Columbus Barrel & Bottle Fest Vendor Contract

1. Services Vendor agrees to packages as outlined under Barrel and Bottle Fest Vendor Order. Vendor is able to add any packages to their Festival Vendor Order (e.g., sponsorships), given they are still available at the time, at the price that is currently listed. Vendor may not remove packages from their Festival Vendor Order. Payment is due upon approval of your Festival Vendor Package.

2. Alcoholic Beverages The selling or providing of alcohol to anyone under the age of 21 is illegal in Ohio. No guests under the age of 21 will be permitted to enter the Event. If there is any member of a Vendor team under the age of 21 that plans to be present at any Vendor site during the Event for any amount of time, Swan Lake must be notified immediately and they will be given an identifying wristband with their credentials and will NOT be allowed to possess, purchase, or consume alcohol at the Event. If any Vendor, regardless of age, is suspected of drinking in excess or is acting belligerent during the Event, Swan Lake has the right to have security escort this Vendor off the property with no refund and no further responsibility owed to said Vendor (see sect. 12).

3. Security A security team will be present throughout the event. We want to ensure you and you and all attendees have an enjoyable and safe time during the event. Vendors are required to wear Vendor Access wristbands for the entirety of the festival. If you are found without your wristband or credentials, our security team has permission to remove you from the festival. 4. Restrictions Swan Lake tables must be covered by a linen. All cords must be out of the way of foot traffic or covered. Vendors must supply all of their own materials such as plates, utensils, etc. Vendors cannot play music that can be heard outside of their space. Vendors are responsible for properly disposing of their trash and and cannot leave trash behind at their vendor space. All Vendors must enclose lit candles in (e.g. votives, hurricanes). Scented candles are only permitted outdoors. No confetti, glitter, or rice is permitted as it could harm our wildlife. Swan Lake does not allow any decorations or marketing materials to be stapled, taped, nailed, or any other hanging method on walls, floors, ceilings, trees or Swan Lake provided tables and chairs. If any Vendor damages Swan Lake property or rentals, they will be responsible for covering the cost of this damage and will be billed within two (2) weeks after the Event.

5. Attendance Policy If a Vendor does not show up to claim their spot or leaves before the scheduled end-time of the event, they will be subject to a Withdrawal Fee ($50) and are not permitted to participate as a Vendor the following year. All Vendors must arrive and check-in within the scheduled set-up time on the day of each event. Any Vendors who arrives after the end of their scheduled set-up time will not be allowed to participate and will not be refunded.

6. Inclement Weather This festival will be held or shine (see sect. 11). Vendors will not be refunded for the price of their Vendor Package due to inclement weather. In the days leading up to the event, additional indoor space may become available as an upgrade to any Vendor package that includes an outdoor space. Swan Lake Event Center cannot be held responsible for power outages.

7. Smoking Policy Swan Lake Event Center is a smoke-free environment. Smoking is only allowed in designated smoking areas. There are containers on-site for disposing of smoking debris. Swan Lake reserves the right to charge for any clean up on the property for inappropriately discarding smoking debris (including on the grounds or in the lake). Vaping is allowed outside so long as it is not disruptive to guests and other vendors.

8.Parking Free parking and shuttle service to and from the festival will be provided in a nearby lot. On-site parking will be available in select Sponsor and Vendor packages. Any vehicles must be removed from Main parking lot at least 20 minutes prior to guest arrival.

9. Force Majeure Notwithstanding anything herein contained to the contrary, no party shall be liable to any other for damages because of any failure to perform hereunder caused by any cause beyond its control, including but not limited to cancellation or postponement of the group, natural disaster, accident, casualty, labor controversy, civil disturbance, embargo, war, act of terrorism, threat of terrorism, act of God, weather, any government ordinance or law, the issuance of any executive or judicial order (see sect. 11). 10. Harassment In the event that any form of harassment may ensue, it is understood and agreed upon that all contracted services will cease immediately with no further obligation or responsibility owed to you. Harassment includes: -Any type of verbal, sexual or physical harassment -Rude and/or erratic behavior by any vendor team member to any member of the Swan Lake Team, including security and volunteers or guests -Drinking excessively or acting belligerent -The overuse of foul or graphic language -General lack of cooperation This pertains to any harassment during the planning process leading up to the Event, and the Event itself. If any harassment ensues in the planning process, Swan Lake will terminate services immediately with no refunds given. If any harassment ensues on the day of the Event, Swan Lake will immediately contact security and all members of your vendor team will be escorted off the property. There is a zero-tolerance policy on harassment. Swan Lake has the right to cancel this agreement due to anything we see as harassment at any time with no refunds given. We reserve the right to pursue any and all legal action, including without limitation, civil and criminal prosecution as it relates to such harassment. In any legal action we may seek under and through this section, you agree to pay any and all of Swan Lake Event Center's attorney fees. 11. Act of God In the event that an act of God was to occur (e.g., natural disaster, pandemic-related mandate) and the event cannot be carried out for its entirety, a 50% refund will be issued to all vendors and sponsors within two (2) weeks after the scheduled festival end-date.

12. Food Trucks All food truck vendors must adhere to vendor contract as well as stipulations listed in this section. All food truck vendors must supply their own electricity/generator. Food trucks may not dispose of any fryer oil or waste on site. Must haeve General Liability of $1,000,000 and list Swan Lake Event Center LLC as Additional Insured, plus Auto Liability of $1,000,000 with Swan Lake Event Center LLC Additional Insured. Copies of both must be submitted to Swan Lake by August 31, 2021. In case of inclement weather, your location may change. This is up to the discretion of Swan Lake Event Center.

13. Insurance, Licensing, Liability All Vendors must have General Liability of $1,000,000 and list Swan Lake Event Center LLC as Additional Insured. Copy of which must be submitted to Swan Lake by August 31, 2021. Vendor certifies that they are in possession of the correct licensing and permits according to the State of Ohio and Liberty Township to sell their alcohol, food, or goods at Swan Lake Event Center. Vendor will submit a copy of any Temporary Food Facility Permits they obtain to Swan Lake Event Center.
