Book I General Norms, Accountability and Ecclesiastical Processes §400 OTHER LAWS §401 INCORPORATION BY REFERENCE 401.1. Policy Diocesan Policies and Procedures ordinarily shall not restate the universal laws of the Church, e.g., the Code of Canon Law, nor include specific local policies which apply only to the internal operations of an Diocesan office or agency. Such policies and procedures shall be incorporated by reference in the Diocesan Policies and Procedures. §402 FEDERAL AND STATE LAWS 402.1. Policy The Diocese of Springfield in Illinois shall follow all applicable civil laws, in so far as they are not contrary to divine law and unless provided otherwise in canon law. (Canon 22). Procedures a) The determination of whether any applicable civil laws are contrary to divine law or canon law is normally made by the Bishop in consultation with the Chancellor, the Vicar General, and the Office of Legal Services and Policy Development. b) The following examples illustrate the rare but not impossible nature of such exceptions to the general rule that civil laws are always to be followed: 1) If federal health care legislation required all physicians and hospitals, whether public or private, to perform abortions, clearly canon 1398 would require Catholic physicians and hospitals to disobey this law. 2) If a city ordinance required all schools, whether public or private, to distribute contraceptives, Church teaching would require Catholic schools to disregard such a law. Note This policy was enacted to cover the numerous laws and regulations that are not mentioned in Diocesan policy books, but which the Diocese recognizes and follows. Some civil laws will be covered in these books because of their importance and frequency of application in the Diocese. [400] - 1 Effective 03-21-2019 .

Everyone is an expert, claiming that prochoice Catholics are “heretics” or have been “excommunicated” because they have had an abortion or have supported legal abortion. Such finger pointing may be politically useful, but it is not an honest way to deal with differences of belief about abortion. What does the church’s law really say about abortion? Beal June 21, 2004 When Cardinal Francis Arinze, prefect of the Vatican Congregation for Divine Worship and the Sacraments, was asked at a press conference in Rome on April 23 whether Senator John F. Kerry should be denied Communion, he responded: “The law of the church is clear. The church exists in the United States. There are bishops there, let them interpret it.” The flurry of conflicting statements prompted by the cardinal’s remark suggests that the law relevant to determining who can be barred from the reception of Communion may be clear, but its applicability to Senator Kerry (or any other politician) is not. Church Teaching and Politics The church’s magisterium has emphasized that politicians are not free to leave their moral principles in the cloakroom when they go to the floor of the legislature, or on the bus when they espouse public policy positions on the campaign trail. Pope John Paul II has clearly stated that all citizens, and by implication public officials, have “a grave and clear obligation to oppose” any law that attacks human life (Evangelium Vitae, No. 73). In a doctrinal note issued in 2002, the Congregation for the Doctrine of the Faith gave the pope’s directive particular application to public officials. The note quotes from Evangelium Vitae (No. 73), “For them, as for every Catholic, it is impossible to promote such laws or to vote for them,” and then comments that nevertheless, when the politician’s personal opposition to abortion is a matter of record and it is impossible to overturn laws allowing abortion, it is permissible for politicians, as Evangelium Vitae says, “to support proposals aimed at limiting the harm done by such a law and at lessening its negative consequences at the level of general opinion or public morality.” In fact, most Catholic politicians in the United States more or less clearly assert their personal opposition to abortion, but this personal opposition is rarely put to the test in straight up-or-down votes on abortion or other life issues.

SECTION I SACRAMENTS POLICIES AND PROCEDURES Priests, deacons and pastoral ministers of the Diocese of Rockville Centre serve parishes and institutions through sacramental ministries. The following sections of the Pastoral Manual are offered to assist them in serving the faithful. They are a general guide and are not meant to be exhaustive in nature. The disciplines of the universal Church and the specific policies of the Diocese of Rockville Centre are summarized below. Note that this section is preceded by a table of contents. The general index at the end of the Pastoral Manual may also be helpful. For a more complete treatment of these sacraments, reference should be made to the 1983 Code of Canon Law which contains legislation for the universal Church; the rite for each sacrament also explains the details of sacramental celebration. Diocesan policies and procedures are coordinated by the Chancellor’s Office. Often parishes have their own sacramental policies which assist Church ministers in serving their parishioners. ARCHDIOCESE OF SAINT PAUL AND MINNEAPOLß CLERGY BULLETIN l.fLay 26120ll Pagella of Faculties, Revised FACULTIES FORPRIESTS With due regard being given for the diversity of Orders, the faculties of priests are to be interpreted in the light of the general and specific norrns given in the Code of Canon Law andthe particular law of the Archdiocese of Saint Paul and Minneapolis. The provisions of the Code of Canon Law state that priests 'share in the priesthood of Christ and, as his ministers under the authority of the Bishop, are consecrated to celebrate divine worship and sanctiff the people' (canon 835, $2). The Code also reminds us that 'Liturgical actions are not private but are celebrations of the Church itself as the 'sacrament of unity', that is, the holy people united and ordered under the Bishops' (canon 837, $l). Moreover, 'since clerics all work for the same purpose, namely, the building up of the Body of Christ, they are to be united among themselves by a bond of brotherhood and prayer and are to strive for cooperation among themselves according to the prescripts of particular law' (canon 275). The following Pagella Facultatum consists of a discussion of those faculties granted to priests and deacons by law, ipso iure, and those delegated them by the Bishop. They extend to an ordained minister the authorization additional to their ordination which is needed to perform certain functions. Therefore, it is important to note that certain actions may not be valid unless they are performed by a cleric with the proper faculties. They may extend to the authority of the cleric in his exercise of the teaching, sanctifying, and ruling roles he has obtained by virtue of ordination. There are also included at the end several notes on matters of specific importance to the priests and deacons of this Diocese. In this document, “priests” and “deacons” refers to only those priests and deacons with canonical assignment and in good standing in the Diocese of Phoenix, and extern priests and deacons who have been granted temporary approval to minister within the Diocese of Phoenix. Retired priests and deacons in good standing and incardinated in this Diocese or who have been approved by the Bishop to minister within the Diocese are granted these faculties and permissions Unless otherwise specified, “cleric,” “clergy,” or “sacred minister” refers to both priests and deacons.

Tseday Gizaw Hailu King’s College London, uk [email protected] Abstract The Holy See ratified the United Nations Convention on the Rights of the Child (crc) in its dual personae as the government of the Catholic Church, and as the government of Vatican City State (vcs). The extent of the Holy See’s obligations under the crc in its former capacity is a current international debate, and the focus of this paper. The Committee on the Rights of the Child in its recent review process concluded that by ratifying the crc, the Holy See committed to its implementation, not only within the territory of vcs, but worldwide on behalf of Catholics “under its authority.” Con- versely, the Holy See restricts its duty to that of the transmission of moral principles recognised in the crc to all people. This paper critically reviews the Committee’s con- cluding observations on the Holy See’s second periodic report, and ends by presenting possible alternatives to the Committee’s recommendations. JANUARY 29, 2019 Bishops Wring Their Hands at the Whirlwind of Hell MONICA MIGLIORINO MILLER (Photo credit: Cuomo and Dolan at Columbus Day Parade, 2018 / Shutterstock) Several years ago, after a course I had taught on Church history, my students presented me with a gift. It was an eight-inch-tall action figure of Pope Innocent III they had purchased from a novelty store in Frankenmuth, MI. A pope of the thirteenth century, Innocent III—besides approving the Rule of St. Francis—is known for calling the Albigensian crusade. This odd children’s plaything came with a short biography which included: “Action-figure’s Weapon of Choice: Excommunication.” On January 22, appropriately and deliberately timed for the 46th anniversary of Roe v. Wade, the New York state legislature passed the “Reproductive Health Act” (RHA). It was immediately and happily signed into law by Catholic governor Andrew Cuomo. Abortion-on-demand was already permitted in the state through the sixth month of pregnancy, but the revision now permits the killing of the unborn through the ninth month, not only for the life, but even the health of the mother. The health of the mother doesn’t mean a serious threat to physical health. Consistent with Roe’s companion case Doe v. Bolton: “medical judgment may be exercised in the light of all factors—physical, emotional, psychological, familial, and the woman’s age—relevant to the wellbeing of the patient. All these factors may relate to health.” The new law is radical in that other health care professionals besides licensed physicians may perform abortions.
