Tender Notice No .-13/ K C-II of 2020 - 21 (3rd call for Sl No-03 )

Sealed Tenders in specified printed form are invited for the following work(s) from reliable, resourceful experienced and benefited Contractors who may be found eligible after scrutiny of their credentials to be submitted as per particulars given below and will be received by the Assistant Engineer, Krishnagar Construction Sub-Division –II, P.W.D in the tender box in his chamber or as stated otherwise. Upto specified date and time and will be opened half an hour later on the same date of later as will be notified, in presence of contractors or their authorized representatives who may to be present at time of opening.

No 01 & 02 and 30% for sl no. 03 of the estimated amount put to tender during 5 (five) years prior to the date of issue of the tender notice& as per 7) Eligibility criteria to participate :- The willing contractors will have to apply for participation in the In the tender tender in their printed letter head containing full mailing address withpresent telephone number ( Mobile No. & Land Line No. if any) along with required documents (self attested) as mentioned herein below. On scrutiny of the required documents and after verification of the same with the original, if the agency is found to be eligible necessary certificate ofeligibility shall be issued by the tender inviting authority to the concerned agency himself or his representative The “Certificate of Eligibility” thus issued to the agencyshall have to be submitted in sealed cover along with the tender documents & EMD. (Original are to be shown for verification by this office at the time of scrutinizing application).

Documents to be furnished for participating in the tender :- i) Valid PAN card. Trade License and Professional Tax Clearance Certificates. GST Registration Certificate(As per G.O), Plumbing License (In case of S & P work) ii) Bye Laws, PAN card, Professional Tax Clearance Certificates, GST Registration Certificate, Last year audit report for Un-employed Engineer’s / Labour Co-Op Society Ltd. 8) Earnest Money :- : As per Annexure – I {To be deposited in the shape of Bank Draft in favour of Executive Engineer P.W.D, Nadia Construction Division. (from any Nationalized Bank)} 9) Applicable Schedule of Rates :- P.W.D.(W.B) Schedule of rates applicable for central Circle (Nadia) and on date of N.I.T. both Building and S & P 10) Last Date and time for receipt of application for Participation. (Off :- On 11-01-2021 Up to 2-00 p .m. line) in the tender

11) Last Date and time of issuing :- On 13-01-2021 Up to 2-00 p .m. permission certificate to Technically Eligible Bidders to participate in Tender 12) :- N.I.T. Special Terms & Conditions, Specified tender forms - 2911,will be available and/for Availability of Tender Documents ( downloaded from the Departmental, Website (http://www.pwdwb.in) at Free of Cost. ( On Line) price per copy of the specified Tender form -2911(ii) Rs 5.00 & other Document Rs. 250.00, Total Rs 255.00 ) 13) Last date and time for receipt of :- On 15-01-2021 Up to 2-00 p .m. tender papers in Sealed Cover (off (In the tender Box kept in the Chamber of Assistant Engineer, Krishnanagar Construction line) along with original permission Sub-Division No -II, P.W.D) certificate and EMD. 14) Date & time of opening of tender :- On 15-01-2021 Up to 2-30 p .m.

Note:- Tenderer shall have to write Tender Notice No., Name of Tenderer on the body of sealed cover, otherwise the bid shall be liable to be rejection at the time of opening Tender.

15) No exemption of Earnest Money Deposit will be entertained for any Bidder and/ or any case.

16) The tender documents & other relevant particulars (if any) may be seen by the intending tenderer during office hours in the office of the undersigned between 11-00 am to 4-00 pm on any working day up to last date of application.

17) Validity of the tender :- The offer will remain valid for acceptance for 120 days from the date of receipt of tender.

18) The contractors should quote in his own writing in figure as well as in words the rate in percentage AT PAR / ABOVE / BELOW on the basis of the priced Schedule of probable items with approximate quantities. The contractors may sign either in English, Bengali or Hindi but the rates as above should also be quoted in the same languages. In case of illiterate contractors the rate tendered for should be attested by a witness.

19) Conditional Tender will be liable for rejection.

20) Time / Cost over-run and consequent cost escalation for any material, labour, POL etc. will not be allowed.

21) No mobilization advance / secured advance will be allowed.

22) Even after submission of tender, the tender will not be taken into consideration during evaluation, if the papers submitted by any agency in support of eligibility are found to be baseless/false in the event of verification from the concerned authority.

23) In case of non-participation in the tender in any shape will be dealt severely for making an attempt towards disruption of competitive spirit of tender and non- participant may be disallowed to participate in 3 (three) nos. consecutive N.I.T of this Sub Division.

24) A CESS of 1% of the cost of construction works will be deducted from the bills of the contractors and remit the amount so collected to the " W.B. Building and other Construction Workers Welfare Board" as notification No. 1182 IR dated 20.09.2005 of the Labour Department. 25) If any contractors fails to start the work within 7 (seven) days from issuing date of work order / Formal tender the work order will be cancelled and relevant clauses of the condition of the contract shall deemed to have executed by the tendering authority. No litigation to this effect shall be entertained by the tender inviting authority, this is incorporated to deliver time bound Public works.

26) Tender inviting Authority reserves the right to issue corrigendum towards the estimated amount, eligibility of contractors, Earnest money, time of completion etc. in case of any revision, three days in advance to the date of application under certain unavoidable circumstances. 27) In case of inadvertent typographical mistake found in the specific price schedule of rates, the same will be treated to be so corrected as to conform to the prevailing relevant schedule of rates and / or technically sanctioned estimate. 28) In case of any Bandh or Holiday or Natural Calamity on the aforesaid dates, the next working day will be treated as scheduled/prescribed date for the purpose. 29) The payment will be made as and when fund will be available from the concerned source. No Claim, whatsoever, for delay in payment, if any will be entertained. Contractors are requested to quote their rate accordingly. 30) Tender inviting Authority reserves his right to rectify / replace / substitute any rate of the priced schedule put to tender in case of any inadvertent / typographical mistake both in figure as well as in words prior to execution of formal Tender. 31) The bills are to be submitted to the office of the Assistant Engineer/Krishnagar Construction Sub Division No - II, PWD by the concerned Junior Engineer (Civil)/Krishnagar Construction Sub-Division –II with the consumption statement of materials and plants & machineries even Up to date issued to the agency. The Executive Engineer (P.W.D) Nadia Construction Division , will make payment subject to the availability of LOC. The progress of work in this connection will not be hampered due to the delayed payment or due to any other reasons. 32) Necessary mandatory deduction towards I.T, SGST / CGST / IGST etc will be made as per relevant Govt. orders. 33) The successful tenderer will have to execute formal agreement as within specified time period as per instruction from this end and during execution of formal agreement price of tender documents accompanied with the cost Tender Form No.2911/2911(i)/2911(ii) & price schedule will have to be paid by the successful Tenderer. 34) Issuance of particular tender to any contractor will be mainly on the merit of documents submitted and other consideration regarding reliability and resourcefulness. Technically qualified agency as allowed by the Tender inviting authority shall be allowed to submit the tender documents (Price Bid) in the Tender Box kept in the chamber of the Tender inviting authority along with certificate of eligibility to be received from the office of the Tender inviting authority along with EMD. The discretion of the tender inviting authority in granting permission cannot be challenged.

35) There shall be no provision of Arbitration. Hence clause 25 of WB Form No.2911 is omitted vide Notification No. 558/SPW dated. 13/12/2011 of Principal Secretary, P.W. & P.W. (Roads) Department. It's also informed to all bidders that , The clause 17 of WB Form 2911(ii) {Liability of contractor for damaged done & for imperfection} is partially modified vide Notification No. 177-CRC/2M- 57/2008 dated 12/07/2012 of the secretary to the Government of West Bengal.

36) Assistant Engineer (P.W.D), Krishnagar Construction Sub Divn No. II, may invite fresh Bid (Open or Sealed) if necessary, among the respective tenderers, after tenders are opened or on the 3rd working day after the date of opening tenders

37) Payments for works may be delayed due to non availability of fund for which no claim would be entertained. Completion of work may not suffer for any non-payment or delay in payment. 38) The successful contractors will have to abide by the provision the West Bengal Contract Labour (Regulation and Abolition ) Rules, 1972 and obtain License from the appropriate authority as per said Act. And Rules , if applicable in this case.

39) In case of partnership firm, the intending tenderer shall have to produce authentic document in respect of firm registration obtained from the Registrar of Firms. West Bengal Pursuant to the Indian Partnership Act 1932 (Act IX of 1932).

40) No credential will be considered unless it is supported by payment certificate, work – order and completion certificate mentioning the date of completion issued by the competent authority not below the rank of Executive Engineer or Similar rank. Priced Schedule of the work should also be submitted at the time of submission of application so that the quantum of similar nature of work may be verified before issue of tender paper. If due to ambiguity, quantum of similar nature of work cannot be ascertained clearly from completion certificate / credential documents, it will be verified from the price schedule of work.

41) Periodical quality test of materials supplied by the agency and final products are to be made as per guidance of schedule of P.W.D/I.S/I.R.S/M.O.R.T. & H at contractor’s cost. Normally quality control test of supplied materials / final products will be done in the Departments Laboratory. Otherwise testing of materials/final products will be done from the outside recognized laboratory at the discretion of Engineer- in-charge. In both the cases necessary cost of testing charges will be borne by the agency.

42) All tenderer or his authorized representative is required to requested to present personally during the opening of the tender and to sign tender opening register as witness. 43) No, person will be allowed to quote rate on the basis of Legal Power of Attorney conferred to him by the Firm / Agency except in circumstances where necessary Govt. approval has been obtained.
