1. Consent agenda: Items on the consent agenda may be removed and discussed separately. Otherwise, all the items may be approved with one action. (a) Approve minutes: March 28, 2000. (b) Acknowledge and file warrants for the period ending March 31, 2000 in the amount of $702,830.17. ( c) Approval and second reading of an ordinance adopting regulations for the issuance of commercial filming and still photo permits. ( d) Acknowledge and file report on the notification procedures for the proposed Millenium Playground at Memorial Park.

2. Appoint members to the Arts Commission and Planning Commission.

3. Appeal of Planning Commission's denial of design review and variance requests for a 2,840 square foot dwelling and 535 square foot garage on a 9,621 square foot parcel, 148 Oak Avenue, AJP Nos. AJP 7-273-30 and 7-273-31, applicant/appellant Bill Johnson.

4. Oral report from the Council representatives to the Marin Town & Country Club Planning Committee.

5. Adjourn

RECOMMENDATION

That the Town Council waive the second reading and adopt the Ordinance Adopting Regulations for the Issuance of Commercial Filming and Still Photography Permits.

BACKGROUND

At March 28, 2000 meeting, the Council introduced the Film Ordinance and continued the item to this meting for final adoption.

Highlights of the new Film Ordinance include a two-pronged administrative permit process, one for the more disruptive film and motion picture requests and a second permit process for the less obtrusive still photography shoots, and associated noticing procedures for each type of request. The Ordinance also includes conditions under which a permit can be denied by the Film Coordinator, as well as an appeals procedure. And finally the Ordinance identifies certain types of filming activity that are exempt from the provisions Ordinance.

AN ORDINANCE OF THE TOWN OF SAN ANSELMO ADOPTING REGULATIONS FOR THE ISSUANCE OF COMMERCIAL FILMING AND STILL PHOTOGRAPHY PERMITS

The Town Council of the Town of San Anselmo does hereby ordain as follows:

Section 1. DECLARATION OF PURPOSE

The Town Council of San Anselmo hereby finds:

1. Current provisions of the Home Occupation regulations within the Zoning Ordinance of the San Anselmo Municipal Code are prohibitive with regard to commercial filming activities throughout the Town, and without these regulations, there are no other standards or conditions by which to regulate commercial filming;

2. Issuance of a business license for commercial filming would be inconsistent with the Home Occupation regulations;

3. To protect the public safety, peace, health and welfare, and to allow continuation of ongoing legitimate business activities it is necessary regulations be adopted;

4. The regulations herein adopted shall not be subject to the Home Occupation regulations or any other zoning regulation of the Town of San Anselmo.

Section 2 DEFINITIONS

1. "Minor Still Photography" includes photography for the purposes of commercial advertising with a crew consisting of no more than five (5) members and two vehicles.

2. "Motion Picture and Commercial filming" includes filming, video taping, photographing or other similar process conducted for the making of motion pictures, television programs, video commercials, and non-theatrical productions and similar activity.

3. "Still Photography" includes photography for the purposes of commercial advertising with a crew of six (6) or more and vehicular traffic of three (3) or more vehicles.

4. "Vehicle, essential" includes large production vehicles such as motor homes, equipment trucks, trailers, generators and other vehicles that are required to be parked at the shoot location. 5. "Vehicle, non-essential" includes crew cars, craft service, shuttle vans and other vehicles that are not essential to the filming activity and can be parked at an offsite location. Section 3. APPLICATION FOR PERMIT

1. Motion Picture and Commercial Filming. The following regulations shall be enforced on all motion picture and commercial filming permit requests made to the Film Coordinator, to be designated by the Town Administrator, of the Town of San Anselmo.

a. Hours of Filming Activity including setup and dismantling of equipment: 7:00 a.m. -7:00 p.m., Monday through Friday. Any request for extended hours must be made at the time of application submittal and must include a signature survey per section 3-1 (g) of the neighborhood acknowledging the extended hour request.

Saturday filming may be permitted with a signature survey per section 3- l(g).

Sunday and Holiday filming may be permitted with a signature survey of property owners within non-residential areas, and on school property.

b. Filming activity at a single residential site shall not exceed a maximum of three (3) consecutive workdays or a maximum of six (6) days in six (6) months. Additional consecutive days may be permitted with a signature survey per section 3-l(g) of the neighborhood acknowledging the additional days of filming.

c. Filming and all related activity shall not exceed noise levels permitted by Chapter 7 of Title 4 of the San Anselmo Municipal Code.

d. Filming and all related activity within residential neighborhoods shall not generate additional vehicular parking of more than eight (8) essential vehicles and six (6) non-essential vehicles. Additional vehicles shall park at a satellite location from the filming site.

e. A parking plan shall be required for all motion picture and filming permits at the time of permit application for approval by the Police Department and the Film Coordinator. The parking plan shall indicate the parking locations of all essential vehicles and indicate the offsite parking location(s) of non-essential vehicles.

f. Notification letter to all occupants and business owners within 300 feet of the film location must be hand delivered at least seventy-two (72) hours prior to commencement of filming activity. The Town-approved notification letter must be typed on film company letterhead with the local telephone number of the company noted, as well as a contact telephone number for the Town of San Anselmo. The Code of Professional Responsibility and Good Neighbor Code of Conduct shall be attached to the notification letter.

2 g. When a signature survey is necessary for a permit approval, the survey shall clearly state the purpose of such survey including that section of the ordinance for which an exception is requested. The signature survey shall contain a minimum of seventy (70) percent of the neighbors' signatures of no less than five consecutive properties on both sides and across the street of the subject property.

2 Still Photography Permits. The following regulations shall be enforced on all still photography permit requests made to the Film Coordinator, to be designated by the Town Administrator, of the Town of San Anselmo.

a. Hours of Still Photography activity including setup and dismantling of equipment: 7:00 a.m. -7:00 p.m., Monday through Friday.

Saturday Still Photography may be permitted with signature survey approval of three properties on both sides and across the street of the subject property.

Still Photography may be permitted on Sundays and Holidays with a signature survey at non-residential locations and on school property.

b. Still Photography activity at a single residential site shall not exceed a maximum of three (3) consecutive days or a maximum of twelve (12) days in six (6) months. Any increase above the maximum twelve days (12) may require a signature survey.

A property owner may file an Annual Signature Survey with the Town and be granted up to a maximum of eighteen (18) days per six-month period. The Annual Signature Survey shall only allow an increase to the number days allowed per six-month period and shall not be accepted in lieu of any other signature survey requirements.

c. Still Photography and all related activity shall not exceed noise levels permitted by Chapter 7 of Title 4 of the San Anselmo Municipal Code.

d. Still Photography and all related activity within residential neighborhoods shall not generate additional vehicular parking of more than five vehicles, of which two (2) may be equipment truck/trailers and/or motor homes. Any increase in vehicle activity, including additional passenger cars shall require submittal of a parking plan at the time of permit application for approval by the Film Coordinator. A signature survey for any increase in parking may also be required.

3 Section 4. PERMIT APPROVAL/DENIAL

The Film Pennit shall be approved by the Film Coordinator unless (s)he detennines, from consideration of the application or other pertinent infonnation, that any of the following conditions exist:

I. The filming activity will substantially disrupt the use of a street at a time when it is usually subject to traffic congestion, or interfere with operation of emergency vehicles in the proposed pennit area.

2. The location of the filming activity will substantially interfere with street maintenance work, or any previously authorized pennitted work.

3. The proposed pennit location is on town-owned property and the filming activity will substantially interfere with municipal functions, or other previously authorized activities on town property.

4. The filming activity creates a substantial risk of injury to persons or property.

5. The applicant failed to complete the application after being requested to do so, or the infonnation contained in the application is found to be false in material detail.

6. The particular filming activity would violate federal, state or local law including license/pennit requirements.

7. The filming activity will be umeasonably disruptive to the nonnal activity of the street or neighborhood.

When the grounds for pennit denial can be corrected by imposing reasonable pennit conditions, the Film Coordinator shall impose such conditions rather than denying the permit.

SECTION 5. PERMIT REVOCATION AND SUSPENSION

The Film Coordinator may revoke the film pennit if the pennittee, or any agents, employees, volunteers, or contractors of the pennittee fail to comply with the conditions and requirements of the pennit or this chapter, or if it is detennined after issuance that the permit application is materially false. The Film Coordinator shall provide the pennittee with the grounds for revocation in writing within a reasonable time of revocation.

Any pennit issued pursuant to the tenns of this ordinance shall be subject to immediate suspension by the Town if it is found necessary for the protection of the public health, safety, or general welfare.

SECTION 6. APP~ALS

The pennit applicant may appeal a pennit denial, permit condition, or pennit revocation or refusal to waive a deadline under this chapter by filing an appeal within ten days with the Town Clerk as outlined in Section 1-4.02 of the San Anselmo Municipal Code.

4 SECTION 7 EXEMPTION

The following shall require a business license but shall be exempt from the provisions of this ordinance:

1. Minor Still photography or staging thereof, when conducted to the exclusion of any other filming activity and when the still photography will not generate the parking of more than two vehicles of which one may be a truck or motor home within the neighborhood.

The following shall be exempt from all Town of San Anselmo regulations:

2. Filming Activities conducted for news purposes as defined in Section 6-6.02(g) of the San Anselmo Municipal Code.

3. Filming Activities conducted for use in a criminal investigation or civil or criminal court proceeding.

4. Non-commercial Filming Activities conducted solely for private or family use.

5. Filming Activities conducted by or for the Town or for any public access or governmental programming channel.

Section 5. EFFECTIVE DATE

BACKGROUND

At the March 28 meeting, the Town Council requested an update of the notification procedures for the proposed Millennium Playground at Memorial Park.

STAFF COMMENTS

The Planning Commission held a workshop on the project at their February 28, 2000 meeting to review the conceptual drawings. This was noticed as a Planning Commission workshop, members of the Committee were at the meeting, and public input was very minimal.

A noticed public hearing on the project and related environmental documentation (Negative Declaration) has been scheduled for the April 17, 2000 Planning Commission meeting. The public hearing process requires notifying property owners within 300 feet of the project site. However, because of the high visibility of this project and the level of Community involvement, staff made a determination to send notice of the April 17th meeting to an expanded mailing list. The attached maps indicate the required 300 feet area and the actual area to which notices were mailed. The expanded list includes all of San Francisco Boulevard and the neighboring streets of Los Angeles Boulevard, Monterey Avenue, and Santa Barbara Boulevard.

Additionally, a letter to same mailing list will be hand-delivered prior to the April 17th Planning Commission meeting with an informational timeline of all activities pertaining to the five-day building period. A request for donations and volunteers will also be included in the letter.

Our main mission was to find ways to provide art classes to underprivileged children in the area, as well as, art programs in the public schools. The Committee formed a liaison with a local non-profit art center and through grants and community funding formed CAP, Children's Art Programs.

Reasons for seeking this appointment: Last October my wife and I chose to settle down and develop roots in this beautiful town of San Anselmo because it is where we would like to see our son raised. I feel that I have a lot to offer the community, being an architect in the Bay Area for four years, and serving as a volunteer for the Town of San Anselmo would provide a venue for which I could do this.

What are your qualifications for this appointment: Being a resident and having my own business in San Anselmo, I am concerned with neighboring development and growth of our area. I have worked directly with a well-respected Marin architect, Donald K. Olsen, in the design, construction document and construction phases of numerous residential, restaurant and commercial office projects in this area for three years. I can readily understand proposed projects and mediate. I have experience working with City Planning Departments throughout Marin County.

Briefly, what do you consider to be the most important one or two current issues facing this Board/ Commission/Committee? As growth spreads north of San Francisco, property owners rights to develop their properties under current roning regulation versus the issues of neighborhood density and quality is something all towns in Marin are facing. We have seen this handled poorly in some areas of Marin where density has overtaken the hillsides. Other areas, however, have.handled the pressure of development with well thought-out growth. San Anselmo is currently feeling an onslaught of pressure to grow to the next level. One example might be the proposed six house development on Redwood Road. How San Anselmo handles the transformation of cottages and vacant lots into family homes will decide the quality of life in San Anselmo in the years to come.

Background of Planning Commission Action

• March 20. 1999: Applications denied on the grounds that "The building is still too tall as viewed from below. Through the Commission's efforts with the applicant, he has reduced the ridge height, but not the plate height, and the size of the dwelling has not changed." The original proposal for the dwelling roof peak was 33' above average grade, which has been reduced to 27'.

• March 6. 2000: Applications referred back with comments: the garage can be supported as designed; explore cutting into the hill and looking at a different configuration; lower the pitch and bring the plate down to 8 feet; the overall height should be reduced 6 to 7 feet (2 to 3 feet is not enough).

• February 7. 2000: Applications continued due to lack of determination: vote of 2 in favor and 2 opposed.

• January 18. 2000: Applications referred back for a complete landscaping plan with additional landscaping and large specimen trees; and a shadow study (winter solstice).

• December 6. 1999: Applications referred back to reconsider the size of the house, consider the drainage, a debris fence, complete landscape plan, driveway widening, and trim color. 3, Discussion of Appeal

The applicant notes that the house is dug 7' into the hill, and since the original submittal, the roofline has been reduced in height between 2.5' and 6', two roof dormers have been removed, the trim color has been adjusted from white to green, and the rear decks have been modified to save existing trees.

· The Planning Commission's position was that due to a 75' + difference in elevation between the roof peak of the proposed dwelling and the neighboring dwellings below on Vine Avenue,· reducing the dwelling height by adjusting the roof pitch is not as effective in reducing bulk as reducing the plate height of the walls. Note: plate height is the top of the wall on which the floor above or roof rafters lie. In this case, the plate heights are proposed at 9'.

Recommendation

Should the Town Council wish to grant the appeal and thereby approve the project as 1 presented, then this matter can be continued to the next meeting on April 25 h for staff to prepare a Resolution.

Dear Council members;

I have been through five design review sessions in my attempt to obtain approval to develop my families property at 148 Oak Ave. I have very little neighborhood issues with the exception of the visual impact on # 11 Vine Street just below one of the 2 lots I am building on.

Through these design review sessions I feel my architect has effectively mitigated all the issues discussed by the planning commission considering the restraints of this downslope lot. The home is dug 7 feet into the hill at the living room level. The roofline is now far below the level of the road. To reduce the mass he has removed 2 large roof dormers one 8 feet and the other 4 feet at the back of the house. He has dropped the roof height by 6 feet over the family room and 2.5 feet over the living room. The home is now well under the hillside zones height limit. He has adjusted the color scheme. Went from white window trim to green. He has revised the rear decks to save all the existing trees on the site. (No trees are being removed for this home for construction). The neighbors down at # 11 Vine are completely screened from this building except for one area where I am adding a large boxed Oak tree, and 18 foot high hedge screen.

The culmination of these revisions is that all the neighbors and planners like the design and concept of this home. I had a split vote 2 for and 2 against before there. were 5 commissioners. The fifth vote was for denial because I did not further drop the elevation of the house deep enough into the ground; (more than the 7 feet at the living room level). This 2800 sq. ft. home is very much in keeping with the size and style of the homes in the neighborhood. I am merging two 50 xl 00 foot lots to create one building site; the two neighboring homes are on 50 x 100-foot lots. The height and mass of this home are stepped down the hill with three sections, the garage and one bed/bath below it, next the kitchen/family and dining room, then two and a half feet lower is the living room area. The challenge on a downslope lot is always the backside of the house and its mass and height. The architect has effectively dealt with both the height and stepped the levels of the house down the hill to break up the mass.

I am sincerely sorry that this matter has had to come before you and could not have been worked out at the design review level. The attempts to gain approval were very successful in reducing the mass and screening. However the 2800 square foot size was a ideological problem for one of the commissioners as a 'trophy size home' and I was unable to alleviate that concept with him. I hope you will support my desire to develop my property in this manner and let me move on to construction this spring.

Ms. Wight presented the staff report.

Bill Johnson, applicant, said he was requested by the Commission to lower the height and push the house farther into the hill. His architect felt that the 9' plate height was very important with a 4: 12 roof pitch. The Commission wanted the house lowered 6' to 7'. There is a 7-foot cut at the bedroom for the crawl space. The living room has also been lowered by 2 Yi' since the last meeting. He put in two skylights in the kitchen/family room area and has removed the dormer windows. He does not believe that the size of the house is out of out of scale with other houses in the- neighborhood. The change in roof pitch will be similar with the pitch of the garage roof.

Commissioner Jochum asked what the elevation was at the lower floor where grade hits the building:

Mr. Johnson responded that finished grade at the bedroom is 452.5'elevation. He also stated that the story poles do not indicate the current reduction in height. He noted that he does not want to reduce the 9' plate height because it is fairly standard with today's construction and provides more light and air.

Donna Horn, 11 Vine Avenue, stated that she was happy to see the skylights in place of the dormer windows. She thought the consensus of the Commission at the last meeting was to reduce the overall height as well as size but that does not appear to have happened.

Mr. Johnson said the garage is set apart from the house and they are two separate elements, which breaks up the mass. There is also a lot of vegetation to screen the house.

Commissioner House said she appreciates the changes that have been made. On the other hand, the house still feels very tall looking up from Vine Avenue. It is a nicely designed structure but it is just so tall. She . has no issues with the garage.

Commissioner Jochum said he does not feel the size of the house is too large or to wide but was disappointed in the lack of an attempt to reduce the height and sink the house into the hill to mitigate the height am;l mass of the structure from below. It is hard to tell just what the current changes will have on the lot below but his feeling is that it will be negladgeable because the ridgeline will probably not be seen from the house below. At the last meeting he asked for the height of the building to be reduced by 6' to 7' and that has not changed. Therefore, he cannot support the project.

Commissioner Zwick said that he understands the floor plan is very important because this is a spec house. Unfortunately, they are sold by the square foot. There are many issues with this house and while the square footage is not at the limit, the mass and bulk of this house on a visible and steep lot is too intrusive. The site drives the house to be responsive in terms of size to the site. Working within the terrain is very important. He is behind the height variance for the garage. The house has been decorated quite well but he is still concerned about the mass and bulk of the house looking up from below on Vine. The Commission asked the applicant to make size adjustments and the applicant decided not to reduce the house size.

Chair Cronk said she is in support of the applicant and wanted to thank the applicant for the adjustments that have been made since the first hearing on this matter. She felt the adjustments do make a significant difference. She also supports the articulation of the house and garage.

Ms. Wight provided a brief overview of the project.

Bill Johnson, applicant, said this is a new house on a 10,000 square foot lot. Two lots are being merged. The house is 2,875 square feet and they are providing 5 off-street parking spaces. In reviewing the project, some of the criticism is that the house is not stepped down the hill and the house is too tall. It is difficult to situate the house without coming out with a one-story house. The garage structure is farther up from the house, which reduces the width of the project. The house is stepped down 12' from the garage. The house has been articulated without stretching it down the hill and there will be about 45 feet of greenbelt below the house. The dormers have been removed. Lowering the garage would require the roof to be flat. Driving by the house the only structure that will be seen is the garage. Therefore putting a flat roof on the garage would not be aesthetically pleasing. The drainage has been taken care of and the runoff will go into the storm drain on Vine Avenue, and has been approved by the Town Engineer. There is a lot of vegetation that will screen the downslope neighbors and he is adding an oak tree. They have redesigned the decks to preserve the oaks. The shade study was done in January and the study indicates that the downhill neighbor will not be impacted but it will block the back of the property line for a few months of the year. He noted that the FAR is 29.5 but the lot coverage is only 25%.

Donna Ford, 11 Vine Avenue, wanted clarification on the dormer. She was under the impression that they were removed and that the roof would not have windows in it and yet the plans still indicate the windows would remain. She would like the windows and dormers removed so it would not be so imposing. This property is a very imposing house to all the other properties on Vine A venue.

Mr. Johnson responded that the dormer that is left acts as a skylight and will allow light to come in. Also, it is over the breakfast bay and looking up, all you will see is the deck.

Commissioner Zwick said that the house would have an impact from various places on various lots. In this case the house is 3,375 square feet, with the exception of 500 square feet for a garage. He thought it would be easier to fit on the site if it were smaller. However, the applicant was not willing to do this because it is a spec house. Tucking the bedroom under the garage does hide some of the mass. He wanted the applicant to explore cutting more into the hill and look at a different configuration on the hillside. The applicant was not cooperative. He does agree with the garage height because it looks better. If this house was built on a site that was flat and screened by trees, then going to the maximums - it might be acceptable. However, on a steep slope and the impact to the neighbors, it is difficult to support.

Commissioner House said she stood down the street and looked up at it; the top of the story pole appears very high. She tried to visualize the surface and she felt it would be looming. She can support the garage and the idea of tucking the room under the garage but she just can't beyond how tall it is. For those reasons she cannot support the project.

Commissioner Jochum said the design overall is fine and they are using quality materials. He had no problem with that. He has no problem with the size of the house it is just the mass that it produces and the relationship to the houses below. His first impression is to bring the house down into the hill, which does add significant cost. He would like to see the house tucked as much as possible. With regard to the

applicant's comment that the house is a Craftsman style house, because of the slope of the roofs the house is really contemporary and not a Craftsman style house. He could see lowering the pitch and bringing the plate down to 8'. It is a quirk of the Zoning Ordinance but the perception from below the house is very massive. He could support the project if it came down in height. The garage structure does not appear to be a problem and he can support the garage roof because he does not want to see a flat roof. The main bulk of the house causes the problem. In summary, he does not support the project at this point and would want the house to come down significantly, 6' to 7'; 2' to 3' would not be enough.

Chair Cronk said she couldn't argue with the points made from the other Commissioners about the height, bulk and mass issues ..

Mr. Johnson asked for a vote by the Commission.

Ms. Wight stated that ifthe project is denied and the denial upheld by the Council, the applicant would not be able to reapply for the next six months unless the project is substantially different.

Based on Ms. Wight's comments, Mr. Johnson stated that he would prefer a continuance to the next meeting.

Ms. Wight presented the staff report

Blii Johnson, appiicant, stated he has iowered the mass by removing the third story dormers at the last meeting. He was not opposed to the green windows as suggested by staff and the landscape plan was augmented to have a more visual barrier with his property and that of 11 Vine. He did a shade and study evaluation of the site and presented photographs of the site, explaining each of the photographs in relationship to the shade study.

Commissioner Zwick wanted to know why the photographs were taken at different times and different places on the site. Mr. Johnson responded that he wanted to follow the sun.

Mr. Johnson went on to expiain that the house is not out of scale or character with the neighborhood. 400 square feet is under the garage and it is good utilization of space. In this case the house is not crowding the neighborhood. He cannot reduce the house without further building into the hillside. He is leaving all the trees on the site and has tried to be sensitive to the neighbors.

Donna Ford, 11 Vine Avenue, stated that she is the downhill neighbor from the proposed house. She said that she did not understand the light and sun study. She was also concerned that the pole had been moved. With regard to the dark green roofing material, she felt that in looking around the neighborhood, any houses that have green roofs would stand out and she would prefer brown because it would blend in. It would be nicer to have the green or brown windows on the outside. She asked if there is anything in the deed that states an owner cannot cut down any trees? $he also wants to have a construction retaining wail to hold back debris.

Tony Kits, 11 Vine Avenue, appreciates the applicant moving the roofline. He is. opposed to moving the house farther down the hill but can support this plan. He would aiso ilke some input in the type of landscaping that would be planted and would like to have a natural flow of vegetation through the spaces. He noted that it is still a really big house but there has been some modification. He has not made an observation about the roof color but he does want the window frames a subdued color so it does not stand out in the hillside. Regarding the shadow study, he is not sure how the house and shade will affect the landscape he has just planted. Fie appreciates the reduction in house size and the fact that he has retained the foliage on the site.

Mr. Johnson said he is happy to work with Mr. Kits on the landscaping.

Commissioner Wittenkeller stated that the response of the architect in lowering the roofline is a positive one and he was happy the downhill neighbor agrees. The size of the house doesn't offend him; 2,800 square feet is probably fairly average in San Anselmo. This applicant has met the Town requirements. He would like to see that the existing vegetation remains.

Ms. Wight commented that the Commission could require a deed restriction that no vegetation can be removed unless it is for heaith and safety reasons.

Commissioner Wittenkeller said that common sense has to prevail because the Town can't legislate everything. If the Fire Marshall feels a tree presents a hazard, the Town must defer to the SAN ANSELMO PLANNING COMMISSION MINUTES OF FEBRUARY 7, 2000

Fire Marshall. Therefore, he does not think the Commission can deny that from a future owner. Regarding the roof color, if a very dark green is used it could work, but perhaps should be reviewed at staff level. Trees should be protected during construction so he would require a tree protection plan. He also concurs that a construction debris fence should be erected to protect the downhill neighbor. The landscape plan is a good effort on a difficult site.

Commissioner Zwick stated that every square foot taken off the house is taking away from the amount of money made because it is a spec house. He was not in favor of the project. It is interesting because he would consider this precedent setting. He noted that many of the houses aiong Oak that wouid not be approved today. This house Is at 30% FAR. He does not see project as a benefit to the town to approve this. The story poles tell the story. The house would loom over the house below. Digging the house into the site is an acceptable option and breaking up the mass Is another alternative. Those things have not been done.

Commissioner House said that the design is nice and attractive but she is concerned about the size. It Is not In keeping with the Town to continue to approve the iarge houses over and over. On the other hand, it does meet all the codes. She is concerned about the size although she does appreciate all the things the applicant has done to mitigate the project.

Commissioner Zwick disagreed, he did not think this is the right size house for the site. He is willing to give on the garage height. The bulk of the house looms over the house below. He understands it would require a lot of redesign but he could not approve it in its currentdesign.

Ms. Wight stated that because of the State Streamiining Act, staff would need a ietter of continuance from the applicant. Mr. Johnson stated that he would be agreeable to the continuation to the next meeting.

Shadow Study: The applicant lowered the center ridge story pole to the 494' elevation height currently proposed (and proposed at the January 18, 2000 meeting) and placed a 2' by 3' rectangular board across.

Standing at the rear property line (elevation 400') at 1 p.m. on January 27, 2000, the sun was just above the board (elevation 494') and hit the applicant's eyes, which was approximately 5.5' above grade. Because the rear property line is approximately 68' North of his proposed roof peak, his assumption was that the sun would then be blocked approximately 10' over no. 11 Vine Avenue's rear yard (elevation 400'), so it does not reach the neighbor's house.

At 9:30 a.m. on January 27, 2000, the sun was to the East of the story pole, so there was no impact to the neighbor. At 3:30 p.m. on January 27, 2000, the sun was behind the hill above this property.

Landscape Plan: In addition to the existing oaks, other trees, and 25' tall bamboo, the applicant plans to plant the following near the rear wall of the dwelling, which rises 25' to the roof eave:

8:5-gallon Photinia Fraseri: evergreen shrubs up to 15' tall and wider 10: 1-gallon Rhododendrons

Ill. RECOMMENDATION

At the January 18, 2000 meeting, revised plans were reviewed and staff still did not recommend approval. Although the Planning Commission indicated concerns about the dwelling size, the applicant was only directed to prepare a sun study and landscape plan. As we are uncertain which direction the Commission plans to take, we have not prepared a Resolution of Approval. Should the Commission support the project, we will schedule it for the February 8, 2000 agenda with a Resolution of Approval.

Ms. Wight presented the staff report. She noted that staff received a letter from the owner of 11 Vine Avenue with concerns about the project. There are other is a petition that was signed by several neighbors but the author of the petition is unable to attend the meeting tonight and is asking for a continuance.

Bill Johnson, applicant, said one direction from the Commission was to step the house down the hill. He showed the proposal to the neighbors and they were not in support of lowering the house on the hill. The letters of protest from the neighbors is based on lowering the house on the site. He is also replacing a sewer line and the Johnson's have allowed him an easement. He stated that he is not removing any trees. The landscape plan adds more oak trees, and the intent is to screen his house from 11 Vine. Regarding the square footage, 155 Oak is 2,882 square feet; 181 Oak is 2,900 square feet; and the Hedin's new house is 3,600 sq. feet; his house is consistent in the neighborhood with 2,800 square feet and on a double lot.

Larry Walter, architect representing the applicant, said they take the comments of the neighbors very seriously. The downhill neighbors were concerned about the mass looking up. Some of the design elements make the house look even taller. You cannot see the roofline from below, although you would be able to see the eve line. What can be seen and what gives the impression of another story is the vertical line of the family room and the hip roof. There is a solid hedge of bamboo that screens the first floor. They dropped the ridgeline of the roof by lowering the pitch by 3', which makes the roofline virtually level to the road. They have also nested the house into the hillside. Regarding the lowering of the garage - it could only be done if they created a long driveway and turnaround. There is a natural break over to the driveway ramp and it is at the maximum now. He has lowered the plates in the garage to 7'6" and can do that by reconfiguring the truss in the garage. However, in this craftsman style, it needs the pitch that they have designed. He is unable to move the garage farther from the road without increasing the overall height of the house. To save the oak tree, they have altered the deck to wrap around the oak tree. It will also do a lot to soften the lower side of the house.

Mr. Johnson added that this house is 40' from one property line and 42' from another property line and the neighbors do not want the house moved down the hill. In addition, the efficiency of the floor plan is nice. He is open to green windows on the outside of the house as proposed by staff.

Donna Ford, 11 Vine Avenue, said that her son-in-law cannot make the meeting and wanted to ask for a continuance. They also want a shadow study because they do not have very much sun during the winter and she is concerned that this structure would take away more sunlight. She is more in support of the house being closer to Oak Avenue and does not support the idea of lowering the house closer to Vine. If the house were lowered on the lot, a very huge tree would also have to be removed. She asked that the applicant be required to install a construction fence to catch debris during construction. And still felt the size of the house should be reduced.

Bill Mitchell, 9 Vine, wanted to know who is responsible for any damage to soil instability, both during and after construction.

Mr. Johnson responded that he is responsible for any damage to the downhill neighbors during construction; after construction there will be adequate drainage to take water off site. 4 SAN ANSEL,.W PLANNING COMMISSION MINUTES OF JANUARY 18, 2000

Mr. Walter said that the house would not increase any shadow of the downhill house because there is already shade from the trees.

Commissioner Wittenkeller commented that the shade from the trees is completely different than the shade from the building.

Chair Z~ck said that if the same building were placed farther down the hill it is normal that the house would appear to be larger and more massive and the neighbors would have every right to object. He suggested that the design be reduced in size (e.g. make the structure narrower or break up the mass) and then change by moving it down the site so it would not be so massive. This proposal is about the same as was at the previous meeting. The detailing of the house and the craftsman style is handled nicely but the house still tends to be too large for the site.

Commissioner Wittenkeller said he is not particularly happy with the 2,800 square foot house on the ·lot and it could be made smaller. He does not necessarily think the house and garage should be pulled apart. He did not think lowering the garage would improve the overall character of the building because it would end up with a flat roof or a carport and a garage would be more of an asset to the neighborhood. If the roof were blocking a view it would be another consideration. The fact that some of the square footage is tucked under the garage helps minimize the mass. The architect has done a reasonably good job to lesson the mass by changing the roof shape. Planting, possibly large specimen trees would lessen the impact from the neighbors. He was not convinced everything has been done to be able to approve the project and he was not sure that reducing the house itself is the only answer. He also wanted additional landscaping and a shadow study prepared by the applicant.

Commissioner Cronk said her main objection was that it looked like a four-story structure; she is swayed by the architect's comments that they need the garage roof for character. She would like to see more changes made in the direction that was stated by Commissioner Wittenkeller.

Commissioner House concurred with the comments of Commissioner Wrttenkeller. It is a large house on a steeply sloped lot. Looking up from Vine, the story poles gives the impression of a very tall house. Because there are going to be people that are impacted, there is reason to continue the item. She would also like to see the window trim green but there was no need to reduce the garage height.

Some supported the white trimmed windows and others supported the dark green trim. It was suggested that separating the garage from the house would help reduce the high mass. The Commission also requested a complete landscape plan showing the existing and proposed species on the entire property relative to neighbors' privacy and views; more information on the drainage impact and consideration be given to tying in with the storm drain on Vine; and a heavy-duty debris fence be installed at the building permit stage.

II. PROJECT DESCRIPTION

Changes to the plans include:

1. 2' lowering of entry trellis to 37' above grade, which necessitates a 2' height variance;

2. 3' lowering of Family Room and Kitchen roof to 30' above grade; 3. 4' lowering of chimney to be 33' above grade;

4. Decrease in roof bulk of the breakfast room and dining room dormers;

5. Redesigned first and second story rear decks to accommodate existing 15" oak tree; and

6. The driveway apron has been widened from 20' to 24' (which will necessitate approval from the Building Department to exceed 20' in width).

The floor area has not been reduced, nor has the height of the garage. Although the height of a portion of the dwelling roof has been reduced 3', the dormer roofs redesigned, and the decks redesigned to accommodate .the 15" oak, the overall height and bulk remain virtually the same as the previous plan. The garage height sets the tone for the remainder of the dwelling as viewed from downhill.

Since the December hearing, the Building Official has approved in concept a proposal to discharge the roof runoff onto Vine Avenue. The design requires the approval of the property owner of 15 Vine Avenue to bury the drain line within an easement on 15 Avenue.

Since the December hearing, an arborist has determined that removal of one limb of the 28 inch oak near the driveway will not adversely impact the tree. The landscape plan has been modified to show existing trees to remain and an existing 25' tall bamboo screen along the rear property line. Plants proposed include miscellaneous shrubs and one oak tree in the front yard.

However, it feels like a four story house to the down hill neighbor and she would like to see some attempts made to address that.

Commissioner Wittenkeller said the square footage of homes in the area seems to be smaller, but he understands that people want more space. He questions whether or not San Anselmo needs "trophy homes", rather than functional homes. If they are going to get a sanitary easement, they should look at a storm water easement. There looks to be an in ground storm drain on Vine. The excess water will not percolate into the ground. A debris fence would be a good idea and something fairly heavy duty is recommended. The project needs a complete landscape plan that indicates the proposed and current landscaping, relative to views and privacy.

Commissioner House added that they should look at widening the driveway so people can turnaround, which could also be used by the neighborhood.

Commissioner Dowd said the structure is large but so is the lot. He is in support of the white trim and could support the project.

Chair Zwick said he likes the color palate but would go with the darker trim window, with white inside. The high plate height adds to the mass for the people below. He would like to see the garage separate from the house. If the two were separate, the house could be molded to the bottom of the lot. Tying the two together is helping the height limit. He would support a variance for the garage if it were separate. He recognized that the lot is large but the size of the house is a bit too large and right against the FAR limit.

Commissioner Wittenkeller said that 150 Oak Avenue has a separate garage and he thinks it is a successful scale.

V-9939/DR-9948 - Wilfred and Janet Willis, 26 Park Drive, A/P 6-044-04, Design Review to add an 644.6 square foot second story addition and a 5' side yard setback (Code: 8') for first and second story additions. The project includes adding 182.6 square feet to the first floor and creating a 857 square foot basement, located within the R-1 Zoning District. (Staff person: Feagans)

Peck Drennan, architect representing the applicant, stated that he presented a sun study for June 22. The row of trees are evergreen and the shadow is falling on the neighbor's house but the trees are also shading the neighbors house. They wanted to get more market value on the house, noting that they currently only have three small bedrooms and one bath. They indicated on the plans that the bottom level would be used as a mudroom and multipurpose room/office. The roofline in the back stays the same, with the exception of where the second story is. The neighbor to the rear has a two-story house and she was comfortable with the design. It has been suggested to push the stairway into the house, - it could be done and they could pull the car back another 6' but there is a tree there which would make it difficult to get the car out.

Susan Neal, 20 Park Drive, said she would be the one most affected by the shade. When she stands in her driveway or sits in her bedroom she would be most affected by the roof peak. She would like to se it designed so it does not affect her south side windows. There is a tree that now shades but it is a deciduous oak and light can come through. The house is very large on the lot and wants consideration on the light issues.

Bill Johnson, applicant, stated he bought the parcel from the owner of 150 Oak Avenue and then they subdivided the lots into two other lots. He is proposing a 2,800 square foot craftsman style house that would be stepped down the hill. The property is 20' off of Oak Avenue. They are trying to get good access from the house to the back yard also. If necessary, the family room chimney can be reduced. The driveway is already at 14% grade from the road so with the garage height, it will be tough to do anything but a flat roof or a mansard roof. The stairway height is an architectural feature at the street frontage. Regarding tree preservation, he has attempted to place the house in a location as not to have to remove trees. The house is set between several oaks. They can redesign the deck so the tree can be saved. He spoke with several neighbors about this project. The owners of 11 and 15 Vine are in support of the project. The owners of 9 Vine are new. He wanted solid deck railings so people below cannot see up into the deck. There is anywhere from 27' to 41' setback from his house and the house at 150 Oak Avenue. He would like to keep the window trim white, not green, as proposed by staff.

Tony Kits, 11 Vine Avenue, is concerned about the mass, height of the structure, his loss of privacy from the windows looking directly into his backyard. He is also concerned about light. The main story pole sits right behind his back door. It looks like the building is three stories. He is concerned about the drainage and would like to see a shadow study.

Jeff Johnson, 15 Vine, said the sewer line would progress through the easement of his property. As agreed, it needs to be addressed on a permanent basis. The other property is located on 150 Oak Avenue. He is more protected by tree coverage but is not sure how that will protect him through the years.

Donna Forbes, 11 Vine Avenue, said she is surprised about how large the house is. The applicant stated that the largest tree must be removed and she did not want that to happen because it helps screen a major portion of the building. She is also concerned about the drainage issues and the impact on the residents on Vine Avenue. She would like a temporary debris fence that would retain all the construction material during construction ..

Maryanne Cowperthwaite, 141 Oak Avenue, said the property at one time went all the way down to Vine Avenue. She was concerned about why the neighbors were not noticed about the certificate of compliance. Ms. Wight stated that it is only recognizing a legal lot and no legal notice was necessary.

Jim Cowperthwaite, 141 Oak Avenue, said that there is an 18' road and a car is roughly T wide and there is a parking situation that is abominable. The proposal is for another carport on Oak Ave. If anybody parks in this area, they park on his side of the street. He would like to see a requirement for off street parking for this project.

Peter Berg, 155 Oak Avenue, said it would be advisable to scale the house back somewhat.

Bill Johnson responded that he understands that privacy is a big issue for the downhill neighbors and he will plant trees. There were geotechnical and drainage studies done for this project. He noted that there would be five off street parking spaces.

December. 1998: Certificate of Compliance issued recognizing the two parcels as one legal building site, separate from 150 Oak Avenue, on the grounds that the parcels were created legally.

II. PROJECT DESCRIPTION

The lot slopes steeply down from the street. The proposed driveway accessed from Oak Avenue will have an average slope of 8% and be up to 18' above grade near the garage. The current design is for the garage roof peak to be 4' above the Code maximum. By sloping the driveway to 14% from the street, the garage floor can be lowered 2' in height, thereby reducing the overall height (the Ross Valley Fire Department requires that driveways have a slope less than 15%). This height could be further reduced to comply with Code by having either an uncovered car deck or a lower garage roof. Reducing the garage floor height will, in turn lower the height of the covered stairs by about 2', which is also currently proposed to be 4' above the Code maximum.

The proposed chimney height is 2' above the Code maximum. When measuring the height of a chimney, the Planning Code includes the top of the spark arrestor and housing and has a maximum of 35'. The Building Code requires a minimum height for the chimney top (where th~ gasses initially escape) to be 2' higher than any structure within 10 horizontal feet. Should the garage floor be lowered 2', then the dwelling would also be lowered, reducing the height of the chimney. There may also be room to reduce the height of this chimney further by use of an alternative spark arrestor and housing.

The lot slopes down steeply from the street; in fact, there is a guardrail along the southeastern section of the front property line. The building footprint is on a 39% slope and the applicant has stepped the house up the hill such that it does not exceed two stories. The story poles were not erected at the writing of this report, but should be up prior to the meeting. While standing on the street at elevation 494, I noted that the roof peak of the dwelling is to be at elevation 499 and the garage at elevation 503. This home will be very tall as viewed by the downhill neighbors (9 and 11 Vine Avenue), who are at an approximate elevation of 430. The dwelling at No. 11 Vine Avenue will be clearly visible from this dwelling, as there is little vegetation between the two properties. There is a large tree at the rear of No. 9 Vine Avenue, which provides some screening. Staff recommends that trees be planted at the rear of this property. Findings of special circumstance and non-detriment can be made for the front yard variance requests for the driveway approach ramp, garage, parking deck; and entry. The special circumstance is the steepness of the lot and by placing the structures closer to the road, there is less of an impact to the rear yard neighboring properties. The 2,875 square foot dwelling is close to the maximum permitted. Although neighboring homes are not as large in terms of square footage, the 30% FAR for the proposed dwelling falls within the FARs of neighboring properties:

The proposal includes natural cedar shingle siding, off-white windows, dark forest green trim and gutters, and dark green asphalt shingles. Staff would prefer dark forest green windows and trim.

New landscaping will include shrubs up to 7' in height in the front, side and rear yards, and 3 live oaks in the front yard. One of the two 18" oak trees in the rear yard (labeled Nos. 13 and 14 in the arborist report) has already been removed. Staff recommends the first and second story rear decks be redesigned to accommodate the one remaining tree (13 or 14) as it will contribute to screening. Because a significant limb of the 28" oak located in the right of way will hang over the proposed driveway location, either major pruning or removal of the limb will be necessary. A steeper driveway will help this situation somewhat. The arborist should address the expected health of the tree if this major limb is removed.

The existing dwelling at 150 Oak Avenue has a deck that encroaches over the common side property line. An 11' wide section of this deck will be removed such that the deck on 150 Oak will end at the common side property line and the other portion of deck located on 148 Oak Avenue will be within 11' of the common side property line.

The soils report prepared by Salem Howes Associates has been peer reviewed by Herzog Geotechnical. A drilled pier foundation is recommended and the new car deck construction will buttress the existing retaining wall on Oak Avenue, providing lateral support and preventing any future movement of the existing wall.

Ill. RECOMMENDATION

• Staff recommends the application be referred back to the applicant to consider the following: 1. Increase the slope of the driveway to be up to 14.75%, thereby reducing the height of the garage, covered stair, and chimney;

2. Reduce the height of the garage roof, chimney anci covered stair to conform to the maximum 35' height above grade;

3. Accommodate the 18" oak to the rear of the first and second story decks;

4. Accommodate the 28" oak in the front yard near the driveway and have the arborist address its expected health.

5. Change the window and trim color to dark forest green.

6. Plant and maintain native trees within 25' of the rear property line with a growth potential of at least 25'. Due to the extreme elevation difference between the two dwellings, a 25' tall tree planted at elevation 446 {25' from the rear property line) should provide screening of the 41' tall rear wall of the proposed dwelling located at elevation 453 when viewed by a 6' person standing in the rear yards of the Vine Avenue properties at elevation 430.

• Should the Commission support the project as presented, this application can be continued to the Consent Agenda on December 20, 1999, for adoption of the Resolution of Approval.

Hodgens requested that the Traffic Safety Committee look at the placement of a stop sign at the comer of Monterey and Los Angeles Blvd. at the north end. She also asked that the committee look into having a stop sign on Veteran's Way, at the entrance to Memorial Park, at the horseshoe pit. There are a lot of children in the parking lot and cars come around that comer very fast.

Kilkus said the Corte Madera Creek Watershed Committee has completed basic studies on fisheries in the creek. The Army Corps of Engineers will hold a public meeting on alternatives for flood control on Thursday, March 30 at 7:30 p.m. at Kent Middle School in Kentfield. He passed out flyers and encouraged attendance. On Saturday, May 20, from 8:30 a.m. to 1:00 p.m. at Dominican College, Angelico Hall, a meeting will be held on "How to Influence Policies that Affect your own Back Yard" by participating in your community's General Plan revision process. ·Kilkus asked that Council members and staff attend, if possible, and that all Town Board, Committee, and Commission members get a copy of the flyer.

Chignell reported that there has been a landmark case decided that should help to hold off antenna farms. San Anselmo has a number of applications pending. This important issue is not going away.

Chignell noted that the Police Department says the Town cannot prohibit bikes on Center Blvd. He would like the Town Attorney to look into this issue, as bicycles on Center are dangerous due to the narrowness of the road.

Chignell requested a report from the Parks Director and the Planning Director on the planning process for the Millenium Playground. He would like to know what planning review is anticipated and what noticing will be done. This will be a massive job and will affect the neighborhood significantly.

Breen said the speeding on Woodside Drive is continuing. He has asked that the radar trailer be used to slow people down. He would like the Traffic Safety Committee to look into this.

Breen said he received a copy of a response from Golden Gate Transit regarding the Town's concern over the elimination of five Route 24 commute runs. The District says they are looking at the issue.

Breen noted that there would be a meeting on bus, rail, and ferry projects on Wednesday, April 19, from 6:30 - 8:30 p.m. at the Fairfax Library. Community attendance is critical,

Regarding item (a), Kroot noted on page two that the Measure G Monitoring Committee was increased temporarily to seven members.·

Regarding item {b), Louise Mat4ews, Foothill Road, submitted a written list of questions for response, which she read into the record, regarding the Quarterly Treasurer's Report and the financial report.

Regarding item (e), it was the consensus of Council to send the staff report to the Planning Commission.

Regarding item {f), Hodgens said she is pleased with the collaboration between the Town and the Robson parents. Both groups are in agreement about the need for fees and that the parents group will have every opportunity to put together funding subsidies, so that those who cannot afford the program can participate.

Louise Mathews, Foothill Road, said she is disappointed that the Robson decision was an act of consensus. This should have come forward as a public issue as the program will use Town funds. Council should follow the process appropriately and legally.

Hodgens said the suggestion was that this would come forward through the Recreation brochure, just like every other program offered by Recreation.

Kroot noted that the dollar figure quoted in the staff report should be $1444.

2. APPROVE . PLANS FOR SAN ANSELMO 2000 STREETSCAPE IMPROVEMENTS AND AUTHORIZE REQUEST FOR BIDS.

Public Works Director Echols presented the staff report. The plans for the improvements were prepared by George Girvin, project architect. The total project cost is $640,000 for the core elements, including resurfacing. There is $115,000 in bid alternates included for other amenities. The goal is to have the work done by September, which necessitates going out for bids in April and beginning construction in June to meet the timeline. The undergrounding construction is on target to be done in late April. The funding is from two sources, campaign pledges and Measure G money for storm drain ·and resurfacing work.

George Girvin, Project Architect, said this is a complicated project with many aspects.

The work that is to be funded by the TLC grant money has been removed from the rest of the downtown bid, so as not to hold up the rest of the work. He presented a summarizing drawing, indicating where the overlay work will be done, and highlighting traffic improvements at Ross, Tunstead and Bridge intersections, which will provide safer crossing and traffic flow. There is some curb and gutter work to correct present drainage problems. The Town Hall plaza is a separate bid item. Thirty-two new street lights are included in the base bid. He recommends the Town buy the trees separately and coordinate planting.

Kroot asked about the suggestions of the Bicycle Task Force .

.. Girvin said the current bike parking at Coffee Roaster's would actually be. larger with the new plan. The tree guards the task force asked for only come in a round size, not square as requested. However, the round guards are adequate for locking bikes.

Kroot asked if the light fixtures are .the types with arms for hanging plants or banners. Girvin answered ~ffirmatively.

Chignell asked if the Town Hall plaza work is included. Girvin said it is included as a separate bid item, as is the information kiosk.

Louise Mathews, Foothill Road, asked if the Tunstead entry was originally included in the TLC grant. She also asked if Town funds would be used if enough money weren't raised for the project. Breen answered affirmatively regarding the Tunstead entry and said no town funds will be used for the project. ·

3. INTRODUCTION AND FIRST READING OF AN ORDINANCE ADOPTING REGULATIONS FOR THE ISSUANCE OF COMMERCIAL FILMING AND STILL PHOTO PERMITS.

Planning Director Feagans presented the staff report. Since the last. meeting, the Film Committee has met to go over the most recent issues, including filming hours, holiday rules, the discretion to deny a permit, the number of filming days allowed, an annual signature survey and notification procedures. The Committee has reached consensus on the ordinance presented tonight.

Louise. Mathews, Foothill Road, referring to filming on school property, asked if the Town has a contract with the schools. Planning Director Feagans said the filmers get permission from the school district and come to the Town for a film permit.

Louise Mathews, Foothill Road, asked if there shouldn't be a specific number of days cited for a writteri notification in case of a permit revocation. Planning Director Feagans said that language could be included but she recommended leaving it as is.

Mis, Chignell/Kilkus, to introduce and waive reading of an ordinance adopting regulations for the issuance of commercial filming and still photo permits. Ayes: All.

4. CONSIDER RESOLUTION IN SUPPORT OF: THE EFFORT TO RENOVATE THE PAVILION IN FAIRFAX.

Parks Director Nyberg presented the staff report.

Hodgens asked about the timing of the fundraising with respect to our own fundraising for the Millenium Playground. Nyberg said agreement was reached between the two groups on how to coordinate the two projects.

Don Briggs, Fairfax Pavilion renovation project, said he is doing this because the Fairfax Pavilion is in terrible shape. It needs about $750,000 worth of work. He has contacted every organization he can think of to achieve broad community support. He needs to

Kilkus asked about their plans with respect to sustainability. Briggs said he has a volunteer architect who is well aware of the history of this site and has taken it into account.

Chignell said there is tremendous support from the community for this project. The Pavilion is an important asset to the community.

Mis, Chignell/Hodgens, to approve Resolution No. 3507 supporting the effort to renovate the Pavilion in Fairfax. Ayes: All.

5. CONSIDER FORMATION OF A SAN ANSELMO QUALITY OF LIFE COMMISSION.

Kilkus presented the report. Such a commission can create synergy in a community because it is different and exciting. He would suggest a two-year limit. The next step would be to ask that this be made a fonnal commission and authorize recruitment of members. Such acommissi9n may not be easy lo establish, but it is worth trying.

Breen said it is difficult to imagine what kind of a product might result from such a corritnission. He feels the government should take a leadership role in this.

Hodgens said issues often unite a community. The committee could be a funnel for policy statements for the community. She would endorse the concept to get a dialog going.

Kilkus said people are looking for a way to do the right thing. If we could get that kind of enthusiasm, it could unite the community.

Chignell said he supports the proposal and feels it may draw younger people from the community.

Krootsaid he supports the concept and would like the recruitment opened to members of other boards, committees and commissions. ·

Breen said he wondered ifthere was a better name for the commission.

Kilkus said he'd be willing to consider other names. The next step would be to approve the concept, ask staff to come back with a resolution establishing the commission with a recommendation on recruitment for members.

Louise Mathews, Foothill Road, said she feels negative about the commission. She doesn't see where it fits into the scheme of things. It won't make the Town any better.

Carlyn Strand, Yolanda Drive, said she likes the idea and doesn't have a problem with the name. If such a commission existed presently, she could have come to them with her concerns about filming in Town.

Mis, Chignell/Kroot, to approve the concept of a Quality of Life Commission, and ask staff to come back with a resolution establishing the commission, including a recommendation on recruitment for members, with some examples of practical outputs. Ayes: All.
