By reason of flood control work upon the Red River of the north an avulsion has occurred leaving two parcels of land described as: (1) That portion of Government Lot 2 in the north- east quarter (NE 1/4) of Section 29, Township 140 North, Range 48 West of the Fifth Principal Meridian, Clay County, Minnesota, bounded by the thread of the Red River of the North as it existed prior to January 1, 1959, and the new thread of the Red River of the North as established by the United States Army Corps of En- gineers under Project CIVENG-21-018-59-22, containing 9.78 acres more or less; and (2) That portion of Government Lot 2 in the north- east quarter (NE 1/4) of Section 7, Township 139.North, Range 48 West of the Fifth Principal Meridian, Clay County, Minnesota, bounded by the thread of the Red River of the North as it existed prior to January 1, 1959, and the new thread of the Red River of the North as established by the United States Army Corps of En- gineers under Project CIVENG-21-018-59-22, containing 12.76 acres more or less, physically detached from the state of Minnesota and at- tached to the state of North Dakota. -

The Appendices contain updated and corrected material. Foreword Lawyers use history, mostly legal precedents, to help guide their clients in their lives and businesses. But not all legal history gets collected and published in appellate opinions, or even in news accounts. History is often scattered in ways that are difficult to follow, and facts are frequently obscured by the fogs of memory. As lawyers, though, we should keep track of the people, politics, and developments that shaped our judicial system, particularly in North Dakota our state Supreme Court. Whether good, bad, or indifferent, the current conditions of the Court and of the judicial system it governs certainly affect how we lawyers practice our profession. Consider these glimpses of how our Court and judicial system came to where they are today. I. LEAVING THE 19TH CENTURY 2 A. Red River Valley Water Supply Project Class I Cultural Resources Inventory and Assessment, Eastern North Dakota and Nortwestern Minnesota
RED RIVER VALLEY WATER SUPPLY PROJECT CLASS I CULTURAL RESOURCES INVENTORY AND ASSESSMENT, EASTERN NORTH DAKOTA AND NORTWESTERN MINNESOTA Michael A. Jackson, Dennis L. Toom, and Cynthia Kordecki December 2006 ABSTRACT In 2004-2006, personnel from Anthropology Research, Department of Anthropology, University of North Dakota, Grand Forks, conducted a Class I inventory (file search) for the Red River Valley Water Supply Project (RRVWSP). This work was carried out in cooperation with the USDI Bureau of Reclamation, Dakotas Area Office, Bismarck, ND. The file search dealt with hundreds of cultural resource sites across much of eastern North Dakota and northwestern Minnesota. Archeological sites, architectural sites, site leads, and isolated finds were examined for 14 North Dakota counties and four Minnesota counties. Five different action alternatives were investigated to determine the number and types of previously recorded cultural resources located within each. Each alternative was ranked in terms of its potential to cause impacts to cultural resources, both known and (presently) unknown. Analysis indicated that the Red River Basin Alternative (#3) has the largest potential for cultural resource site impacts. Sandpiper Pipeline: Comparison of Environmental Effects of Reasonable Alternatives In the Matter of the Application of North Dakota Pipeline Company LLC for a Certificate of Need for the Sandpiper Pipeline Project in Minnesota Minnesota Public Utilities Commission Docket CN-13-473 Minnesota Department of Commerce Energy Environmental Review and Analysis | December 2014 Sandpiper Pipeline: Comparison of Environmental Effects of Reasonable Alternatives Abstract North Dakota Pipeline Company LLC (NDPC) is proposing to construct the Sandpiper Project, a 565 to 608-mile long pipeline and associated facilities from the Tioga, North Dakota, through Minnesota to Superior, Wisconsin. On November 8, 2013, NDPC filed two applications with the Minnesota Public Utilities Commission (Commission): the first for a Certificate of Need (CN) and the second for a pipeline route permit for the project. The CN rules at Minn. R. 7853.0130 require, in determining if a certificate of need should be granted, that consideration be paid to the “natural and socioeconomic environments compared to the effects of reasonable alternatives,” and “the effect of the proposed facility, or a suitable modification of it, upon the natural and socioeconomic environments compared to the effect of not building the facility.” For the Sandpiper Project, the Commission concluded that an environmental analysis of six system alternatives, which were identified in the Route Permit docket, and six alternatives to the proposed project identified by NDPC in its CN application would provide it with valuable information to be weighed along with other information while making its need decision. This document is intended to provide that analysis. It is intended for the use of any party who chooses to advocate for or against consideration of an alternative in the certificate of need docket. -

How North Dakota Returns “Unconventional” Oil Revenue to Local Governments Headwaters Economics | Updated January 2014 Introduction This brief shows how North Dakota’s local governments receive production tax revenue from unconventional oil extraction. Fiscal policy is important for local communities for several reasons. Mitigating the acute impacts associated with drilling activity and related population growth requires that revenue is available in the amount, time, and location necessary to build and maintain infrastructure and to provide services. In addition, managing volatility over time requires different fiscal strategies, including setting aside a portion of oil revenue in permanent funds.1 The focus on unconventional oil is important as horizontal drilling and hydraulic fracturing technologies have led a resurgence in oil production in the U.S. Unconventional oil plays require more wells to be drilled on a continuous basis to maintain production than comparable conventional oil fields. This expands potential employment, income, and tax benefits, but also heightens and extends public costs. This brief is part of a larger project by Headwaters Economics that includes detailed fiscal profiles of major oil-producing states—Colorado, Montana, New Mexico, North Dakota, Oklahoma, Texas, and Wyoming—along with a summary report describing the key fiscal differences between these states. These profiles will be updated regularly. The various approaches to taxing oil make comparisons between states difficult, although not impossible. We apply each state’s fiscal policy, including production taxes and revenue distributions, to a typical unconventional oil well. This allows for a comparison of how states tax oil extracted using unconventional technologies, and how this revenue is distributed to communities. -

Robinson’s History of North Dakota: How the State’s History Created a Community Jennifer Heth University of North Dakota Abstract In his History of North Dakota, Elwyn B. Robinson described six themes of North Dakota’s history: remoteness, dependence, radicalism, a position of eco- nomic disadvantage, the Too-Much Mistake, and adjustment. Robinson also concluded that these six themes of the state’s history influenced the state’s people and produced the North Dakota character, which included such traits as pride, stubbornness, and radicalism. Robinson’s scholarship did much to illumi- nate the complexities and interconnectedness of the state’s history, geography, and society, and his History of North Dakota is considered to be the cornerstone of North Dakota historical discourse.
