Tetapi, banyak sarjana yang mengkaji isi teks itu kerap membuat tanggapan yang salah. Dalam kajian mereka, mereka menetapkan aspek luaran, dan bukannya aspek fungsi dan sejarah pada cerita mitos dan legenda itu. Oleh itu, adalah tujuan rencana ini untuk menerokai pemahaman konsep saya tentang cerita legenda dan mitos dalam teks sejarah klasik Melayu untuk membuktikan adanya kebenaran sejarah yang tersirat di sebalik cerita itu. Untuk tujuan itu, saya telah memilih Sejarah Melayu, Hikayat Raja-Raja Pasai dan Hikayat Merong Mahawanga. Kata kunci: Kosmologi Melayu, Sejarah Melayu, simbol Melayu, tafsir dan ta’wil ABSTRACT Malay historical texts are also rich in the mythical and legendary stories. Unfortunately, many scholars who study the content of the texts have always misunderstood them. In their study, they specify on the superficial aspects, instead of functional and historical aspects of the mythical and legendary stories. It is the purpose of this paper to explore my conceptual understanding of mythological and legendary stories in the Malay classical historical texts to prove that there are indeed historical truth embedded within these stories. To do that, Sejarah Melayu, Hikayat Raja-raja Pasai and Hikayat Merong Mahawangsa are selected. Arab Malaysian Finance Bhd and Serac Asia Sdn Bhd v. Sepakat Insurance Brokers Sdn Bhd, a High Court can set aside an order of another High Court of concurrent jurisdiction that have been obtained in breach of rules of natural justice This was an appeal against the High Court’s decision allowing, among others, the plaintiff/1st respondent’s action for a declaration that he was a bona fide purchaser and proprietor of a piece of land which he had purchased pursuant to a Sale and Purchase Agreement (“SPA”) between him and the 1st defendant/2nd respondent. The land was registered under the 1st defendant’s father’s name, Tan Yew Lin (“TYL”) and upon TYL’s death, the 1st defendant inherited the land. TYL had a brother by the name of Tan Tuan Kam (“TTK”), who married the 2nd defendant and had a son who was the 3rd defendant. TTK had also passed away. The 2nd and 3rd defendants contended, inter alia, that the land was registered under TYL’s name although TTK was the one who bought it, because TTK wanted to help TYL who was then unemployed; and upon a promise made by TYL that he would later transfer the land to TTK. -

These manuscripts, perhaps with the exception of the oldest among them, preserved in the Cambridge and Oxford University libraries, have undergone various deliberate changes at the hands of scribes. This in no way lessens their importance. How- ever, in this paper we are only concerned with the survival of manu- scripts and their accessibility to researchers. Researchers have discovered that some of the texts mentioned in Franc,ois Valentijn's list, published in 1726, no longer exist. But not all losses of ancient literary texts took place so early. Some of the texts referred to in Raja AH Haji's Tuhfat al-Nafis, too, are no longer trace- able. They are known to us from no other source. Other manuscripts, while surviving the destruction of the Malay sul- tanates of Pasai, Palembang, Malacca, Acheh, and others, perished later. Some of them may have been too tattered to be of much practical use when found, and so probably were abandoned as waste materials. Still others were left to perish, as no one was interested in reading and copying them because writing-materials (paper, palm-leaves, etc.) were too scarce and expensive to be used widely. -

Jurnal Melayu (8) 2011: 111 - 132 PENGHAYATAN TRADISI LISAN MELAYU DALAM KALANGAN MASYARAKAT CINA KELANTAN APPRECIATION OF MALAY ORAL TRADITIONS AMONG THE CHINESE IN KELANTAN MOHAMAD NAZRI AHMAD HANAPI DOLLAH TEO KOK SEONG ABSTRAK Makalah ini membincangkan penghayatan tradisi lisan Melayu dalam kalangan orang Cina Kelantan. Kajian ini didasarkan pada tiga jajahan iaitu Tumpat, Kota Bharu dan Pasir Mas. Kajian lapangan yang dilakukan di kawasan kediaman orang Cina. Tradisi lisan dalam masyarakat Cina Peranakan dilihat dari aspek kehidupan mereka seperti aspek bahasa, pakaian, makanan, kraftangan, kesenian dan kaedah perubatan. Data kajian enunjukkan bahawa mereka berasimilasi dengan budaya Melayu dan Siam di Kelantan. Dengan menerima budaya tempatan ke dalam amalan harian, mereka kelihatan seperti orang Melayu. Tradisi lisan Melayu seperti wayang kulit, menorah dan mak yong dihayati dengan baik dalam kalangan mereka. Kata Kunci: Cina Kelantan, budaya, bahasa, kebaya pendek, budu, tangkee, tulisan jawi. ABSTRACK This article attempts to discuss the appreciation of Malay oral traditions among the Chinese in Kelantan. The discussion is based on the fieldwork data which were collected in the three districts, i.e. Tumpat, Kota Bharu and Pasir Mas. Their appreciation could be viewed from several aspects such as language, daily costume, food, handy craft, art and healing rituals. The data show that the Chinese are assimilated with the Malay and the Siamese culture in Kelantan. As they accept the local cultures into their daily life, they resemble the Malays. The Malay oral traditions such as wayang kulit, menora and mak yong are appreciated well among them. Key words: Kelantan Chinese, culture, language, short kebaya, budu, tangkee and jawi script. -

CHAPTERIntroduction 19513 STARE DECISIS AND RATIO DECIDENDI1 19.1 DOCTRINE OF STARE DECISIS The maxim stare decisis et non quieta movere literally means ‘to stand by the decision, and not to disturb the settled matters’ i.e. to stick with what has been decided or the like cases should be decided alike. The commonly used term is the doctrine ofstare decisis or the rule of judicial precedent which dictates that it is necessary for each lower tier to accept loyally the decision of the higher tiers. Thus, a court other than the highest court is obliged generally to follow the decision of the court at a higher or the same level in the court structure subject to certain exceptions. The application of the doctrine from a higher court to a lower court is called the vertical stare decisis. Whereas, the notion that a judge is boundFOR to follow ACADEMIC or respect the decision of an earlier judge of similar or coordinate jurisdiction is called horizontal stare decisis.2 Further, the rule of judicialREPOSITORY precedent shall apply whenever the relevant facts of an earlier case is similar to the facts of a subsequent case, i.e. the relevant facts of the two cases are similar. However, if the facts are not similar then the earlierPURPOSES decision would be distinguished and as such would not be binding on the subsequentONLY case.3 As the doctrine has been developed by the English courts and accepted by the Malaysian courts as part of the common law applicable by virtue of s. 3 of the Civil Law Act 1956, hence, it would be worthwhile to refer 1 This chapter is contributed by Ashgar Ali Ali Mohamed. -
