1. PAPERS LAID ON THE TABLE

Shri Chaturanan Mishra (Minister of Agriculture) on behalf of Shri Birendra Prasad Baishya laid on the Table, under clause (1) of article 151 of the Constitution a copy (in English and Hindi) of the Report of the Comptroller and Auditor General of - No. 22 (Commercial) of 1995 (Ferro Scrap Nigam Limited).

Shri Muhi Ram Saikia (Minister of State in the Ministry of Human Resource Development (Deptt. of Education) on behalf of Shri Somtppa Bommai laid on the Table a copy each (in English and Hindi) of the following papers:-

(i) Annual Report and Accounts of the Central Social Welfare Board, , for the year 1994-95, together with the Auditors' Report on the Accounts.

(ii) Review by Government on the working of the above Board.

(iii) Statement giving reasons for the delay in laying the papers mentioned at (i) above.

Shri Muhi Ram Saikia (Minister of state in the Ministry of Human Resource Development (Deptt.of Education) on behalf of Shri P. Chidambaram laid on the Table, under clause (1) of article 151 ofthe Constitution a copy (in English and Hindi) of the Report of the Comptroller and Auditor Generalof India-No. 14 (Commercial) of 1995 (the new India Assurance Company Limited).

Capt. Jainarain Prasad Nishad Minister of State (Independent Charge) in the Ministry of Environment and Forests) laid on the Table, under Section 26 of the Environment (Protection) Act, 1986,a copy (in English and Hindi) of the Ministry of Environment and Forests, Notification S. O. No.157(E), dated the 27th February, 1996, relating to delegation of powers of Section '5' of Environment(Protection) Act, 1986, to Chairman, Central Pollution Control Board pertaining to issue of directions.

Shri Muhi Ram Saikia (Minister of State in the Ministry of Human Resource Development (Deptt. of Education) laid on the Table-

I. A copy (in English and Hindi) of the Uttar Pradesh University (Amendment) Act, 1996 (No. 4 of 1996), under sub-section (4) of Section 3 of the Uttar Pradesh State Legislature (Delegation of Powers) Act,

II. A copy each (in English and Hindi) of the following papers:-

(i) (a) Annual Accounts of the Aligarh Muslim University, Aligarh for the year 1994- 95, and the Audit Report thereon, under sub-section (4) of section 35 of Aligarh Muslim University Act, 1920. (b) Statement giving reasons for the delay in laying the papers mentioned at (a) above.

(ii) (a) Annual Report of the Indian Institute of Technology, Delhi, for the year 1994- 95.

(b) Annual Statement of Accounts of the Indian Institute of Technology, Delhi for the year 1994-95 and the Audit Report thereon under sub-section (4) of Section 23 of the (Institute of Technology) Act, 1961.

(c) Review by Government on the working of the above Institute.

(d) Statement giving reasons for the delay in laying the papers mentioned at (a) and (b) above.

(iii) (a) Consolidated Annual Accounts of the Kendriya Vidyalaya Sangathan, New Delhi, for the year 1993-94 and the Audit Report thereon.

4. RECOMMENDATIONS OF THE BUSINESS ADVISORY COMMITTEE

The Deputy Chairman informed the House that the Business Advisory Committee has allocated time as follows for the legislative business:

Consideration and passing of the following Bills:-

(1) The Mahatma Gandhi Antarrashtriya Hindi Vishwavidyalaya Bill, 1995. 1 Hour

(2) The Maulana Azad National Urdu University Bill, 1995." 1 Hour

5. MOTION FOR ELECTION TO THE JOINT-COMMITTEE ON OFFICES OF PROFIT-ADOPTED

Shri Ramakant D. Khalap [Minister of State (Independent Charge) in the Ministry of Law and Justice] moved:

"That this House concurs in the recommendation of the Lok Sabha that a Joint Committee of the House to be called the Joint Committee on Offices of Profit be constituted for the purposes set out in the motion adopted by the Lok Sabha at its sitting held on the 12th July, 1996 and resolves that this House do join in the said Joint Committee and proceed toelect, in accordance with the system of proportional representation by means of the single transferable vote, five Members from among the Members of the House to serve on the said Joint Committee."

The motion was adopted. 6. RESOLUTION RE. NOMINATION OF MEMBERS TO PARLIAMENTARY COMMITTEE TO REVIEW RATE OF DIVIDEND PAYABLE TO GENERAL REVENUES

Shri Satpalji Maharaj (Minister of State in the Ministry of Railways) moved:

"That this concurs in the recommendation of the Lok Sabha that the Rajya Sabha do agree to the nomination by the Chairman of Six members from the Rajya Sabha to the Parliamentary Committee to review the Rate of Dividend which is at present payable by the Indian Railways to the General Revenues as well as other ancillary matters in connection with Railway Finance vis-a-vis General Finance and to make recommendations thereon."

The Resolution was adopted.

(The Resolution was withdrawn by leave of the House.

9. PRIVATE MEMBERS RESOLUTION-UNDER CONSIDERATION

Shri Ramdas Agarwal moved:-

"Having regard to the fact the population of our country is growing at an alarming rate with serious implications on the rate with serious implications on the overall socioeconomic development em- ployment, housing, poverty alleviation and on the living standard of the people of India, this House resolves that-

(i) the family welfare planning programmes be strictly implemented.

(ii) the strigent rules be framed so that Govvernment employees would be allowed to derive benefits in service, only if they agree to have two or three children;

(iii) suitable laws pertaining to family planning be enacted so as to restrain the candidates having more than three children from contesting elections of any type; and

(iv) sufficient funds should be allocated under the family welfare programmes during the Ninth Five Year Plan."

Members took part in the discussion.

"That this House disapproves of the Building and other Construction workers (Regulation of Employment and Conditions of Service) Third Ordinance, 1996 (No. 25 of 1996) promulgated by the President on the 20th June, 1996."

@ (b) STATUTORY RESOLUTION SEEKING DISAPPROVAL OF THE BUILDING AND OTHER CONSTRUCTION WORKERS' WELFARE CESS THIRD ORDINANCE, 1996- WITHDRAWN

Shri Satish Agarwal moved:

"That this House disapproves of the Building and other Construction Workers' Welfare Cess Third Ordinance, 1996 (No. 26 of 1996) promulgated by the President on the 20th June, 1996."

Shri M. Arunachalam (Minister of Labour) moved:

"That the Bill to regulate the employment and conditions of service of building another construction workers and toprovide for their safety, health and welfare measures and for other matters connected there with or incidental thereto, as passed by Lok Sabha, be taken into consideration."

Shri M. Arunachalam also moved:

"That the Bill to provide for the levy and collection of a cess on the cost of construction incurred by employers with a view to augmenting the resources of the Building and Other Construction Workers' Welfare Boards constituted under the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, as passed by Lok Sabha, be taken into consideration."

An amendment for reference of the Building and other Construction Workers' Welfare Cess Bill, 1996 to a Select Committee of the Rajya Sabha was moved by Shri Satish Agarwal.

(a) The Resolution disapproving the Ordinance was withdrawn by leave of the House. (c) (i) The motion for consideration of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Bill, 1996 was adopted.

Thereafter, clause by clause consideration of the Bill was taken up.

Clauses 2 to 64 were adopted.

Clause 1, the Enacting Formula and the Title were adopted.

The motion moved by Shri M. Arunachalam that the Bill be passed was adopted and the Bill was passed.

(b) The Resolution disapproving the Ordinance was withdrawn by leave of the House.

The amendment moved by Shri Satish Agarwal for reference of the Bill to a Select Committee of the Rajya Sabha was withdrawn by leave of the House.

(c) (ii) The motion for consideration of the Building and Other Construction Workers' Cess Bill, 1996 wasadopted.

Thereafter, clause by clause consideration of the Bill was taken up.

Clauses 2 to 15 were adopted.

11. STATEMENT BY MINISTER

Shri Chaturanan Mishra (Minister of Agriculture) laid on the Table a statement (in English and Hindi) regarding minimum support prices for Kharif Crops and Raw Jutes for 1996-97 season.

(I) Shri H. D Deve Gowda (Prime Minister) made a statement on Jammu and Kashmir.

Thereafter, Members sought clarification on the statement.

(ii) Shri H. D. Deve Gowda (Prime Minister) laid on the Table a statement (in English and Hindi) Regarding the law and order situation in Delhi.
