(Joint Administration Requested) CERTIFICATION OF DEBTORS’ CONSOLIDATED LIST OF CREDITORS In accordance with Rule 1007(a) of the Federal Rules of Bankruptcy Procedure and Rule 1007-2(a) of the Local Rules of Bankruptcy Practice and Procedure of the United States Bankruptcy Court for the District of Delaware (the “Bankruptcy Rules”), a joint list of creditors (the “List”) of the above-captioned debtors and debtors-in-possession (the “Debtors”) in the above-captioned chapter 11 cases (the “Chapter 11 Cases”) is filed by attachment hereto. The List has been prepared from the Debtors’ books and records. The undersigned hereby certifies that the List contains the names and addresses of all creditors of the Debtors that could be ascertained after diligent inquiry, based on a review of the Debtors’ books and records, and is consistent with the information contained therein. To the extent practicable, the List complies with Local Bankruptcy Rule 1007-2(a). The Debtors reserve the right to amend or supplement the List as necessary. Although the information contained in the List is based on a review of the Debtors’ books and records, the Debtors have not completed a comprehensive legal and/or factual investigation with regard to possible defenses of the Debtors and their estates to any claims of the potential claimants included in the List. Currently, a singular, localized weather station collects useful information on patterns that can be used for indicators, yet the data requires manual processing and there is not a system in place to report the findings. The current method of information transfer is in person during weekly meetings which can be ineffective and inconsistent. In continuation of a previous project focused on sharing water quality information, our mobile application acts as a platform for leaders to share valuable weather indicators with members of the community in real time instead of on a weekly basis.

  • VTA's BART Silicon Valley—Phase II Extension Project Draft SEIS/SEIR
    Chapter 10 Agency and Community Participation Over the years, a number of environmental studies have been prepared for VTA’s BART Silicon Valley Program. A combined Draft Environmental Impact Statement/Environmental Impact Report (Draft EIS/EIR) and Draft 4(f) Evaluation was released for public comment in March 2004 and addressed the 16-mile BART Extension. However, VTA suspended the NEPA process but continued the CEQA process, and the VTA Board of Directors approved the Final EIR in December 2004. VTA certified a Final Supplemental EIR for the project in June 2007. A Draft EIS was released for public comment in March 2009, and a Final EIS was published in March 2010. The Draft and Final documents included three alternatives: a no-build project, a 10-mile project, and a 16-mile project. On June 24, 2010, the Federal Transit Administration (FTA) issued a Record of Decision (ROD) approving the 10-mile project from Warm Springs to Berryessa—designated the Phase I Berryessa Extension Project. This decision formally approved Phase I to move forward into detailed design and construction. The current Supplemental EIS/Subsequent EIR (SEIS/SEIR) now analyzes the remaining 6 miles of the original 16-mile project that was analyzed in the 2009 EIS, now called Phase II. Refer to Chapter 1, Purpose and Need, Section 1.4, BART Extension Project History, for a full description of the history of the Bart Extension. This chapter describes agency and community participation conducted for the Phase II Project during the preparation of this SEIS/SEIR. Adopt a Resolution authorizing the purchase of the 23760 Alamitos Road, LLC property at a cost of $2,800,000 with corresponding authorization for a Fiscal Year 2017-18 budget increase of the same amount. 3. Adopt a Preliminary Use and Management Plan for the property, as set out in the staff report. 4. Withhold dedication of the 23760 Alamitos Road, LLC property as public open space. 5. Authorize the Acting General Manager to enter into a grant agreement with the Gordon and Betty Moore Foundation to receive $750,000 for property acquisition costs. SUMMARY The Midpeninsula Regional Open Space District (District) has an opportunity to purchase the 153.59-acre 23760 Alamitos Road, LLC property (Property) at a price of $2,800,000 as an addition to Sierra Azul Open Space Preserve (Preserve). The property offers high natural resource, wildlife connectivity, and trail connectivity value and the potential to recover sensitive riparian habitat through creek restoration work. Time is of the essence and avoidance of a foreclosure sale is why this item is coming to the Board of Directors at this time to allow the District to enter into a purchase agreement.
