Co-Chairs Laura Reyes Kopack and Rasha Demashkieh Michigan Civil Rights Commission 110 West Michigan Avenue, Suite 800 Lansing, MI 48913 June 30, 2017 Dear Co-Chairs Reyes Kopack and Demashkieh: We are writing to request that the Michigan Civil Rights Commission (“Commission”) issue an interpretative statement finding that the prohibition on sex discrimination in employment, housing, and public accommodations found in Michigan’s Elliott-Larsen Civil Rights Act (“Elliott-Larsen”), MCL 37.2101 et seq., includes a prohibition on discrimination based on an individual’s gender identity and sexual orientation. The Commission has the authority to issue such a statement under MCL 37.2601; MCL 24.201 et seq.; Mich Admin Code, R 37.23. This interpretative statement is of critical importance to lesbian, gay, bisexual, and transgender (LGBT) Michiganders. As you are no doubt aware, unlike 18 other states1, Michigan does not have a state law that explicitly prohibits anti-LGBT discrimination in employment, housing, or public accommodations. The Commission itself has concluded that discrimination against LGBT people in Michigan “exists and is significant” and “has direct negative economic effects on Michigan.”2 In addition, although the federal prohibition on sex discrimination in employment under Title VII of the Civil Rights Act of 1964, 42 U.S.C. § 2000e-2(a)(1) (“Title VII”), has been interpreted to encompass discrimination based on gender identity and sexual orientation, many LGBT people in Michigan do not receive the benefit of this prohibition, because they work for employers with fewer than fifteen employees, the threshold for Title VII coverage. Amending Elliott-Larsen to prohibit discrimination based on gender identity and sexual orientation is a top public policy priority for Michigan’s LGBT community and our respective organizations. -
Transgender Adolescents Has Been Difficult to Estimate Given Barriers to Research, Treatment, and Disclosure
GENDER DIVERSE youth (also known as gender non-conforming, gender creative, or gender variant) may prefer clothing, accessories, hair length/styles, or activities that are not expected in the culture based on their sex assigned at birth. They typically feel comfortable with being a girl who looks or acts “like a boy” or vice versa and are usually not interested in transitioning from one gender to another, although some may explore transitioning options. TRANSGENDER youth typically consistently, persistently, and insistently express a cross- Gender gender identity and feel that their gender is different from their assigned sex. Transgender youth are more likely to experience gender dysphoria (i.e., discomfort related to their bodies dysphoria not matching their internal sense of gender) than gender diverse youth, although some transgender youth are comfortable with their bodies. While many transgender youth have that continues expressed their gender since they were old enough to talk, still many others do not realize their feelings about their gender until around puberty or even later. Transgender youth may desire through to make a social, legal, or medical gender transition while in school. They may or may not be the onset of perceived by others as androgynous or as a different sex than they were assigned at birth. Gender diverse and transgender youth are not part of a “new” phenomenon. History suggests puberty or that they have existed in a wide range of cultures for thousands of years. Although no consensus exists on the etiology of gender diversity, neurobiological evidence for sexually increases at dimorphic brain differences in transgender people are being explored. -

If you have a question about these laws or other issues your clients are facing, please feel free to contact the Transgender Law Center. I. Identity Documents A. State of the law • California Driver’s License – a court order is required to change name using a form DL 44. Gender marker may be changed without a court order provided a doctor or psychologist completes a form DMV 329. People under the age of 18 will need parental support to apply unless person is an emancipated minor. (Attachment A – DL 329 and instructions; DL 44 is only available at DMV office or by mail) • Social Security Number – a court order is required to change name on a Social Security account. Gender marker may be changed with a letter from a surgeon stating that “sex reassignment surgery” has been completed. No guidance is given as to what type of surgery constitutes sex reassignment surgery. To make these changes, complete a Form SS-5 (Attachment B – Info from SSA website about change of name and gender; Form SS-5 and instructions) • Common Law Name Change – This method of changing a person’s name remains legally possible, however many organizations and agencies will not recognize it due to concerns about identity theft and immigration fraud. -

Here, as there, my opinions are based upon my knowledge and research in the matters discussed. The materials I have used to research and write this report are the standard sources used by other experts in my field. I have actual knowledge of the matters stated in this declaration. Dr. Turban makes a variety of criticisms of my report, but very few of them touch upon the primary concerns in my original report. -
