Charles Mix County, South Dakota LOCATION AND SCOPE Springfield The0 proposed4,000 8,000 project includes two segments of the existing Nebraska Highway 12 (N-12) roadway east and west of the Village of XW Niobrara, in Knox County, Nebraska. The highway experiences flooding and damage due to high water levels associated with the Feet MissouriXW River. The U.S. Army Corps of Engineers (Corps) and NDOT are proposing to improve N-12 and provide a reliable and stable roadway85 for4 the region. The ultimate configuration will be a two-lane roadway with paved shoulders. NDOT, working with the Corps, developed a new project purpose and need and re-evaluated the proposed design criteria that resulted in new alternatives being identified. PURPOSE & NEED SUMMARY The purpose of the proposed project is to rehabilitate the existing roadway to maximize utilization, improve the safety and reliability, and bring the roadway up to current NDOT design standards for a major arterial highway between Verdel, Nebraska and Santee Spur (S-54D). The project is needed due to ongoing risk of flooding, unreliable operations, and interruptions to regional connectivity. TYPICAL SECTION OF ALTERNATIVE CONSIDERED The following illustrates the alternatives considered that satisfy the purpose and need for the project. Alternative R-1 was identified as NDOT’s preferred alternative based upon an evaluation of impacts and is being refined in the design process to further minimize impacts and provide for efficiencies where possible. It is anticipated sections of N-12 will be closed during construction with through traffic detoured along existing highways and local traffic maintained using a combination of the existing roadway and other local roads. Access to existing or proposed future driveways may be limited during construction due to construction sequencing. The Applied-for Project is the alternative for which NDOT has submitted an application for a US Army Corps of Engineers (Corps) Section 404 of the Clean Water Act (Section 404; 33 United States Code [USC] 1344) permit. This SDEIS informs decision makers and the public of the environmental impacts of the Applied-for Project, and the reasonable alternatives that would avoid or minimize adverse impacts or enhance the quality of the human environment. The Corps’ Omaha District, Regulatory Branch, received a Section 404 permit application from the applicant, NDOT, on September 11, 2015. NDOT requested authorization for the placement of fill material in waters of the US in connection with NDOT’s proposed project east and west of the village of Niobrara, Nebraska. The Corps, as part of its permit review process, developed a Draft Environmental Impact Statement (EIS) in compliance with the requirements of the National Environmental Policy Act of 1969 (NEPA).1 A Draft EIS for this project was released on October 9, 2015. A public open house and hearing was held on November 9, 2015. During the public comment period that was scheduled to close on November 23, NDOT elected to withdraw its Section 404 permit application on November 20, 2015.

Segment 1 is approximately 6.4 miles long and extends from just east of Verdel, Nebraska, on the west end to 2 miles west of the bridge over the Niobrara River. Segment 2 is approximately 6 miles long and extends from just east of Spruce Avenue in Niobrara, Nebraska, to approximately 1 mile east of Nebraska Spur-54D (see attached figures). The overall project purpose is to provide a reliable and safe roadway that meets the existing and projected traffic needs for the region. This project purpose will be used to evaluate the full range of alternatives under Section 404 (b)(1) guidelines. The need for the project is based on the following problems and/or concerns caused by the high water levels and flooding: instability of the existing roadway; driver hazard; roadway maintenance countermeasures; and traffic disruption.

    APPENDIX K Public Involvement r.'P'r:'I ~ FOR IMMEDIATE RELEASE Comments Requested on the Nebraska Highway 12 – Niobrara East & West Project May 2, 2019 - The U.S. Army Corps of Engineers (Corps) is preparing an Environmental Impact Statement (EIS) in accordance with the National Environmental Policy Act (NEPA) for Nebraska Highway 12 (N-12) Niobrara East & West (Project) in Knox County sponsored by the Nebraska Department of Transportation (NDOT). NDOT proposes an on-alignment route constructed under traffic. Alternatives to this proposal will be evaluated during the NEPA process. In March 2019, northeast Nebraska experienced severe flooding that impacted homes, farms, businesses, and Nebraska’s transportation system. The east and west portions of N-12 that are a part of the Project were impacted by flooding. NDOT continues to focus on recovery efforts across the state in addition to the commitment and delivery of projects already underway. Please see the Nebraska 511 website (https://www.511.nebraska.gov/) for current status of road closures, detours (if applicable), and status of re-opening. At this time, NDOT is proceeding with the N-12, Niobrara East & West Project. The Corps is developing a Supplemental Draft Environmental Impact Statement (SDEIS) for the Project. A Draft EIS for this project was released on October 9, 2015, with a base-of-bluffs preferred alternative (A7). A public open house and hearing was held on November 9, 2015. After the public comment period ended, NDOT elected to withdraw its Section 404 permit application on November 20, 2015. Since that time, NDOT has developed a modified project purpose and need, and alternatives responsive to this purpose and need.
