Dengan pengenalan kursus yang berbentuk ‘pengkhususan’ (“customised”) dan baharu dalam bidang undang-undang yang baharu (“new areas of law”) dapat melengkapkan pegawai undang-undang untuk menghadapi cabaran tempat kerja dengan pengenalan dan persiapan yang komprehensif, sistematik dan relevan serta mengutamakan kehendak pelanggan dan stakeholder. Pengetahuan dan kemahiran teknikal secara ‘pengkhususan’ yang tinggi akan menentukan kejayaan seseorang pegawai untuk menjadi lebih efisien kepada pelanggan dan stakeholder. Penghasilan professional dalam bidang kehakiman dan perundangan yang berkemahiran tinggi inilah yang akan menjamin kejayaan ILKAP sama ada di dalam atau luar negara. Sejajar dengan Rancangan Malaysia Ke -11, amatlah besar harapan saya semoga ILKAP dapat mengorak langkah dengan lebih progresif ke arah sebuah institusi latihan yang dinamik, berdaya saing dan mampan dalam melatih pegawai kehakiman dan perundangan serta penguatkuasa yang berwibawa dan cemerlang. Menerusi Pelan Strategik 2015-2020 yang telah dirangka secara komprehensif dan menyeluruh, saya percaya ILKAP berupaya melaksanakan teras-teras strategi yang terkandung di dalamnya dan bakal muncul sebagai salah sebuah institusi latihan negara yang menjadi pemangkin kepada pembangunan modal insan seiring dengan cita-cita menuju ke arah negara maju pada tahun 2020. Akhir kalam, bagi pihak Lembaga Pengurusan ILKAP, saya mengucapkan setinggi-tinggi penghargaan kepada semua pihak yang berkepentingan dan pelanggan yang selama ini telah memberi kerjasama erat serta sokongan berterusan kepada ILKAP. Selain itu, setinggi penghargaan juga kepada, Ketua Pengarah, pihak pengurusan dan semua warga ILKAP yang telah bertungkus lumus menjayakan visi dan misi ILKAP ke tahap yang membanggakan. ALI BIN HAMSA KETUA SETIAUSAHA NEGARA 4 Buku Laporan Tahunan ILKAP 2015 / www.ilkap.gov.my Kata Pengantar Ketua pengarah ilkap Salam Sejahtera dan Salam 1 Malaysia, Laporan Tahunan 2015 ini akan menerangkan pencapaian ILKAP bagi tahun 2015. Pencapaian yang diperoleh merupakan kayu pengukur bagi ILKAP untuk terus berkhidmat dengan komited dan cemerlang. Bagi pihak ILKAP, saya dengan sukacitanya membentangkan Laporan Tahunan bagi tahun 2015. Sejajar dengan visi ILKAP iaitu “Peneraju Kecemerlangan Pembangunan Modal Insan dalam Bidang Kehakiman dan Perundangan yang Terkemuka Menjelang Tahun 2020”, ILKAP menyasarkan bukan sahaja untuk kekal sebagai penyedia latihan terkemuka dalam negara tetapi juga untuk menembusi peringkat serantau dan antarabangsa. Bagi melaksanakan visi ini, ILKAP sentiasa berusaha untuk menambahbaik program latihan yang diadakan. Bagi maksud ini, mesyuarat jawatankuasa kurikulum kursus telah diadakan melibatkan 23 kursus baharu dan 11 kursus sedia ada telah dikaji semula supaya relevan dengan keadaan semasa. Bagi tahun 2015, ILKAP telah melaksanakan 103 kursus bagi pegawai kehakiman dan perundangan, pegawai awam lain termasuk pegawai penguat kuasa undang-undang serta pihak swasta. Program latihan ini dirancang berasaskan analisis keperluan latihan secara komprehensif, kurikulum latihan yang dinamik serta mengkaji semula kurikulum sedia ada dari semasa ke semasa dengan mengambil kira peruntukan undang-undang terkini. Antara kursus yang signifikan sepanjang 2015 adalah seperti yang berikut: • Kursus Mengenai Undang-Undang Kesalahan Keselamatan dan Undang-Undang yang berkaitan dengannya; • Course on Statutory Interpretation (Foreign Expert); • Workshop on the International Legal Frame work Governing Nuclear; Safety, Security and Safeguards (Foreign Expert); • Workshop on Chicago Convention: The Key Annexes and Malaysia’s Obligations (Foreign Expert); dan • Course on Personal Data Protection - Issues and Challenges for Judicial and Legal Officers (Foreign Expert). 5 Buku Laporan Tahunan ILKAP 2015 / www.ilkap.gov.my Seperti tahun yang lalu, ILKAP sekali lagi telah mengadakan program utama iaitu Program Outreach dan ILKAP Speaker Series (ISS) untuk tahun 2015. Bagi Program Outreach, sebanyak tiga (3) seminar telah berjaya diadakan di negeri Johor, Terengganu dan Sabah. Sesungguhnya program ini telah mencapai objektifnya iaitu untuk berkongsi maklumat dan menyediakan analisis yang tepat, komprehensif dan holistik berkaitan isu undang-undang yang sedia ada melalui topik-topik yang dibincangkan selaras dengan peranan ILKAP sebagai penyedia latihan undang-undang yang bertanggungjawab untuk pembangunan kapasiti pegawai kehakiman dan perundangan dan pegawai penguat kuasa di Malaysia. Bagi program ILKAP Speaker Series (ISS) pula, ILKAP telah menjemput YAA Tun Dato’ Seri Arifin bin Zakaria, Ketua Hakim Negara bagi menyampaikan ceramah yang bertajuk “Judicial Trasformation” sebagai satu usaha ILKAP untuk mengadakan platform perbincangan intelektual dan perkongsian pengetahuan oleh tokoh berpengalaman dan terkemuka dalam bidang undang-undang untuk berkongsi pemikiran dan idea mengenai isu-isu perundangan semasa. Saya juga ingin mengambil kesempatan ini untuk mengucapkan ribuan terima kasih dan penghargaan kepada Lembaga Pengurusan ILKAP yang sentiasa memberikan sokongan kepada ILKAP sehingga ke tahap pencapaian yang lebih tinggi sejajar dengan visi dan misinya. Ucapan terima kasih juga kepada pelanggan dan penceramah dari dalam dan luar negara yang telah menjayakan program latihan ILKAP serta seluruh warga ILKAP yang telah merealisasikan program latihan ILKAP.     Malaysia’s 14th General Election Mahathir Returns to Power May 10th, 2018 EXECUTIVE SUMMARY In an outcome that surprised everyone, the opposition coalition led by Dr Mahathir Mohamad won the majority of the Parliamentary seats, enabling him to form the next Federal Government. Mahathir’s Pakatan Harapan (PH) or Coalition of Hope together with a Sabah opposition party won 121 of the 222 Parliamentary seats. The outgoing government coalition, National Front (BN) won only 79 seats. The Islamist party, Pan Malaysia Islamic Party (PAS) won 18 seats. The remaining four seats were won by independent candidates and another small opposition party. At the state level, PH now controls five out of the 13 state governments. PH may end up with as many as seven states once the process of forming state governments is completed. The transition process at the Federal level is likely to be smooth with Mahathir acknowledging the role of the head of the civil service in managing the transfer of power. In the coming weeks, it is very likely that the new Federal administration will focus on ensuring a smooth and orderly transition. THE TRANSITION PROCESS Barring any mass defection of PH Members of Parliament, Mahathir is likely to be sworn in as the Prime Minister in the coming days. As expected, the swearing in ceremony has been delayed for unknown reasons. Following his swearing in as the Prime Minister, Mahathir will negotiate with other PH parties on distribution of Cabinet positions. The slow process in Cabinet appointments is unlikely to cause major disruptions to essential services as the government machinery is operated by career civil servants who are not affected by electoral politics.

The country is committed to its goal of achieving a developed nation status by 2020. This goal continues to be pursued against a backdrop of an increasing borderless and more demanding environment with the nation having to meet the challenges of enhancing competitiveness, achieving sustainable development and inclusive growth. The Government is continuously striving for new avenues through which we can maintain and enhance our efficiency and competitiveness through a private-sector driven and people-centred growth. We also need to ensure that competitiveness is not eroded and gains made are sustained and transferred to citizens and businesses. Better regulation is one of the proven instruments available to achieve this. Good regulations are required for good governance in these challenging times. Good regulations are also crucial for harnessing national efforts and resources for competitiveness and sustained economic growth. This necessitates that regulations and the rule-making process keep pace with changing times and circumstances. Effective regulations achieved through a more robust process of analysis and consultation with stakeholders enhances efficiency and accountability and at the same time promotes greater participation, inclusiveness and ownership of the problem resolution process. Reflecting the desire to improve the rule-making process, the Government will introduce a new policy to transform rule-making in Government.

Introduction Before the devaluation of the baht in July 1997 that triggered the East Asian financial crisis Malaysia was enjoying an enviable average growth rate of per cent per annum in the four years prior to the crisis. In the beginning most analysts expected it to be contained within a few months. However, the crisis turned out to be unprecedented in terms of the speed and severity of the contagion effect that also spread to countries outside of East Asia. In Malaysia, as in other East Asian countries, the financial crisis quickly deteriorated into an economic and social crisis. The objective of this paper is to evaluate the impact of the financial crisis on poverty incidence and income distribution in Malaysia. Unlike in other crisis affected countries such as Indonesia, Thailand and Philippines, where a substantial volume of works impact of the financial crisis on poverty incidence and income distribution have been published, very little work on this subject has been done for Malaysia.

Many more... 1 FOREWORD “Ola a todos (Hello everyone)”, The only highlight for this issue was the visit to the state of Mato Grosso Do Sul by ASEAN Ambassadors and other members of the ASEAN Committee in Brasil- ia (ACB) in February. As Covid-19 started to hit Brazil, Brazil close its land borders and airspace to oth- er countries. Mask wearing was made mandatory in most of the states, while peo- ple are still allowed to travel internally for essential purposes. Over the past months, the Covid-19 outbreak has literally forced all the diplomatic activities in Brasilia to come to a halt. There is no more business as usual for Mis- sion since the beginning of March although Mission is still functioning. Mission continues to provide consular assistance and travel advice to Malaysians in Brazil, Guyana and Suriname through online services as well as in-office ap- pointments. Apart from following closely the pandemic development in the country, Mission also works in concerted effort with the Task Force back home to coordinate ac- tions in support of making arrangements for Malaysians stranded in foreign countries all over the world to return to Malaysia safely. Together with our other Missions in the region, we played a constructive role in offering timely assistance to Malaysians stranded in Argentina and Bolivia to return home on 22 March and 20 April respectively.

Malaysia has one of the most competitive economies in Asia and is becoming globally recognised as having a business- Transformation, friendly environment. The country is committed to achieving sustainable development and inclusive growth, while also recognising the challenges and opportunies posed by a global competitive economy as well as the establishment of the ASEAN community and regional economic integration. POWERING The government has encouraged private sector-driven and people- centered growth through a variety of initiatives and policies that has been very successful. But maintaining these reforms has led the government to go Growth” further, and embark on an agenda for good regulatory practice. Producing regulations through a more robust process of analysis and stakeholder engagement enhances efficiency and accountability, and also promotes greater participation, inclusiveness and ownership of the end solution or government intervention. In 2013, the launch of the National Policy on the Development and Implementation of Regulations reflected the government’s desire to improve the rule-making process. Regulatory impact statements and public consultations were introduced in order to standardize the way that polices, laws and regulations are developed and improve overall regulatory quality. We are grateful to the OECD for its support in introducing and implementing this policy, drawing on the vast experience and expertise of other countries so that Malaysia can learn from best practice and avoid the mistakes of others.
