Robert Weigel Powers, III, 64, of Marstons Mills passed away on November 4, 2016 surrounded by his family and loved ones after a courageous battle against cancer. He was the first son of predeceased Rita S. and Robert W. Powers, Jr., who was also a longtime President of the Massachusetts Lobstermen’s Association.

Raised in Marstons Mills, his passion for horticulture brought him to land clearing with his father and the development of his own business, RWP III. Later, he then became a commercial lobsterman based out of the Sandwich Marina, following in his father’s footsteps. Robert was a longtime member of the Massachusetts Lobstermen’s Association.

A beloved father, brother, and uncle, Robert is survived by his daughters Crystal Downs of Walpole, Jennifer Powers of Melbourne, F.L., and Heather Powers of Portland, M.E.; his sisters Susan P. Cavanaugh of N.C., Janet E. Powers, Kathryn P. Caplice, and Patricia P. Tierno; and brother Stephen J. Powers, all of Marstons Mills. He was predeceased by his brother Michael M. Powers. 19 nieces, nephews and 2 grandchildren, survive him as well.

In lieu of flowers, donations may be made to the Massachusetts Lobstermen’s Association Scholarship Fund in his memory at 8 Otis Place, Scituate, MA.

New England Council Approves 2017 Management Priorities

The New England Fishery Management Council recently approved its 2017 management priorities, which will guide the Council’s committees and working groups in the year ahead. The Council annually takes this step for two reasons: to focus its time on mutually agreed-upon issues of importance; and to give the public a snapshot of what to expect in the foreseeable future. “Our priority-setting exercise helps us determine how to best allocate available resources,” said Council Executive Director Tom Nies. “We always have more proposals on the table than we’re able to handle each year, so by collectively deciding upfront which actions rank the highest, we’re able to work much more efficiently on the Council’s most pressing issues without getting sidetracked.”

Setting annual catch limits and other fishery specifications – a requirement under the Magnuson-Stevens Fishery Conservation and Management Act – remains the Council’s highest cross-cutting priority. But for 2017, the Council also supported many high-priority items that fishermen and other stakeholders said were especially important. Here are a few of the highlights that were approved during the Council’s mid-November meeting in Newport, Rhode Island:

• Sea scallops: Consider regulatory changes to the Northern Gulf of Maine Management Area; • Groundfish: Revise Atlantic halibut management measures; • Groundfish: Review groundfish catches in “other” non-groundfish fisheries and assess implications; • Recreational fishing: Improve Gulf of Maine cod and haddock recreational management process; • Barndoor skates: Initiate action to allow landings of this rebuilt species; • Habitat: Coordinate wind power issues with other agencies over the long term, not just 2017; and • Council: Conduct a programmatic review of Council operations. – Portland Fish Exchange photo

 Now is the time to shop for a health insurance plan through the Health Connector. Plan availability and premiums are changing and you need to take action before January 31.

 If you have enrolled in health insurance through the Health Connector, you don’t need to apply again for 2017 - you can be renewed in the same or similar plan for next year.

 Tell the Health Connector if any of your information has changed since you last applied. For example, you should update your account if you have income changes to report or you've recently moved.

Currently in New York, the Riverhead Foundation for Marine Research and Preservation is the organization authorized by NOAA to respond to both marine mammal and sea turtle strandings. Under their stranding agreements, all Network members agree to manage any expenses incurred during stranding response.

NOAA is able to provide partial funding through the competitive John H. Prescott Marine Mammal Rescue Assistance Grant Program, and the Riverhead Foundation has successfully received funding in recent years to support their mission.

The Riverhead Foundation and all the other authorized volunteer stranding network organizations around the country are NOAA’s “boots on the ground” during marine mammal emergency events. They are typically the first responders on scene. Stranding network staff assess and respond to local stranding events, and then confer with NOAA’s Marine Mammal Health and Stranding Response Program staff at both the regional and national level to determine the best and most humane course of action for animals in distress.

In the rare cases when animals are relatively healthy and might benefit from being moved off the beach, there are still many practical considerations that can’t be avoided, such as the size and weight of these incredibly large animals, as well as physical limitations at the stranding site. Time is of the essence for these responses; a team and appropriate vessels would have to be available within 24 to 36 hours of a whale stranding to have a chance of success.

In this recent case with the whale in Moriches Bay, the animal was 29.5 feet long and approximately 15 tons (30,000 pounds), which is the size and weight of a large school bus. To add to the challenge, the whale was stuck in the mud a fair distance from shore and from open deeper water. There are serious health and injury considerations that expert responders have to take into account when they consider moving a whale. Muscle, tendon, bone, or spinal cord damage would cause additional pain, suffering, or paralysis. If a whale is injured during a tow, it suffers an unnecessarily painful death.

We recognize all this context does not mend the heartache the Moriches community feels about the stranding and death of the young humpback whale.

We’re sorry there wasn’t more explanation and discussion with the community about the dialogue among experts and decisions being made.

Would outcomes have been different if local knowledge, equipment, and resources were known and in place on day one? Governor Cuomo called me personally on Tuesday to offer any equipment and personnel we needed to free the whale. We all regret that we did not have this conversation with the State on the first day that the whale stranded. We’ll never know for sure, but within the first 36 hours, an expert­directed response with the resources of the State and local community may have been worth a try.

With this and all other stranding events, we learn and improve future responses. Moving forward, we will do our best to work with stranding network members and local authorities to develop inventories of resources and contacts. I will ensure staff are available to help communicate with the local communities and to assure a clear incident command structure when needed. As a silver lining, I hope the Moriches whale stranding inspires community members to volunteer and to get the necessary training to have skills to respond and to perhaps help improve outcomes when another live whale strands.

(I have been hooked many times, once even with a tuna hook, which I duck taped over for the rest of the trip until I could cut the hook and get it out. That was the last time I didn’t bring a pair of wire cutters with me out on the boat!)

During high school I worked on my first boat, the Yankee Fleet. They are a charter fishing fleet who do day fishing trips and whale watching. During high school I worked at the fleet, and I also lettered in Cross Country track my senior year. After high school I stayed on with them full time and spent the winters with them in Key West Florida. I did that for a few years and it was quite the experience.

After working for the Fleet for a few years and getting my Captains license, I finally decided to take the plunge and buy my own boat, to work for myself. That is basically all I have ever wanted to do and I am grateful that I have this opportunity to work outside in all kinds of weather.

Along the way I married my wonderful wife Nancy, in 1990, and have 3 awesome kids. Angelica is currently a college student; Joseph is in high school and works with me on the boat during the summers and school breaks, and little Eva Rose is in elementary school.

All my kids and my wife love to fish and we have the best familytime doing that. My wife actually has a record for catching a striper in Massachusetts. Few people see the effects of climate change as clearly as fishermen. As the climate changes and the oceans warm, fish are moving in search of cooler water, and this can have a big effect on fishermen’s livelihoods. For some, the evidence of climate change turns up in the net, such as when they catch longfin squid in the Gulf of Maine, far north of the usual range for that species. For others, the evidence is in what they’re not catching. Lobstermen in the Long Island Sound, for instance, have had little to catch since the valuable species that once supported them headed up the coast. Winter flounder, silver hake, and black sea bass have all shifted north as well.

These are just a few examples from the East Coast, but a study released last year that looked at more than 350 species from all over North America found that many are moving, and that their movements closely track changing ocean temperatures.

“We found that all over North America, marine fish and invertebrates are shifting their distributions quite rapidly,” said Malin Pinsky, a biologist at Rutgers University and the lead author of the study, which compiled data from more than 40 years of surveys conducted by scientists at NOAA Fisheries, Canada’s Department of Fisheries and Oceans, and other organizations. Those surveys were designed to produce estimates of fish abundance that managers use when setting catch limits. M assachusetts L o b s t e r m e n ’ s A s s o c i a t i o n • w w w . l o b s t e r m e n . c o m • 53 J But even though few people were thinking about climate change when those surveys were originally designed, they y r a u n a turned out to be a treasure trove of data for tracking the effects of a changing climate. “These data show where marine fish and invertebrates have been, and where they’ve moved, over the last several decades,” Pinsky said. F / In the year since that study was published, Pinsky, in collaboration with NOAA Fisheries, has built a website called OceanAdapt that makes that trove of data, which had been scattered and difficult to access, easily available to y r a u r b e the public. Users can search and download data on the geographic and depth ranges of more than 650 species of fish and invertebrates and track how those distributions have changed over time. This will be a valuable tool for the fishermen, fishery managers, and scientists who are grappling with the challenge of adapting to a changing climate. 7 1 0 2 When Fish Cross State Boundaries

Black sea bass are important to both recreational and commercial fishermen on the East Coast, and each state gets a fixed share of the total catch. That catch was divvied up based on where black sea bass were in the late 1980s and early 1990s. At that time, the fish were most abundant off North Carolina, so that state got the largest share of the catch. Since then black sea bass have moved, but the regulations haven’t caught up. Today, New England fishermen are catching black sea bass as far north as the Gulf of Maine. Meanwhile, North Carolina fishermen often have to motor far north to fill their quota, with the extra fuel costs eating into their profits.

“Our fisheries regulations are built around the idea that fish distributions don’t change very much. When they do, that makes things complicated for fishermen and for managers trying to maintain a sustainable fishery,” Pinsky said.

But changing fishery regulations to reflect today’s conditions won’t be easy, in part because any redistribution will inevitably leave some states with less than their historical share. What’s more, fishery regulations exist to prevent overfishing, and in that respect they have worked—36 stocks have been rebuilt in U.S. waters since 2000. For that track record to continue, any changes to fishery regulations must be made with great care.

Basing Policies in Sound Science

To strike the right balance between effectiveness and flexibility, we need to base our policies in sound science. To do that, we need reliable, up-to-date information on changes in ocean conditions. Fish distributions are a key indicator of how climate is affecting the ocean, and the OceanAdapt website makes that information widely available. This will help scientists and fishery managers keep a finger on the pulse of the ocean.

In addition, we need to be able to predict how these changes will affect fisheries and ecosystems. For example, one key question that scientists are asking is how marine food webs reorganize as species distributions shift. Although many species are moving, they’re not moving in lock step, and as predators become separated from their prey, the effects will reverberate through the ecosystem in unpredictable ways. Researchers can use the OceanAdapt database to investigate these changes and develop early warning systems that can alert us to impending disruptions.

This database will also help scientists understand the cumulative impacts of fishing and climate change. These are two of the most significant ways that humans influence marine ecosystems, but scientists don’t have a good understanding of how these two effects interact and combine. “If we’re not careful, we might end up compounding the effects of climate change through overfishing,” Pinsky said.

But the effects won’t all be negative. As some species move out of their historical range, others may come in to take their place. The key to adapting will be to have flexible regulations that are grounded in sound science.

“We don’t foresee a catastrophic collapse,” Pinsky said. “But there will be fundamental and large-scale changes that we have to prepare for if our fisheries are to remain stable and healthy.”

The Mass Fishermen’s Partnership (MFP) held its annual meeting on December 17th, in Boston. The MFP includes all the Massachusetts Commercial

Fishermen’s Associations and the MLA is probably the largest associations of 7 1 0 2 them all.

A presentation was given by J.J. Bartlett, the head of the Fishermen’s Partnership Support Services on what is now offered for fishermen and their families. J.J. noted that the FPSS has now expanded to include, besides Massachusetts, all New England states and moving into some states to the south. It now covers over 19,456 fishing households and 4,891 active member households. He also reported on outreach contacts which amounted to over 445,000.
