IMPROVEMENT NOTICE SECTION 10 REGULATION OF CARE () ACT 2001 ("the Act")

The Care Commission has concluded that Seaforth House Ltd (Care Home), Maryburgh, Ross Shire,lV7 8ED, is not operating in accordance with requirements or conditions imposed by or under the Act, or the requirements of Regulations made under the Act. The Care Commission hereby gives you notice that unless there is a significant improvement in provision of the service, it intends to make a proposal to cancel your registration in terms of section 12 of the Act. The nature of the improvements to be made, and the period within which they must be made, are specified below.

Improvement

1. Within one month of the date of receipt of this letter, you must ensure the service adopts 'Safer Recruitment Through Better Recruitment' practices. (Scottish Executive 2007) and 'Scottish Social Services Council Code of Practice for Employers', (Scottish Executive 2005) For those staff currently in employment since July 2006, retrospectively obtain a completed application form, two satisfactory references, and a Disclosure Scotland check. You must obtain a completed application form, two satisfactory references, and a Disclosure Scotland check prior to appointing new staff.

This is in order to comply with:

Regulation 9(1) & 9(2)(a)(b) of The Regulation of Care (Requirements as to Care Services) (Scotland) Regulations 2002 (Scottish Statutory Instrument 2002/114).

2. Within two months of the date of receipt of this letter, you must present the Scottish Commission for the Regulation of Care with an action plan specifying anticipated time scales for the environmental improvements to be made in order to achieve a reasonable physical and decorative standard. To include: bathrooms, toilets, shower rooms, sluice, car park and surrounding pathways. This is in order to comply with:

Regulation 10(1) & (2)(a)(b) of the Regulation of Care (Requirements as to Care Services) (Scotland) Regulations 2002 (Scottish Statutory Instruments 2002/1 14).

Please also note that where more than one improvement is specified, failure to demonstrate compliance with any one of the improvements within the required timescale may result in the Care Commission proceeding to make a proposal to cancel registration.

A copy of this notice has been sent to the local authority of the area in which the service is provider.
