SITE & VICINITY DESCRIPTION (see attached map) The subject property is located South of 3100 South, in the center of the block, surrounded by existing developed properties. The predominant types of neighboring housing are single-family homes and condominiums. Request: Subdivision File #: 30936 GENERAL PLAN CONSIDERATIONS The general plan is supportive of creating additional housing and a variety of housing options, this subdivision will allow for the eventual addition of a single-family dwelling and guest house as part of the housing options available within the Magna Metro Township. Yes Compliance with Landscaping Requirements Verified. No Compliance with the General Plan. Yes ISSUES OF CONCERN/PROPOSED MITIGATION One issue of concern is the narrow access to the main property. While the limited access can meet the minimum paved width of 16 feet for a flag lot, it does not meet the minimum landscape requirement on both sides of the pavement. Also, existing utility infrastructure also impacts the width of the access at the street. The applicant will be required to obtain fire code modifications from the Unified Fire Authority, which may include the requirement to add fire sprinklers to the home(s). As for the lack of an additional 4 feet of landscaping on the East side of the access drive pavement, staff is supportive of the Planning Commission allowing for the modification to the standard to eliminate that landscaping based upon the layout of the neighboring property to the East which is also a flag lot, but one that does not currently conform to the current policy. Allowing for this modification allows for potential future cooperation between property owners to mutually improve access to both rear properties. PLANNING STAFF ANALYSIS The subject property is comprised of two pieces of property that combined will create a flag lot. As the property was created through parcel divisions that did not comply with Subdivision regulations at the time, the one lot subdivision application was necessary at this time to remedy the situation and verify that the lot does indeed meet minimum subdivision standards. Another issue that needs to be addressed is the required landscaping. The current plans show the location of where landscaping will go, but not what landscaping will be installed. Staff believes that this can be simply remedied by providing a plan that meets the intent of the policy to staff for review and approval prior to signature on the final plat. The following is an excerpt from the flag lot policy regarding landscaping along the access drive: E. The area within the access connection between the required travel way surface improvements and the property line(s) or easement line(s) shall be planted in its entirety and maintained as a landscaped buffer in accordance with plans reviewed and approved as part of the flag lot subdivision approval process. The plans shall be designed to one of the following design standards: 1. Eight feet of landscaping buffer split between both sides of the access travel way with one tree and four shrubs per 25 lineal feet; or, 2. Where the access drive is adjacent to the subdivision boundary: i. Five feet of landscaping buffer with a solid visual barrier fence along the exterior property line with one tree and six shrubs per 25 lineal feet; or ii. Zero feet of landscaping buffer with a solid visual barrier fence along the exterior property line and the use of County approved permeable pavers or permeable pavement as the road surface. The Planning Commission may approve an alternative landscape buffer proposal that is in line with the intent of this section to accommodate unusual circumstances on the property such as topography, natural hazards, lot size, lot shape, or the preservation of existing vegetation. PLANNING STAFF RECOMMENDATION Staff recommends that the Magna Metro Township Planning Commission approve application #30936 for a one lot subdivision as proposed with the following conditions: 1. That a landscape plan be submitted to planning staff for final approval that is in line with the intent of the flag lot policy. 2. That the landscaping along the access drive be installed or a bond guaranteeing the installation of the required landscaping be posted prior to recordation of the Final Plat.
