Mexican Americans, Racial Discrimination, and the Civil Rights Act of 1866 Gary A Mexican Americans, Racial Discrimination, and the Civil Rights Act of 1866 Gary A. Greenfield* and Don B. Kates, Jr.*- The authors examine the legislative history of section one of the Civil Rights Act of 1866, scientific concepts of race and racial classifica- tions, state racial statutes and litigation, the early federal naturaliza- tion law, the perception of Mexican Americans in the Southwest, and the discrimination which the Mexican American has encountered. They conclude that Mexican Americans generally have been per- ceived as a nonwhite racial group and that the discrimination they have encountered has been based upon that perception. They fur- ther conclude that Mexican Americans are entitled to the protections of section one of the Civil Rights Act of 1866. Since the Civil War, Congress has enacted a number of statutes designed to eradicate various forms of discrimination. The earliest of these statutes was the Civil Rights Act of 1866.1 The first section of that Act read: That all persons born in the United States and not subject to any foreign power, excluding Indians not taxed, are hereby declared to be citizens of the United States; and such citizens, of every race and color, without regard to any previous condition of slavery or involun- tary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall have the same right, in every State and Territory in the United States, to make and enforce con- tracts, to sue, be parties, and give evidence, to inherit, purchase, lease, sell, hold, and convey real and personal property, and to full and equal benefit of all laws and proceedings for the security of per- son and property, as is enjoyed by white citizens, and shall be subject to like punishment, pains, and penalties, and to none other, any law, statute, ordinance, regulation, or custom, to the contrary not- withstanding. 2 That section is now codified as sections 1981 and 1982 of title 42 of 3 the United States Code. * B.A. 1971, Stanford University; J.D. 1975, University of California, Berkeley. ** LL.B. 1966, Yale University. Section 1981 reads: All person within the jurisdiction of the United States shall have the same 19751 MEXICAN AMERICANS & RACIAL DISCRIMINATION 663 In early cases dealing with the post-Civil War amendments and civil rights statutes, the Supreme Court gave restrictive interpretations to both section one of the 1866 Act and the thirteenth amendment,4 upon which the Act was initially based. In the Civil Rights Cases,5 for example, the Court "conceded" that the thirteenth amendment em- powered Congress to eliminate all the "badges and incidents of sla- very,"'0 but declared that: "Mere discriminations on account of race and color were not regarded as badges of slavery."' 7 As for the Civil Rights Act of 1866, the Court stated in dictum8 that section one, which had been reenacted after passage of the fourteenth amendment, 9 was right in every State and Territory to make and enforce contracts, to sue, be parties, give evidence, and to the full and equal benefit of all laws and proceed- ings for the security of persons and property as is enjoyed by white citizens, and shall be subject to like punishment, pains, penalties, taxes, licenses, and exactions of every kind, and to no other. 42 U.S.C. § 1981 (1970). Section 1982 reads: "All citizens of the United States shall have the same right, in every State and Territory, as is enjoyed by white citizens thereof to inherit, purchase, lease, sell, hold, and convey real and personal property." Id. § 1982. The Civil Rights Act of 1866 was reenacted by the Enforcement Act of May 31, 1870, ch. 114, § 18, 16 Stat. 144, codified as sections 1977 and 1978 of the Revised Stat- utes of 1874, and appears now as 42 U.S.C. §§ 1981-82 (1970). 4. The text of the thirteenth amendment reads: Section 1. Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction. The question presented in the Civil Rights Cases was the constitutionality of the first two sections of the Civil Rights Act of 1875, Act of March 1, 1875, ch. 114, §§ 1-2, 18 Stat. 336, banning private racial discrimination in public accomodations. 109 U.S. at 8-9. 9. The fourteenth amendment was certified as having been adopted by the requi- site number of states on July 28, 1868. See 15 Stat. 708-11 (appendix to Statutes at Large for the 40th Congress). The Civil Rights Act of 1866 was reenacted in 1870. See note 3 supra. The interrelationship of the 1866 Act, its reenactment, the fourteenth amendment, and the Civil Rights Cases is protean and complex. A minority of congressmen had, in opposition to the original enactment of the 1866 Act, urged the view later adopted by the Supreme Court in the Civil Rights Cases, i.e., that the thirteenth amendment did not authorize congressional enactments beyond a direct prohibition of slavery itself. See, e.g., CONG. GLOBE, 39th Cong., 1st Sess. 1290 (1866) (remarks of Rep. Bingham). The majority disagreed, feeling that the thirteenth amendment allowed congressional eradication of the "incidents" of slavery, by which they meant the legal theory of slavery. That theory had provided that a slave, being simply a species of property, could not own, devise, inherit, or convey realty or personalty, nor make contracts, testify, sue or be sued. See, e.g., Kates, Abolition, Deportation, Integration: Attitudes Toward Slavery in the Early Republic, 53 J. NEGRo I-hsT. 33, 37-38 n.25 (1968). Representative Bingham, who believed that the thirteenth amendment did not an- CALIFORNIA LAW REVIEW [Vol. 63:662 "intended to counteract and furnish redress against state laws and pro- ceedings," 10 rather than against private activities. These statements by the Court were typical of those made in both earlier1 and later12 cases, with the result that section one of the 1866 Act was thought to ban only government denials of the rights accorded therein. In Jones v. Alfred H. Mayer Company,'3 however, the Court con- cluded that the thirteenth amendment, in outlawing the institution of slavery, also empowered Congress to ban both public and private ra- cial or color discrimination as vestiges of slavery not immediately eradi- cated by the prohibition of the institution itself.' 4 Moreover, the Court held that Congress, in enacting section 1982, had intended to make both public and private housing discrimination illegal.'3 As a result of the Court's reassessment of the thirteenth amendment and the Civil Rights Act, sections 1981 and 1982 have become important vehicles for combatting private discrimination, particularly in the areas of em- ployment and housing.' 6 While Title VII of the Civil Rights Act of thorize the Civil Rights Act, was the author of the fourteenth amendment. In it he intended to incorporate the principles enunciated by the 1866 Civil Rights Act and thereby put them beyond constitutional challenge. The vast majority of other supporters of the fourteenth amendment, though reading it as unnecessary for this purpose, advo- cated it as a method of placing the principles of the 1866 Act in the Constitution and beyond repeal by Southerners and their allies should they ever regain control of Con- gress. Thus, after the fourteenth amendment became effective, the 1866 Act was reenacted as an addendum to the Enforcement Act of 1870 in order to dispel any possible doubt as to its constitutionality. Following the Supreme Court's lead, a number of lower federal courts have interpreted section 1981's guarantee of the right to "make and enforce con- tracts" as creating a cause of action for racial discrimination in private employment. Magister Negi Magi, by Ken Akamatsu, a manga series of 29 titles known in Japan as Magical Teacher Negima!, and Gossip Girl, by Cecily von Ziegesar, a young adult novel series of 15 titles that became the 2007 inspiration for the “Gossip Girl” teen drama television series. Only three individual titles were reported twice on the 2009 survey, a teen comedy increase film “Fired Up!” directed by Will Gluck, a children’s picture book Mummy Laid an Egg! by Babette Cole, and NOW Magazine. The children’s picture book And Tango Makes reported in Three was again challenged in 2009, making it the only title to appear on the survey every year since it began in 2006. Altogether, 139 challenges were reported in the 2009 survey conducted annually by Canadian the CLA Advisory Committee on Intellectual Freedom. Of these, 137 were to library resources and two were to library policies.

BACKGROUND At the height of the Vietnam War in 1968, a young Japanese graduate student at the University of California at Berkeley, Yuji Ichioka, banded with other students in an attempt to shut down the university in collective protest against the conflict. The demonstration was not only successful for five months, but Ichioka and his student colleagues also successfully initiated a self-determination campaign against the derogatory term, “Oriental,” then reserved for all persons of Asian descent, birthing the distinction, “Asian American,”1 which we use to this day. The United States Census Bureau’s “Asian” racial category refers to “a person having origins in any of the original peoples of the Far East, Southeast Asia, or the Indian subcontinent...,” while “Native Hawaiian or other Pacific Islander” refers to “a person having origins in any of the original peoples of Hawaii, Guam, Samoa, or other Pacific Islands.2” Asian Americans and Pacific Islanders (AAPI) collectively comprise the largest and fastest growing racial group in the U.S.

A LETTER OF MARCUS ANTONIUS KAPPUS TO EUSEBIUS FRANCISCUS KINO (SONORA IN1690) Tomaž Nabergoj INTRODUCTION The life and work of the Slovene Jesuit, Marcus Antonius Kappus (1657 -1717) who, three centuries ago, worked as a missionary in Sonora, north-west Mexico, has, in recent years, been the subject of several short studies in Slovenia. In this journal, Professor Janez Stanonik has, so far, published five letters which Kappus sent home to his relatives and friends, and one letter which he sent to hi s friend in Vienna, 1 as well as a study on the collection of poems (276 chronograms) in Latin, which Kappus published in Mexico City, in 1708, entitled IHS. Enthusiasmus sive solemnes !udi poe tici. 2 Prompted by the above publications, the author of this paper spent a month in Sonora while journeying in Mexico in 1991. In Archivo General de la Naci6n (the general Mexican archives) in Mexico City, he happened to find another letter written by Marcus Antonius Kappus. The letter comprises two A4 pages and is kept in Archivo Hist6rico de la Hacienda, legajo 279, expediente 19.3 This, hitherto unpublished document, was written by Kappus on 25th November 1690, in Cucurpe, and is addressed to Eusebius Franciscus Kino, his superior. Chronologically, it is one of his earliest preserved letters. Among those so far published, as far as we know, it is the only one preserved in original. At the same time this is Kappus' second earliest preserved letter written in Sonora. The first he wrote in Cucurpe, on 30th April 1689, to his aunt Francisca Adlmann in Škofja Loka, Slovenia.

    Emerging Paradigms in Critical Mixed Race Studies G. Reginald Daniel, Laura Kina, Wei Ming Dariotis, and Camilla Fojas Mixed Race Studies1 In the early 1980s, several important unpublished doctoral dissertations were written on the topic of multiraciality and mixed-race experiences in the United States. Numerous scholarly works were published in the late 1980s and early 1990s. By 2004, master’s theses, doctoral dissertations, books, book chapters, and journal articles on the subject reached a critical mass. They composed part of the emerging field of mixed race studies although that scholarship did not yet encompass a formally defined area of inquiry. What has changed is that there is now recognition of an entire field devoted to the study of multiracial identities and mixed-race experiences. Rather than indicating an abrupt shift or change in the study of these topics, mixed race studies is now being formally defined at a time that beckons scholars to be more critical. That is, the current moment calls upon scholars to assess the merit of arguments made over the last twenty years and their relevance for future research. This essay seeks to map out the critical turn in mixed race studies. It discusses whether and to what extent the field that is now being called critical mixed race studies (CMRS) diverges from previous explorations of the topic, thereby leading to formations of new intellectual terrain. In the United States, the public interest in the topic of mixed race intensified during the 2008 presidential campaign of Barack Obama, an African American whose biracial background and global experience figured prominently in his campaign for and election to the nation’s highest office.

Banaji San Diego State University Harvard University American = White? 2 Abstract In six studies, the extent to which American ethnic groups (African, Asian, and White) are associated with the national category “American” was investigated. Although strong explicit commitments to egalitarian principles were expressed (Study 1), each of five subsequent studies consistently revealed that both African and Asian Americans as groups are less associated with the national category “American” than are White Americans (Studies 2-6). Under some circumstances, a complete dissociation between mean levels of explicit beliefs and implicit responses emerged such that an ethnic minority was explicitly regarded to be more American than were White Americans (e.g., African Americans representing the U.S. in Olympic sports), but implicit measures showed the reverse pattern (Studies 3 and 4). In addition, Asian American participants themselves showed the American = White effect, although African Americans did not (Study 5). Importantly, the American = White association predicted the strength of national identity in White Americans: the greater the exclusion of Asian Americans from the category “American,” the greater the identification with being American (Study 6). Together, these studies provide evidence that to be American is implicitly synonymous with being White. American = White? 3 American = White? In 1937, the Trustees of the Carnegie Corporation of New York invited the Swedish sociologist Gunnar Myrdal to study the “Negro problem” in America. The main message from Myrdal’s now classic study was captured in the title of his book, An American Dilemma (1944). Contrary to expectations that White Americans would express prejudice without compunction, Myrdal found that even sixty years ago in the deep South, White citizens clearly experienced a moral dilemma, “an ever-raging conflict” between strong beliefs in equality and liberty for all and the reality of their actions and their history.
