MALAYSIA 2019 HUMAN RIGHTS REPORT EXECUTIVE SUMMARY Malaysia is a federal constitutional monarchy. It has a parliamentary system of government selected through regular, multiparty elections and is headed by a prime minister. The king is the head of state, serves a largely ceremonial role, and has a five-year term. Sultan Muhammad V resigned as king on January 6 after serving two years; Sultan Abdullah succeeded him that month. The kingship rotates among the sultans of the nine states with hereditary rulers. In 2018 parliamentary elections, the opposition Pakatan Harapan coalition defeated the ruling Barisan Nasional coalition, resulting in the first transfer of power between coalitions since independence in 1957. Before and during the campaign, then opposition politicians and civil society organizations alleged electoral irregularities and systemic disadvantages for opposition groups due to lack of media access and malapportioned districts favoring the then ruling coalition. The Royal Malaysian Police maintain internal security and report to the Ministry of Home Affairs. State-level Islamic religious enforcement officers have authority to enforce some criminal aspects of sharia. Civilian authorities at times did not maintain effective control over security forces. Case Study Women in Politics: Reflections from Malaysia Wan Azizah Women constitute half of humanity, and it follows that any decision-making, whether at the personal, family, societal or public levels, should be mindful of and involve the participation of women in the making of those decisions. Women’s political, social and economic rights are an integral and inseparable part of their human rights. Democracy is an inclusive process, and therefore in a functioning democracy, the points of view of different interest groups must be taken into account in formulating any decision. The interest and opinions of men, women and minorities must be part of that decision-making process. Yet far from being included in the decision-making process, women find themselves under-represented in political institutions. Numerous challenges confront women entering politics. Among them are lack of party support, family support and the "masculine model" of political life. Many feel that Malaysian society is still male dominated, and men are threatened by the idea of women holding senior posts. In the political sphere this is compounded by the high premium placed on political power. This makes some men even less willing to share power with women. -
Malaysia Program Summary Political Party Strengthening Public Opinion
Malaysia Program Summary Since Malaysia’s independence in 1957, the country has experienced a series of national elections, but never a change in national government. The ruling coalition (now known as the Barisan Nasional or BN) has held power continuously during Malaysia’s post-independence era. In the 2008 general elections, for the first time, the BN lost its two-thirds majority in parliament and also lost control of five state assemblies to the opposition coalition, Pakatan Rakyat. Subsequently, in Sarawak in April 2011, in the only state assembly elections held before national elections due in 2013, the BN retained control of the state assembly but suffered a reduction in its majority. It is in this context that the International Republican Institute (IRI) provides technical assistance, training and consultation to political parties and works to build knowledge and impart skills that enable Malaysian political leaders to more effectively address citizen concerns. Political Party Strengthening IRI is working to strengthen political parties at both the national level and in targeted states where the Institute can have impact. IRI works with political parties to run better campaigns, to develop get out the vote (GOTV) drives, to improve platform development and messaging, and to identify and respond to constituent concerns via utilization of public opinion research. IRI is assisting political parties from both the BN and Pakatan Rakyat (PR) coalitions in these areas. For example, in advance of the recent Sarawak elections, IRI assisted parties from both coalitions with campaign trainings, GOTV drives and also developed Sarawak-specific polling to better enable parties to develop platforms and messages that met the needs of all Sarawakians. -

Parti Pribumi Bersatu Malaysia in Johor: New Party, Big Responsibility By Wan Saiful Wan Jan EXECUTIVE SUMMARY • Parti Pribumi Bersatu Malaysia (PPBM) was officially launched on 14 January 2017, led by prominent personalities including former Prime Minister Mahathir Mohamad, former Deputy Prime Minister Muhyiddin Yassin, and former Kedah Chief Minister Mukhriz Mahathir. • Upon establishment, the party immediately announced that they are aiming to win the southern state of Johor in the upcoming general election. Historically, UMNO splinter parties have never been able to threaten UMNO in this state. Since independence, Johor has always been seen as an UMNO bastion. • PPBM has moved quickly to establish themselves in all parliamentary and state constituencies in Johor, however, and it has been rather successful in attracting support from those aged below 35. Their key challenge remains the rural and female voters. • Identity politics is a major hurdle for PPBM. The presence of the Democratic Action Party (DAP) in the Pakatan Harapan coalition — of which PPBM is a member — is a hurdle in attracting Malay support. Among Malay voters, DAP is perceived as a threat to Malay privileges. • At the same time, PPBM leaders in Johor believe that their contribution towards the coalition is not yet fully recognized by their coalition partners who insist that PPBM contests only in constituencies with a large Malay population. Areas with a high percentage of Malay voters are difficult for PPBM to win because UMNO tends to enjoy huge support in such constituencies, and PPBM leaders argue that they deserve more mixed seats to run in as well. -

4 Electoral boundaries in Malaysia’s 2018 election Malapportionment, gerrymandering and UMNO’s fall Kai Ostwald Introduction Malaysia’s General Election 14 (GE14) on 9 May 2018 broke with the previ- ous thirteen in a fundamental way: the United Malays National Organisation (UMNO) and its coalition partners were defeated for the first time, bringing about an unprecedented transition of power after over six decades of political dominance. Despite the unpopularity of UMNO Prime Minister Najib Razak and widespread frustrations with the cost of living, the outcome was not anticipated. This is largely due to the extensive partisan manipulation of Malaysia’s electoral process, which provided the ruling Barisan Nasional (BN) coalition with far- reaching advantages in electoral competition. Of the many advantages, perhaps the most powerful came through biased elec- toral boundaries that use malapportionment and gerrymandering to provide the BN with a reliable and significant seat bonus over the opposition. This bias was enough to fundamentally distort outcomes, for example in the 2013 general elec- tion (GE13) where the BN lost the popular vote by 4% but still emerged with a 20% seat advantage in parliament (Wong 2018 ; Lee 2015 ; Ostwald 2013 ). Rede- lineation exercises concluded just prior to GE14 increased malapportionment further and showed signs of extensive gerrymandering. Critics from the opposi- tion and civil society feared that they would make a turnover of power through the ballot box nearly impossible. Relative to brazen manipulations like phantom voting or ballot box stuffing, biased electoral boundaries do not easily rouse cries of electoral malpractice. However, their effects are powerful. -

Loh and Kevin Zhang* EXECUTIVE SUMMARY • On 26 September, the East Malaysian state of Sabah heads to the polls. The state election was called following the defection of 13 assemblymen from the Warisan-led state government. • The competition is fierce, with 447 candidates from many parties contesting for the 73 state legislative assembly seats. The main battle is however being fought between Warisan Plus on one hand and Gabungan Rakyat Sabah (GRS) on the other. Warisan Plus consists of the Pakatan Harapan (PH) coalition and the Sabah-based Warisan, while GRS consists of Perikatan Nasional (PN), Barisan Nasional (BN), and Parti Bersatu Sabah (PBS). • The COVID-19 pandemic has pushed much of the political campaigns and discussions to online media platforms. Our research indicates that a vigorous online discourse has emerged in Sabah, particularly since the dissolution of the state assembly on 30 July. • Three key themes can be seen in the online media discourse among Sabahans: wariness against the role of “Cybertroopers”, cynicism over party-hopping, and a deepening political divide between Sabah and Peninsular Malaysia. • Both the incumbent (Warisan) and major opposition (BN) parties have been viciously attacked. The Warisan is painted as a pro-migrant party with poor administrative ability shown during their short tenure, while the BN parties are tagged as “robbers of the state” who failed to develop Sabah despite having exploited its natural resources for decades. -

Introduction: The Electoral System’s Impact on Outcomes 1 Chapter 1 Introduction: The Electoral System’s Impact on Outcomes Johan Saravanamuttu, Lee Hock Guan and Mohamed Nawab Mohamed Osman PREAMBLE Much has occurred on the political stage even within a year after the 13th general election (GE13) on 5 May 2013. In terms of electoral politics, there have been six by-elections at the time of writing; one resulted from the untimely death of Karpal Singh, the veteran Democratic Action Party (DAP) politician, and another from the death of the Pan-Malaysian Islamic Party (PAS) Menteri Besar of Kedah. The by-elections were held in Kuala Besut (Terengganu state seat) on 24 July 2013; Sungai Limau (Kedah state seat) on 19 October 2013; Kajang (Selangor state seat) on 23 March 2014; Bukit Gelugor (Penang parliamentary seat) on 25 May 2014; Teluk Intan (Perak parliamentary seat) on 31 May 2014; and Pengkalan Kubor (Kelantan state seat) on 25 September 2014. Barisan Nasional (BN) retained the Kuala Besut seat, thus holding on to its thin two-seat majority in the state. This was to prove a little problematic later when the Menteri Besar of Terengganu and another member of the State Assembly announced that they had resigned from the United Malays National Organisation (UMNO) in mid-May 2014, although they soon recanted their intention to do so.1 The Kajang by-election was a complex move by the Parti Keadilan Rakyat (PKR) to initially provide its leader Anwar Ibrahim with the opportunity to be in the Selangor state government, 1 2 Coalitions in Collision if not even to undertake leadership of the state. -
