ESTABLISHMENT OF SMALL CLAIMS COURTS FOR THE AREAS OF KRUGERSDORP, ROODEPOORT, RANDFONTEIN AND WESTONARIA AND WITHDRAWAL OF GOVERNMENT NOTICE NO. 910 OF 4 NOVEMBER 2011

I, Andries Carl Nel, Deputy Minister of Justice and Constitutional Development, acting under the power delegated to me by the Minister of Justice and Constitutional Development, under section 2 of the Small Claims Courts Act, 1984 (Act No. 61 of 1984), hereby -

(a) (i) establish a Small Claims Court for the adjudication of claims for the area of Krugersdorp, consisting of the district of Krugersdorp;

(ii) determine Krugersdorp to be the seat of the said Court; and

(iii) determine Krugersdorp to be the place in that area for the holding of sessions of the said Court.

(b) (i) establish a Small Claims Court for the adjudication of claims for the area of Roodepoort, consisting of the district of Roodepoort;

(ii) determine Roodepoort to be the seat of the said Court; and

(iii) determine Roodepoort to be the place in that area for the holding of sessions of the said Court.

(c) (i) establish a Small Claims Court for the adjudication of claims for the area of Randfontein, consisting of the district of Randfontein;

(ii) determine Randfontein to be the seat of the said Court; and

(iii) determine Randfontein to be the place in that area for the holding of sessions of the said Court.

(d) (i) establish a Small Claims Court for the adjudication of claims for the area of Westonaria, consisting of the district of Westonaria;

1. I, Mrs B E E Molewa, in my capacity as the Minister of Water and Environmental Affairs, hereby levy, in terms of the authority vested in me by section 11 of the Water Research Act, 1971 (Act No. 34 of 1971), the following rates and charges:

(a) Four hundred and seventy three cents (473c) in respect of each hectare of land of which the water use is permissible during the 2012/2013 water year in terms of section 22(1)(a)(ii) of the National Water Act, 1998 (Act No. 36 of 1998), or in respect of which an allocation has been made under Chapter 4 of the said National Water Act for the irrigation thereof at any time during the said water year, with water supplied or made available from any government water work. These rates and charges shall be recovered by or on the instructions of the

Director-General: Water Affairs, simultaneously with any other charge which I may make in respect of the land concerned during the said period in terms of section 57 of the said National Water Act or,if no such charge is made, the charge shall be payable upon demand to the Director-General: Water Affairs. (b) The amount mentioned in 1(a) above shall apply in respect of each hectare of landpermittedunder thecontrolofanirrigationboardorother water management institution established in terms of the said National Water Act for the irrigation of land at any time during the 2012/2013 financial year of such board or institution with water supplied or made available from a government water work or a water work belonging to such board or institution. This charge shall be recovered by the irrigation board or statutory body concerned and shall be remitted to the Director-General: Water Affairs within thirty (30) days of the close of the financial year of that irrigation board or statutory body. (c) With effect from 1 July 2012, four comma six zero cents (4,60c) per cubic meter in respect of metered water supplied or made available from a government water work for purposes other than the irrigationof land: Provided thatif a free allocation has been made to a specific consumer from a government water work, the said charge shall not apply to that allocation as it shall be deemed to be water supplied from his own sources by the consumer concerned. These charges shall be recovered by the Director-General: Water Affairs, simultaneously with any charge which I may make in terms of section 57 of the National Water Act in respect of the supply of water as from the said date or shall be payable to him upon demand. (d) With effect from 1 July 2012, four comma six zero cents (4,60c) per cubic meter in respect of the quantity of water supplied or made available for use for urban, industrialor domestic purposes by a statutory body or water management institution established in terms of the said National Water Act or by any other water services institution as defined in terms of the Water Services Act, 1997 (Act No. 108 of 1997): Provided that there shall be deducted from the total quantity of water supplied or made available after 1 July 2012 by any one of the abovementioned suppliers the quantity of water supplied or made available from a government water work as contemplated in paragraph 1(c) and the quantity of water obtained from any of the abovementioned suppliers after that date in respect of which the charge referred to in paragraph 1(c) or (d) has already been paid. The total amount payable in terms of this paragraph in respect of water supplied or made available shall be remitted by the supplier concerned, so as to reach the Director-General: Water Affairs, Private Bag X313, Pretoria, 0001, or such other offices as may be agreed upon, as follows: (aa) In respect of the period 1 July to 31 December of each year, on or before 31 March of the ensuing year; and (bb) in respect of the period 1 January to 30 June of each year, on or before 30 September of the same year.

The audited statements prescribed in terms of section 11(3)(b) of the said Water Research Act shall be submitted as soon as possible after the payments mentioned in paragraph 1(d) have been made.

2. If such rates and charges remain wholly or partly unpaid after the due date, interest shall be charged in terms of section 80(1)(a) of the Public Finance Management Act, 1999 (Act No. 1of 1999) on the outstanding amount at a rate determined from time to time by the Minister of Finance, on loans granted out of a Revenue Fund.

3.For the purpose of this notice, one cubic meter shall be equal to one kiloliter.

(c) Met ingang van 1 Julie 2012, vier komma ses nul sent (4,60c) per kubieke meter ten opsigte van gemeterde water wat vir ander doeleindes as die besproeiing van gronduit'nstaatswaterwerk verskaf of beskikbaar gestel word: Met dien verstande dat waar aan'nbepaalde verbruiker'ngratis toewysinguit'n staatswaterwerk gemaak is, genoemde vordering nie op daardie toewysing van toepassing is nie deurdat dit geag word water te wees wat deur die betrokke verbruiker uit eie bronne voorsien is. Hierdie vordering word deur die Direkteur- generaal: Waterwese verhaal, gelyktydig met enige vordering wat ek kragtens artikel 57 van die Nasionale Waterwet hef ten opsigte van die verskaffing van sodanige water vanaf genoemde datum, of is op aanvraag aan horn betaalbaar. waterdiensteinstelling soos omskryf in die Wet op Waterdienste, 1997 (Wet No. 108 van 1997): Met dien verstande dat daar van die totale hoeveelheid water wat na daardie datum verskaf of beskikbaar gestel word deur een van bogenoemde verskaffers, die hoeveeldheid water afgetrek moet word wat veskaf of bekikbaar gestel is uit 'n staatswaterwerk soos bedoel in paragraaf 1(c) en die hoeveelheid water wat na daardie datum van enige van bogenoemde verskaffers verkry is ten opsigte waarvan die vordering in paragraaf 1(c) en (d) bedoel, reeds betaal is. Die betrokke verskaffer moet toesien dat die totale bedrag betaalbaar ingevolge hierdie paragraaf ten opsigte van water verskaf of beskikbaar gestel,die Direkteur-generaal: Waterwese, Privaat Sak X313, Pretoria, 0001, of sodanige ander kantore as waarop ooreengekom is, soos volg bereik:

(aa) Ten opsigte van die tydperk 1 Julie tot 31 Desember van elke jaar, voor of op 31 Maart van die daaropvolgende jaar; en (bb) ten opsigte van die tydperk 1 Januarie tot 30 Junie van elke jaar, voor of op 30 September van dieselfde jaar.

Die geouditeerde state voorgeskryf kragtens artikel11(3)(b) van genoemde Waternavorsingswet, moet so you moontlik nadat die betaling genoem in paragraaf 1(d) gedoen is, voorgele word.

2.Indien sodanige belastings en vorderings na die betaaldagindie geheel of gedeeltelik nog onbetaald is, word rente op die onbetaalde bedrag gehef, teen 'n rentekoers wat van tyd tot tyd deur die Minister van Finansies, in terme van artikel 80(1)(a) van die Wet op Openbare Finansiele Bestuur, 1999 (Wet No 1 van 1999), op lenings wat uit die Staatsinkomstefonds deur die Staat toegestaan word.

3.By die toepassing van hierdie kennisgewing is een kubieke meter gelyk aan een kiloliter.

BILL

To provide for the disestablishment of the Africa Institute of South Africa; to provide for the repeal of the Africa Institute of South Africa Act, 2001, and for the transfer of its assets and liabilities; and to provide for matters connected therewith.

BE IT ENACTED by the Parliament of the Republic of South Africa, as follows:-

Definitions

1. In this Act, unless the context otherwise indicates-

"Council"means the Human Sciences Research Council established by section 2 of the repealed Human Sciences Research Council Act, 1968 (Act No. 23 of 1968), and retained by section 2 of the Human Sciences Research Council Act, 2008 (Act No. 17 of 2008);

"Institute" means the Africa Institute of South Africa established by section 2 of the Africa Institute of South Africa Act, 2001 (Act No. 68 of 2001);

"Minister"means the Cabinet Member responsible for Science and Technology.

Disestablishment of the Institute

2. The Institute is hereby disestablished.

Transitional measures

3. (1)The Minister will stipulate, by notice in the Government Gazette, the date from which all assets, liabilities, rights and obligations of the Institute will be transferred to the Council. STAATSKOERANT, 24 AUGUSTUS 2012 No. 35602 55

(2)All assets, liabilities, rights and obligations of the Institute will, from the date referred to in subsection (1), be transferred to the Council, which will acquire all such assets, liabilities, rights and obligations.

(3)Without derogating from the generality of subsection (1) -

(a) the Council will become the owner of all movable and immovable property owned by the Institute prior to the date referred to in subsection (1) without formal transfer, except in the case of immovable property, and without payment of any fees, duties, taxes and other charges; (b) the Council will be substituted as litigating party for the Institute on the date referred to in subsection (1) in all pending litigation, including arbitration, labour disputes and mediation, as if the Council had been a litigant at the time the cause of action arose; (c) the Council will be substituted as contracting party for the Institute on the date referred to in subsection (1) in all contracts, as if the Council had been a contracting party at the time of contracting; and (d) all financial instruments of the Institute existing prior to the date referred to in subsection (1) will be deemed to have been issued by the Council.

(4) The Minister will stipulate, by notice in the Government Gazette, the date from which all permanent employees of the Institute will be transferred to the Council.

(5) All permanent employees of the Institute will, from the date referred to in subsection (4), and in accordance with section 197 of the Labour Relations Act, 1995 (Act No. 66 of 1995), be deemed to be employed by the Council on the same terms and conditions of employment, including remuneration and other benefits, as those which applied to such employees' previous employment with the Institute.

(6) The Council of the Institute, established by section 4(1) of the Africa Institute of South Africa Act, 2001 (Act No. 68 of 2001), will be deemed to have been disestablished and dissolved, with effect from the date referred to in section 5.

(7) The Institute's parliamentary budget allocation will be exclusively reserved for the Institute's operational activities within the Council from the date referred to in section

4. The Africa Institute of South Africa Act, 2001, is hereby repealed.

Short title and commencement

MEMORANDUM ON THE OBJECTS OF THE AFRICA INSTITUTE OF SOUTH AFRICA

ACT REPEAL BILL, 2012

1. BACKGROUND

1.1 The Bill seeks to repeal the Africa Institute of South Africa Act, 2001 (Act No. 68 of 2001) (the Act), which established the Africa Institute of South Africa

(the I nstitute).

1.2 When the Department of Science & Technology (the Department) was established in 2004, the responsibility for the administration of the Act was assigned to the Minister of Science & Technology, presumably because AISA was regarded as a research institute intended to generate and disseminate knowledge, albeit with an Africa focus.

1.3 Prompted by the recommendations of the Institute's 2010 institutional review, the Minister requested the Department to consider the alignment of the Institute's role and activities within the department's broad strategic mandate. It was discovered that there was a significant overlap between the mandate and operational activities of the Institute and the Human Sciences Research Council (the Council), which the department believes causes or has the potentialof causing unnecessary duplicationofactivities,resultingin inefficient deployment of resources and unhelpful competition between these two institutions.

1.4 During 2008 the mandate of the Council was expanded to include a strong focus on public purpose research and stressed effective engagement with Africa and the rest of the world.

1.5 The Department therefore considered the possibility of merging the two institutions, due to the significant alignment in the research focus and activities of both entities. It was however advised that due to the relative sizes of the respective institutions, it would be prudent to incorporate the Institute into the Council rather than to pursue a traditional merger approach. The Department also believes that the said incorporation will reduce destructive competition,strengthen theInstitute'sresearchcapacity and enhance 58 No. 35602 GOVERNMENT GAZETTE, 24 AUGUST 2012

synergies in the two institutions' research foci and activities. It was therefore deemed necessary to repeal the Act and incorporate the Institute into the Council.

1.6 The Department does not believe that there is a need to amend the Human Sciences Research Council Act, 2008 (Act No. 17 of 2008) to accommodate the incorporation of the Institute into the Council as the mandate of the Institute (i.e. the Africa focus) is already catered for in the said Act, and any existing function of the Institute which may not be centrally aligned to the objectives of the Council will be realigned to be consistent with such objectives where thisenhances theperformanceoftheCouncil,or discontinued over time where it does not.

1.7 In order to ensure funding certainty for the Institute's current projects and other operational activities, as well as the preservation of the identity of the Institute and retention of its brand after the incorporation, the Institute's budget will be ring-fenced within the HSRC.

2. OBJECTS OF THE BILL

The Bill seeks to repeal the Act and consists of four clauses.

2.1 Clause 1 deals with the definitions of terms.

2.2 Clause 2 provides for the disestablishment of the Institute.

2.3 Clause 3 provides for the - 2.3.1 transitionalarrangementsinrespectof thetransferofassets, liabilities, rights and obligations of the Institute as well as the transfer of employees from the Institute into the Council; 2.3.2dissolution of the Council of the Institute; and 2.3.3ringfencing of the Institute's budget within the Council

2.4 Clause 4 repeals the Act.

4. FINANCIAL IMPLICATIONS FOR THE STATE

All expenses for specialised services relating to the incorporation process have been budgeted for by the department. Operational management and oversight relatingto such incorporation will, as far as possible, be undertaken by members of the senior management of the department, the Institute and the Council.

5. PARLIAMENTARY PROCEDURE

5.1 The State Law Advisors and the Department of Science and Technology are of the opinion that this Bill should be dealt with in terms of the procedure established by section 75 of the Constitution, since it does not contain provisions to which section 76 of the Constitution applies.

5.2 The State Law Advisors are of the opinion that it is not necessary to refer the Bill to the National House of Traditional Leaders in terms of section 189(1)(a) of the Traditional Leadership and Governance Framework Act, 2003 (Act No. 41 of 2003), sinceit does not contain provisions pertaining to customary law or customs of traditional communities. 60 No. 35602 GOVERNMENT GAZETTE, 24 AUGUST 2012

GUIDELINES REGARDING APPLICATIONS FOR PERMITS UNDER REBATE ITEM 311.1816309/01.04 OF SCHEDULE 3 TO THE CUSTOMS AND EXCISE ACT

1. APPLICATION

1.1 Applications for rebate permits must be addressed to the International Trade Administration Commission, Private Bag X 753, Pretoria or delivered by hand to the DTI Campus (Block E), 77 Meintjies Street, Sunnyside, Pretoria, 0002.

1.2 Applications for permits must be submitted according to the requirements reflected in the application form. If the space provided in the application form is insufficient, please use the format of the application form to submit the requested information.

1.3 If all the information requested in the application form is not submitted, the application is deficient and will not be considered, and it will be returned to the applicant.

1.4 At least seven working days must be allowed for the processing of rebate permit applications and the issuing of the rebate permit.

1.5 Worn clothing and other worn articles of textile materials are subject to Import Control conditions and an import permit will only be issued in instances where a rebate permit has already been obtained. 62 No. 35602 GOVERNMENT GAZETTE, 24 AUGUST 2012

1.6 Each rebate permit defines the period during which the goods cleared in terms of the rebate permit must be used for the manufacture of wiping rags and cleaning cloths. The rebate permit will valid for twelve months from date of issue, or a shorter period as decided upon by ITAC.

1.7 Rebate and Import Control permits may not be transferred in any manner by the holder thereof, to any other person, or be used to the benefit of any person, not named in the permits.

1.8 The applicant must submit a Tax Clearance Certificate;

1.9 The applicant must comply with labour laws and agreements gazetted by the Minister of Labour;

1.10The applicant must provide in each permit application the number of jobs it expects to create or sustain annually as a result of this rebate. The applicant must submit to ITAC a quarterly report on its job creation performance;

2. CONDITIONS OF PERMITS

2.1 Rebate permits (Note: can't provide for import permit conditions in this guideline) issued will be subject to the following conditions:

2.1.1 Production capacity Rebate permit allocations will be based on actual capacity of the applicant. The capacity will be calculated on actual production, employment and sales figures. These figures may be verified should it be required. STAATSKOERANT, 24 AUGUSTUS 2012 No. 35602 63

2.1.2 Movement of clothing and other textile material

There shall be no movement of any clothing or articles of textile materials from the premises, described in the application as the premises where the

manufacture of wiping rags and cleaning cloths will take place..

2.1.3 Goods suitable for the manufacture of wiping rags and cleaning cloths

Only worn clothing and other worn articles of textile material with cotton containing less than 35% by mass of cotton fibers are regarded as suitable for the manufacture of wiping rags and cleaning cloths.

Articles of worn clothing therefore allowed to be imported under this rebate item are vesting, T-shirts, sweat-shirts, polo shirts, men's cotton shirts, lounge shirts, men's cotton pants, track suit tops and pants, sweat tops, ladies cotton blouses, shirts, dresses and skirts, pajama tops and pants, nightdresses, flannel shirts and skirts, corduroy shirts and pants and men's and ladies denim pants and skirts.

Articles such as, inter alia, brassieres, girdles, corsets, braces, suspenders, garters, worn jackets, coats, blazers, jerseys, pullovers, cardigans, overcoats, car-coats, raincoats, anoraks, ski-jackets, duffle coats, mantels, parkas, swimwear, socks and similar clothing articles are not suitable for the manufacture of wiping rags and cleaning cloths and are not allowed to be imported under this rebate item. Other worn articles of textile material allowed to be imported are towels, bed sheets, bed covers and pillow casings of cotton. 64 No. 35602 GOVERNMENT GAZETTE, 24 AUGUST 2012

2.1.4 Location and requirements of rebate store

The rebate store must be situated on the manufacturers registered factory premises. These premises must be physically separated from premises where any activity other than the manufacture of wiping rags and cleaning cloths is taking place. Therefore, the premises where the rebate store is situated must exclusively be used for the manufacture of wiping rags and cleaning cloths and the storage of clothing and other articles of textile material obtained for the purpose of the manufacture of wiping rags and cleaning cloths.

All manufacturers under this rebate item must comply with the following rebate store requirements:

Rebate stores must be substantially constructed and must offer the maximum security possible. The walls must be extended to the ceiling, and suitable steps must be taken to prevent access to the materials over the walls. The doors must be lockable and suitably equipped with fastenings for Customs locks. The windows, if any, must be fitted with bars. Rebate store must have only one entry point.

2.1.5 Notification requirement

The Inspectorate of the Directorate Import and Export Control [Fax number (012) 394 4606 and Telephone no (012) 394 3606], e-mail [email protected] must be notified in writing by the permit holder at least 10 working days in advance of the date of the arrival of consignments of imported worn clothing and other imported worn articles of textile materials at its premises. The notification must state:

Anticipated date or dates of arrival of the goods concerned at the premises. The mass and invoice value in Rand of the goods concerned A description of the goods reflecting the type of clothing, type of article of textile material and whether the goods are new, used or worn.

Before the arrival of goods imported under this rebate item at the registered rebate store of the rebate permit holder, the Manager: Inspectorate of the Directorate Import and Export Control, Mr. Desmond Daniels, must be informed in writing by the permit holder of the details of any clothing and any article of textile material obtained in South Africa that are kept on the premises where the rebate store are situated

2.1.6 Documentation Requirement

The following documents must be available on the day of any physical inspection by ITAC:

A Rebate register, as required by SARS, must be kept in respect of worn clothing and other worn articles of textile materials cleared under rebate of the duty.

Records must be kept of any clothing and any other article of textile materials obtained by the permit holder in South Africa and that enters the premises described in the permit or permits issued to the permit holder.

These records must contain the following:

The name, postal address, e-mail address and telephone number of the firm or copy of I. D. Document and other contact details of the person from whom the clothing or other articles of textile material was purchased. The date of the purchase. The mass (kg) and sales value (R) of the clothing or other articles of textile material. A description of the clothing and other articles of textile materials purchased, indicating the type of clothing, type of other articles of textile material and whether the goods are new, used or worn. The date on which the clothing and the other articles of textile materials entered and, if applicable left the premises.

Records must be kept of imported worn clothing and other worn articles of textile material for the manufacture of wiping rags and cleaning cloths for at least five years. Invoices reflecting the sale of wiping rags and cleaning cloths manufactured from worn clothing and other worn articles of textile materials obtained in terms of rebate permits must be kept for at least five years. These records must include the date, mass (kg) and sales value of each sale and the name, addresses (postal and street) and telephone number of each purchaser.

Invoices reflecting the sale of wiping rags and cleaning cloths manufactured from clothing and other articles of textile materials obtained in South Africa must be kept for at least five years. 2.1.7 Requirements in respect of goods not suitable for the manufacture of wiping rags and cleaning cloths.

Any clothing and other articles of textile material that enter the premises for the manufacture of wiping rags and cleaning cloths that are not suitable for the manufacture of wiping rags and cleaning cloths, must be cut up at the premises, within 10 working days of being identified as not suitable for the manufacture of wiping rags and cleaning cloths,

Any product not suitable for the manufacture of wiping rags and cleaning cloths, such as zips, that are removed from the consignment must be destroyed within 10 working days of being removed from the clothing or other articles of textile materials, with the exception of buttons. Buttons removed from clothing or other articles of textile material must be disposed off within 10 working days after removal. The not suitable material can only be removed from the premises in terms of a written authorization issued by the Manager: Inspectorate of the Directorate Import and Export Control in which authorization the nature and mass of the goods, the date or dates on which the goods will be removed from the premises and the destination of the goods are fully described.

Requests to obtain the above authorization must be in writing and submitted to the Manager: Inspectorate of the Directorate Import and Export Control at least 15 working days before the date on which authorization is required. Should waste be removed more frequently, requests need to be submitted to the Manager: Inspectorate of the Directorate Import and Export Control at least five working days before the date on which authorization is required. Requests must describe the nature and mass of the goods, the planned date or dates of the removal of the goods from the premises and the designation of the goods.

2.1.8 Inspections by the Inspectorate: Import and Export Control of the International Trade Administration Commission.

Investigators from the Inspectorate of the Directorate Import and Export Control of the International Trade Administration Commission will visit permit holders and the premises of permit holders to inspect and to investigate any matter or record related to the importation and the manufacture of wiping rags and cleaning cloths under this rebate item. This includes the inspection of the goods cleared in terms of permits, any other goods that entered the premises and any wiping rags, cleaning cloths and waste that leave or came from the premises. 2.1.9 The use of other rebate provisions

Registered users of the rebate provision for the manufacture of wiping rags and cleaning cloths may not apply to register and import under the rebate provision for used overcoats.

3 NON-COMPLIANCE TO THE CONDITIONS OF PERMITS

If there is a reason to believe that any condition of a permit issued in terms of this rebate provision the consignment in terms of which the rebate permit was used can be seized by ITAC. If non-compliance is detected, appropriate steps will be taken in terms of the International Trade Administration Act, relevant regulations and the Customs and Excise Act that can include, criminal charges, withdrawal of the permit or permits concerned and/or the rejection of future applications for permits. 70 No. 35602 GOVERNMENT GAZETTE, 24 AUGUST 2012
