Dissertation (1.510Mb) ABSTRACT Factors Influencing African-American Students Enrollment in Texas Law Schools Janis A. Hunter, M.S.Ed. Mentor: Robert C. Cloud, Ed.D. While extensive research has been conducted examining the college choice process of undergraduate students, little empirical research has been conducted on the relative factors affecting the law school choice of prospective African-American students, not only in Texas, but also nationwide. By developing a college choice model for African-American students considering legal education, this study will assist researchers and law school administrators in understanding the importance of these factors in the decision-making process. For example, how influential are (1) minority faculty role models and mentors; (2) financial aid; (3) assurance of employment after graduation; (4) supportive on-campus and off-campus organizations; and (5) scholarships in the law school selection process of African-Americans? The study was designed to survey prospective African-American students enrolled in Texas law schools during the 2004-2005 and 2005-2006 academic years. Of the nine law schools located in the state of Texas, four private law schools, three public law schools and one historically Black law school chose to participate. Overall, 364 African-American students were admitted and enrolled in Texas law schools when both academic years were combined. Of the 364 African-Americans attending Texas law schools; 299 chose to participate in the study, which constitutes an overall response rate of 82%. In addition, seven of the eight law school administrators chose to participate in the interview portion of the survey, which constitutes an overall response rate of 87.5%. The study focused on the consideration of eleven research questions related to the factors that affect the law school choice of prospective African-American students. Additionally, a purpose was associated with each research question. The need to understand the factors that influence the law school choice of African-American students in Texas has never been greater, not only because of the pressures involved with today’s recruitment process, but also because of the declining number of African-Americans in the legal profession. Hopefully, these reflections might help (1) determine the most influential factors; and (2) assist Texas law school administrators in determining whether to commit resources to (a) the recruitment of minority students, (b) the hiring of minority faculty, and/or (c) curricular modifications. A deep study of the science of law, he adds, may do more than all other writing to give soundness to our judgment and stability to the state.”1 So explained Dean Roscoe Pound of Harvard Law School in 1923,2 and his words resonate nearly a century later. But missing are three other possibilities regarding the value of legal education: To assess, critique, and improve laws and legal institutions; To train those who pursue careers based on legal training, which may mean work as lawyers and judges; leaders of businesses, civic institutions, and political bodies; legal academics; or entre- preneurs, writers, and social critics; and To advance the practice in and study of reasoned arguments used to express and resolve disputes, to identify commonalities and dif- ferences, to build institutions of governance within and between communities, and to model alternatives to violence in the inevi- table differences that people, groups, and nations see and feel with one another. INTRODUCrION In Emancipation: The Making of the Black Lawyer, 1844-1944 ("Emancipation"), Dr. J. Clay Smith, Jr.,' a law professor and a prolific writer,2 pens a spellbinding factual narrative of the history of African American lawyers. Dr. Smith identifies hundreds of African American men and women who became lawyers between 1844 and 1944. The social and legal history chronicled in Emancipation begins with the first African American lawyer, Macon Boiling Allen, who was licensed to practice in Maine in 1844. It ends with Rachel E. Pruden-Herndon, the first African American woman admitted to the Georgia bar in 1943. With meticulous detail, Dr. Smith recounts African American attorneys' relent- less efforts to gain admittance to the bar; to earn the respect of white judges, opposing counsel, and jurors who controlled their client's fate; and to emancipate other African Americans.     THE NEED FOR WOMEN IN ARBITRATION AND HOW TO IMPLEMENT DIVERSIFICATION OF ARBITRAL APPOINTMENTS Devorah Spigelman IntroduCtion The legal world of the previous millennium was a men’s club, but that is no longer the case in the year 2020; or at least it should not be.1 When Ruth Bader Ginsberg enrolled in Harvard Law School in 1956, she was one of nine women in a class of nearly five hundred men.2 Today, women make up over half of all law students in America,3 and that number continues to grow. Gender is not the only demographic that has diversified over time; as time has elapsed and the legal community has implemented active and concrete steps to diversify,4 the legal profession has indeed grown to include more people from ethnic minorities, members of the LGBT community, and others who are considered ‘diverse’.5 In 1884 Macon Bolling 1 Deborah L. Emerson answered his inquiry as follows: "Let him renounce every- thing which is not true to him, and put all his practices back on their first thoughts, and do nothing for which he has not the whole world for his reason."' In 1844, Macon Bolling Allen became the first black American to complete a course of study in law and the first black lawyer for- mally introduced to jurisprudence,2 at a time when black people in the nation were considered "far less esteemed than the veriest stranger and sojourner."' Allen's study of law and his admission to the bar must have rocked the ages past, as well as the American experiment of law and equality.

THE "OLD" BLACK CORPORATE BAR: DURHAM'S WALL STREET, 1898-1971* AMOS N. JONES" Over the last twenty years, eminent scholars such as David Wilkins have paid considerable attention to the "new black corporate bar" as a phenomenon worthy of treatment. This Article builds on that work by introducing a fascinating law- practice reality that developed in a unique setting in the early 1900s American South. What if Wall Street had been black? What if its elite feeder institutions had been black? What if the black bar were, in a corporate economy of scale, relatively sizable? These questions might make for fascinating counterfactuals, if not for the concrete reality that such a community-albeit small-actually existed, expanded, and prospered in midcentury Durham, North Carolina. Coining the term "old black corporatebar" to stand in distinction to the "new black corporate bar," the Article analyzes the world in which that exceptional and heretofore unexamined black bar germinated and influenced a relatively sophisticated legal landscape in a moderate, midsized southern city backdropped by a laissez-faire white leadership class that proved progressive for racialrelations.
