Drapeau' Ottawa The Canadian Charter ofRights and Freedoms recognizes the existence of the militaryjustice system and its own tribunals operating in parallel to the Canadian criminal law system. Yet, there continues to be an absolutepaucity of any reference works on military law and members of the Canadian military bar are seldom heard or read. This article aims atfilling the void, at least in part. In writing this article, the author, who servedfor 34 years in general staff and command positions in the Canadian Forces, had two general purposes in mind: a) to present the general reader with a general overview ofthe history, customs, organization, and structure ofthe military personnel system, and b) to provide a reference work presenting a detailed view ofthe Code ofMilitary Discipline, both in its contents and its workings. Finally, in light ofthe extensive changes in 1999 to the National Defence Act and the accompanying regulations, the author concludes by reviewing the nature and impact of each of the punishments that may be imposed by a military tribunal or the Court Martial Appeal Court ofCanada to those who are subject to the Code ofService Discipline.     PARLIAMENT OF CANADA / PARLEMENT DU CANADA The Dominion of Canada was created under the provisions of an Act of the Imperial Parliament (30 Victoria, Chapter III) passed in 1867, and formally cited as The British North America Act, 1867. This Act received Royal Assent, March 29th, 1867, and came into effect by virtue of Royal Proclamation, July 1st, 1867. The Constitution Act, 1867, provides: “There shall be one Parliament for Canada, consisting of the Queen, an Upper House styled the Senate, and the House of Commons.” (Clause 17) “There shall be a Session of the Parliament of Canada once at least in every year, so that twelve months shall not intervene between the last Sitting of the Parliament in one Session and its first Sitting in the next Session.” (Section 20) “Every House of Commons shall continue for five years from the Day of the Return of the Writs for choosing the House (subject to be sooner dissolved by the Governor General), and no longer.” (Section 50) “The Governor-General shall, from time to time, in the Queen's name, by instrument under the Great Seal of Canada, summon and call together the House of Commons.” (Section 38) “Either the English or the French language may be used by any person in the Debates of the House of the Parliament of Canada and of the House of the Legislation of Quebec, and both these languages are used in the respective records and Journals of those Houses; and either of those languages may be used by any person or in any Pleading or Process or in issuing from any Court of Canada established under the Constitution Act and in or from all or any of the Courts of Quebec.” (Section 133) “91.

Corrigan, B.A., M.A., LL.B.* There has been mixed treatment at the Canadian Federal Court of U.S. deserters who have claimed refugee status in Canada on the basis of refusal to serve in the U.S. military. To quote one article: In their battle to secure asylum in Canada, U.S. military deserters are being sorted into winning and losing camps by the Federal Court, which some law- yers contend has been inconsistent and confusing in its treatment of war re- sisters. In six court decisions in the last two years, there have been four losers and two winners among the first batch of former soldiers to challenge their defeats at the Immigration and Refugee Board. “We’ve got a divided court,” said Toronto lawyer Geraldine Sadoway, whose client, Justin Colby, recently lost his refugee bid, after fleeing to Canada two years ago following a one-year stint as a medic in Iraq. Ms. Sadoway says she cannot figure out why the Federal Court rejected Mr. Colby’s claim on June 26, only one week before it handed the first ever victory to deserter Joshua Key, who also served in Iraq.1 To date there have been at least ten cases considered by the Canadian Federal Court and the Federal Court of Appeal on the U.S. war resister issue. In seven of those cases the decision went against the Americans who claimed refugee status on the basis of refusal to serve in the U.S.
