Report No R1096/05 ANGUS COUNCIL DEVELOPMENT CONTROL COMMITTEE 29 SEPTEMBER 2005 DELEGATED APPROVALS REPORT BY THE DIRECTOR OF PLANNING & TRANSPORT Abstract: This report recommends that the Committee notes the applications detailed in Appendix 1 of the report granted by the Director of Planning & Transport in accordance with the Scheme of Delegation detailed in Standing Orders. 1.0 RECOMMENDATION 1.1 The Committee is asked to note the applications, detailed in the Appendix, granted approval under delegated powers. 2.0 INTRODUCTION 2.1 In terms of the Scheme of Delegation to officers, the Director of Planning & Transport is authorised to approve planning applications in accordance with the Development Plan, the Local Plans or established policies and where there are no objections, except those which raise a general issue affecting a large area, or are of major land or economic development significance. 3.0 APPROVALS 3.1 Attached as an Appendix is a list of applications granted under delegated authority during the period to 24 August 2005 to 21 September 2005. 4.0 FINANCIAL IMPLICATIONS 4.1 There are no financial implications. 5.0 HUMAN RIGHTS IMPLICATIONS 5.1 There are no Human Rights issues arising directly as a result of this report. 6.0 CONSULTATION 6.1 The Chief Executive, Director of Law & Administration and Director of Roads have been consulted in the preparation of this report. Uniform\DCDELGAT Report No R1096/05 ANGUS COUNCIL DEVELOPMENT CONTROL COMMITTEE LIST ‘A’ - DELEGATED APPROVALS Application No. Promoter Location 04/01241/FUL K Scott Erection of Housing Development at:- Kellas Farm Kellas Broughty Ferry Dundee DD5 3PD Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority. 3 That the disposal of sewage effluent be in accordance with the standards required by both the building control authority and the Scottish Environment Protection Agency. 4 That the rainwater run-off from roofs and hard surfaces be directed to a soakaway system to the satisfaction of the building control authority. 5 That prior to occupation of any dwellinghouses herby approved a 1.8 metre wide footway shall be provided on the B978 Broughty Ferry to Wellbank Road and the unclassified Kellas Road ex adverso the site, to the specification of Director of Roads to the satisfaction of the planning authority. Positive drainage of the public road shall be provided where necesary as a result of the formation of the new footway. 6 That visibility splays of 4.5 metres x 60 metres be provided on the southwest side of the unclassified Kellas Road at the junction with the B978 Broughty Ferry - Wellbank Road. 7 That minimum visibility splays of 3 metres x 60 metres be provided on each side of the junction of the proposed access with the unclassified Kellas Road. 8 That the crossing(s) over the footpath and/or verge be constructed in accordance with the standards required by the Director of Roads to the satisfaction of the planning authority. 9 That a remediation scheme identifying measures to deal with any contamination within the site shall be submitted to and approved in writing by the Director of Planning & Transport prior to commencement of development on site. The scheme shall include information on previous uses and details of the location and nature of any contamination within the site and shall be implemented prior to the commencement of the development on site. 10 That all beech hedging along boundaries as shown on the approved site layout drawing OS (01) 01 G shall comprise of feathered trees a minimum of 1.5 m tall planted in a double row at 400mm centres and trimmed to form a hedge a minimum of 1.2 metres in height. All boundary hedging shall be fully planted in accordance with this specification prior to occupation of any of the dwellinghouses hereby approved unless otherwise agreed in writing with the Director of Plannning and Transport. Uniform\DCDELGAT Report No R1096/05 11 That the boundary enclosures along the frontages of the site with the B978 and unclassified Kellas Road shall comprise of a natural stone wall as shown on the approved site layout drawing OS (01) 01 G. This wall shall comprise a minimum of 1.2 metres in height from the adjacent pavement level and full details of the alterations to the existing wall and new areas of walling shall be submitted to and approved in writing by the Director of Planning & Transport prior to the commencement of development. The boundary walls shall thereafter be implemented in accordance with approved details prior to the occupation of any dwellinghouse. 12 That notwithstanding the provisions of the Town and Country Planning (General Permitted Development) (Scotland) Order 1989, the permitted development rights provided by Classes 1, 3 and 7 are hereby removed unless otherwise agreed in writing with the Director of Planning & Transport. 13 That the roof and external wall finishes be agreed in consultation with and be to the satisfaction of the Director of Planning & Transport prior to the commencement of work. 14 That no development takes place until there has been submitted to and approved by the planning authority, a scheme of landscaping. 15 That all planting comprised in the approved details of landscaping be carried out in the first planting season following the completion of the development or at earlier stages and any plants or trees which within a period of five years from the commencement of the use die; are removed or become seriously damaged or diseased, shall be replaced in the next planting season with others of a similar size and species. 04/01710/FUL Augment/Strathairlie Erection of a Building for Augment and Neighbourhood Strathairlie Neighbourhood Associations at:- Association Land Adjoining 24 Strathairlie Avenue Arbroath Angus DD11 1LP Conditions 1 That the development hereby permitted shall be begun before the expiration of five years from the date of this permission. 2 That no alterations or amendments be made to the details contained in the approved and docqueted plans unless so indicated by conditions attached to this consent or agreed in writing with the planning authority. 3 That the footway crossing adjacent to the proposed car parking spaces shall be formed and constructed in accordance with the standards of Angus Council. 4 That the hours of opening be restricted to between 09.00 and 19.00 on weekdays and the premises be closed at weekends. 5 That the premises be used for no other purpose within Class 10 or any other Class of the Town and Country Planning (Use Classes) (Scotland) Order 1997 without the express approval of the planning authority. 6 That prior to the commencement of any development on site details of the proposed boundary treatment be submitted to the Director of Planning & Transport for approval.
