1. I N T R O D U C T I O N

The Regulatory Authority of Electronic and Postal Communications (RAEPC) is an independent regulatory authority in the area of electronic and postal communication services, which functions based on the Law No. 04/L-109 on Electronic Communications and is given additional responsibilities and competences in the area of postal services, by the Law No. 03/L-173 on Postal Services.

In the capacity of National Regulatory Authority (NRA) responsible in the area of electronic and postal communications, in addition to duties and authorizations provided by the Law No. 04/L- 109 on Electronic Communications (hereinafter: Law on EC), to the Regulatory Authority of Electronic and Postal Communications (hereinafter: Authority) were given additional competences and responsibilities in the area of postal services as well as with the provisions of the Law No. 03/L-173 on Postal Services (hereinafter: Law).

Authority, as a regulatory of postal services is responsible for the implementation of legal provisions – applicable laws and inter alia has the following competencies:

 Issues and revokes licenses of postal operators for providing universal postal services and other services;  Approves fees for universal and reserved postal services, proposed by the public postal operator;  Determines the degree of weight –limit, for the reserved postal services;  Determines fees for issuing licenses and annual taxes for provision of postal services as well as deadlines for performing the payments;  Proposes to the Ministry rules for provision and fulfilment of standards for performing postal services;  Keeps the registry of issued licenses with the relevant data;  Oversees the observance of conditions set by the license and in case of violation of the terms of the license takes the necessary measures vis-à-vis the postal operators;  Oversees the use of postal service fees and proposes legal measures in cases when the mail operator imposes or uses tariffs contrary to the measures stipulated by this law;  Monitors the developments related to postal sector and market of postal services and takes the necessary measures to ensure equality and transparency for competition in the market of postal services;  Settles disputes between postal operators and costumers with postal operators;

 Provides costumers of postal services equal conditions;  Collects necessary information regarding the postal service and publishes them if necessary.

The Authority, through this document - report, presents key indicators of statistical data in the Postal Services Sector for 2015, in the Republic of Kosovo, as well as comparisons and changes during 2014 and 2013.

Document-report aims to inform the stakeholders, namely licensed postal operators and potential operators who intend to enter the market of postal services to provide services to users-consumers, namely to inform the public by providing a clear overview of the postal sector and services in the country. Document-report is prepared based on received-reported data and information for the period 1 January to 31 December 2015 by postal service operators, referring to postal activities and services and other data related to the provision and performance of postal and courier services.

The Authority notifies and explains to all stakeholders in the postal service sector and to the public that based on its legal obligations and considering the secrecy and confidentiality of data, not all information, data and indicators reported by postal operators are involved and published in this document.

In order to gather the necessary data by postal operators and postal service providers, the Postal Service Sector (hereinafter: PSS) within the Authority has integrated obligations and duties to report pursuant to Regulation No. 11 for periodical statistical data of operators who provide telecommunications and postal services' (Ref. No. Prot. 048/B/11, dated 13/09/2011) (hereinafter: Regulation), by preparing a questionnaire for periodical reporting of postal service statistical data, according to which the postal operators are required to periodically report to the Authority.

2. Postal services, legal framework, activities conducted, objectives and challenges

Postal services imply services provided by a postal service provider that is licensed-authorized by the competent state body (Authority-RAEPC). Postal services are performed by Postal Operators (hereinafter: PO), who upon request by users/consumers, which means services; receiving or collecting, processing, transport, distribution and delivery of postal shipments to the recipient's address or to the addressee through a fee-price (postal tax) for performing the postal service.

2.1. Legal and regulatory framework

The postal service sector is regulated by Law No. 03/L-173 on Postal Services and other bylaws issued based on this law. In addition to the documents issued by the line ministry (MED), the Authority has issued a number of bylaws for the purpose of implementing and supplementing provisions of the law, with regulatory effect such as regulations, decisions.

The documents issued to regulate the Postal Service Sector are:

 Decision No. 432 on Determination of Weight Limit for Reserved Services (Ref. Prot. 2.2. Activities conducted in 2016

The Authority, namely the Postal Service Sector (PSS), in accordance with its responsibilities and authorizations and in addition to daily and ongoing regular engagements, as well as those provided in the ‘Work Plan for 2016’, has successfully fulfilled the duties and obligations arising from the basic law and bylaws.

Within the scope of its objectives and activities, in 2016, PPS accomplished the following tasks:

 A total of six (6) applications were received by entities that applied to obtain a license - authorization for the provision of postal services in the territory of the Republic of Kosovo;  A total of five (5) postal service operators were licensed, thus, increasing the number of licensed postal operators to thirteen (13) by 31 December 2016;  Various papers and interpretations were prepared and sent for review to postal service operators, a total of thirteen (13) papers accompanied by different remarks for postal service operators;  Various regulatory interpretations and answers were provided regarding three (3) complaints filed by private postal operators;  A total of fourteen (14) general (routine) and specific checks and inspections to postal service operators were conducted, namely: o General Inspections: seven (7) general inspections in offices - points of postal operators, namely inspected offices - points of licensed/authorized entities, postal operators who provide postal services in the territory of the Republic of Kosovo. o Specific Inspections: seven (7) specific inspections to entities - operators who have applied for re-licensing and first-time licensing, namely specific inspections to verify the fulfillment of license conditions;  A total of nine (9) complaints were received, containing various requests from postal service users/customers, which were administered and handled within the legal deadlines by giving concrete answers to the parties that filed the complaints;]  Drafting of Regulation on periodical statistical data of operators who provide telecommunication and postal services (Ref. Draft harmonized Regulation between the functional units of DEC and PSS within the Authority), etc.

2.3. Objectives and challenges in the postal sector

Among the main objectives of the Authority in the field of postal services remain:

 Implementation of sector policies in the field of postal services;  Termination of illegal operations of illegal operators in certain parts of the country;  Efficient regulation of postal market;  Further liberalization of postal market and services;  Increased quality of postal services;  Effective protection of consumer rights, and efficient addressing of their complaints, etc;  Approximation of domestic legislation with EU legislation;  Regional cooperation and membership of relevant institutions and bodies in the international organizations, etc.

Whereas, challenges to be faced by the Postal Sector in the Republic of Kosovo over the years to come are:

 Difficulties in implementing the policies of the postal service sector throughout the territory of the Republic of Kosovo;  Difficulties in undertaking actions to ban the operations of illegal, unauthorized - unlicensed operators, in certain parts of the country;  Due to low sector incomes, the lack of investment in the sector, outdated postal infrastructure, digitalization of services, human capacity building and promotion of postal services;  Lack of institutional support and lack of professional staff in the sector;  Due to Kosovo's situation in the international arena, difficulties of membership in international organizations, etc.

To enforce the Law No. 03/L-173 on Postal Services, the Government of Kosovo (hereinafter: GoK) has issued the document 'Strategic policies for development of postal services in the Republic of Kosovo 2013-2017' (hereinafter: Policy paper), which sets out strategic policies for the development of postal services in the Republic of Kosovo for the period 2013 - 2017.

3. Overview of postal services market in the Republic of Kosovo, 2016

The main data and information presenting the state of play of the postal sector, are represented by the main data and indicators which reflect the postal services market in the Republic of Kosovo, namely by the following indicators: volume - number of postal shipments received, processed, shipped - transported and delivered -distributed by postal operators during 2016, the comparison and market trend with 2015 and 2014, market sharing between postal operators, and comparison by percentage (%) of volume - number of postal shipments, type of shipments, etc.

As foreseen in the ‘Regulation on periodical statistical data of operators who provide telecommunication and postal services’ (Ref. Regulation No. 11, Prot. No. 048/B/11, dated 13/09/2011), the Authority has regularly received quarterly reports (Q) from postal operators for the period January - December 2016 and based on these reports issued a general overview of the postal services market for 2015 in the Republic of Kosovo..

The report is based on the key measurement indicators of the postal services market:

 Data on activities - postal services during the calendar year;  Data on financial income - revenues of the postal sector;  Data on quality of performance of postal services;  Data on number of employees in the postal sector;  Data on complaints by users of postal services; and  Data on postal infrastructure and network, etc.

Based on the processed data by the Authority, it appears that in comparison with 2015, in 2016, there has been a significant increase in the overall number of postal items - shipments by 3.38 %, whereas CPE ‘Post of Kosovo JSC’ marked a significant increase of the overall volume of postal shipments by 4.20 %, whereas private operators experienced a decrease of 13.50 %.

Based on the volume of postal shipments, the trend and comparion from 2012 to 2016, indictaes that there is a continuous increase of the overall volume of postal shipments by 37.74%. From the total volume of postal shipments, about 50.90 % of shipments are letter post, whereas around 44.94 % of shippments are direct mail and around 4.16 % are postal package, parcel post. From the total volume of shipments, about 89.33 % of postal shipments are internal - domestic mail, whereas about 10.67 % are international mail.

Also, compared with 2015, in 2016, the postal services sector, in the overall total of the revenues from the sector, has recorded a growth of total revenues in the amount of; 13.90%, while the CPE 'Kosovo Post JSC', has marked an increase in the value of; 23.81%, while private operators have experienced a slight decrease in the value of 0.59%.

If we take into account the 'Postal Sector' revenue trends, from 2012 to 2016, then we can say that the postal services sector in the Republic of Kosovo marked a continuous increase of revenue, where compared to 2012, it marked an increase in the value of; 30.37%, while the comparison between 2015 and 2014 shows an increase in the value of; 12.07%, where CPE 'Post of Kosovo JSC', had an increase in the value of; 10.39%, while private postal operators have also marked an increase in value of; 13.35%.

4. Market regulation and trends of the movement of postal services in the Republic of Kosovo

Postal services have a special strategic importance in the country's economic development and are indispensable for mutual communication between users - postal service customers (C2Cs), businesses between each other (B2B) and businesses to users-costumers (B2C) of services and vice versa.

Also the liberalisation of the postal services market, a process which has so far been completed in all EU countries, is important in the development of the postal service sector in our country. Liberalisation would have an impact on the orientation towards the full opening of the market for free competition for postal service providers and the orientation towards user-customer requirements, creating fair competition, which would directly increase the quality of providing services, competition in the provision of postal services, etc.

The following figures show an overview of trends in volume movement, number of letter posts and volume, number of postal parcels - packages for 2012 - 2016. Statistical data are received and processed by the Authority, for the following years, which are dedicated to postal operators, various institutions and stakeholders.

The figures above represent the trend of the volume movement of letter posts, where it is noticed that the letter post still shows a continuous decline, while in the package post, the parcel post there is a continuous increase.

Meanwhile, the figure below shows the movement index of the letter posts and postal package - parcels volume, respectively the trend of movement from 2012 to 2016.

From the above figures, it is observed that the movement trends of the volume of letter posts, despite the slight increase in 2016 have decreased in the international markets, while there is a greater growth of the market of parcel post services, the volume of parcel post services, both in the international arena and in the Republic of Kosovo.

Despite the declining trends of the letter post, there is an increase of the package post - parcel post trends, as a result there is a sales increase of goods and products 'Online' through the internet by businesses, and increase of the Direct Post volume (Advertising).

In EU countries, the regulation of the postal services market has an important role in the development of the postal services market. The main goal is to provide high-quality services, affordable tariffs and consumer protection (through clear definitions of universal postal service) and market liberalisation. The postal services market in EU countries has marked a

The European Commission (EC) has regulated this area through its Directives; 'E-commerce Directive' and 'Consumer Rights Directive' (CRD), defining procedures for the sale and delivery of goods ordered Online and transactions between businesses and consumers (B2C). The rules include and are implemented by 'Online' product sellers - businesses, customers and postal operators.

The following figure gives an example regarding the form namely the sales cycle - online ordering of goods, the method of service delivery in the context of service delivery, business and consumer contract (B2C).

Despite the fact that here in the Republic of Kosovo, the issue of selling and buying products online, namely online purchase orders, is not adequately regulated, so there are no specific detailed rules for this issue in EU countries, this issue is well regulated and before an online purchase order is done, businesses - Online Product Sellers - should clearly inform their customers about the following rules:

 The overall commodity price, taxes, and shipping costs (if traders do not provide information on any charges or additional costs, the Online seller must bear the costs themselves - additional charges);  Arrangements for payment, delivery and the time which the trader undertakes to deliver the goods;  Evidence or absence and the terms of the right to withdraw the product - the commodity in the period of 14 days (if the traders do not provide information on the right of withdrawal, the period is extended to twelve months); and Adresa: Str.  The cost of returning commodities in case of withdrawal, where applicable - traders should provide at least an estimate of what the maximum amount of the return of grouped commodities may be (if traders fail to inform consumers, they must be able to afford the cost of returning the goods).

5. Register of licensed postal operators

In accordance with the law, the Authority is the only institution authorised to issue and revoke licenses and authorizations to all those intending to provide postal services.

Conditions and criteria for obtaining a license authorization are defined by the provisions of Article 5 of Administrative Instruction No. 05/2012 on Licensing of Postal Service Operators (hereinafter: AI), whereas the license validity period authorization is set for ten (10) years and is eligible for renewal.

The licensing process, upon the day of receipt of application by the Authority, the review, handling by the Evaluation Commission, all the way to the decision for granting or refusing the license, lasts up to sixty (60) days, and throughout this process, adequate procedures are applied based on the following principles: transparency; non-discrimination of applicants requesting to be licensed; simple and transparent licensing procedures; and reasonable and objective criteria for granting licenses, etc.

The Authority, keeps and updates ex-officio the registry of postal operators licensed-authorized to provide services, whereas, until the end of 2016, the registry of licenses-authorizations included in total thirteen (13) postal operators who are active and provide postal services:

CPE ‘Post of Kosovo JSC’ is a Public Postal Operator (hereinafter; PPO) is obliged to provide all universal (basic) and reserved postal services, pursuant to the Agreement-authorization from MED, where CPE ‘Post of Kosovo JSC’ is authorized it to perform universal and reserved postal services according to conditions and criteria set by legal and sublegal provisions in force (Ref. Article 14, paragraph 1; of LPS No 03/L-173, Agreement between MED and CPE ‘Post of Kosovo JSC’, Prot. No. 263/01, dated 06/02/2014), and for the purpose of fulfilling these services, enjoys the exclusive right to provide reserved postal services for a certain period of time. The Authority with the aim of further opening up the market, liberalising postal services, after analyses and comparisons with the relevant markets, adopted in 2013; 'Decision no. 432, for the determination of the weight scale - the limit for postal services reserved, recommending the initial level of weight change from (1) kg to five hundred (500) grams from the date; January 1, 2014, respectively to one hundred (100) grams from the date; 1 January 2016, (Ref. Decision No. 432, No. Prot. 046/B/13, dated 13/12/2013).

In addition to these services, CPE 'Post of Kosovo JSC' may provide other postal services (business services) outside the area of universal and reserved postal services.

On the other hand, private operators provide mainly express and courier services, out of which six (6) postal operators are licensed to provide postal services – domestic post, only within the territory of the Republic of Kosovo, whereas seven (7) others, including the CPE ‘Post of Kosovo JSC’ provides postal services in the international postal traffic as well.

Private operators that provide international postal services, operate as representatives of the globally recognised operators such as DHL, UPS, FedEx, TNT, SKYNET, etc.

6. The volume of postal shipments and market share in the Republic of Kosovo for 2016

Volume - the total number of postal shipments in 2016 in total was; 7,551,848; postal shipments - items, of which the CPE 'Post of Kosovo JSC' has had a total of; 7,259,159; postal shipments - items, which were received and distributed in the domestic and international traffic, while private operators have had a total of; 292.689; postal shipments - items received and distributed in the domestic and international traffic.

The total number of shipments destined namely received and distributed in the domestic traffic was 6,746,423; postal shipments - items, whereas the number of shipments received and/or distributed in the international traffic was 805,425; postal shipments - items.

CPE ‘Post of Kosovo JSC’ compared to private operators, has the highest number-volume of letter post in 2016, with around 7,259,159 postal shipments - items, considering that it provides a wide range of postal services, including the volume of shipments for domestic and international traffic, while private operators had in total 292,689 postal shipments – items from domestic to international traffic.

From the figure above, we notice that in 2016, compared to 2015, CPE 'Post of Kosovo JSC' has marked a slight increase by achieving a total market coverage in the value of; 96.12%, while private operators have experienced a decrease by covering the overall market with around; 3.88%.

Since 2016, private operators have received and distributed a very small number of 'Direct Mail' (Ref. 'PriMail LLC', a total of 96,600 Advertisements), then the number of shipments decreased significantly to private operators compared to previous years where they have been more active in distributing 'Direct Mail'. Whereas, the CPE 'Post of Kosovo JSC', has had an

From the total of postal shipments, around 50.90 % of shipments are letter posts (simple letter posts with special services), respectively about 4.16 %, are postal packages and about: 44.94 % are 'Direct Mail' (Advertisements).

The number of letter posts received, processed, carried - shipped and delivered respectively distributed to the domestic and international traffic for 2016, totals the figure of; 7,551,848; postal shipments - items, compared to 2015, that had around; 7,305,030; postal shipments - items, there is an increase in the total volume of postal shipments in a value of; 3.38 %. And if we compare 2016 to 2014, that was about; 5,508,050; postal shipments - items, then we note that we have an increase in a value of; 37.11 %, of the total volume of postal shipments.

From the figures presented above, based on the volume - the total number of postal shipments, it is noted that there is a continuous increase of the power and domination in the market of PPO, namely CPE 'Post of Kosovo JSC'. Therefore in 2016 CPE 'Post of Kosovo JSC', there has been an increase in the coverage of the postal services market of about; 96.12 %, in relation to private operators who have had a coverage of; 3.88 %, while in 2015, CPE 'Post of Kosovo JSC' has had a market coverage of value; 95.37 %, whereas private operators have had a market coverage in a value of; 4.63 %.

Index of the trend of shipments volume from 2012 to 2016, shows a continuous increase of shipments volume at CPE ‘Post of Kosovo JSC’, and a continuous decrease of volume at private postal operators.

The figure above shows that CPE ‘Post of Kosovo JSC’ during 2016 in comparison to 2015 marked an increase of 4.20 %, of the total volume of postal shipments, whereas private operators experienced a sharp decline of 13.50 %, in the total volume of postal shipments. If we compare 2015 to 2014, CPE ‘Post of Kosovo JSC’ marked an increase of 49.44 %, whereas the private operators marked a decline of 60.01 %.

Despite the increase in the overall number of volume of postal shipments in 2016 compared to 2015, it appears that in average per capita were accepted, processed, transported and divided 4.18 shipments – items. (Source: https://ask.rks-gov.net/ballina, dated 22/04/2016, total Population of Kosovo: 1,804,944 inhabitants), which means that in 2016, compared to 2015, there has been a slight increase of 0.14 %, which is still far lower than the average in developed and European Union countries.

From the figures above, it is noted that based on the total number of postal shipments around; 96.12 % of shipments were received and divided by CPE 'Post of Kosovo JSC', while about 3.88% were received and divided by private operators. Whereas, from the total number of postal shipments around; 89.33 %, of the number of postal shipments, had for destination domestic traffic - local mail, whereas only; 10.67 % of the total number of postal shipments had for destination the international traffic.

The above figure shows that from the total number of shipments that were destined for international traffic, CPE 'Post of Kosovo JSC' dominates the market with; 92.44 % of the volume - the total number of shipments, followed by '3P LLC', as representative of DHL - International, with; 4.46 %, and 'KCC LLC' as representative of TNT with; 1.42 %, while 'Al Dushi KPS' as a UPS representative has had a market value; 1.04 %, while all other operators are in value; 0.64 %.

From the figure above, which represents the volume of postal shipments for international traffic on incoming and outgoing, carried out by private operators, private postal operator; '3P LLC', as a representative of DHL - International, from the total number of postal shipments destined for and from international traffic, has had the largest number of shipments, and dominates the market around; 59.04 % of the volume - the total number of international postal shipments, followed by 'KCC LLC', as representative of TNT, which is represented on the market with around; 18.81 %, respectively from 'Al Dushi LLC' as representative of UPS with round; 13.33 %, while all other private operators are in value; 12.06 %.

8. Volume of postal shipments for CPE “Post of Kosovo JSC” 2016

CPE ‘Post of Kosovo JSC’, based on the comparisons presented above, is still considered and remains the leader in the market of postal services, namely in provision of universal services, as well as other postal services in the Republic of Kosovo with the highest volume - number of shipments – postal items with around 7.259.159; items – postal shipments, out of which around 6.514.643; shipments-items had as destination the internal traffic, whereas 744.516; items – shipments had as destination the international traffic, incoming and outgoing.

The following part of the document represents data on the volume – quantity of simple letter post, registered letter post and parcel post, represented or expressed in the number of shipments - items (piece) and divided by %, and type of the shipment for the internal traffic – domestic and international traffic, received and divided by the public postal operator CPE ‘Post of Kosovo JSC’, for the period Q1 - Q4, 2016, as well as comparison with the same period of 2015 and 2014.

From the figures above we note that in 2016, CPE 'Post of Kosovo JSC', from the total of postal shipments, divided by type of shipments, around; 89.74 %, were shipments destined for domestic traffic - local mail, while around; 10.2 6%, are shipped to and from international traffic. As for the total number of postal shipments around; 51.65 %, were postal letters, while around; 2.92 % were packages – parcel post, and around; 45.42 %, were 'Direct Mail' (Advertisements).

In 2016, compared to 2015, CPE 'Post of Kosovo JSC' has marked an increase of; 4.20 %, of the total volume of postal shipments, compared with 2012, there is an increase of; 78.21 %. So, despite the downturns in recent years, there is an increase of the volume of postal deliveries in the Republic of Kosovo.

The figures above show that during 2016, CPE ‘Post of Kosovo JSC', based on the total number of simple shipments including the 'Direct Mail', about 89.73 % are shipments destined to domestic traffic, namely, received and distributed in domestic level - domestic mail, and about 10.27 %, are shipments that belong to international traffic, respectively 8.86 %, are postal shipments received from international traffic, as well as 1.41 % of shipments sent in international traffic.

Compared to 2015, in 2016, CPE 'Post of Kosovo JSC' has marked a slight increase in the mail of simple letters in value; 3.67 %. It is worth mentioning that in the category of simple shipments belonging to the domestic post there are received and distributed about 3,297,424; items – shipments of 'Direct Mail' (Advertisements), which make up; 44.94 %; of the total number of postal shipments, which have considerably increased the number of simple shipments of domestic traffic and the total number of shipments received and distributed by the CPE 'Post of Kosovo JSC', for the period Q1 - Q4, Of 2016.

CPE ‘Post of Kosovo JSC’, based on the overall number of simple shipments and not counting the "Direct Mail" (Advertisements), there are 67.16 %, of shipments which constitute the domestic traffic, namely which are received and distributed in internal traffic – domestic mail, whereas abort 31.03 %, are shipments which belong to the international traffic, namely about 28.31 %, are shipments generated by international traffic, as well as 4.52 %, are shipments delivered in the international traffic.

The figures above show that in 2016, index of the changes in the volume of simple shipments marked a significant decrease compared to 2015 (Ref. Value: 4.36), whereas based on the destination traffic, in 2016 compared to 2015, CPE ‘Post of Kosovo JSC’ has an decrease of volume of simple shipments in internal traffic – domestic mail; 1.81 %, as well as an increase of volume of simple shipments received by the international traffic in the value; 2.87 %, whereas it is marked a slight decrease of simple shipments delivered in the international traffic in the value; 1.07 %.

The above figures show that CPE ‘Post of Kosovo JSC’ during 2016, from the total number of the registered shipments, around 90.24 %, were destined shipments, namely received and distributed in the internal traffic – domestic post, whereas around 9.76 %, of the registered shipments, namely around 6.77 %, have been shipments received from the international traffic, as well as around 2.99 %, of the shipments which were sent in the international traffic.

The figures above show that during 2016, CPE ‘Post of Kosovo JSC’, from the total volume of the parcel-posts, in the domestic traffic were received and distributed around 3.09 %, of parcel posts, whereas the highest volume of parcel posts, was received from incoming international traffic and that in the value of 86.81 %, whereas around 10.10 %, of parcel posts were delivered in the international traffic.

The above figures show that, based on the reports of private postal operators who provided domestic and international courier and Express services, in 2016 the postal operator ‘KOEX LLC’ had around 30.34 %, of the number of postal shipments, followed by the operator ‘3 P LLC’ Adresa: Str. (DHL) with around 21.78 %, who operated only in the international traffic, ‘NPT Burimi’ with 14.05 %, then ‘ACK LLC’ with 8.58 %, ‘GEP LLC’ with around 6.40 %, KCC LLC (TNT) with 5.85 %, ‘AL Dushi LLC (UPS)’, with 4,14 %, etc, whereas, all other operators are in the value of 22.91 %. The postal operator ‘Primail LLC’ from the total number of reported postal shipments of around 99,974; had around 96,600 shipments of ‘Direct Mail’, that were not taken into account, as consequence of impossibility of confirmation, whereas, were considered and calculated only 3374 postal shipments, that in the overall market volume participate with 1.72 %.

The above figures show that during 2016, the largest number of shipments around; 79.19 %, were received and distributed in the internal traffic – domestic post, whereas around 20.81 %, of the total number of shipments had as destination the international traffic, namely, were received for and from the international traffic. In comparison to 2015, where the number of shipments in the internal traffic – domestic post, was around 80.13 %, whereas the international was around 19.87 %, it is observed a small decline in the domestic traffic – domestic post, namely, small increase of number of shipments for and from the international traffic.

We can also point out that with private operators the highest number of postal shipments during the previous years was as result of the distribution of ‘Direct Mail’. Now they are quite inactive in providing of this service.

It is also noted that during 2016, the largest number of shipments 32.37 %, were postal deliveries, where around 34.62 %, parcel posts, and around 33.00 %, were the postal shipments, namely ‘Direct Mails’ (Advertising). Reporting of ‘Direct Mail‘, namely, receiving and their distribution remains the responsibility of the declaration of the postal operators, while the possibility of their verification is impossible, due to the lack of agreements – contracts between businesses and operators.

From the figure above relating to the international traffic, carried out by private postal operators, it is observed that the private postal operator ‘3 P LLC’, as representative of ‘DHL – International‘, has the market share of about 59.04 %, of the total market in international traffic, and is a leader in the international traffic, followed by ‘KCC LLC’ as representative of ‘TNT‘, with 18.81 %, and ‘Al Dushi LLC’, as representative of ‘UPS‘, with around 13.83 %, namely ‘NTP Vlora Komerc’ as the representative of ‘FedEx‘, with 4.81 %. Whereas two other operators ‘ACK LLC’ and ‘CALI LLC’ as representatives of ‘SKYNET‘, have about 4.02 % of the overall market.

10. Data on revenues in the Postal Sector for 2016

Pursuant to the provisions of the ‘Law No. 03/L-173, on Postal Service, ‘Administrative Instruction No. 05/2012, on Licensing of Postal Operators, and ‘Decision No. 697 for ‘Approving the Fees for Licensing the Postal Operators and Establishment of Regular Annual Fee (One-Off- Fee) for Postal Service Operators ‘(Ref. Decision697, No. Prot. 042/B/15, dated; 15/10/2015), postal operators presented – reported to the Authority, the ‘Financial Statements for 2016’, in accordance with the foreseen legal rules and regulations.

According to the official data reported by the postal operators, the Authority managed to obtain and calculate the revenues in the postal service sector for 2016, whose total turnover and balance of revenues amounted to 5,857,040.61 Euros.

When compared to official data reported in 2015 (Ref. ‘Report of RAEPC for 2015, submitted to the Assembly of the Republic of Kosovo), where the total of revenues of postal sector amounted to 5, 42,181.46 Euros, it is observed that that the postal service sector in 2016, had a significant increase in total revenues from postal services, in the amount of around 13.90 %, whereas compared to 2012 had an increase of 30.37 %.

Below you will find comparative data of total revenues of the postal sector during the period 2011 – 2016, broken down by the market by the revenues of the postal operators individually, the market share by % of participation in the market, as well as the comparison of revenues of PPO, CPE ‘Post of Kosovo JSC’ and private postal operators.

The figure above shows that the postal services sector in 2016, marked an increase of; 13.90 %, compared to 2015, whereas in the same period of 2015 compared to 2014 there was an increase about; 12.07 %. Whereas compared to 2012, in 2016 we have a constant increase and that in the value of; 30.37 %, which shows that we have a stable and sustainable growth and development of the postal service market in the Republic of Kosovo.

On the basis of the revenue of the postal sector, it turns out that CPE ‘Post of Kosovo JSC’, dominates the market with around; 67.10 %, of revenues in the postal sector, while private operators, despite the increased revenue of operators, possess around; 32.90 %, of total revenues.

In 2015, CPE ‘Post of Kosovo JSC,’ in comparison with private operators, marked a slight increase of revenues compared to previous year, namely 2015, covering the market with around; 67.10 %, of the overall market of the postal services sector. Whereas during 2015, CPE ‘Post of Kosovo JSC’ in comparison with private operators, has implemented or had a coverage in value; 61.73 %, of overall market revenues in the postal services sector.

While comparing to 2012, CPE 'Post of Kosovo JSC', marked a slight increase in value of; 26.30 %, of overall revenues, in relation to the revenues of private postal operators that also marked an increase in value; 39.52 %.

The index of revenue 2016, compared with 2012 shows that CPE 'Post of Kosovo JSC' marked an increase of revenues in value of; 0.26, of overall revenues, while private postal operators also marked an increase in value; 0.40.

11. Data on quality and standards of implementing universal postal service delivery,

The quality and standards of service delivery is one of the key elements to measure the quality of postal service delivery. The criteria amongst EU communities are determined pursuant to Article 16 of Directive 97/67/ EC.

Whereas criteria for quality standards of universal postal service delivery within countries – domestic and cross-border mail, are determined by the Member States themselves namely the relevant bodies regulating the postal services sector. For this purpose, the Authority within its responsibilities and competences, during 2016 issued the following:"Regulation on quality standards for delivery of universal postal services, (Ref. Regulation No. 23, Prot. No. 004/B/14, dated 24/02/2014) which determines the standards for delivery of universal postal services within the territory of the Republic of Kosovo.

In this report we have presented data about universal services reported on quarterly basis from the CPE ‘Post of Kosovo JSC’ and the time limits and the time of distribution of postal shipments.

The figures below reflect the data on: quality of delivery – deliveries of postal shipments, namely the number of postal shipments distributed - delivered by days (D- day of receipt, n- days within which the item was delivered), within one Region and to other Regions, reported by CPE "Post of Kosovo JSC", for the period Q1 - Q4 2016.

Whereas, CPE ‘Post of Kosovo JSC’, in compliance with the Regulation No. 23, conducted an internal test within a certain time period, and applied the following criteria, methodology and samples:

1. The size of the sample involved in testing is 8.634 postal shipments in total, according to categories presented below: o 9.217; simple letter posts, domestic traffic; o 2.330; express priority letter posts, domestic traffic; o 28; domestic parcel posts; o 127; shipments from international postal traffic; 2. Time period for conducting the measurements was the month of December 2016, and in the following order: o Simple non-priority shipments: 15 -20/12/2016; o Express priority shipment: 10-12/12/2016; o Domestic parcel posts: 02-06/12/2016; o Cross border mail, international: 12-16/12/2016;

3. Territory covered by the test was the Regional Post offices of CPE "Post of Kosovo JSC" in’: Pristina, , , Ferizaj, , Gjilan, Mitrovica, and the municipal and rural post offices within these regional posts.

One of the most important stages of the postal service process is the transport of postal deliveries which directly affects in achievement of quality standards of universal postal services. Receiving, processing, sorting and preparation for distribution of all postal deliveries,

After processing these deliveries, preparation for distribution is made if their further destination remains within the territory of the Republic of Kosovo.

The results of the internal testing based on the quality assessment presented in the tables above, and the clarification provided through graphs, determine that the assessment process was conducted correctly and professionally by CPE ‘Post of Kosovo JSC’, whereas the quality of local and cross-border mail delivery within the territory of the Republic of Kosovo, results to be successful, always based on the standards and time limits set by the Regulatory Authority of Electronic and Postal Communications (RAEPC) for the transfer and distribution of postal shipments in entirety.

12. Data on human resources involved in the postal sector

The following graphs reflect the data on the number of employees in the postal sector, number of personnel engaged-involved directly or indirectly in the provision and implementation of postal services by the end of the calendar year, presented in numbers and %, and broken down by the number of postal operators for 2016, and the comparison and trend during 2015 and 2014.

Based on figures above, we notice that the index of trend of the number of employees shows a continuous increase from 2012, whereas in 2016, in comparison with 2015, we have an increase of around; 0.02.

Based on figures above, we notice that in 2016 in the postal sector about 1105 employees were engaged; while in 2015 around 1085 employees were engaged. In comparison with 2015 in 2016 there is an increase of 1.94 %, while CPE 'Post of Kosovo J.S.C' has the largest number of employees around 1003 employees - officials, and covers the postal service sector with 90.69 %, while in the private sector, private operators have employed around 103 employees, respectively around 10.27 %,.

The postal sector continuously over the years marked a continuous increase in the number of employees in the postal sector, and if we compare the number of employees in 2016 with the number of employees in 2012, then we notice that there is an increase in the value of; 9.83 %.

13. Complaints of users - consumers of postal service, 2016

Postal services operators are obliged to review - address any users – consumers’ complaint in accordance with the legal provisions in force regarding the provision of postal services, failure to provide the service within the time limits foreseen by legal provisions, loss or damage to deliveries etc. Results on complaints received by users – consumers of postal services, according to the data reported and received by the postal operators within the Authority, are presented in the following figures.

CPE ‘Post of Kosovo J.S.C’ reported that during 2016 were received about; 1.523 complaints, of users - consumers of postal services of which 1.184; have been addressed and resolved by the operator, whereas 678; complaints of users - customers have remained unresolved, some of them from the previous year. Whereas during 2015, CPE ‘Post of Kosovo J.S.C’, received 2387 complaints, out of which 2216 were resolved, while the number of complaints under the review procedure and which were transferred to the following year is 1085 complaints. From solved cases, which in total were 1.523; complaints by the end of 2016, users - consumers of postal services were compensated in the amount of 6.080 € and compared to 2014, the amount of compensation was 4,012.69 €.

Whereas private operators did not report any users-consumers complaint on postal services provided during 2016, which is also indicated in their reports submitted to the authority.

14. Data on the infrastructure – postal network

The infrastructure and postal network are of particular importance for the functioning of postal service sector and for provision of more qualitative postal services, therefore the need to create a better and more modern infrastructure is necessary to establish a more efficient system for functioning of postal sector. The total number of post offices in the entire territory of the Republic of Kosovo in 2016 is 195 post offices for collection of shipments. Compared to the number of inhabitants (Source; https://ask.rks-gov.net/ballina, dated on 22/04/2016, total population of Kosovo: 1.804.944 inhabitants-number of inhabitants in RKS), results that a post office serves to 9.256 citizens,

In these post offices, in total are 365 active desks that perform different postal services. Whereas for transferring and transporting these postal shipments 381 different transport vehicles are engaged.

CPE "Post of Kosovo JSC”, performs its postal activity based on its postal network and infrastructure available in 155 postal offices, organized in 7 regions, out of which, 101 post offices are located in urban areas – cities, whereas 54 in rural areas – villages, with a total of 330; desks, and 540; post boxes placed at the entrance of the post offices and various public locations (Ref. Report of PK JSC – Q4 2016). Also, CPE "Post of Kosovo JSC” within its post offices has in its disposal also around 3355; Post Boxes throughout the network, mainly placed at the main offices in big cities. Within its network also functions the "Postal Transit Centre" (PTC) which processes, sorts and transports (exchanges) postal shipments for domestic and international traffic.

Private postal operators exercise their postal activity mainly in the capital city, Prishtina, and have smaller number of post offices, respectively around 43, respectively postal agents that have one desk for receiving postal shipments, whereas some of them also exercise their activity in other major cities of the country through their postal agents, who are known to the Authority.
