Popular because the song somehow found its way into international households via the renowned Disney‘s Lion King. Controversial because the popularity passage of the song was tainted with illicit and grossly unfair dealings tantamount to theft and dishonest misappropriation of traditional intellectual property, giving rise to a lawsuit that ultimately culminated in the out of court settlement of the case. The lessons to be gained by the world and emanating from this dramatics, all pointed out to the dire need for a reconsideration of measures to be urgently put in place for the safeguarding of cultural intellectual relic such as music and dance. 1. Introduction Music has been and, and continues to be, important to all people around the world. Music is part of a group's cultural identity; it reflects their past and separates them from surrounding people. Music is rooted in the culture of a society in the same ways that food, dress and language are”. Looked at from this perspective, music therefore constitute an integral part of cultural property that inarguably requires concerted and decisive efforts towards preservation and protection of same from unjust exploitation and prevalent illicit transfer of same.

Mbube (Zulu for ‘lion’, pronounced ‘eem-boo-bay’) was released as the song (‘The Lion Sleeps Tonight’) ‘Mbube’ written by Solomon Linda in Johannesburg and released through Gallo Record Company in 1939. ‘Mbube’ became a UK and USA #1 hit single in 1969 by the Tokens – and is now the name widely used for the South African a cappella genre, mbube.

It has a three-fold approach. First, it provides an overview of archival theory as it has developed since the French Revolution in 1789. It follows the trajectory of changing archival principles such as appraisal and provenance and provides an oversight into the changing understanding of ‘the archive’ as an impartial custodian of the Truth, to its conceptualisation in the Humanities as a concept deeply rooted in discourses around power, justice and knowledge production. Interrogating the unfolding concept of the archive throws into relief its current envisioned function within a post-Apartheid South Africa. Secondly, this dissertation explores five music archives in South Africa to investigate the level to which archival theory is engaged with and practiced in music archives.

EDMUND “NTEMI” PILISO JAZZING THROUGH DEFEAT AND TRIUMPH: AN INTERVIEW by CHRISTOPHER BALLANTINE Abstract: Associated with the local swing style usually described as African jazz, Edmund “Ntemi” Piliso was one of the most highly regarded, frequently recorded, extensively consulted and best known South African musicians of the twentieth century. Renowned for his deep knowledge of the urban black South African popular music of his time, as well as for his reflexively intelligent insights into its relationship with mainstream international jazz, he is perhaps more appropriately thought of as an “organic intellectual” of his time, place, and musical culture. The article introduces Piliso and then presents a wide-ranging interview dealing with his life and work. Piliso recounts this history, offering numerous insights into many of the key social, political, and musical developments of his time. Introduction Race-based capitalism was already firmly in place in South Africa when the National Party assumed power in 1948. What the new government did was to perfect the system: it devised measures to make more efficient the exploitation of, in particular, the huge sector of the working class racially defined as “African”. So the state became increasingly totalitarian, a process in which it steadily assumed the form that achieved global notoriety as apartheid. Among the many features essential to its tightening grip was a draconian approach to ideas: what people thought came under ever-expanding surveillance and control, including ideas about how power and authority might be resisted, pushed back, or even ultimately overthrown.
