ISSUES OF CONCERN/PROPOSED MITIGATION

One issue of concern is the narrow access to the main property. While the limited access can meet the minimum paved width of 16 feet for a flag lot, it does not meet the minimum landscape requirement on both sides of the pavement. Also, existing utility infrastructure also impacts the width of the access at the street. The applicant will be required to obtain fire code modifications from the Unified Fire Authority, which may include the requirement to add fire sprinklers to the home(s).

As for the lack of an additional 4 feet of landscaping on the East side of the access drive pavement, staff is supportive of the Planning Commission allowing for the modification to the standard to eliminate that landscaping based upon the layout of the neighboring property to the East which is also a flag lot, but one that does not currently conform to the current policy. Allowing for this modification allows for potential future cooperation between property owners to mutually improve access to both rear properties.

PLANNING STAFF ANALYSIS

The subject property is comprised of two pieces of property that combined will create a flag lot. As the property was created through parcel divisions that did not comply with Subdivision regulations at the time, the one lot subdivision application was necessary at this time to remedy the situation and verify that the lot does indeed meet minimum subdivision standards.

Another issue that needs to be addressed is the required landscaping. The current plans show the location of where landscaping will go, but not what landscaping will be installed. Staff believes that this can be simply remedied by providing a plan that meets the intent of the policy to staff for review and approval prior to signature on the final plat. The following is an excerpt from the flag lot policy regarding landscaping along the access drive:

E. The area within the access connection between the required travel way surface improvements and the property line(s) or easement line(s) shall be planted in its entirety and maintained as a landscaped buffer in accordance with plans reviewed and approved as part of the flag lot subdivision approval process. The plans shall be designed to one of the following design standards: 1. Eight feet of landscaping buffer split between both sides of the access travel way with one tree and four shrubs per 25 lineal feet; or, 2. Where the access drive is adjacent to the subdivision boundary: i. Five feet of landscaping buffer with a solid visual barrier fence along the exterior property line with one tree and six shrubs per 25 lineal feet; or ii. Zero feet of landscaping buffer with a solid visual barrier fence along the exterior property line and the use of County approved permeable pavers or permeable pavement as the road surface.

3. The Planning Commission may approve an alternative landscape buffer proposal that is in line with the intent of this section to accommodate unusual circumstances on the property such as topography, natural hazards, lot size, lot shape, or the preservation of existing vegetation.

PLANNING STAFF RECOMMENDATION

Staff recommends that the Magna Metro Township Planning Commission approve application #30936 for a one lot subdivision as proposed with the following conditions: 1. That a landscape plan be submitted to planning staff for final approval that is in line with the intent of the flag lot policy. 2. That the landscaping along the access drive be installed or a bond guaranteeing the installation of the required landscaping be posted prior to recordation of the Final Plat.

PLANNING STAFF RECOMMENDATION

The Planning Staff is recommending approval of the proposed fencing (see sample picture below) to be placed around the perimeter of the project. Staff also believes the applicant should not be required to landscape the project area, but should reclaim the property to its original vegetation state, since it will be behind an opaque fence.

This is a request for approval of a Conditional Use PUD Site Plan to allow for construction of a retail building and a restaurant site. This property is part of the Flangas Crossing PUD subdivision, as well are the Qquirrh Hills Apartments, the Burger King, the Family Dollar store and the vacant lots to the south of the Family Dollar along 8400 West. ****Review of north elevation façade along Magna Main Street.

PLANNING STAFF ANALYSIS/RECOMMENDATION

At the October 10th, when this application received preliminary approval, the topic of the north facing façade along Magna Main Street was discussed. The discussion was regarding whether the façade could be changed to look more like a store front rather than the back of a building, since it is positioned along Magna Main Street. One of the main options that was discussed was possibly adding faux windows to look like a store front side.

The applicant has come back with a very similar look as his original submission. Staff does not think that this is a significant change to what the Planning Commission wanted.

Staff has designed a proposed look and thinks the Planning Commission should consider this for the façade.

Planning Staff is recommending denial of the façade proposed by the applicant.

PROJECT DESCRIPTION

The applicant is requesting Exception Request for a waiver from having to install curb, gutter and sidewalk along this project property of Lot 1 of Jack Ass Flats Subdivision.

SITE & VICINITY DESCRIPTION (see attached map)

The property is located off 2100 South in the newly subdivided Jack Ass Flats subdivision. The property in question is the interior lot of the subdivision. The property to the east is in Salt Lake City’s jurisdiction and currently stores jersey barriers. The properties to the west and south are both vacant lands, zoned A-20 (Agriculture). The property to the east is zoned M-2.

PLANNING STAFF ANALYSIS

Jack Ass Flats Subdivision Plat was recorded with the requirement that “curb, gutter, and sidewalk improvements are required at the time of any land use approval and/or building permit”. Planning Staff believes the applicant was made aware of this at the time that they made application for the Conditional Use request. Although there are no other improvements along this roadway, Planning Staff believes at this time curb and gutter should not be waived and these improvements should be installed. As for the sidewalk, Staff believes this too should not be waived but perhaps the applicant can be required to sign a 10 year delay agreement, so that if the sidewalk is called to go in within that 10 year period, this applicant would be required to put in the sidewalk at their cost.

Request: Exception Request File #: 31069

Greg Shultz, Managing Director, recommends to the Council that the waiver be denied. And has stated “the fact that the property sits in the Utah Inland Port footprint and is surrounded by other properties that are highly likely to see development in the near term. Waiving required infrastructure is not the responsible move here and sets a trend for others to ask for the same treatment. The improvements are required, per ordinance, so if they want to develop the property, they need to install the required infrastructure.”

Crystal Hulbert, County Transportation Engineer, has stated that “Engineering does not think it is imperative for sidewalk or curb and gutter to be installed for this application at this time…”

PLANNING STAFF RECOMMENDATION

Planning staff recommends that the Magna Metro Township Planning Commission forward a recommendation to the Magna Metro Mayor (or his designee) that the exception to the installation of roadway improvements be denied, and that the roadway improvements be installed as required, and that instead a delay agreement be entered into between Magna Metro Township and the applicant to allow for a delay of the installation of the required sidewalk at a later time when requested by engineering and the Metro Township (up to 10 years).
