County Council (Various Roads, ) (E-Scooters Traffic Regulation) Experimental Amendment Order 2021

Devon County Council makes the following order under sections 9, 10 of the Road Traffic Regulation Act 1984 and of all other enabling powers

Part 1 Introduction

1.1 This order comes into force 16th July 2021 and may be cited as “ (Various Roads, North Devon) (E-Scooters Traffic Regulation) Experimental Amendment Order 2021”

1.2 The Chief Officer for Highways, Infrastructure Development and Waste at Devon County Council or someone authorised by that officer, after consultation with the chief officer of police, is an authorised person for the purpose of modifying or suspending this order or any provisions of it under section 10 of the Act if it appears to them essential for any of the reasons stated in section 10(2) of the Act

Part 2 The County of Devon (Gratton Way/Oakwood Close, Roundswell, Tawstock) (Traffic Regulation) Order 2000

2.1 The County of Devon (Gratton Way/Oakwood Close, Roundswell, Tawstock) (Traffic Regulation) Order 2000 is amended as follows

2.2 In article 2, (a) after the definition of “disabled person’s badge” insert ““electric scooter” has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;” (b) after the definition of “tag” insert ““trial” has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;”

2.3 In article 5, after item (b) insert “(c) an electric scooter being used in a trial”

Part 3 The County of Devon (Various Streets, ) (Traffic Regulation) Order 2003

3.1 The County of Devon (Various Streets, Ilfracombe) (Traffic Regulation) Order 2003 is amended as follows

3.2 After article 1, insert, “1A Except where the context otherwise requires the following expressions have these meanings assigned to them “electric scooter” has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended; “trial” has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;”

3.3 In article 3(b), after “cycle” insert “ or an electric scooter being used in a trial”

3.4 For article 6, substitute “Nothing in Article 5 shall apply so as to prevent any person from causing any motor vehicle to proceed in the roads or lengths of roads referred to in that Article if the vehicle is:- (a) being used for the conveyance of persons goods or merchandise to or from any premises situated on or adjacent to that road or length of road (b) in connection with any building operation or demolition in or adjacent to that road or length of road the removal of any obstruction to traffic in that road or length of road the maintenance improvement or reconstruction of that road or length of road or the laying erection alteration or repair in or adjacent to that road or length of road of any sewer or of any main pipe or apparatus for the supply of gas water or electricity or of any telecommunication apparatus as defined in Schedule 2 to the Telecommunications Act 1984 (c) in the service of a local authority in pursuance of statutory powers or duties or (d) being used for fire brigade ambulance or police purposes (e) an electric scooter being used in a trial”

Part 4 Devon County Council (Various Streets, & ) (Traffic Regulation) Order 2014

4.1 Devon County Council (Various Streets, Lynton & Lynmouth) (Traffic Regulation) Order 2014 is amended as follows

4.2 In article 1.2, (a) after the definition of “driver” insert “electric scooter has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;” (b) after the definition of “traffic sign” insert “trial has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;”

4.3 In article 4.2, after item (j) insert “(k) an electric scooter being used in a trial”

4.4 In article 5.2, after item (d) insert “(e) an electric scooter being used in a trial”

4.5 In article 6.2, after item (c) insert “(d) an electric scooter being used in a trial”

Part 5 The County of Devon (Ellerslie Road, Fremington, and Beechwood Avenue, ) (Prohibition of Entry) Order 1998

5.1 The County of Devon (Ellerslie Road, Fremington, and Beechwood Avenue, Barnstaple) (Prohibition of Entry) Order 1998 is amended as follows

5.2 In article 2, after the definition of “cycle" insert ““electric scooter” has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended; “trial” has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;”

5.3 In article 4, after “school bus” insert “, electric scooter being used in a trial”

5.4 In article 6, after “apply to” insert “ an electric scooter being used in a trial or”

Part 6 The County of Devon (Park Lane Area, Barnstaple) (Prohibition Of Motor Vehicles) Order 2004

6.1 The County of Devon (Park Lane Area, Barnstaple) (Prohibition of Motor Vehicles) Order 2004 is amended as follows

6.2 After article 1, insert, “1A Except where the context otherwise requires the following expressions have these meanings assigned to them “electric scooter” has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended; “trial” has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;”

6.3 For article 3, substitute “Nothing in Article 2 of this order shall make it unlawful for a motor vehicle to proceed in the lengths of roads between the hours specified if the vehicle is:- (a) being used in an emergency, for fire, police or ambulance purposes; (b) being used in connection with the carrying out on those lengths of roads of any of the following operations, namely – (i) the maintenance, improvement or reconstruction of the road; (ii) the laying, erection, alteration or repair in, or in land adjacent to, the roads of any sewer, or any main, pipe or apparatus for the supply of water, gas or electricity, or any telegraphic line as defined in the Telecommunications Act 1984; (c) in the service of a local authority or a water authority in pursuance of statutory powers or duties; (d) being used to access premises on or adjacent to those lengths of roads. (e) an electric scooter being used in a trial”

Part 7 The County of Devon (Rose Lane to Fairacre Avenue, Barnstaple) (Prohibition of Vehicles) Order 2006

7.1 The County of Devon (Rose Lane to Fairacre Avenue, Barnstaple) (Prohibition of Vehicles) Order 2006 is amended as follows

7.2 In article 2, (a) after the definition of “cycle"” insert “electric scooter has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;” (b) after the definition of “public service vehicle” insert “trial has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;”

7.3 In Schedule 2, after item (e) insert “(f) an electric scooter being used in a trial”

Part 8 The County of Devon (Westacott Road, Whiddon Valley, Barnstaple) (Cycle Lane) Order 2006

8.1 The County of Devon (Westacott Road, Whiddon Valley, Barnstaple) (Cycle Lane) Order 2006 is amended as follows

8.2 In article 2, (a) after the definition of “the cycle lane"” insert “electric scooter has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;” (b) after the definition of “pedal cycle” insert “trial has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;”

8.3 In article 3, after “pedal cycle” insert “ or an electric scooter being used in a trial”

8.4 In article 4, after “pedal cycle” insert “ or an electric scooter being used in a trial”

Part 9 The County of Devon (Various Streets, Sticklepath Area, Barnstaple) (Traffic Regulation) Order 2006

9.1 The County of Devon (Various Streets, Sticklepath Area, Barnstaple) (Traffic Regulation) Order 2006 is amended as follows

9.2 In article 2, (a) after the definition of “cycle lane” insert “electric scooter has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;” (b) after the definition of “public service vehicle” insert “trial has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;”

9.3 In article 4, after “pedal cycle” insert “ or an electric scooter being used in a trial”

9.4 In article 10, for “No” substitute “Save as provided in article 10A no”

9.5 After article 10, insert, “10A Nothing in article 10 shall render it unlawful to cause or permit any vehicle to proceed in the road referred if the vehicle is an electric scooter being used in a trial”

Part 10 The County of Devon (Rumsam Area, Barnstaple) (Prohibition of Motor Vehicles) Order 2007

10.1 The County of Devon (Rumsam Area, Barnstaple) (Prohibition of Motor Vehicles) Order 2007 is amended as follows

10.2 After article 1, insert, “1A Except where the context otherwise requires the following expressions have these meanings assigned to them “electric scooter” has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended; “trial” has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;”

11.1 Devon County Council (Barnstaple Town Centre) (Vehicle Prohibitions) Order 2014 is amended as follows

11.2 In article 1.2, (a) after the definition of “driver” insert “electric scooter has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;” (b) after the definition of “traffic sign” insert “trial has the same meaning as in The Traffic Signs Regulations and General Directions 2016 as amended;”

11.3 In article 4.2, after item (d) insert “(e) an electric scooter being used in a trial”

11.4 In article 5.2, after item (m) insert “(n) an electric scooter being used in a trial”

11.5 In article 6.3, after item (g) insert “(h) an electric scooter being used in a trial”

11.6 In article 6.4, after item (c) insert “(d) an electric scooter being used in a trial”

11.7 In article 7.2, after item (d) insert “(e) an electric scooter being used in a trial”
