Due to Governor Greg Abbott’s March 13, 2020 proclamation of a state of disaster affecting all counties in Texas due to the Coronavirus (COVID-19) and the Governor’s March 16, 2020 suspension of certain provisions of the Texas Open Meetings Act, this meeting will be held by video conference call, as authorized under Texas Government Code section 551.127 and 551.125, respectively.

TIME & PLACE The Texas Commission on the Arts (TCA) held a video/telephonic meeting of the Commission beginning at 9:00 a.m. on December 3, 2020.

CALL TO ORDER Commission Chairman Dale Brock called the meeting to order by reading the following statement: “A public notice of the meeting containing all items on the agenda has been filed in the Office of the Secretary of State at 8:56 a.m. on November 18, 2020 as required by the Texas Government Code, Chapter 551, referred to as The Open Meeting Law.”

13 PRESENTATION, DISCUSSION, AND POSSIBLE COMMISSION ACTION ON THE FOLLOWING ITEMS:

APPROVAL TO EXCUSE ABSENT COMMISSIONERS Commissioner Heller made the motion and Commissioner Chang seconded that Commissioner Payton be excused from the December 3, 2020 meeting. Motion carried.

APPROVAL OF MINUTES OF THE SEPTEMBER 3, 2020 MEETING Commissioner Partee made the motion and Commissioner Guerra seconded that the minutes of the September 3, 2020 Commission meeting be approved as written. Discussion followed. Motion carried.

UPDATE ON FISCAL YEAR 2021 OPERATING BUDGET Director of Finance, Amber Rhodes, reviewed the 2021 operating budget with Commissioners. Discussion followed.

UPDATE ON TCA’s INTERNAL AUDIT Ms. Rhodes gave the Commissioners an update on the internal audit.

ACCEPTANCE OF LETTERS OF APPEAL IMPACTING THE GRANTS TO BE CONSIDERED FOR APPROVAL AT THIS MEETING Program Administrator, Kenneth Williams, stated that there were no appeals to be considered.

APPROVAL OF ARTS RESPOND PERFORMANCE SUPPORT GRANTS Director of Communications, Anina Moore, reviewed the Arts Respond Performance Support Grants with Commissioners. Discussion followed. Commissioner Gibson made a motion and Commissioner Heller seconded that the Commission approves the funding distribution for the second round of FY 2021 Arts Respond Performance Support grants as presented, with noted abstentions reflecting Commissioners’ conflicts of interest. Motion carried.

APPROVAL OF COMMISSION INITIATIVE GRANTS Director of Programs & Technology, Laura Wiegand, reviewed the Commission Initiative Grants with Commissioners. Discussion followed. Commissioner Chang made a motion and Commissioner Gibson seconded that the Commission approves the funding distributions for the second round of FY 2021 Commission Initiatives grants as presented, with noted abstentions reflecting Commissioners’ conflicts of interest. Motion carried.

APPROVAL OF CHANGES TO THE ARTS CREATE APPLICATION PROCESS DUE TO COVID-19 Ms. Wiegand informed the Commissioners that in consideration of the needs of the Texas nonprofit arts field during the continuing pandemic, TCA is recommending an alteration to the Arts Create grant program for FY22 application cycle. Discussion followed. Commissioner Guerra made a motion and Commissioner Roberts seconded that the Commission approves the proposed changes to the Arts Create application process due to COVID-19 and extend the current Arts Create grants recipients for an additional two

14 years (FY22 and FY 23), while allowing new applicants the opportunity to apply to the program in March 2021. Motion carried.

APPROVAL OF EVALUATORS FOR ARTS CREATE Ms. Wiegand reviewed the slate of grant evaluators with Commissioners. Discussion followed. Commissioner Partee made a motion and Commissioner Gibson seconded that the Commission adopts the slate of grant evaluators as presented and that TCA staff be instructed to recruit individuals to serve as necessary in order to fill vacancies. Motion carried.

REPORT ON STATE NOMINATIONS Ms. Moore reviewed the nominations process with Commissioners. Discussion followed. Commissioner Gibson urged that a new category of classical musician be added to the statute authorizing process.

UPDATE ON THE 87th LEGISLATIVE SESSION Executive Director, Dr. Gary Gibbs, informed the Commissioners of the following: the LAR was submitted on September 11th with an exceptional item for the restoration of the 5 percent cut for use in COVID-19 relief; he attended a virtual hearing with the Governor’s office and the LBB and there were no questions; Samantha Martinez is the new LBB analyst and Benjamin Barkley is the new analyst in the Governor’s office; the presumed new Speaker of the House is from Beaumont, Texas but the Speaker will be elected first day of session with committee chairs named after that; still unclear how Session will be run in the midst of the pandemic; redistricting is a big issue this session; and that constitutionally the legislature is only required to pass a budget. Discussion followed.

COMMISSIONER REPORTS Commissioners Chang, Guerra, Heller, Gibson, Partee, Roberts and Chairman Brock gave reports.

TCA EXECUTIVE DIRECTOR REPORT Dr. Gibbs reported the following: he and Chairman Brock attended the Mid America Arts Alliance board meeting (virtually); he accepted the Gary Young Award from NASAA; attended several TCA and TFA Zoom meetings; TCA will host “TCA Conversations” via Zoom throughout December to inform and assist grantees with concerns and needs during the pandemic. He added that staff will be on hand to assist with their discipline. Discussion followed.

TEXANS FOR THE ARTS (TFA) REPORT Ann Graham gave a verbal report.

TEXAS CULTURAL TRUST (TCT) REPORT No report was given.

PUBLIC COMMENT No public comments were made.

15 FUTURE MEETING SCHEDULE The Commissioners reviewed the list of upcoming meetings. Commissioner Guerra noted that he will be not be in attendance at the March 18, 2021 meeting.

REPORT OF: COMMISSION MEETING PRESENTATION, DISCUSSION, AND POSSIBLE COMMISSION ACTION ACCEPTANCE OF THE POETRY FOUNDATION DONATION FOR POETRY OUT LOUD

DISCUSSION: The National Endowment for the Arts (NEA) partners with the Poetry Foundation on the national program, Poetry Out Loud. The NEA supports the agency’s work on Poetry Out Loud through our annual partnership agreement. This year, because of the pandemic, the statewide competitions had to shift to an online virtual format. The Poetry Foundation is providing additional support to help make the Texas virtual 2021 Poetry Out Loud statewide finals more accessible and equitable.

In consideration of the agency’s gift policy, staff is bringing the contribution to the Commission for its approval.

RECOMMENDATION: That the Commission approves and accepts the $3,000 donation from the Poetry Foundation to supplement the costs associated with the virtual 2021 Poetry Out Loud statewide finals.

REPORT OF: COMMISSION MEETING PRESENTATION, DISCUSSION, AND POSSIBLE COMMISSION ACTION ACCEPTANCE OF THE TEXAS CULTURAL TRUST DONATION FOR YOUNG MASTERS

DISCUSSION: Our partner, the Texas Cultural Trust, is continuing their role in the Young Masters program by raising the funds for the awards for fiscal years 2020 & 2021.

In consideration of the agency’s gift policy, staff is bringing the contribution to the Commission for its approval.

RECOMMENDATION: That the Commission approves and accepts the $70,000 donation from the Texas Cultural Trust to provide grants for the 2021 Young Masters.

REPORT OF: COMMISSION MEETING PRESENTATION, DISCUSSION, AND POSSIBLE COMMISSION ACTION ACCEPTANCE OF LETTERS OF APPEAL IMPACTING GRANTS TO BE CONSIDERED FOR APPROVAL AT THIS MEETING

DISCUSSION: Applicants for TCA grant programs who believe their proposals for funding were rejected for the following two reasons may appeal to the Commission for reconsideration:

1. Influence of evaluation panel or Commissioners who willfully failed to disclose conflicts of interest; or 2. Provision of incorrect information by the TCA staff or evaluators at the time of voting, despite the presence of the correct information as part of the original application.

The applicant must be able to show a link between one of these circumstances and a low score or rating and/or negative panel comment.

Dissatisfaction with the denial of a grant or with the amount of the grant is an insufficient reason for appeal.

Appeals must be presented through a written appeal form. The deadline for appeals is one week prior to the quarterly Commission meeting where the application under appeal will be considered. All appeals will be presented to the Commission for their consideration.

RECOMMENDATION: Staff will present appeals and recommendations for the Commission to consider.

REPORT OF: COMMISSION MEETING PRESENTATION, DISCUSSION, AND POSSIBLE COMMISSION ACTION APPROVAL OF ARTS RESPOND PROJECT GRANTS

DISCUSSION: In accordance with TCA’s guidelines for Arts Respond Project grants, TCA staff received and processed 205 applications submitted for the January 15, 2021 deadline. Ten applications were ineligible and withdrawn prior to panel review. Fourteen panels of discipline experts were convened to evaluate and score 195 applications from 195 organizations from 49 Texas cities. Two applications received a score below 700 points and are not recommended for funding.

The remaining 193 applications were scored as follows: 5 between 700 – 799 61 between 800 – 899 127 between 900 – 1000

34 PROGRAM DESCRIPTION Arts Respond Project

This program provides project assistance grants on a short-term basis and may include administrative costs directly related to the project. Projects must address one of the following priority areas:

• ECONOMIC DEVELOPMENT Intent: Projects that use to diversify local economies, generate revenue, and attract visitors and investment. Designed for projects that focus on job growth or cultural tourism (festivals, gallery walks, art fairs, etc).

• EDUCATION Intent: Projects that use art to promote innovations in K-12 public education. Designed for projects that impact K-12 public school students during the school day. Projects must be aligned with the TEKS and conducted in conjunction with school officials. Projects may occur in a school setting or off-site (field trip). Before and after-school projects are not eligible.

• HEALTH & HUMAN SERVICES Intent: Projects that use art to improve human health or functioning. Designed for projects that focus on health related topics, serve specific populations, or occur in a health care or human service setting (hospital, clinic, senior activity center, women’s shelter, homeless shelter, etc).

• PUBLIC SAFETY & CRIMINAL JUSTICE Intent: Projects that use art to prevent delinquency and recidivism in youth and adults. Designed for projects that focus on at-risk youth or incarcerated populations (after school program, juvenile detention center, adult prison, alternative learning center).

• NATURAL RESOURCES & AGRICULTURE Intent: Projects that use art to understand and/or improve the ecological and agricultural environment. Designed for projects that occur in rural counties (festivals, fairs, exhibitions, performances) or focus on natural resources (oil, water, green art, ecological issues).

Grant Type: Semi-annual Application Limit: Organizations may submit one application per deadline. Over the course of TCA’s fiscal year, organizations may address two different priority areas through Arts Respond. Organizations should not submit more than one application addressing the same priority area per fiscal year. Minimum Request: $1,000 Maximum Request: 50% of project budget Match Requirement: dollar for dollar (1:1) Semi-annual Grants Subject to Commission Approval

REPORT OF: COMMISSION MEETING PRESENTATION, DISCUSSION, AND POSSIBLE COMMISSION ACTION APPROVAL OF ARTS RESPOND PERFORMANCE SUPPORT GRANTS

DISCUSSION: In accordance with TCA’s guidelines for Arts Respond Performance Support grant applications, TCA staff processed applications submitted and completed for the February 1, 2021 quarterly deadline. This batch of grants includes applications submitted for activities starting between March 15, 2021 and June 14, 2021. The Commission received and processed 60 applications in this quarter. Of these 60 applications, 5 were ineligible and withdrawn prior to panel review. The remaining 55 applications come from 39 organizations in 30 Texas cities. All of these applications are recommended by staff to receive funding.

Five advisory evaluators reviewed the requests, and a majority of the evaluators approved the funding recommendations made by TCA staff. These recommendations are now submitted to the Commission for its approval.

DISCUSSION: The Young Masters grant program is a Commission Initiative. In accordance with TCA’s guidelines for distributing Commission Initiatives and Designated Funding grants, TCA staff is submitting recommendations to the Commission for its approval.

Included in this funding category is: • Fourteen grants to students selected as Young Masters for 2020-2021

Five advisory evaluators reviewed the requests, and a majority of the evaluators approved the funding recommendations made by TCA staff. These recommendations are now submitted to the Commission for its approval.

92 PROGRAM DESCRIPTION Young Masters

Eligibility: Texas 8th to 11th grade students (or homeschooled students who have achieved a comparable status towards high school graduation) who are legal US and Texas residents

Intent: To advance the creative economy of Texas by investing in the future of the arts.

This program awards grants to talented young artists to further their studies in their chosen field. This grant is not a college scholarship. The most talented young artists will receive the title of Young Master and will be awarded grants of up to $5,000 per year to further their studies in their chosen arts disciplines. Students are eligible to receive the grant for up to two years, but not beyond their senior year in high school, and they must reapply annually. Students must be participating in a school-based arts program, summer institute, a specialized course of study, or receiving private lessons from a qualified instructor. Students must maintain passing grades in all academic areas. Applications will be from the student, his or her parent/guardian, and his or her arts instructor. This program is available every other year.

Nominations are encouraged from Commissioners, past panelists, artists, and arts organizations. Evaluators volunteer their time and expertise to review applications submitted to the Commission. Their feedback is used by agency staff to make recommendations for the Commission.
