REPORT Background Procureur du Bien Public, Geraint Jennings, has been asking the Parish of St Helier to consider the establishment of a Conseil Municipal for many years, recommending that the informal arrangements introduced by the Constable of St Helier in 2002 to develop the role of the Roads Committee should be put on a more formal footing. These arrangements, including the holding of regular monthly meetings in public, the publication of agendas and minutes, the holding of public consultations and presentations (both on matters of local interest and on wider issues such as the development of Island Plans), and the discussion of strategies and policies that are outside the remit of the Committee, have enabled individual members to take on responsibility for particular areas of interest, such as tackling the problems of speeding and littering, encouraging recycling, advising on legal aspects of the purchase and sale of Parish property, and so on. The Constable has welcomed the greater involvement of the Roads Committee, together with that of the Procureurs du Bien Public in the running of the Parish, and believes that the evolution of the Committee into a Conseil Municipal, with additional members elected including a youth representative, would allow the expertise and interest of more parishioners to be harnessed for the benefit of all.

Everyone at the Parish is delighted that the continuing low infection rates of Covid-19 are allowing the ‘reconnection’ of our town, and it is gratifying to see so many people coming to town to enjoy St Helier’s unique atmosphere and variety of things to do. Of course, there is no room for complacency, and we are mindful that many other communities are not yet able to enjoy the freedoms that we can in Jersey; there is also the need for continued vigilance and the maintenance of good hygiene, including handwashing and the wearing of masks indoors. While this may annoy some people, we rely upon the scientific advice from the Government and it is definitely a case of ‘better safe than sorry’.     Review of the Roles of the Crown Officers Submission by Paul Le Claire “A love of tradition and reform are not mutually exclusive.” Bailiff’s speech to the Assize d’Heritage 2008 The Bailiff continued: “The independence of the Court from political interference is one of the pillars of democracy. What may be worth restating, however, is that every [litigant] has a legal right to be tried by a court which is impartial and free from the appearance of bias.” Bailiff 1. For the purpose of this submission the term Bailiff is used also to denote Deputy Bailiff and Lieutenant Bailiff. The role of the Bailiff of Jersey is many faceted but the two main elements of what has been described as the dual role, are those of President of the States and President of the Royal Court or Chief Justice . To an extent flowing from these two areas of responsibility are the Bailiff’s other functions of President of the Court of Appeal, Deputy Governor in the absence of the Lieutenant Governor, President of the College of Electors, member of the Emergencies Council and the various ceremonial duties he performs. 2. The general view in democratic societies is that there should be a separation of powers in respect of legislative, judicial and executive functions. This is not always completely achieved, as even in democracies such as the UK and the USA there are overlaps. Nevertheless, in order for there to be confidence in government institutions and the courts, there is a need not only for there to be independence but for the system to be transparent.

Strang In attendance 26 Members of the Public Mr W. Millow, Project Manager 1. Chairman’s Introduction 1.1 The Chairman welcomed everyone to the meeting and introduced the Panel Members and the Project Manager. Apologies were presented on behalf of Mrs M-L. Backhurst. He described the background to the Review, explaining that it stemmed from a States decision and that there had been consideration of the Crown Officers’ roles in the past. He set out the Panel’s Terms of Reference and the areas it had been tasked to consider. The Panel would consider the principles underlying the Crown Officers’ roles rather than the personalities of the individual Office holders. 1.2 The Chairman explained that the Panel would report to the States in due course. The Panel had invited written submissions and had held pubic hearings. The large majority of written submissions and hearing transcripts had been uploaded to a dedicated webpage. Notwithstanding the views it had already received, the Panel wished to ascertain whether other people had views and it had therefore arranged the public meeting. A record of the meeting would be taken and would be made available on the webpage in due course. The Chairman highlighted that if anyone present were uncomfortable with that approach, he or she was free to write to the Panel with their views and request confidentiality, a request which the Panel would consider.

Perhaps we allow one or two minutes to ensure that the doors to the Chamber had been correctly closed and people have left the precincts. Deputy Troy Sir, can I ask one question regarding the recording. Will the usual conditions apply to obtaining access to the recordings? I understand that the information is sensitive but if members can have copies of the recording under an undertaking that they keep the contents confidential that is acceptable presumably. Greffier We will need to seek advice from the Law Officers. I would imagine, unfortunately, Deputy it may not be possible for copies to be made but possibly the Solicitor General may be able to advise us whether it would be appropriate for the recordings to be available for members to listen to, perhaps we can come to that later unless you wish to address that point now Madam Solicitor General.
