Peace in Venezuela: Is There Life after the Barbados Talks? Crisis Group Latin America Briefing N°41 Caracas/Brussels, 11 December 2019 What’s new? At least for now, Norwegian-facilitated negotiations to end Venezue- la’s presidential showdown have collapsed. Meanwhile, President Nicolás Maduro’s government has forged an agreement with minority opposition parties. Together with regional powers’ decision to define Venezuela as a threat to hemispheric security, these developments could complicate a resolution of the crisis. Why does it matter? Failure to restore political stability and socio-economic well-being in Venezuela fuels South America’s worst-ever refugee crisis, risks a low- intensity internal conflict, propagates tensions across the region and threatens to trigger military clashes with neighbouring Colombia. What should be done? Allies of the two sides should press them to overcome their reluctance and return to the negotiating table, possibly under a new format, where they should show the necessary flexibility to reach a workable agreement. I. Overview After seven rounds of formal talks in Oslo and Barbados, facilitated by the Norwe- gian government, negotiations between representatives of President Nicolás Maduro and the opposition led by Juan Guaidó – now recognised as the legitimate acting president by 58 countries, including the U.S. – broke down in mid-September. The talks had centred on a six-point agenda, agreed upon in April, to which the Maduro government had contributed just one point – the lifting of U.S. sanctions. The re- maining five were the restoration of constitutional checks and balances; conditions for the holding of elections (understood by the opposition to mean a presidential election, though that was not made explicit); the terms of a transition away from Maduro; peace and reconciliation; and post-electoral guarantees for both sides. -

Authorities denied having information on his fate and whereabouts since his detention by intelligence officers until 31 May. Gilber Caro was also arbitrarily detained from January 2017 until June 2018 under unfounded accusations of treason and stealing military equipment. His disappearance and incommunicado detention is arbitrary since it reverses the freedom he was granted in June. We call on the Director of the intelligence service (SEBIN) to swiftly allow access to Gilber Caro and to release him immediately. Incommunicado detention for prolonged period of time can amount to torture under human rights law. The SEBIN must allow access Gilber Caro’s lawyers access to him, guarantee his personal integrity and release him immediately. Report August 2016 The Venezuelan crisis, regional dynamics and the Colombian peace process By David Smilde and Dimitris Pantoulas Executive summary Venezuela has entered a crisis of governance that will last for at least another two years. An unsustainable economic model has caused triple-digit inflation, economic contraction, and widespread scarcities of food and medicines. An unpopular government is trying to keep power through increasingly authoritarian measures: restricting the powers of the opposition-controlled National Assembly, avoiding a recall referendum, and restricting civil and political rights. Venezuela’s prestige and influence in the region have clearly suffered. Nevertheless, the general contours of the region’s emphasis on regional autonomy and state sovereignty are intact and suggestions that Venezuela is isolated are premature. Venezuela’s participation in the Colombian peace process since 2012 has allowed it to project an image of a responsible member of the international community and thereby counteract perceptions of it as a “rogue state”. Its growing democratic deficits make this projected image all the more valuable and Venezuela will likely continue with a constructive role both in consolidating peace with the FARC-EP and facilitating negotiations between the Colombian government and the ELN. However, a political breakdown or humanitarian crisis could alter relations with Colombia and change Venezuela’s role in a number of ways. Exploring Hugo Chávez’s use of mimetisation to build a populist hegemony in Venezuela Elena Block Rincones MSc, BA A thesis submitted for the degree of Doctor of Philosophy at The University of Queensland in 2013 School of Journalism and Communication Abstract “You too are Chávez”… (Hugo Chávez, 2012i) This thesis examines the political communication style developed by Hugo Chávez in his hegemonic construction of power and collective identity during the 14 years he governed Venezuela. This thesis is located in the field of political communication. A culturalist approach is used for the case, which prioritises issues of culture and power and acknowledges the role of human agency. Thus, it specifically focuses on the way the late President appears to have incrementally built an emotional, mimetic bond with his publics in a process that culminated in the mimetisation of the leader and his followers in a new collective, but top-down, identity called Chávez. This process expresses a hegemonic dynamic that involved the displacement of former dominant groups and rearrangement of power relations in Venezuela. The logic of mimetisation proposes an incremental logic of articulation whereby I tried to make sense of Chávez’s political communication style and success. It involves the study of the thread that joined together key elements in Chávez’s political communication style: hegemony and identity construction, political culture, populism, mediatisation, and communicational government. It is a style that appears to have exceeded classic populist forms of communication based on exerting an appeal to the people, towards more inclusive, participatory, symbolic-pragmatic forms of practising political communication that may have constituted the key to Chávez’s political success for 14 years. -

COMISIÓN INTERAMERICANA DE DERECHOS HUMANOS RESOLUCIÓN 16/2019 Medida Cautelar No. 70-19 Roberto Marrero y Sergio Vergara respecto de Venezuela (Ampliación) 27 de marzo de 2019 I. INTRODUCCIÓN 1. Mediante comunicación de 22 de marzo de 2019, la Comisión Interamericana de Derechos Humanos (en adelante “la Comisión Interamericana”, “la Comisión” o “la CIDH”) recibió una solicitud de ampliación de las medidas cautelares vigentes presentadas por Juan Carlos Gutiérrez, Ignacio J. Álvarez Martínez, María Daniela Rivero y Génesis Dávila (en adelante “los representantes”) instando a la CIDH que requiera a la República Bolivariana de Venezuela (en adelante “Venezuela” o “el Estado”) que proteja los derechos de Roberto Marrero y Sergio Vergara, quienes se encontrarían en una situación de riesgo en el marco del contexto actual por el que atraviesa Venezuela. 2. Tras analizar las alegaciones de hecho y de derecho aportadas por la solicitante, la Comisión considera, desde el estándar prima facie aplicable, que los propuestos beneficiarios se encuentran en una situación de gravedad y urgencia, toda vez que sus derechos enfrentan un riesgo de daño irreparable. Por consiguiente, con base en el artículo 25 de su Reglamento, la Comisión solicita al Estado de Venezuela que: a) adopte las medidas necesarias para proteger los derechos a la vida e integridad personal y garantice la seguridad del Roberto Marrero y Sergio Vergara de conformidad con los estándares establecidos por el derecho internacional de los derechos humanos, incluyendo la protección a sus derechos en relación con actos de riesgo atribuibles a terceros; b) adopte las medidas necesarias para garantizar que las condiciones de detención de Roberto Marrero cumplan con los estándares internacionales en la materia; c) garantice el acceso a visitas de representantes y familiares de Roberto Marrero, según los estándares internacionales aplicables; y d) informe sobre las acciones adoptadas a fin de investigar los presuntos hechos que dieron lugar a la adopción de la presente medida cautelar y así evitar su repetición. -

VENEZUELA 2019 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY Venezuela is legally a multiparty, constitutional republic, but for more than a decade, political power has been concentrated in a single party with an authoritarian executive exercising significant control over the judicial, citizens’ power (which includes the prosecutor general and ombudsman), and electoral branches of government, and standing up a parallel, illegitimate legislative body alongside the existing elected one. On January 10, the term of former president Nicolas Maduro ended. He sought to remain in power based on his claimed “victory” in the 2018 presidential elections widely condemned as neither free nor fair, a claim not accepted by the democratically elected National Assembly (AN). On January 23, Juan Guaido, as president of the National Assembly, assumed the role of interim president pursuant to the provisions of the constitution related to vacancies. Former president Maduro, with the backing of hundreds of Cuban security force members, refused to cede control over the instruments of state power, preventing interim president Guaido from exercising authority within the country. In the 2015 legislative elections, opposition political parties gained supermajority (two-thirds) control of the AN. The former Maduro regime, however, used its control over the Supreme Court (TSJ) to create the illegitimate Constituent National Assembly (ANC) that placed the AN in contempt, usurped its constitutional role to legislate, and weakened the constitution’s separation of powers principle. Civilian authorities’ control over the security forces declined and was deeply politicized. The National Guard (GNB)--a branch of the military that reports to both the Ministry of Defense and the Ministry of Interior, Justice, and Peace--is responsible for maintaining public order, guarding the exterior of key government installations and prisons, conducting counternarcotics operations, monitoring borders, and providing law enforcement in remote areas. -

Venezuela: Background and U.S. Relations Updated June 4, 2019 Congressional Research Service https://crsreports.congress.gov R44841 Venezuela: Background and U.S. Relations Summary Venezuela remains in a deep political and economic crisis under the authoritarian rule of Nicolás Maduro of the United Socialist Party of Venezuela. Maduro, narrowly elected in 2013 after the death of Hugo Chávez (president, 1999-2013), began a second term on January 10, 2019, that most Venezuelans and much of the international community consider illegitimate. Since January, Juan Guaidó, president of Venezuela’s democratically elected, opposition-controlled National Assembly, has sought to form an interim government to serve until internationally observed elections can be held. Although the United States and 53 other countries recognize Guaidó as interim president, the military high command, supported by Russia and Cuba, has remained loyal to Maduro. Venezuela is in a political stalemate as conditions in the country deteriorate. Venezuela’s economy has collapsed. It is plagued by hyperinflation, severe shortages of food and medicine, and electricity blackouts that have worsened an already dire humanitarian crisis. In April 2019, United Nations officials estimated that some 90% of Venezuelans are living in poverty and 7 million need humanitarian assistance. Maduro has blamed U.S. sanctions for these problems, but most observers cite economic mismanagement and corruption under Chávez and Maduro for the current crisis. U.N. agencies estimate that 3.7 million Venezuelans had fled the country as of March 2019, primarily to other Latin American and Caribbean countries. Las absurdas acusaciones que se han formulado ejemplifican la creciente desesperación de Maduro y sus corruptos asociados. La fabricación de pruebas para justificar detenciones arbitrarias por motivos políticos es una herramienta habitual del antiguo régimen ilegítimo de Maduro. La hemos visto usarse contra Roberto Marrero, Juan Requesens, Gilber Caro e Ismael León, quienes constituyen una pequeña parte de los más de 350 presos políticos actualmente en Venezuela. Estos actos deplorables sólo retrasan la resolución de la trágica crisis en Venezuela que Maduro y sus colaboradores insisten en perpetuar. Diosdado Cabello, jefe de la Asamblea Constituyente ilegítima, argumenta que Márquez había introducido ilegalmente material explosivo a bordo de un vuelo internacional directo desde Portugal, después de haber pasado por el estricto control y los protocolos de seguridad del aeropuerto de Lisboa. VENEZUELA: INFORME DE LOS DERECHOS HUMANOS DE 2019 RESUMEN Venezuela es legalmente una república constitucional multipartidista, pero por más de una década el poder político se ha concentrado en un solo partido, con un poder ejecutivo autoritario que ejerce un control considerable sobre el poder judicial, el poder ciudadano (que incluye la Procuraduría General de la República y la Defensoría del Pueblo) y los órganos electorales del gobierno, y defiende un poder legislativo ilegítimo que funciona de forma paralela al actual poder legislativo elegido. El 10 de enero finalizó el mandato del expresidente Nicolás Maduro, quien procuró permanecer en el poder sobre la base de su pretendida “victoria” en las elecciones presidenciales de 2018, ampliamente condenadas por no ser ni libres ni imparciales; la Asamblea Nacional elegida democráticamente rechaza ese argumento. El 23 de enero Juan Guaidó, en su calidad de presidente de la Asamblea Nacional, asumió la función de presidente interino de conformidad con las disposiciones de la constitución relativas a los puestos vacantes. El expresidente Maduro, con el apoyo de cientos de miembros de las fuerzas de seguridad cubanas, se negó a ceder el control de los instrumentos de poder del Estado, impidiendo así que el presidente interino Guaidó ejerciera autoridad dentro del país. En las elecciones legislativas de 2015, los partidos políticos de la oposición obtuvieron el control de la supermayoría (dos tercios) de la Asamblea Nacional. Sin embargo, el régimen anterior de Maduro se sirvió del control que ejerce sobre el Tribunal Supremo de Justicia (TSJ) para crear la Asamblea Nacional Constituyente ilegítima, que declaró a la Asamblea Nacional en situación de desacato, usurpó su función constitucional de legislar y debilitó el principio de separación de poderes establecido en la constitución. -
