USE ATTAINABILITY ANALYSES FOR NAVIGABLE WATERS

PALMER WATER QUALITY STANDARDS UNIT ARIZONA DEPARTMENT OF ENVIRONMENTAL QUALITY :INTRODUCTION This document constitutes ADEQ's review of the designated uses of Arizona navigable waters. There are four sections to this document. The first three concern navigable waters which have not been designated for Full Body Contact (FBC). The final section concerns navigable waters which have not been designated for any Aquatic and Wildlife (A&W) uses. All the waters listed in a section were not designated A&W or FBC for the same reason. The reason is stated at the beginning of each section. Following each J.isted navigable water are one or more numbers in parentheses. These numbers indicate the source or sources that were used in making the final use determination. All sources are listed in Appendix A. Information obtained from the sources is on file at the ADEQ office located at 2655 East Magnolia, suite 2, Phoenix, Arizona. I. NAVIGABLE WATERS NOT DESIGNATED FOR FULL BODY CONTACT USE PURSUANT TO 40 CFR PART 131.10(g) (2) The navigable waters listed in Section I have not been designated for Full Body Contact (FBC) use. Pursuant to 40 CFR Part 131.lO(g) (2), an FBC use designation is not necessary if low water levels and/or low flow conditions in a navigable water prohibit the attainment of the use. ADEQ has determined that the navigable waters listed below meet this requirement. EAVIGABLE WATERS NOT LISTED FOR FBC DUE TO PROHIBITIONS Partial Body Contact (PBC) is a designated use in the following navigable waters, .because by law swimming (FBC) or wading is not permitted. All of these waters are city owned urban lakes. They have been designated for PBC protection because boating and fishing are uses that may be allowed in these lakes. RATIONALE FOR NOT DESIGNATING FULL BODY CONTACT AS A USE OF EFFLUENT DOMINATED WATERS The navigable waters listed in Section III have been classified as Effluent Dominated Waters (EDW), and have been assigned a designated use of Partial Body Contact (PBC) rather than Full Body Contact (FBC). ADEQ believes that using EDWs for FBC activities is inappropriate and should not be encouraged by designating FBC as a use. However, ADEQ recognizes that FBC activities could occur in EDWs. Therefore, fecal coliform standards for EDWs have been set to protect at an FBC level to ensure protection from waterborne pathogens. NAVIGABLE WATERS NOT DESIGNATED FOR AQUATIC AND WILDLIFE USES The waters listed in Section IV have not been designated for any aquatic and wildlife uses. All of these waters are canals which were constructed for the purpose of conveying water for use in agricultural activities or as a municipal water supply. The presence of aquatic life in these canals is considered to be incidental and that by no means should these waters be regulated to support aquatic life uses. Use of these canals by wildlife other than waterfowl is extremely unlikely because access to the water in the canals is limited by steep walls and/or fences. Use of the canals by waterfowl is minimal and is also limited by a lack of appropriate habitat.
