Heard: February 3, 2011 Judgment: February 11, 2011 Immigration and citizenship –––– Admission — Application for temporary resident or immigrant visa — Powers and duties of visa or immigration of- ficer –––– Applicant applied for permanent residence in Canada under skilled worker class — Immigration officer refused application — Officer awarded total of 63 points for application based on applicant’s test scores — Officer was of opinion that applicant would not be able to perform required duties at her ar- ranged employment because she did not have sufficient language skills — Ap- plicant brought application for judicial review of officer’s decision — Applica- tion granted — Matter was sent for redetermination — Applicant’s procedural fairness was breached — Officer used poor test scores to make finding on lan- guage proficiency despite evidence that results were due to bad health — Officer also used poor test scores as basis to not award any points under arranged em- ployment criterion, despite evidence that employment was confirmed — In turn, this had repercussions on adaptability criterion — Officer’s decision to adjudi- cate matter without fairness letter or interview was unreasonable, especially as officer knew that second test was to follow — Manual provided clear guidance that more information should have been sought — Procedural fairness called for further inquiry by officer. 2 IMMIGRATION LAW REPORTER 97 Imm.
