Roma, 2 marzo 2012 Comunicato stampa Incontro TAV Torino-Lione Si è svolto in data odierna l’incontro a Palazzo Chigi tra il Presidente del Consiglio Mario Monti, Il Ministro dell’Interno, Anna Maria Cancellieri, Il Ministro dello Sviluppo economico, delle Infrastrutture dei Trasporti, Corrado Passera, il Ministro dell’Ambiente, Corrado Clini, il Ministro della Giustizia, Paola Severino, e il Commissario di Governo per l’alta velocità Torino-Lione, Mario Virano. Al centro dell’incontro la questione della TAV Torino-Lione. Nel corso dell’incontro si è confermata l’intenzione del Governo di proseguire nella realizzazione dell’opera infrastrutturale, parte del corridoio mediterraneo e, in quanto tale, inserita nella rete strategica dell’Unione Europea. La decisione conferma il complesso processo decisionale avviato negli scorsi anni – anche attraverso un approfondito lavoro di concertazione con le comunità e gli enti locali – e portato a compimento con l’accordo firmato a Roma lo scorso 30 gennaio tra Governo italiano e francese. Dal completamento dell’opera si attendono vantaggi importanti dal punto di vista infrastrutturale, ambientale e occupazionale. In particolare, si dimezzano i tempi di percorrenza (da Torino a Chambery si passa da 152 minuti a 73; da Parigi a Milano da 7 a 4 ore), mentre la portata delle merci si raddoppia a parità di trazione (da 1.050 a 2.050 tonnellate per treno) con costi di esercizio quasi dimezzati. Si riduce sensibilmente il numero di camion su strada (circa 600.000/anno) nel delicato ambiente alpino. Si genera lavoro e occupazione direttamente sul territorio: è prevista infatti una struttura di appalti per individuare e separare tutte le opere preparatorie e complementari da quelle principali, assicurando così competitività anche alle imprese locali. -

La Conferenza Stato-Regioni ha già presentato la richiesta di applicazione della clausola di salvaguardia, come previsto dalla direttiva 2001/18/CE per vietare la coltivazione di piante geneticamente modificate sul nostro territorio per motivazioni ambientali e sanitarie, tuttavia questa giace ancora ferma in attesa di inoltro da parte del Governo italiano, creando un vacuum normativo che potrebbe generare confusione pro OGM. Apprezziamo la recente apertura da parte di alcuni Ministri sull’argomento, con la richiesta di revoca dell’autorizzazione del Mais Mon. 810, tuttavia ciò non è sufficiente a garantire consumatori e produttori. Vi chiediamo pertanto di rompere gli indugi e approvare subito la clausola di salvaguardia Nazionale, prevista dalla legge che disciplina gli OGM. Sulla base del Diritto Costituzionale, non delegato ai trattati Internazionali in materia di salute e ambiente, e sul principio di sussidiarietà del trattato europeo, VIETARE COLTIVAZIONE E IMPORTAZIONE DI OGM in Italia, sottoponendo se il caso, la materia, a consultazione popolare (referendum consultivo) atta a far esprimere TUTTI i cittadini, come previsto dalla Dir. 2001/18 CE in materia. Tolleranza zero per gli OGM quindi nei prodotti agricoli e a tutela della biodiversità e patrimonio agroalimentare Italiano, a maggior ragione per quelli biologici. -

Introduction∗ This work aims to show that the present banking regulations of two very different countries—the United States and Italy—can be viewed as two outcomes of the same evolutionary path. Let us start by quoting a leading American scholar of banking law: ♦ Leonardo Giani currently works as an Attorney at Law in Italy and he is a Fellow in Business Law (Cultore della materia in diritto commerciale) at the University of Florence School of Law. In 2004, he earned an L.L.B. at the Bocconi University of Milan School of Law; in 2008, an M.Sc. in Law and Economics at the University of Siena School of Economics; and, in January 2010, a Ph.D. in Law and Economics at the University of Siena School of Economics. In the past he was a Visiting Scholar at the Boston University School of Law during the spring semester of 2007 and he worked in the capacity of Financial Supervision Expert at the European Central Bank. ♥ Riccardo Vannini is currently a Research Fellow at I-Com (www.i-com.it) and a Ph.D. candidate in Law and Economics at the University of Siena School of Economics.
