MASON AND HANS A. von SPAKOVSKY The Washington State Republican Party filed the complaint in this matter alleging that Respondents violated the Federal Election Campaign Act (“FECA”), 2 U.S.C. § 431 et seq. The Commission voted unanimously to adopt the Office of General Counsel (“OGC”) recommendation to (1) find no reason to believe Respondents violated FECA and (2) close the file.1 Although we agree with the OGC recommendation, we write separately to clarify why the press exemption applies in this matter, because the standard is easier to meet than the analysis2 accompanying the recommendation might suggest and does not require any content analysis of the radio shows. I. BACKGROUND Respondent Dave Ross has a radio talk show on Respondent KIRO-AM in Seattle, Washington,3 that “discusses news, current events, politics, entertainment, technology, and a range of other subjects.”4 Ross also provides occasional short commentaries on CBS News Radio, which KIRO carries.5 The station is owned by Respondent Entercom Seattle, LLC, which 1 First General Counsel’s Report (“GCR”) at 13 (Jan. 10, 2006). Molluscan Forum 2013 The Malacological Society of London was founded in 1893 and registered as a charity in 1978 (Charity Number 275980) Number 62 (February 2014) The Malacologist Page 2 EDITORIAL It is with great regret that we note the deaths of two important contributors to the field of malacology, Professor Bryan Campbell Clarke FRS (1932 – 2014) and Dr Stuart ‘Bill’ Bailey 1942-2014 Bryan Clarke was a university teacher and a leading geneticist who investigated speciation in Partula land snails on the volcanic islands of the Eastern Pacific. The Partula species complex was devastated by the introduced carnivorous snail Euglandina in the latter part of the twentieth century. Along with Jim Murray and Michael Johnson, Bryan Clarke was one of the saviours of some of the Partula species described so exquisitely by Crampton.

DAVE ROSS TO THE COMPLAINT BY CHRIS VANCE I. INTRODUCTION On behalf of the Friends of Dave Ross, Philip Lloyd as Treasurer, and Mr. Dave Ross (collectively, the “respondents”), we respectfully submit the following joint response to the complaint filed in the above captioned matter under review (“MUR”). On October 5,2004, Chris Vance, Chairman of the Washington State Republican Party, filed the complaint that initiated this MUR. In his complaint, Mr. Vance alleges, inter alia, that the respondents violated federal campaign finance law by using The Dave Ross Show to benefit Mr. Ross’s congressional campaign. Mr. Vance also alleges that the respondents participated in “illegal corporate coordination” with 710 KIRO, Mr. Ross’s employer.’ See Complaint at 1. I 1 Mr. Vance also alleges that KIRO-AM denied Mr. Ross’s opponent “equal time” under Federal Communications Commission rules. See Complaint at 4. Because potential violations of FCC regulations are not within the jurisdiction of the FEC, we do not address these allegations here. Accordingly, any such “equal time” argument should be dismissed for lack of FEC jurisdiction. .. .. .. __ ..
