTS Allstream (MTS):

For starters, the revenue situation has improved. Advertising revenues, which have traditionally supported local stations, increased in both 2010 and 2011, relative to 2009, at the depth of the recession.

34. In response to Chairperson Katz’ request that MTS file the information on which they base this conclusion, MTS provided data from the 2011 financial results for Canadian conventional television stations released by the Commission on April 4th, 2012. This information was summarized in a table that showed local and national revenues in the millions in 2009, 2010 and 2011 for two groups: private conventional stations and CBC conventional stations.

35. Corus takes issue with MTS’ conclusion for two reasons. First, the Commission has made it clear that the impetus for the LPIF was the fact that spending on local programming by private and public broadcasters had, over the past decade, remained flat, and in some cases, had declined. In response to this, the Commission established the LPIF as a mechanism to “support the production of such programming provided by private and public conventional television stations operating in non-metropolitan markets” (BNC 2011-788).

36. There is no doubt that the recession of 2009, like any other, had a significant impact on our OTA stations. But the LPIF was not developed as a knee-jerk response to a temporary drop in advertising markets caused by a particular recession. The trend observed by the Commission, to which it responded, was one that had developed over a period of several years. To view the issue as a product of one economic cycle, as a function simply of increases and decreases in gross revenue over a period of three years, is to ignore and to mischaracterize the challenges faced by small market, independent stations.

37. Second, the information on which MTS bases its conclusion is aggregate data that says nothing about how each station within each group --- private conventional broadcasters and public conventional broadcasters --- fared over that period. There are no distinctions made between stations serving small markets and those serving larger markets or between those that form part of larger networks, and those that are independent.

38. MTS’ point is no more than an assertion that advertising revenues have increased for all conventional broadcasters since 2009. This conclusion tells us nothing about whether and how individual stations within this group used the LPIF monies and whether it was useful to them during this time.

39. As we stated in our written submission, our OTA stations did see modest growth in both local and national adverting revenues in 2010 and 2011. This increase may have, at least in part, been a function of post-recessionary spending. However, we expect advertising revenues to decline in the next year and beyond. This expectation is based on our first-hand observations about buying trends amongst national advertisers which was also supported by the evidence provided by Air time in this proceeding --- trends that we believe are cementing themselves as the norm.

40. Corus also notes that recent economic indicators support the argument that the Canadian economy has not fully recovered from the most recent recession. On April 30th, 2012, Statistics Canada released data, which demonstrates that the Canadian economy has slowed as evidenced by the GDP decrease of 0.2% in February 2012. This information was released just two weeks after Mark Carney, Governor of the Bank of Canada, stated that the Canadian economy was becoming much firmer.

41. As noted in our written submission, and as we reiterated in our oral remarks, our three OTA stations are the only local stations in their markets. The stations against which we compete are specialty channels or television services that form part of large, regional 7

networks. More and more, national advertisers are able to reach smaller and larger markets alike, buying advertising on specialty channels and on regional or national networks. Effectively, this results in small market, independent stations being bypassed by national advertisers. If this trend were to continue, as we expect it to, it will have more than a passing effect on our revenues. It will fundamentally alter the way we operate, and consequently, how we deliver services.

(ii) Canadian Cable Systems Alliance Inc. (CCSA)

42. In its oral remarks and in its April 25th, 2012 response to undertakings, CCSA explained why the media operations of vertically integrated companies should not be eligible for LPIF. Harris Boyd, President of Solarcom Inc., and consultant to the CCSA listed the companies he considered to be ineligible on that basis.

43. The Commission has already ruled on the eligibility of Corus Entertainment Inc. with regard to the LPIF. This matter is not a subject of this proceeding and in any event the Commission specifically canvassed this issue during the Group Based Licensing proceeding and determined that Corus is a separate, publicly traded, independent company from Shaw Media both in law and for the purposes of Group Based Licensing. This conclusion remains valid for the LPIF.

D. Additional Corus Undertaking Responses

45. During its appearance at the oral phase of the hearing with the SMITS Coalition, Corus undertook to provide the following information to the Commission. Specifically, we were asked to provide an explanation of how LPIF monies were used in F’10 and F’11. This additional information is provided in Attachment B. Finally, we were requested to provide information for proposed future use of LPIF monies for the three year period starting in F’12 and ending in F’142. This information is provided in Attachment C. The proposals contained in Attachment C are dependent on Corus getting LPIF funding at substantially the same levels as it currently receives.

E. SMITS Coalition Final Comments

46. Corus supports all of the comments made by the SMITS Coalition in its final comments submission, including replies to subjects not addressed in Corus’ final comment submission.

Conclusion

47. For all the reasons stated above, we urge the Commission to renew the LPIF for a minimum of three years at the same funding level and using the existing criteria for eligibility with the exception of the introduction of a new incrementality criterion for English-language television as proposed by the SMITS Coalition. We believe the LPIF has met its stated purpose of ensuring that television stations in small markets are able to continue to deliver local programming to their audiences. As a fundamental objective of the Broadcasting Act, the ability to provide information services to all Canadians in Canada’s smaller television markets has been well served by the LPIF.

48. Should the Commission believe that LPIF-recipients ought to be required to demonstrate incremental spending as a condition of continued eligibility in a manner that is different than that proposed by the SMITS Coalition, we respectfully request that the Commission seek comment on such a proposal in order to ensure a proper understanding of the operational consequences of such a proposal and to confirm that it is fair to all LPIF- eligible participants.

ATTACHMENT A

SMITS INCREMENTALITY PROPOSAL

Objectives

• To establish an incrementality element, by requiring that incremental percentage increases in local programming expenditures (LPE) must exceed percentage increases in LPIF funding.

• To ensure that, if LPIF is renewed under the current criteria, a station’s LPE will be less dependent on LPIF funding than at present, and that the degree of reliance on LPIF will continue to decrease year after year.

Specific Mechanism

The required minimum LPE for any given year would be determined based on the amount of actual LPIF funding received in the previous year. This is necessary because LPE cannot be determined in relation to LPIF funding for the same year, given that the total amount of LPIF funding is known only towards the end of that broadcast year.

To determine the minimum required level of LPE for a given year:

• Calculate the percentage amount by which the LPIF for the previous year has changed from the year before.

• The required LPE must exceed the previous year’s LPE by a percentage amount greater than the change in the previous year’s LPIF funding.

Example Calculation

Because operating budgets, including local programming, are being set now for F’13, we assume that this model could be implemented only for the F’14 broadcast year. The following example therefore illustrates how minimum LPE requirements would be set for F’14 and F’15, based on LPIF amount received in the previous years.

• In F’13, a station receives LPIF funding of $105. This represents a 5% increase from the LPIF funding of $100 received in F’12.

• In F’14, the station must therefore have LPE that is more than 5% greater than the previous year’s LPE. In F’13 , LPE was $200. For F’14, LPE must be more than 5% greater than this amount; i.e. more than $210. The station actually budgets and spends $215. The previous year’s LPIF funding ($105 in F’13) represents 48.8% of F’14 LPE.

• In F’14, the station receives LPIF funding of $110, representing a 4.8% increase over the previous year’s LPIF funding.

• In F’15, therefore, the station must have LPE that is more than 4.8% greater than the previous year’s LPE of $215; i.e. more than $225. The station actually budgets and spends $230 on LPE in F’15. The previous year’s LPIF funding ($110 in F’14) represents 47.8% of F’15 LPE, a decrease from the previous year’s ratio of 48.8%.

Observations / Comments

Since the percentage increase in LPE in a given year must be greater than the percentage increase in LPIF funding for the previous year, the ratio of LPIF funding to LPE (the LPIF funding ratio) must decline year after year. Thus, this model ensures decreasing reliance on LPIF funding to subsidize the production of local programming, a trend that will continue year after year for as long as the LPIF is in place.

Moreover, the fact that LPE would grow at a higher rate than LPIF funding establishes a measure of incrementality in relation to LPE. In other words, incrementality is assured in terms of LPE because the degree to which the station funds LPE over and above LPIF monies it receives must increase year after year.

If LPIF funding should decrease in a given year, simply maintaining LPE at the previous year’s level would ensure that the LPIF funding ratio would still decline for that year. In principle, a station could decrease LPE in the year following a decrease in LPIF funding, provided that the percentage decrease in LPE was less than the percentage decrease in LPIF funding for the previous year.

Therefore, the principle of decreasing reliance on LPIF funding works in all circumstances, whether LPIF funding increases or decreases from one year to the next.

This model also allows individual stations the flexibility required to fairly implement the incrementality criterion. This means that the additional LPE spend could be towards quantitative or qualitative initiatives depending on the operational realities of the individual television stations.

ATTACHMENT B

LPIF Initiatives 2009 – 2010

In the first year of LPIF funding (2009-2010), we strengthened our news teams at CHEX-TV in Peterborough and CKWS-TV in Kingston, and developed and invested in a new strategy for Channel 12 in Oshawa.

In Kingston, we filled two job vacancies for full-time videographers, vacancies that had existed for most of the previous year. We also created a new full-time videographer position, and a new part-time position. The extra resources allowed us to cover more local news throughout the week, and also to expand our weekend coverage, where previously we had no coverage at all. Also in Kingston, we installed a live link to the KROC centre, allowing our news to include live inserts from the Kingston Frontenacs home arena, as well as provide coverage of other major KROC events and concerts. We made improvements in our studio, our sets, and our graphic packages to update the look of our 5:30 p.m. and 6:00 p.m. newscasts. The result was an improvement across the board in our news ratings, and in revenues associated with news.

In Peterborough, we used the LPIF resources to hire two new full-time videographers. We also promoted our Assignment Editor/Producer to the vacant position of News Director. We had not had a News Director in Peterborough for several years. We then hired a full-time Assignment Editor. Those changes made an immediate and significant impact on the quality of our coverage. We also did a total revamp of the set, and refreshed and updated the graphic look of the programs. Again, the changes allowed more local coverage and enabled us to maintain or improve our already strong ratings.

In Oshawa, we hired a part-time sports videographer. We revamped our computer weather system in Peterborough to enable us to provide Oshawa with customized weather packages. However, the most significant change in Oshawa involved ending our tenancy in a strip mall in Southeast Oshawa and moving our studio to a building in the heart of downtown. That involved a major capital investment in technology, installation of new cable, satellite and transmitter paths, and a total revision of our programming strategy. The move of the Oshawa studio was a full-time job for three engineers through two months of the summer of 2010.

LPIF 2010 – 2011

In 2010-2011, we started the year by using our LPIF resources to mount a major programming initiative. We commissioned a poll across our three markets, with another general sample from across Ontario. The survey looked at the world of high school students – how they related to their families, their schools, the law, morality, and their future. We also assembled experts and panels of students from all markets to discuss and interpret the findings. It was the kind of expensive initiative usually only mounted by major-marker stations. It was an important initiative, because the results in our markets differed significantly in some areas from the results in the rest of Ontario.

In regards to staffing, in Kingston in 2010–2011, we promoted our Operations Manager to the position of News Director. As in Peterborough, we then added a new Assignment Editor. The result was a further strengthening of our local news operation.

Otherwise in Peterborough and Kingston, we maintained all the improvements we had made in the previous fiscal year.

In Oshawa, the move to downtown and the redesigned programming greatly increased the visibility and impact of our news programming.

The major operational focus in all our markets in 2010-2011 was the introduction (late in the year) of HD. We rebuilt our Master Control operation in Peterborough, installed HD fibre between CBC in Toronto and Peterborough, and HD fibre to Kingston and Oshawa from Peterborough. We installed HD connections to Cogeco cable in both Peterborough and Kingston, and to Rogers cable in Oshawa. Our Belleville transmitter was switched from SD to HD, and HD fibre installed from Kingston to Belleville.

LPIF 2011-2012

In this fiscal year, we made a major aggressive move in our schedules in Kingston and Peterborough. We added an extra half hour of Supper Hour News in both markets, expanding our news programming from 5:00 p.m. to 7:00 p.m. Monday to Friday. In each market, we added one full-time videographer position to provide the production backup for the new programming, as well as extra coverage on the streets. A key component of the new programming is live hits and talkbacks with reporters, so the output from each of our employees has also been expanded. Aside from doing the expected packaged report, each reporter typically also does a “rant” for the 5 o’clock news and a short on-location summary of the story for the 5:30 p.m. program.

In Oshawa, we have hired two part-time videographers, as well as additional part-time control room help. The extra resources have enabled us this year to mount significant local coverage for the first time. Every day we package at least two reports, plus video and other coverage of events throughout the Durham region.

ATTACHMENT C

LPIF 2012 – 2013 and Going Forward

If LPIF is continued with funding at the substantially the same levels as Corus currently receives, we plan to continue to augment both the quality and quantity of our local news production.

We would again undertake a major programming initiative each year across all our markets, involving in-depth reporting in Oshawa, Peterborough and Kingston, supported by polling and research. Like the poll we did with high school students in 2010, we would attempt to address the major impacts and changes facing our population. We have discussed looking at issues facing the aging; a significant segment of the population throughout southeastern Ontario. A programming initiative of this sort serves not only the local community; it also enables us to understand better our audience.

We would also re-introduce news updates through the late morning, afternoon and evenings, giving local viewers a brief one or two minute update on stories we are covering that day. The updates function would keep our audience informed and would also act as a promotion for our evening and late night newscasts. They would be reinstated through hiring part-time employees to deal with the gathering, writing, editing, production and anchoring.

In providing the extra nightly half hour of news in Kingston, we cancelled a half hour news program at 6:00 p.m. on Saturday (in Peterborough, that program had been cancelled several years ago). If LPIF remains, we will reintroduce that program in both markets, along with the expanded weekend reporting shifts we would need to sustain the program.

Given the schedule restrictions contained in our new affiliation agreement with the CBC in terms of available time for local programming, other improvements in our local news programming would be qualitative. In Peterborough and Kingston, we would create an opening for in-depth investigative reporting, a style of journalism that currently we can’t accommodate as each reporter is responsible to get at least one story (usually two) on air every day. Hiring an extra videographer would give us the capacity to take one person out of the daily treadmill to concentrate on stories that requires more research and context.

In Oshawa, we would look to hire another Producer/Videographer. With that support, we would look into creating a further half hour a day of original local coverage for the Oshawa market, turning the 7:00 p.m. repeat news broadcast into another live news program.

Of course, while we are improving our programming, we will also be working towards converting our news production to HD, a process that will involve changing our switchers, cameras, sets and archival systems. That will be a major and expensive change that will also need to be implemented along with our programming improvements.
