2. GUIDELINES FOR SUBMISSION OF TENDER INVITATION

a. One Bidder shall submit only one tender.

b. Bids must be submitted in the prescribed format only. No other format will be accepted.

c. Each page of Tender Document shall be signed by the Authorised Signatory.

d. The bidder must submit copies of valid registration with Government and all other statutory licenses/ permits along with the Bid. The successful bidder will be required to produce the originals of these licenses/ permits for verification if required by State Bank of India before finalizing the contract.

e. The FINANCIAL bid enclosed with the tender should show the rates. The quoted rates should be inclusive of excise duty, labour, transportation & installation charges but exclusive of GST. GST shall be paid extra.

f. Offer(s) incomplete or deficient, received late and/or not signed by the Bidder on all the pages shall not be accepted.

g. Documents constituting the contract: The invitation of Bids, the terms and conditions of the Tender, Bid of the successful Bidder and Letter of Acceptance issued by State Bank of India along with any amendment issued prior to signing of the Contract shall constitute the Contract between State Bank of India and the successful Bidder. A separate contract on these lines may also be signed between the parties.

h. The tender will be processed under Two-Bid Tender System. Therefore, separate TECHNICAL and FINANCIAL BIDS are to be submitted as per the following procedure:

TECHNICAL BID Technical Bid as per Annexure-I should be furnished in Envelope ’A’. This shall include details of services being provided and various other terms & conditions. Details of documents asked for should also be enclosed with the Technical Bid. (FINANCIAL and other financial details must not be included in the technical bid.)

The technical bid consisting of the following documents shall be submitted by the respondents:

a. Technical Bid Form along with copies of supporting documents mentioned in the eligibility criteria. b. EMD of Rs.20,000/- in the form of DD favoring State Bank of India , LHO,JAIPUR OFFICE , Payable at Jaipur,Rajasthan. c. Bidder shall provide List of Branch offices, in the State of Rajasthan with their complete addresses, contact numbers duly signed mentioned on their letter head. Tenderer shall Sign all the Tender Document pages and duly stamped. Unsigned tender document would be rejected outrightly.

However, Bidders must produce the originals of the copies of the documents submitted for the verification as and when desired by the office. The technical bids, which are not accompanied with copies of documents prescribed above, are liable for rejection forthwith.

FINANCIAL BID Financial Bid as per Annexure-II should be furnished in Envelope ‘B’ . Both envelopes should be sealed and kept in another Envelope ‘C’ and sealed super scribed as “Tender for Empanelment of Supply, Installation & Maintenance of Fire Extinguishers for SBI, LHO, JAIPUR”.

i. The FINANCIAL bid enclosed with the tender should show the rates. The quoted rates should be inclusive of VDA, EPG, ESG, Local Lavies, Local Fire Rules etc.but exclusive of GST.

ii. The FINANCIAL bids shall be valid up to 3 months from the date of opening of tenders. The FINANCIAL, if it is not in conformity with the above requirements, shall not be considered.

iii. The tender documents should be signed on every page by the bidder and enclosed with technical bid as an unconditional acceptance of the terms and conditions mentioned therein.

The Successful bidder to whom, the contract will be awarded, shall have to deposit a sum of Rs. 30,000/- in the form of STDR favoring AGM (Premises & Estate) SBI, LHO, Jaipur as security deposit for the period of contract within 7 days from the date of empanelment. The security Deposit will be refunded only on the completion of the contract. Failure of the bidder to submit the above mention security deposit shall constitute sufficient grounds for the annulment of the contract awarded. If the successful bidder fails, in course of the contract period to comply with the terms and condition of the Agreement/Contract, the security deposit may be forfeited in full of or in part as decided by the competent Authority. The Security Deposit will not carry any additional interest and will be refunded only on completion of the contract. The security Deposit will be refunded within a month of expiry or termination of the contract as the case may be after adjusting the dues payable by the contractor to the Bank. The individual signing the tender form or any document forming part of the tender on behalf of Manufacturers/Firms/Companies/Dealers/Vendors shall be responsible to produce an authenticated copy of the resolution passed by the company or Power of Attorney duly executed in his favour stating that he has the authority to bind other such persons of the Manufacturers/Firms/Companies/Dealers/Vendors, as the case may be, in all matters pertaining to the tender. If the person so signing fails to provide the said copy of resolution passed or Power of Attorney, the Bank without prejudice to other civil and criminal remedies may cancel the tender and hold the signatory liable for all costs and damages. In case of registered or unregistered Partnership firm, all the partners should sign the tender. The EMD will be returned interest free, to the unsuccessful Bidders after fifteen (15) days from completion of tender process. The EMD is payable by all categories of Bidders and no exemption from earnest money deposit is permissible. Earnest Money Deposit (EMD) in the form of cheque or cash is not acceptable. Bids without earnest money deposit shall be treated as invalid. Bids with defective financial instruments shall also be treated as invalid. In the case of successful Bidders, Earnest Money Deposit amount will be forfeited by the Bank, if:

TENDER INVITATION

Tenders are invited for Hiring of services of fire control room operator and firemen for round the clock monitoring of fire fighting systems Viz Fire Alarm system, beam detector system, PA system, hydrant & riser system, sprinkler system, with diesel engine pump, wet riser pump, sprinkler pump, Jockey pump, dewatering pumps, other pumps etc. at our Local Head Office building. C-Scheme,Tilak Marg,Jaipur. The contract is for a period of one year & is extendable upto two more years on yearly basis subject to providing of satisfactory services and subject to decision of the competent authority of the bank. The bank’s reserves the right to reject any or all applications received without assigning any reasons thereof. The bank at its sole discretion reserves the right to extend/discontinue/terminate the services of successful vendor at any point of time with the change in name/or its constitution of Bank without assigning any reasons thereof. 2. Eligibility Criteria: Professional Fire protection contractors having experience in providing of expert fire control operators and firemen and having executed at least one work of value exceeding Rs 10 lakh in round the clock running operation monitoring and installation of a High rise building fire fighting systems (attach certificate of the employer) Viz Fire Alarm system, beam detector system, PA system, hydrant & riser system, sprinkler system, with diesel engine pump, wet riser pump, sprinkler pump, Jockey pump, dewatering pumps, other pumps etc by their fire control operators and firemen, satisfactorily during the last three years (2014/15, 2015/16 and 2016/17) and with GST Number ,PAN Number. (attach certificates from the concerned deptt or Gazetted officer) may submit applications in the prescribed form to the undersigned.

1. TENDERERS SHALL VISIT THE SITE

Intending tenderer shall visit the site and make himself thoroughly acquainted with the local site condition, nature and requirements / fire fighting works involved in the systems. The tenderer shall include in their tender for salary, insurance, statutory act including EPF, minimum wage act & also for any special difficulties. The minimum wages or any increase if any shall be updated by the contractor and paid to labours as per Rajasthan state govt notifications during the currency of the contract no increase will be paid by the bank on account of such increase. The bank shall review the contract annually for renewal subject to the request made by the contractor,satisfactory perforomance and shall be at discreation of the bank’s competent authority.

The entire set of tender paper issued to the tenderer should be submitted fully priced and also signed on the last page together with INITIALS on every page. Initial / signature will indicate the acceptance of the tender papers by the tenderer. The schedule of quantities shall be filled in as follows: i) The “Rate” column to be legibly filled in ink in both English figures and English words. ii) All corrections are to be initialed. iii) In case of any errors / omissions in the quoted rates, the rates given in the tender marked “original” shall be taken as correct rates. The Employer reserves the right to reject the lowest or any tender and also to discharge any or all to split up and distribute any item of work to any specialist firm or firms, without assigning reasons. The tenderer shall note that his tender shall remain open for consideration for a period of three months from the date of opening of the tender.

3. AGREEMENT

The successful contractor will be required to sign agreement in accordance with the draft agreement form enclosed. The contractor shall pay for all stamps and legal expenses, incidental there to. However the written acceptance by the employer of a tender will constitute a binding contract between the employer and the person so tendering whether such formal agreement is or is not subsequently executed.

4. GOVERNMENT AND LOCAL FIRE STAUTORY RULES FEES

The contractor shall confirm to the provisions of all local Fire safety byelaws and Acts relating to the work and to the regulations etc, of the Government and local Authorities and building bye-laws etc., and pay all fees payable to such authority / authorities local fire service authorities or the authorities of state. The cost, if any, shall be deemed to have been included in his quoted rates, taking into account all liabilities for licenses, fees etc, and shall indemnify the Employer against such liabilities and shall defend all actions arising from such claims or liabilities.

5. LEVIES AND DUTIES

The tenderers must include in their tender prices quoted for all duties royalties, cess and works contract tax or any other or local charges if applicable. GST shall be paid extra as applicable. No extra claim on this account will in any case be entertained. The Administrative charges shall not be less than 5% and if any quotes less than the 5% his tender will be summarily rejected. Incase of the total rates quoted by the Contractors are same,the work will be awarded to the contractors who is high in technical qualification.

6. WORK / DEPLOYMENT OF REQUISITE MANPOWER

The contractor shall deploy 1 Fire control Room Operator and 1Firemen in each shift. The shift shall be from 6.00AM to 2.00PM, 2.00PM to 10.00PM, 10.00PM to 6.00AM round the clock (inclusive of leave arrangement).

a)QUALITATIVE REQUIREMENT (QR) OF CONTROL ROOM OPERATORS:- i) Selection of Control Room operators will be carried out by a committee of Chief Fire Officer / Fire officer of the Bank and a representative from the HR department of the bank ii) All the Control Room Operator should have original service / discharge Book of the Defense Service. iii) Self attested Copy of the Ex servicemen Id card issued by the Competent authority, acceptance of this condition will be at the sole discretion of the bank.(preferably JCO rank, signal course, age 45 yrs) iv) Self attested copy of PPO v) Three months Statement of the bank account in which pension is credited vi) Police verification. The Bank reserves the right to reject /accept any or all the offers or waive off conditions without assigning any reasons thereof and no correspondence in this regard shall be entertained b) QUALITATIVE REQUIREMENT OF FIREMEN ;- i. Experience; candidate should be an ex fire brigade / Home guard / civil defence / ex serviceman. Personnel with five years experience in fire fighting. Age relaxation will be available to ex servicemen,SC/ST ii. Qualification - viii th standard Pass iii. Age - not more than 29yrs.

iv. Police verification - Antecedents to be verified by police. The Bank reserves the right to reject /accept any or all the offers or waive off above conditions, or change any conditions through corrigendum on the banks website which shall be accepted by all during currency of the tender and without assigning any reasons thereof and no correspondence in this regard shall be entertained

7. OTHER PERSONS ENGAGED BY THE EMPLOYER The Employer reserves the right to execute any part of the work included in this contract or any work, which is not included in this contract by the other Agency or persons and contractor shall allow all reasonable facilities for the execution of such work. The main contractor shall extend all cooperation in this regard.

8. BILL PAYMENT The bill will be raised by the contractor on the monthly basis. The work & bill will be checked by our Chief Manager (fire-safety) /officer assigned by the bank.

9. CONTRACTOR’S EMPLOYEES The contractor shall employ competent Fire Control Room Operators, Firemen for the work in uniform (light blue colour shirt and dark blue trouser) who shall be available throughout the working / non working hours to receive and comply with instructions of the Employer/ or his fire officer. Any labourer supplied by the

SBI Lho Jaipur CRO FIREMEN HIRING Signature & Seal of the vendor 10 contractor to be engaged on the work on day work basis either wholly or partly under the direct order or control of the Employer or his representative shall be deemed to be a person employed by the contractor. The contractor shall comply with the provisions of all labour legislation including the requirements of a) The payment of Wages Act. b) Employer’s Liability Act c) Workmen’s Compensation Act. d) Contract Labour (Regulation & Abolition) Act. 1970 and Central Rules 1971 e) Apprentices Act. 1961 f) Minimum Wages Act g) Any other Act or enactment relating thereto and rules framed there under from time to time. The contractor shall keep the Employer saved harmless an indemnified against claims if any of the workmen and all costs and expenses as may be incurred by the Employer in connection with any claim that may be made by any workmen.

10. DISMISSAL OF WORKMEN

The contractor shall on the request of the Employer even if apprised verbally immediately dismiss from works any person employed thereon by him, who may in the opinion of the Employer be unsuitable or incompetent or who may misconduct himself. Such discharges shall not be the basis of any claim for compensation or damages against the Employer or any of their officer or employee.

11. ASSIGNMENT a) The works include operation, testing, of hose reel, hose pipes & branch pipes operation of sluice valves, Diesel engine driven pumps, electrical motor driven pumps & fighting of all types of fire in the on all floors / basement etc. b) The fire control room operator shall report on duty dressed in Blue uniform with berry cap, belt badge with his name plate at chest level, in shifts c) Fire control room operator shall keep all the keys of all the hydrant boxes in the area d) Fire control room operator shall carry out all the drill, mock drills should know all the procedure of all types of fires, rescue

12. DAMAGE TO PERSONS AND PROPERTY INSURANCE ETC. a) The contractor shall be responsible for all injury to the work or workmen to persons, animals or things and for all damages to the structural and/or decorative part of property which may arise from the neglect of himself or of any sub-contractor or of any of his or a sub-contractor‘s employees, whether such injury or damage arise from carelessness, except in case of fire /extinguishing of fire or any other fire related cause b) The clause shall be held to include inter-alia, any damage to buildings whether immediately adjacent or otherwise. c) The contractor shall indemnify the Employer and hold harmless in respect of all and any expenses arising from any such injury or damages to the person or property as aforesaid and also in respect of any claim made in respect of injury of damage

SBI Lho Jaipur CRO FIREMEN HIRING Signature & Seal of the vendor 11 under any acts on compensation or damage consequent upon such claim. d) The contractor shall effect the insurance necessary and indemnify the Employer entirely from all responsibility in this respect. The insurance must be placed with a company approved by the Employer and must be effected jointly in the name of the contractor and Employer and the policy lodged with the letter.

13. FOREFEIT OF EMD: The EMD of the lowest bidder at the time of allotment shall stand forfeited in case lowest bidder backtracks, or seeks for increase in tendered lowest rates, or changes his stand from the tender and no correspondence in this regard shall be entertained.

14. INDEMNITY & LIABILITY (a) The Bidder agrees to indemnify the Bank against all losses or claims in respect of any or all statutory / financial obligations arising out of any negligence or misconduct on the part of the bidder howsoever and in whatsoever manner caused to the Bank. The Bank will not enter into any litigation whatsoever under any circumstances in respect of afore-stated statutory / financial obligations. Any litigation if so warranted /compelled will be conducted and pursued by the Bank at the cost of the Bidder only.

(b) The Bank shall be liable only for paying agreed charges. The Bidder shall be responsible and answerable for all claims from third parties including the employees of the Bank in the event of any accident or injury, death, loss or damage leading to / involving any liability caused by the Bidder or its employees. The Bank will have no master servant relationship with the employees of the Bidder. The relation of bidders and the Bank is principal-to- principal basis. If during the contract period, any loss or damage to property or life, death due to accident etc., is caused either to the occupants or employees of the Bidder or any other third party, the Bank shall not be responsible for the same.

(c) The Bidder shall be responsible for all legal compliances prescribed by Government of India and the State Governments concerned which shall among others include law relating to Income Tax, Accidents, ESI, EPF, Insurance, Contract Labour (Abolition & Regulation) Act, Industrial Disputes Act, Workmen Compensation Act, Payment of Wages Act, Minimum Wages Act etc. The Bidder hall submit proof of payment of statutory dues. Any breach of the applicable laws, rules and regulations would entitle the Bank to cancel the contract.

(d) The security deposit of the successful Bidder shall remain deposited with the Bank during the period of contract which can be forfeited in case Bidders violates the terms and conditions of tender during this period and will not carry any interest.

15. TERMINATION The Bank reserves the right to terminate the contract by giving 30 (thirty) days notice and without assigning any reason whatsoever.

(i) The Bank may, without prejudice to any other remedy for breach of contract, may terminate the contract/agreement by 30 (thirty) days notice in the event of unsatisfactory performance or on breach of any stipulated conditions or qualitative dimensions of the various services specified/agreed upon by the contractor, or the engagement is not in the interest of the Bank or the Bank no more requires any such service and the Contract shall be deemed to have been terminated for all purposes on the expiry of the 30 (thirty) days day from the date of receipt of the notice.

(ii) Other Grounds for Termination: The Bank is entitled to terminate this contract/agreement for any reason at its absolute discretion forthwith without notice without assigning any reason and without payment of any compensation, in the following cases: -

a) the bidder is adjudicated insolvent by a Competent Court or files for insolvency or if the hirer being a company is ordered to be wound up by a Court of competent Jurisdiction.

b) If any charge sheet is filed by a competent authority of the Government against the Agency / Company, or the bidder is convicted by a criminal court on grounds of moral turpitude.

c) For any reason whatsoever, the bidder becomes disentitled in law to perform his obligations under this agreement.

d) The Bidder is involved in wrongful billing. In addition hereto wrongful billing shall also result in the organization being debarred from participating in any other tender of the Bank

16. VALIDITY OF TENDER Bids shall remain valid and open for acceptance for a period of 3 (three) months from the date of opening of Bids. If the bidder withdraws his/her offer during the validity period or makes modifications in his/her original offer which are not acceptable to the Bank, the Bank shall be at liberty to forfeit the EMD without prejudice to any other right or remedy. 17. JURISDICTION The Courts in Jaipur alone shall have jurisdiction in respect of any or all matters/disputes relating to connected with the tender and supply and maintenance services

1. Report for duties punctually in full proper uniform and mark his attendance in duty roster and log his time of arrival & departure and shall fight all kinds of fire in the Local Head office building. 2. He is responsible to test & operate, the PA systems, Smoke Detector panels, Fire alarm panels, and inform the maintenance contractor staff of any malfunctions.

3. In case of fire he shall take action under the instructions of Fire officer/Premises & Estate officer /any other authorized officer of the respective shift. He will take appropriate action by sending Bank guard / Firemen on duty to attend the alarm.

4. In case the shift duty officer is not on duty he will take full charge of the control room. He will put his observations in the logbook of his shift.

5. If any point requires immediate attention of fire officer he will bring such point to the notice of fire officer through logbook. For any emergency he will contact fire officer depending upon the time of occurrence.

6. For any fault / repairs of the equipment he will report in his log book & put up to Fire officer for action by the maintenance staff.

7. In case of fire CRO will inform the fire brigade. He will also inform AGM (P&E) /FO /Officer Incharge.

8. At the time of assuming his duties the CRO will test the smoke detectors, panels, Test button, He will get fire pumps DG pumps started / from the maintenance staff and record in the register kept for the purpose.

9. He shall carry out the actions given in the “fire drill” at the time alarm and drills. 10. He will send the details of the smoke detector that may have actuated / given alarm / developed defects / to fire officer and maintenance staff and ensure rectification.

11. He will attend to only those defects in panel as authorized by the maintenance contractor. Major defects will be attended by the maintenance staff only. However defects if any be recorded in the logbook and brought to the notice of relieving operator.

13. Any other duties pertaining to the control room that may be assigned to him from time to time by AGM (P&E) / Fire officer / officer incharge.

14. He shall clean, unroll, operate, test, check refit automatic smoke alarm system, close check, test, First Aid Hose Reels, and its parts in the Head office, multilevel parking building. 15. Check, test, the riser hose lines in the , operate Pumps /Pump Panel building at various floors.

16. Operate, sluice & all Valves in Hydrant and Sprinkler Systems to be kept operational in the building.

17. Checking of smoke sensors and refitting of Detectors, as required and keeping Fire Alarm System Operational in the building.

18. Fire pump house connected duties / any other duties assigned by the AGM (Premises & Estate) / fire officer /Officer Incharge.
