BRENNER* This Article explains why and how computer technology complicates the related processes of identifying internal (crime and terrorism) and external (war) threats to social order of respondingto those threats. First, it divides the process-attribution-intotwo categories: what-attribution (what kind of attack is this?) and who-attribution (who is responsiblefor this attack?). Then, it analyzes, in detail, how and why our adversaries' use of computer technology blurs the distinctions between what is now cybercrime, cyberterrorism, and cyberwarfare. The Article goes on to analyze how and why computer technology and the blurring of these distinctions erode our ability to mount an effective response to threats of either type. -
In Defense of Cyberterrorism: an Argument for Anticipating Cyber-Attacks
IN DEFENSE OF CYBERTERRORISM: AN ARGUMENT FOR ANTICIPATING CYBER-ATTACKS Susan W. Brenner Marc D. Goodman The September 11, 2001, terrorist attacks on the United States brought the notion of terrorism as a clear and present danger into the consciousness of the American people. In order to predict what might follow these shocking attacks, it is necessary to examine the ideologies and motives of their perpetrators, and the methodologies that terrorists utilize. The focus of this article is on how Al-Qa'ida and other Islamic fundamentalist groups can use cyberspace and technology to continue to wage war againstthe United States, its allies and its foreign interests. Contending that cyberspace will become an increasingly essential terrorist tool, the author examines four key issues surrounding cyberterrorism. The first is a survey of conventional methods of "physical" terrorism, and their inherent shortcomings. Next, a discussion of cyberspace reveals its potential advantages as a secure, borderless, anonymous, and structured delivery method for terrorism. Third, the author offers several cyberterrorism scenarios. Relating several examples of both actual and potential syntactic and semantic attacks, instigated individually or in combination, the author conveys their damagingpolitical and economic impact. Finally, the author addresses the inevitable inquiry into why cyberspace has not been used to its full potential by would-be terrorists. Separately considering foreign and domestic terrorists, it becomes evident that the aims of terrorists must shift from the gross infliction of panic, death and destruction to the crippling of key information systems before cyberattacks will take precedence over physical attacks. However, given that terrorist groups such as Al Qa'ida are highly intelligent, well-funded, and globally coordinated, the possibility of attacks via cyberspace should make America increasingly vigilant. -

Last of U.S. Marines Leave Afghanistan’s Helmand Province Departure Is Part of the Withdrawal of Most Foreign Combat Troops by Dec. 31 KANDAHAR AIRFIELD, Afghanistan – The air traffic controllers had to stay until the very end. After several busy days and hundreds of flights out of Helmand province, the last of the U.S. Marines filed into helicopters around midday Monday, leaving behind a sprawling compound that for years served as a crucial base of the fight against the Taliban in Afghanistan. “I don’t think we’ve had time to digest it, we’ve been so busy,” said Marine Corps Capt. Benjamin Kiley, an air- control officer, who said he had slept just four hours over the past four days. Minutes before leaving, air tower workers destroyed sensitive gear and made sure no classified papers were lying around. For years, Helmand was the focus of Marine Corps operations in Afghanistan. Camps Leatherneck and Bastion— shared by U.S. and British forces before being formally handed over Sunday—comprised the logistical hub and headquarters. The base once housed some 40,000 U.S. and allied troops. The compound is now in the hands of Afghan forces, who began trickling in to secure the perimeter Monday morning. Marines prepare to depart Helmand on Monday after American and British forces formally handed over the Leatherneck and Bastion camps. “It’s kind of surreal. When you’ve been here for so long it’s incredible to think that we are finally leaving,” said Marine Corps Lt. Nicole Kreis, an air-traffic controller who was on one of the last helicopters out of Camp Leatherneck. -

AFGHANISTAN 2015 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY Afghanistan is an Islamic republic with a strong, directly elected presidency, a bicameral legislative branch, and a judicial branch. Presidential and provincial elections held in 2014 were marred by allegations of fraud that led to an audit of all ballot boxes. Protracted political negotiations between the presidential candidates led to the creation of a national unity government headed by President Ashraf Ghani, with runner-up Abdullah Abdullah assuming the newly created post of chief executive officer. Constitutionally mandated parliamentary elections did not take place during the year. The most recent parliamentary elections took place in 2010 and were marred by high levels of fraud and violence, according to domestic observers, the Organization for Security and Cooperation in Europe, and other international election-monitoring organizations. Civilian authorities generally maintained control over the security forces, although there were occasions when security forces acted independently. The most significant human rights problems were widespread violence, including indiscriminate attacks on civilians by armed insurgent groups; armed insurgent groups’ killings of persons affiliated with the government; torture and abuse of detainees by government forces; widespread disregard for the rule of law and little accountability for those who committed human rights abuses; and targeted violence of and endemic societal discrimination against women and girls. Hekmatyar taken off UN sanctions list: Paving the way for his return – and Hezb-e Islami’s reunification? This was the next step in the implementation of the peace agreement signed by the Afghan government and Hezb in September 2016. It paves the way for the return of the former mujahedin leader, one of the most contentious figures in recent Afghan history – a hero of the jihad according to supporters, a war criminal according to detractors. AAN’s co-director Thomas Ruttig follows up on earlier AAN analysis of the peace agreement, looks at what happens next and possible implications for Hekmatyar’s party (with input from Kate Clark, Fazal Muzhary and Ehsan Qaane). Over four months after the peace deal between the Afghan government and Hezb-e Islami was signed by President Ashraf Ghani and Hezb leader (amir) Gulbuddin Hekmatyar (who was not personally present but brought in via video link), the United Nations Security Council (UNSC) has taken Hekmatyar off its sanctions list. A press release about this measure was published on 3 February 2017 (see the full text in the annex to this dispatch). Without it, the government would have been obliged to detain Hekmatyar if he came to Kabul openly. In the September 2016 agreement with Hezb-e Islami Afghanistan (HIA, Islamic Party of Afghanistan), the Afghan government had committed to take measures that would remove “all sanctions” against the leadership and members of Hezb as a prerequisite for its implementation. -
