Scottish Executive Barry Winetrobe 1.1 Collective responsibility The application of the doctrine of collective responsibility has been under the spotlight in the Glasgow hospitals issue. The Culture Minister, Mike Watson, has been a leading public opponent of the reorganisation plan, but voted with the Executive in a debate on the issue on 12 September. His MPA, Janis Hughes, put herself in an even more unusual position, by abstaining on the Executive amendment to the critical SNP motion, but then voting for the as-amended motion. The First Minister refused to sack either, on the basis that they had both adhered to collective responsibility by their votes. -

PATRICIA MCCAFFERTY WORKING THE 'THIRD WAY': NEW LABOUR, EMPLOYMENT RELATIONS, AND SCOTTISH DEVOLUTION THESIS PRESENTED FOR THE DEGREE OF DOCTOR OF PHILOSOPHY, DEPARTMENT OF SOCIOLOGY, UNIVERSITY OF GLASGOW MAY 2004 © PATRICIA M`CAFFERTY, MAY 2004. ABSTRACT Labour's election victory in 1997 was heralded as a new era, the dawn of a Third Way, a novel attempt to chart a unique political course overcoming the perceivedlimitations of both New Right and Old Labour. In this thesis I explore the era of New Labour generally and, in particular, the impact of the Third Way on working lives. Key to my analysis is New Labour's attempt to synthesise oppositional interests,in particular those of capital and labour. This involves a crucial rhetoric of flexibility, competitivenessand partnership. My research explores the rhetoric of New Labour in relation to the reality of this new force in power. It does this by: " drawing out key features in the development of New Labour, especially its relation to Old Labour; " examining central elementsof New Labour ideology; " arguing that Scotland should be seen as central to the transition from Old to New :Labour; " utilising a case study of industrial relations developments in a major electronics factory in the West of Scotland and, to a lesser extent, key developmentsin public sector employment. My main finding is that where New Labour's ideology promisespositive benefits, the form of its implementation has negative impacts for workers. Since I take New Labour as a process, my thesis concludes with a more speculative exploration of possible future developments,both in relations to New Labour's role in them, and their possible impact on the New Labour project. -

This document relates to the Scottish Register of Tartans Bill introduced in the S cottish Parliament on 27 September 2006 . It has been prepared by Jamie McGrigor MSP, the member in charge of the Bill with the assistance of the Parliament’s Non Executive Bills Unit to satisfy Rul e 9.3.3(c ) of the Parliament ’s Standing Orders. The contents are entirely the responsibility of the member and have not been endorsed by the Parliament. Explanatory Notes and other accompanying documents are published separately as SP Bill 76 –EN. POLICY OBJECTIVES OF THE BILL Overview 2. The Bill provides for the establishment of a Register of Tartans and for the appointment of a Keeper to administer and maintain the Register . 3. The stated purpose of the Bill is to create an archive of tartans for reference and information purposes. It is also hoped that the existence of the Register will help promote tartan generally by providing a central point of focus for those interested in tartan . Key objective of the Bill 4. The object ive of the Bill is to create a not for profit Scottish Registe r. While registration is voluntary the Register will function as both a current record and a national archive and will be accessible to the public. Registration does not interfere with existing rights in tartan or create any additional rights and the purpose of registration is purely to create, over time, a central, authoritative source of information on tartan designs. -

Scotland and the UK Constitution The 1998 devolution acts brought about the most significant change in the constitution of the United Kingdom since at least the passage of the 1972 European Communities Act. Under those statutes devolved legislatures and administrations were created in Wales, Northern Ireland, and Scotland. The documents below have been selected to give an overview of the constitutional settlement established by the devolution acts and by the Courts. Scotland has been chosen as a case study for this examination, both because the Scottish Parliament has been granted the most extensive range of powers and legislative competences of the three devolved areas, but also because the ongoing debate on Scottish independence means that the powers and competencies of the Scottish Parliament are very much live questions. The devolution of certain legislative and political powers to Scotland was effected by the Scotland Act 1998. That statute, enacted by the Westminster Parliament, creates the Scottish Parliament and the Scottish Executive (now the “Scottish Government”), and establishes the limits on the Parliament’s legislative competence. Schedule 5 of the Act, interpolated by Section 30(1), lists those powers which are reserved to the Westminster Parliament, and delegates all other matters to the devolved organs. Thus, while constitutional matters, foreign affairs, and national defence are explicitly reserved to Westminster, all matters not listed— including the education system, the health service, the legal system, environmental -

Political Change and Scottish Nationalism in Dundee 1973-2012 Thomas A W Stewart PhD Thesis University of Edinburgh 2019 Abstract Prior to the 2014 independence referendum, the Scottish National Party’s strongest bastions of support were in rural areas. The sole exception was Dundee, where it has consistently enjoyed levels of support well ahead of the national average, first replacing the Conservatives as the city’s second party in the 1970s before overcoming Labour to become its leading force in the 2000s. Through this period it achieved Westminster representation between 1974 and 1987, and again since 2005, and had won both of its Scottish Parliamentary seats by 2007. This performance has been completely unmatched in any of the country’s other cities. Using a mixture of archival research, oral history interviews, the local press and memoires, this thesis seeks to explain the party’s record of success in Dundee. It will assess the extent to which the character of the city itself, its economy, demography, geography, history, and local media landscape, made Dundee especially prone to Nationalist politics. It will then address the more fundamental importance of the interaction of local political forces that were independent of the city’s nature through an examination of the ability of party machines, key individuals and political strategies to shape the city’s electoral landscape. The local SNP and its main rival throughout the period, the Labour Party, will be analysed in particular detail. The thesis will also take time to delve into the histories of the Conservatives, Liberals and Radical Left within the city and their influence on the fortunes of the SNP. -
Constitutional Convention for Giving Firm Shape to That Will
We Commend ..... This report is about practical intent. It says: "Here is what we are going to do," not "here is what we would like". Those who seek inspirational home rule rhetoric are respectfully directed elsewhere, including to the Convention's own previous publications. We have moved on. We regard the argument in principle as compelling. The longing of the people of Scotland for their own Parliament rings clear and true every time opinion is sounded. We believe that the momentum for change is now too great to deny; and that a Scottish Parliament will soon be meeting for the first time in nearly three centuries. What has been missing has been a practical scheme for bringing the Parliament into existence, and a hard-headed assessment of what it will be able to achieve. That is the gap which this report fills. This report shows that the Parliament can work, and it shows how. In doing so, it answers opponents who have tried to portray a Scottish Parliament as a pipe- dream, a fantasy which the Scots, unlike other peoples around the world, somehow cannot turn into reality. The Convention has a diverse membership, as diverse as we could make it. Diversity and unanimity are not natural companions. It is the instinct of political parties to disagree with one another, and the instinct of civic groups like the churches, the trade unions and others to be impatient with the preoccupations of politicians. This has meant that a lot of time and effort has been required to arrive at the proposals in this document. -

THE SCOTTISH BAR: THE EVOLUTION OF THE FACULTY OF ADVOCATES IN ITS HISTORICAL SOCIAL SETTING Nan Wilson* Although the expression "advocate" is used in early Scottish statutes such as the Act of 1424, c. 45, which provided for legal aid to the indigent, the Faculty of Advocates as such dates from 1532 when the Court of Session was constituted as a College of Justice. Before this time, though friends of litigants could appear as unpaid amateurs, there had, of course, been professional lawyers, lay and ecclesiastical, variously described as "fore- speakers," procurators and prolocutors. The functions of advo- cate and solicitor had not yet been differentiated, though the notary had been for historical reasons. The law teacher was then essentially an ecclesiastic. As early as 1455, a distinctive costume (a green tabard) for pleaders was prescribed by Act of Parliament.' Between 1496 and 1501, at least a dozen pleaders can be identified as in extensive practice before the highest courts, and procurators appeared regularly in the Sheriff Courts.2 The position of notary also flourished in Scotland as on the Continent, though from 1469 the King asserted the exclusive right to appoint candidates for that branch of legal practice. -

The British Trust for Ornithology Scotland, Stirling, FK9 4NF * [email protected] Introduction Many birds have declined across Scotland and the UK as a whole (Balmer et al. 2013, Eaton et al. 2015, Foster et al. 2013, Harris et al. 2017). These include five species of farmland wader; oystercatcher, lapwing, curlew, redshank and snipe. All of these have all been listed as either red or amber species on the UK list of birds of conservation concern (Harris et al. 2017, Eaton et al. 2015). Between 1995 and 2016 both lapwing and curlew declined by more than 40% in the UK (Harris et al. 2017). The UK harbours an estimated 19-27% of the curlew’s global breeding population, and the curlew is arguably the most pressing bird conservation challenge in the UK (Brown et al. 2015). However, the causes of wader declines likely include habitat loss, alteration and homogenisation (associated strongly with agricultural intensification), and predation by generalist predators (Brown et al. 2015, van der Wal & Palmer 2008, Ainsworth et al. 2016). There has been a concerted effort to reverse wader declines through habitat management, wader sensitive farming practices and predator control, all of which are likely to benefit waders at the local scale. However, the extent and severity of wader population declines means that large scale, landscape level, collaborative actions are needed if these trends are to be halted or reversed across much of these species’ current (and former) ranges.
