IT is hereby notified that His Excellency the President, has, in terms of section 22 of the Radiation Protection Act [Chapter 15:15], made the following regulations: — 1. These regulations may be cited as the Radiation Protection (Naturally Occurring Radioactive Material) (Amendment) Regulations, 2021 (No. 2). 2. The Radiation Protection (Naturally Occurring Radioactive Material) Regulations, 2013, published in Statutory Instrument 99 of 2013, is amended by the insertion (before the First Schedule) of the following Schedule—

The Customs and Excise (Suspension) Regulations, 2003, published in Statutory Instrument 257 of2003, are amended in section 9T by the insertion of the following section after section 9(MM)—

IT is hereby notified that the Minister of Finance and Economic Development has, in terms of section 235, as read with section 120, of the Customs and Excise Act [Chapter 23:02], made the following regulations: —

1. These regulations may be cited as the Customs and Excise (Shoe Manufacturer) (Rebate) (Amendment) Regulations, 2021 (No. 1).

2. The Customs and Excise (Shoe Manufacturer) (Rebate) Regulations, 2017, published in Statutory Instrument 61 of 2017, are amended by the insertion after section 11, of a new section as follows—

“Transparency and accountability in the utilisation of rebate facility 12. (1) A manufacturer shall be required to present to the Minister responsible for Finance, an annual report in a form approved by the Minister, showing full particulars of all the benefits achieved in the utilisation of the rebate facility granted in terms of these regulations. The report shall be in such a manner that the effect on the following aspects on the manufacturer’s business can be readily ascertained or accounted for to the satisfaction of the Minister­ ial the incremental employment levels achieved by the manufacturer; and (b) capacity utilisation levels attained from the use of the rebate; and (c) value of new investment received since the implementation of the rebate; and (d) growth in the manufacturer’s output; and (e) research and development initiatives carried out by the manufacturer.

9 Customs and Excise (Shoe Manufacturer) (Rebate) (Amendment) Regulations, 2021 (No. 1)

(2) If a manufacturer fails to produce the annual report in the manner approved in terms of subsection (1), the rebate shall be immediately withdrawn and any rebated goods received by the manufacturer during the period when the report was not so produced shall be deemed to have been used for a purpose other than that for which the rebate was granted. The manufacturer shall be required to pay the rebated revenue forthwith and the penalty for failure to keep records. (3) The annual report by the manufacturer shall be submitted within thirty days from the end of the twelve months period calculated from— (a) the 1st day of January 2021 in the first year; and (b) thereafter from the 1st of January every year subsequently.”.

3. The principal regulations are amended by the insertion in the Second Schedule of the following items —

IT is hereby notified that the Minister of Finance and Economic Development has, in terms of section 235 of the Customs and Excise Act [Chapter 23:02], made the following regulations: — 1. These regulations may be cited as the Customs and Excise (General) (Amendment) Regulations, 2021 (No. 103). 2. The Customs and Excise (General) Regulations, 2001, published in Statutory Instrument 154 of2001 (hereinafter called “the principal regulations”), are amended with effect from 1st December, 2020, in section 140 (“Rebate of duty on goods imported temporarily for an approved project”)— (a) by the deletion of subsection (1) and substitution with the following subsections — “(1) Subject to this section, and to such other conditions or restrictions as the Commissioner may in each case determine, a rebate of duty may be granted on such goods which are certified by the Secretary of the responsible Ministry and as the Commissioner may approve, but excluding goods intended for consumption in Zimbabwe, when such goods are temporarily imported by contractors or other persons for completion of such Public Sector Investment Programme Projects. The Minister shall be responsible for granting the approved project status for the Public Sector Investment Programme Projects.”. (2) Any person wishing to be granted a rebate in terms of this section shall make an application to the Commissioner, giving details of— (a) the goods referred to in subsection (1) on which a rebate is sought; and (b) the purpose for which the goods are to be used; and

(c) the date on which the project will be completed, which will not exceed five years; and (d) the date on which the goods are to be re-exported; and (e) submission of completed feasibility studies endorsed by the responsible Ministry; and (f) proof of funding for the project; and (g) evidence of the physical place of business where the project will be undertaken; and (h) compliance with— (i) the requisite regulatory requirements for the nature of the project; and (ii) local authority by-laws or regulations.”; (b) by the insertion of the following new subsections after subsection 6— “(7) In the case of an application for extension of a rebate previously granted in terms of this section, details and proof of utilisation of previous concessions granted under the approved project. The proof shall be in the manner, form and to the extent requested by the Minister.”.

3. The principal regulations are amended in section 141 ( “Rebate of Duty on goods for incorporation in the construction of approved projects”) — (a) by the deletion of the subsection (1) and substitution with the following— “(1) Subject to this section and with effect from 1 st December, 2020, a rebate of duty shall be 12 S.I. 5 of 2021

granted on goods which are certified by the Secretary of the responsible Ministry and the Commissioner, to be components or materials for incorporation in the construction of Public Sector Investment Programme Projects. The Minister shall be responsible for granting the approved project status for the Public Sector Investment Programme Projects.”;

(b) by the insertion after subsection (4) of the following subsections — “(5) A project may be granted a rebate in terms of this section subject to the fulfilment of the following additional conditions — (a) submission of completed feasibility studies endorsed by the responsible Ministry; (b) proof of funding for the project; (c) evidence of the physical place of business where the project will be undertaken; (d) compliance with— (i) the requisite regulatory requirements for the nature of the project; and (ii) local authority by-laws or regulations. (6) In the case of an application for extension of a rebate previously granted in terms of this section, details and proof of utilisation of previous concessions granted under the approved project. The proof shall be in the manner, form and to the extent requested by the Minister.”.

(a) by the repeal of the definition of “public service bus” and substitution with— ““public service bus” means new buses of tariff code 8702.1911 and 8702.9011, with a sitting capacity of at least sixty passengers being imported or removed from in bond by an approved importer;”; (b) by the deletion of the words “... with effect from 1st January, 2020...” and the substitution with the words “.... for a period of twelve months with effect from 1 st January, 2021”.

7. The principal regulations are amended in section 9JJ (Suspension of duty on specified buses imported by tour operators) by the deletion of the words “1st January, 2020” and the substitution of the words “1st January, 2021”. 8. The principal regulations are amended in section 9MM ("Suspension of duly on raw cheese imported by approved importers") — (a) by the deletion of the words “31 st December, 2020” and the substitution of the words “31st December, 2021”; (b) by the deletion of the Schedule to the section and the substitution with the following:

17 Customs and Excise (Suspension) (Amendment) Regulations, 2021 (No. 246)

9. The principal regulations are amended by the insertion, after section 9MM, of a new section as follows — “Suspension of duty on importation of public service buses imported by the Zimbabwe United Passenger Company (Private) Limited 9NN. (1) In this section— “approved importer” means the Zimbabwe United Passenger Company (Private) Limited approved in terms of subsection 2 of this section; “public service bus” means buses of tariff code 8702.10.11 and 8702.90.11, with a sitting capacity of at least sixty passengers being imported or removed in bond by an approved importer. (2) The Minister of Finance and Economic Development in consultation with the Minister of Local Government and Public Works has approved the Zimbabwe United Passenger Company (Private) Limited as a public service bus importer for the purpose of this suspension. (3) The Commissioner may not grant the suspension of duty to the Zimbabwe United Passenger Company (Private) Limited as an approved importer on the basis of non-compliance with section 34C of the Revenue Authority Act [Chapter 23:11], (4) The Zimbabwe United Passenger Company (Private) Limited as an approved importer shall, for a period of twelve months with effect from 1st January, 2021, be allowed to import a maximum of two hundred and fifty public service buses under suspension of duty as provided for in this section. (5) The approved importer shall, when effecting entry on importation, or on removal from bond of a public service bus under suspension, submit with the relevant bill of entry a declaration signed by him or her, to the effect that the public service bus is to be used for transporting persons in line with the approved importer’s public transportation business.

(6) Subject to these regulations the effective rate of duty shall be five per centum. (7) Subject to sections (2) and (3) an approved importer shall not dispose of any public service bus cleared under suspension of duty unless — (a) written authority of the Commissioner is obtained; or (b) payment of the duty suspended in accordance with this section has been made. (8) The Commissioner may authorise the disposal of a public service bus on payment of such duty, not exceeding the amount of duty suspended, as he or she thinks fit, if, in his or her opinion, the public service bus cannot be economically used for the purpose for which it was entered under suspension. (9) Duty suspended on a public service bus, which would have bee u accidentally destroyed before being used in the approved importer’s business may be remittedif the Commissioner is satisfied that every reasonable effort was made and precaution taken to prevent its destruction. ( 10) A public service bus shall be admitted under suspension of duty only if the approved importer has furnished to the satisfaction of the Commissioner— (a) written authority from the Minister of Local Government and Public Works indicating the make, model, engine number and chassis number of the public transport service bus being imported; and (b) a valid tax clearance certificate and proof of registration in terms of the Revenue Authority Act [Chapter 23:11].".
