The National Assembly Twelfth Parliament First Session (006) (035) REPUBLIC OF KENYA TWELFTH PARLIAMENT – (FIRST SESSION) THE NATIONAL ASSEMBLY VOTES AND PROCEEDINGS TUESDAY, SEPTEMBER 26, 2017 1. The House assembled at thirty minutes past Two O’clock 2. The Proceedings were opened with Prayer 3. Presiding – the Honourable Speaker 4. PAPERS LAID The following Papers were laid on the Table of the House– a) Annual Report and Financial Statements of the Judicial Service Commission for the financial year 2015/2016; b) Reports of the Auditor-General on the Financial Statements in respect of the following Institutions for the year ended 30th June, 2016 and the certificates therein: - (i) National Museums of Kenya; (ii) Consolidated Bank of Kenya; (iii) Occupational Safety and Health Fund; (iv) Water Resources Management Authority; (v) National Environment Management Authority; (vi) Public Complaints Committee on Environment; (vii) Office of the Attorney-General and Department of Justice; (viii) State Corporations Appeal Tribunal; (ix) The National Assembly; and (x) Egerton University. c) The Reports of the Auditor-General on the Financial Statements in respect the following Constituencies for the year ended 30th June, 2016 and the certificates therein: - (i) Kikuyu Constituency; (ii) Rabai Constituency; (iii) Taveta Constituency; (iv) Kinango Constituency; (v) Isiolo South Constituency; (vi) Mt. Elgon Constituency; (vii) Subukia Constituency; (viii) Baringo South Constituency; (ix) Jomvu Constituency; and (x) Kitui East Constituency. (The Leader of the Majority Party) (No.006) TUESDAY, SEPTEMBER 26, 2017 (036) 5. NOTICES OF MOTION The following Notices were given – (i) ADJOURNMENT OF THE HOUSE UNDER STANDING ORDER 33 TO DISCUSS A DEFINITE MATTER OF NATIONAL IMPORTANCE REGARDING THE 2017 GENERAL ELECTIONS Rising in his place on a Point of Order, the Member for Garissa Town (Hon. Aden Duale) claimed to move a Motion for the adjournment of the House under the provisions of Standing Order 33 in order to discuss a definite matter of national importance regarding the 2017 General Elections; And the Speaker having acceded to the claim; And there being sufficient number of Members rising in their places in support of the claim; Thereupon, the Speaker directed that the Motion be moved immediately after the conclusion of Order appearing as number ten in today’s Order Paper; (ii) THAT, cognizant of the Report of the Select Committee on Regional Integration of the 11th Parliament on the Ratification of the Nile Basin Cooperative Framework Agreement, and pursuant to Section 8 of the Treaty Making and Ratification Act, 2012, this House approves the Ratification of the Nile Basin Cooperative Framework Agreement; (iii) THAT, cognizant of the Report of the Select Committee on Regional Integration of the 11th Parliament on the Ratification of the Protocol to operationalize the Extended Jurisdiction of the East African Court of Justice, and pursuant to Section 8 of the Treaty Making and Ratification Act, 2012, this House approves the Ratification of the Protocol to operationalize the Extended Jurisdiction of the East African Court of Justice; (iv) THAT, cognizant of the Report of the Select Committee on Regional Integration of the 11th Parliament on the Ratification of the East African Community Protocol on Privileges and Immunities, and pursuant to Section 8 of the Treaty Making and Ratification Act, 2012, this House approves the Ratification of the Protocol to operationalize the East African Community Protocol on Privileges and Immunities; and, (v) THAT, this House adopts Sessional Paper No. 2 of 2017 on the Kenya Health Policy for the period 2014-2030 from the Ministry of Health, laid on the Table of the House on Wednesday, September 13, 2017. 6. MOTION - DEBATE ON THE PRESIDENT’S ADDRESS – (4TH DAY) Motion made and Question proposed – THAT, the thanks of the House be recorded for the exposition of public policy contained in the Address of the President delivered on Tuesday, September 12, 2017 (The Leader of the Majority Party – 13.09.2017) (No.006) TUESDAY, SEPTEMBER 26, 2017 (037) Debate on the Motion having been concluded on Thursday, September 14, 2017 (Morning Sitting); Mover replied; Question put and agreed to. 7. MOTION - APPOINTMENT OF MEMBERS TO THE COMMITTEE ON SELECTION Motion made and Question proposed – THAT, pursuant to the provisions of Standing Order 172, this House approves the appointment of the following Members to the Committee on Selection in addition to those specified under paragraphs (a) and (b):- (i) The Hon. Jimmy Angwenyi, M.P. (ii) The Hon. Benjamin Washiali, M.P. (iii) The Hon. Jude Njomo, M.P. (iv) The Hon. Naisula Lesuuda, M.P. (v) The Hon. Khatib Mwashetani, M.P. (vi) The Hon.     FINAL REPORT REPUBLIC OF KENYA General Elections 2017 REPUBLIC OF KENYA European Union Election Observation Mission FINAL REPORT General Elections 2017 January 2018 This report contains the findings of the EU Election Observation Mission (EOM) on the general elections 2017 in Kenya. The EU EOM is independent from the European Union’s institutions, and therefore this report is not an official position of the European Union. KEY CONCLUSIONS OF THE EU EOM KENYA 2017 1. The Kenyan people, including five million young people able to vote for the first time, showed eagerness to participate in shaping the future of their country. However, the electoral process was damaged by political leaders attacking independent institutions and by a lack of dialogue between the two sides, with escalating disputes and violence. Eventually the opposition withdrew its presidential candidate and refused to accept the legitimacy of the electoral process. Structural problems and specific electoral issues both need to be addressed meaningfully to prevent problems arising during future elections. 2. Electoral reform needs to be carried out well in advance of any election, and to be based on broad consensus. The very late legal amendments and appointment of the leadership of the Independent Electoral and Boundaries Commission (IEBC) before the 2017 elections put excessive pressure on the new election administration. 3. Despite efforts to improve the situation, there was a persistent lack of trust in the IEBC by the opposition and other stakeholders, demonstrating the need for greater independence and accountability as well as for sustained communication and more meaningful stakeholder consultation. There was improved use of technology, but insufficient capacity or security testing.

    Chapter One Introduction Imagine trying to cover Northern Ireland‟s troubles without using the words „Protestant‟ or „Catholic‟. Or reporting Iraq without referring to „Shias‟ and „Sunnis‟. The attempt would be absurd, the result unfathomable. And yet, in Kenya‟s post-electoral crisis, that is exactly what much of the local media doggedly tried to do. When we read an account in a British newspaper of shack-dwellers being evicted from a Nairobi slum, or see on the BBC gangs attacking inhabitants in the Rift Valley, we are usually told whether these are Kikuyus fleeing Luos, or Kalenjins attacking Kikuyus. But, in Kenya, this particular spade is almost never called a spade. No, it‟s "a certain metal implement". The "problem of tribalism" may be obsessively debated, the gibe of "tribalist" thrown with reckless abandon at politicians and community leaders, but it is just not done to identify a person‟s tribe in the media. The results, given a crisis in which the expression of long-running grievances has taken the most explicit ethnic form, can be opaque. When Mr Maina Kiai, chairman of the Kenya National Commission on Human Rights, addressed displaced people in Eldoret earlier this year, he was booed and heckled. Kenyan media reported the incident without explaining why. The answer was that the displaced he met were mostly Kikuyus, and Kiai, a vocal Kikuyu critic of a Kikuyu-led Government, is regarded by many as a traitor to his tribe. Sometimes, the outcome is simply bizarre. When one newspaper ran a vox pop in January, one entry was meant to capture vividly the predicament of a 15-year-old girl of mixed parentage.
