Why? I had no idea. But, I was now in the hands of Rwanda's dictatorial President, Paul Kagame.4 I had arrived five days earlier to consult with would-be Presidential candidate Victoire Ingabire, who had been briefly jailed for "genocide denial." Her supposed "crime" was asking why genocide memorials did not mention Hutu victims even though both the U.N. and Rwandan government both acknowledged that both Hutus and Tutsis had died. Paul Rusesabagina, the 2005 U.S. Medal of Freedom recipient from President George Bush and the main figure in the award winning film Hotel Rwanda, had told me as I left Belgium that Kagame had threatened him, and that he could not go home. But, I had immunity as a U.N. Tribunal defense lawyer and planned to do no more than meet with the U.S. Embassy and U.N. Office, Rwandan officials and consult with my prospective client. Rwanda's President Paul Kagame, had an unsavory reputation for rumored assassinations and jailing opponents, but he had never arrested an American lawyer and, in late 2009, Bill Clinton had given Kagame a "human rights" award and declared "things have changed in Rwanda!" With the 2010 Rwandan elections approaching, Kagame's new image had been burnished by an honorary MIT degree, Tony Blair signing-on as a consultant, and Rwanda's 2009 admission to the British Commonwealth. But, as I was being taken away by Kagame's secret police, I realized I had put far too much faith in Clinton's public embrace of Kagame and an effective public relations campaign. 4 See Josh Kron & Jeffrey Gettleman, American Lawyer for Opposition Figure is Arrested in Rwanda, N. Tribunal client through original U.N. documents that showed the defeated army had not conspired to commit a "long-plannedgenocide," as Kagame had claimed, and then writing articles about the meaning of the acquittal. A worldwide, "Internet-peoples' campaign" pressured the U.S. and Rwandan governments to release me in slightly less than a month, on humanitarianhealth grounds (together with the brave, skilled representation of my Kenyan lawyers Ken Ogetto and Gershom Otachi, with support from U.S. lawyer Kurt Kerns). On October 6, 2010, the U.N. Tribunal issued an injunction against the Rwandan government, ordering that the pending prosecution against me be dismissed as illegal under principles of UN-ICTR defense counsel immunity.5 However, Rwanda's Chief Prosecutor has threatened to pursue a second prosecution that will avoid U.N. immunity protections.6 I remain at risk of arrest under Rwanda-issued INTERPOL 5 See Bagasora, Ntabakuze, Nsengiyumva v. "You may also recall that few days ago the ICTR ruled that he doesn't have immunity when it comes to publications and statements that he does out of the scope of his duties in the defence council of his clients at the ICTR," said Ngoga. "That his arrest here was not in breach of his functional immunity because he was not on ICTR business. That is the development that paved the way for us to pursue the case against him." Ngoga dismissed recent allegations by Erlinder that he fears for his life. This article summarizes how my U.N. work made me an "enemy of the Rwandan state" and explains why original U.N. documents in evidence at the International Criminal Tribunal for Rwanda, as well as more recent development including the 600 page U.N. report of Rwanda's genocidal crimes in the Congo 1993-2003 leaked to the world press by LeMonde and the New York Times in late August 2010,7 require a re-assessment of the "Rwanda- genocide" narrative. INTRODUCTION The precedent for the U.N. Security Council tribunals, estab- lished in the mid-1990's to prosecute individuals allegedly com- plicit in international crimes, 8 were the post-World War II Nuremberg and Tokyo War Crimes Tribunals created by the vic- torious Allies to prosecute the leadership of Japan and Ger- many.9 However, unlike the WWII Tribunals, the U.N.

The third genocide of the twentieth century took place in the small and remote African country of Rwanda, at the crossroads between Central and Eastern Africa. Fifteen years after the events, the Rwandan genocide, which cost the lives of between 800,000 and a million people in less than four months (April-July 1994), remains one of the most passionately debated topics in African and international history. Several aspects of the event have generated intense scrutiny from a variety of scholars in various disciplines: the speed and scale of the massacres (about 10% of the entire Rwandan population was massacred); the ethnicization of political life under Belgian colonial rule (which ‘constructed’ ethnicity around the Hutu and Tutsi poles); the inability or unwillingness of the international community to stop the cycle of violence once it had started; and, France’s responsibility in supporting the Hutu-dominated regime which ultimately orchestrated the genocide of part of the country’s population (Tutsis and moderate Hutus). On the 17th of November 2006, Judge Louis BRUGIERE 1st Vice President of the “Tribunal de Grande Instance de Paris” requested the French Chief Prosecutor for permission to issue International arrest warrants against senior Rwandan officials for involvement in the 1994 shooting down of a Rwandan plane, Falcon 50, numbered “9 XR-NN”. Judge BRUGUIERE’S action was ostensibly made following a judicial process initiated by Madame Sylvie, Marie, and Simone MINABERRY, daughters of Jean Pierre MINABERRY. Madame Annick PERRINE, widow of Jean Michel PERRINE, and Madame Francoise HERAUD, wife of Jacky HERAUD joined the case as civil litigants. Agathe KANZINGA Habyarimana, wife of Juvenal Habyalimana, and Habyarimana’s children, Bernard RUGWIRO, Jean Luc, Leon Jean Baptiste Aimable, Marie Merci, Marie Aimee, and Jeanne NTILIVAMUNDA also joined the case. In pursuit of a long term French Plot to destabilize the Government of the Republic of Rwanda, Bruguiere has launched a thinly veiled political attack on the Government under the veneer of a judicial process.

    The (Un)Believable Truth about Rwanda Nicki Hitchcott ABSTRACT Since the Genocide against the Tutsi in Rwanda, a proliferation of fictional and non- fictional narratives has appeared, many of them claiming to represent the truth about what really happened in 1994. These include a small but significant number of Rwandan- authored novels which, this article suggests, invite the reader to accept what I call a “documentary pact”. While there is no single version of the truth about what happened in Rwanda, one of the common features of fictional responses to the genocide is an emphasis on truth claims. Drawing on examples of both fictional and non-fictional responses to the genocide, this essay discusses the implications of Rwandan authors’ insistence on the veracity of narratives that are sometimes difficult to believe. Emphasizing the importance for Rwandan writers, particularly survivors, of eliciting empathy from their readers, this essay will show that the documentary pact is an effective means of appealing to our shared human experience.     RWANDA-US: Papers Imply Hutu Hard-Liners Downed President's Plane Jim Lobe WASHINGTON, Apr 8 (IPS) - As France and Rwanda exchange charges over responsibility for the Rwandan genocide that was launched 10 years ago this week, newly declassified U.S. documents make clear U.S. officials believed that Hutu hard-liners were responsible for the shoot-down of the Rwandan president's plane, which triggered the massacres. The 13 documents released Wednesday, obtained under the Freedom of Information Act by the independent National Security Archive, include Pentagon, CIA, and State Department cables and reports that circulated within the U.S. government from Apr. 6, when Rwandan President Juvenal Habyarimana's plane was shot down as it prepared to land at Kigali airport. The genocide, which killed as many as 800,000 people in just three months, began just days later. ''The PG hardliners were operationally in a position to take action'', the 'Secretary's Morning Summary' for Apr. 8, 1994 asserted, although it also acknowledged a lack of physical evidence for the conclusion ''because the PG has sealed off the site''.     The Great African War Congo and Regional Geopolitics, 1996–2006 This book examines a decade-long period of instability, violence and state decay in Central Africa from 1996, when the war started, to 2006, when elections formally ended the political transition in the Democratic Republic of Congo (DRC). A unique combination of circumstances explain the unravelling of the conflicts: the collapsed Zairian/Congolese state; the continuation of the Rwandan civil war across borders; the shifting alliances in the region; the politics of identity in Rwanda, Burundi and eastern DRC; the ineptitude of the international commu- nity; and the emergence of privatised and criminalised public spaces and economies, linked to the global economy, but largely disconnected from the state on whose territory the ‘entrepreneurs of insecurity’ function. As a complement to the existing literature, this book seeks to provide an in-depth analysis of concurrent developments in Zaire/DRC, Rwanda, Burundi and Uganda in African and international contexts.
