Abruzzese Brooklyn Daily Eagle INADEQUATE APPENDIX LEADS TO DISMISSAL OF DIVORCE APPEAL Appellate Division, Second Department In the Appellate Division, Second Department, Hisham Ahmed Almeh- dawi appealed a judgment of divorce that was rendered by Hon. Esther Morgenstern of Kings County Supreme Court, Civil Term, on Sept. 23, 2016. In response to Almehdawi’s appeal, the appellate justices explained that, although they have the inherent juris- diction to do so, they do not consider issues that were, or could have been, previously raised on an earlier appeal which was dismissed for lack of prose- cution. Previously, Almehdawi had Hon. That appeal was dismissed for failure to prosecute on Jan. 5, 2015. Therefore, the justices deter- mined that the dismissal for lack of prosecution barred the most recent appeal by Almehdawi. They went on to note that the remainder of the appeal had to be dismissed for failure to compile an adequate appendix. In order to perfect an appeal using the appendix method, the appellant must file an appen- dix that “contains all the relevant portions of the record in order to enable the court to render an informed decision on the merits of the appeal.” In his appeal, Almehdawi contend- ed that the Supreme Court erred in determining that the mar- riage was valid. In their review of the record, the justices found that the court’s decision after trial indicated that the court had received evidence at the trial on the issue, including Almehdawi’s purported testimony that the marriage between himself and Khadija Abouelhassan was “fake.” However, Almehdawi’s appendix did not contain any of the relevant trial transcripts and was therefore inadequate to enable the jus- tices to render an informed decision on the merits. As a result, the appeal was dismissed. —Abouelhassan v. Almehdawi, 2016-11958, Nov. 20, 2019 ••• DISMISSAL DENIED IN MEDICAL MALPRACTICE COMPLAINT Appellate Division, Second Department IIn a case that involved claims of medical malpractice, defendants Deepak Nanda, Debra Carter-Greene and North Shore LIJ Medical Center appealed an order by Hon. Peter O’Donoghue of Queens County Supreme Court, Civil Term. That order, entered May 23, 2017, denied the defendants’ motion for summary judgment, dismissing the complaint insofar as asserted against them. In her complaint, Lashal Williams alleged that that Nanda and Carter-Greene were negligent in their failure to timely diagnose and treat a pla- cental abruption that resulted in the intrauterine demise of her fetus, which was at 28 weeks of gestation, and that North Shore LIJ Medical Center was vicariously liable for the actions of Nanda and Carter-Greene. Following the completion of dis- covery, the defendants moved for summary judgment dis- missing the complaint and were denied by the Supreme Court. In response to their appeal, the justices of the Appellate Division, Second Department, explained that a defendant seeking summary judgment in a medical malprac- tice complaint must demonstrate either that he or she did not depart from the accepted standard of care or that any depar- ture was not a proximate cause of the plaintiff’s injuries. In this case, the justices found that the North Shore defendants met their burden for summary judgment through the affirmation of their expert who asserted that, based on his review of the medical records, Nanda and Carter-Greene’s treatment of Williams was within the appropriate standard of medical care and that, in any event, any alleged departures were not a proximate cause of the fetal demise. However, the justices also concluded that Williams raised a triable issue of fact in response, through her expert’s opinion that the North Shore defendants departed from the standard of care by failing, upon her presentation with sharp back and abdominal pain and other symptoms characteristic of placental abruption, to admit Williams to the hospital for continuous fetal monitor- ing. In the opinion of Williams’ expert, such monitoring would have allowed the defendants to monitor the fetus for signs of distress and prompted them to deliver the fetus by emer- gency c-section. Additionally, the justices noted that the expert for Williams opined that a fetus at 28 weeks of gesta- tion is viable and would have had a 90 percent chance of sur- vival. As such, the justices agreed with the Supreme Court’s determination to deny the motion for summary judgment dis- missing the complaint against the North Shore defendants. —Williams v.
